GENERAL SALES POLICY

It is the Company’s policy that all electrical or gas related parts or equipment shall be sold to only those persons who hold a valid State of Michigan mechanical heating and cooling license. This information must be validated prior to any sales. At a Company’s request, SWAC can maintain a list of individuals authorized to purchase goods. It is the customer’s responsibility to notify SWAC Distribution of any changes to the “Authorized to Purchase” list.

STANDARD TAX EXEMPT TERMS

To be exempt from Michigan Sales Tax, a copy of a Michigan Sales Tax Certificate must be supplied to SWAC.

VISA AND MASTERCARD CHARGES

We accept VISA and MasterCard for purchases. An authorization number must be obtained to process payments. Standard credit card pricing will be used on any credit card purchase.

QUOTING

SWAC Wholesale reserves the right to quote certain plan and specification jobs and/or projects on a net basis. This will be made clear at the time of quoting. On all quoted jobs, a purchase order stating equipment model number and price or a signed SWAC Distribution quote must be supplied to enter the order.

PRICING

SWAC Wholesale issues pricing lists with actual prices. For special project pricing, please contact SWAC Wholesale directly. Please note prices are subject to change without notice and clerical errors are subject to correction.

BILLING ERRORS

Within 30 days of receipt of an invoice, all billing errors must be brought to the attention of a SWAC representative for correction. Any errors beyond 30 days will be considered on an individual basis.

RETURNED GOODS

A 25% restocking fee will be applied to all authorized returns. Contact the Branch Manager to obtain approval for your return. Electrical parts WILL NOT BE ACCEPTED FOR RETURN. All equipment must be in the original condition and in the original container or it WILL NOT BE ACCEPTED.

DAMAGED OR MIS-SHIPPED GOODS POLICY

SWAC will accept responsibility for goods shipped in error by SWAC. The uninstalled and unfired incorrectly shipped goods shall be returned at no cost to the customer. It is the customers responsibility to check each piece of equipment for correct model number and to verify voltage at time of delivery. Upon receipt of a shipment with visible damage, the model number, serial number, and extent of damage must be noted on the carrier’s delivery receipt. If the material arrived in a sealed trailer, the seal number should be noted for comparison with the seal number used at the original shipping point. A request should be made to the carrier’s local terminal for an inspection of the material. In the case of a truckload shipment via a specialized carrier, the driver should contact either his home terminal or headquarters for instructions on inspection of material. After inspection, or if the carrier has waived inspection, a claim should be filed in accordance with the rules, regulations, and practices established by order of the Interstate Commerce Commission in Ex Parta 263. All claims for damaged items must be filed with the carrier, including UPS. Fedders makes every attempt to handle and load goods with utmost care. While concealed damage can periodically occur, it is virtually impossible to determine where in the distribution chain the damage occurred, unless it is noted upon receipt. For this reason, it is SWAC policy that no claim for product damage will be accepted that is not noted upon receipt of the material.

ERRORS IN SHIPMENTS

This policy applies to all equipment, accessories, and service parts. Errors in shipment include shipment of wrong items, shortage or over shipment. Shortages or overages must be documented on the carrier’s freight bill or the SWAC shipping document at the time of delivery. Missing pieces need to be identified on the receiving document. Signing for the number of pieces shown on the carrier’s delivery receipt constitutes acceptance that the shipment is complete. All claims for missing pieces must be filed with the carrier. This includes UPS.

SPECIALIZED SERVICES

For shipments requiring next day air or other specialized services, we will quote approximate costs. Final costs, as billed by the carrier, are the responsibility of the customer.

COMMERCIAL SHIPMENTS

All dealers must VERIFY THE VOLTAGE ON ALL COMMERCIAL PRODUCTS prior to the delivery, to confirm that the correct voltage was ordered.

PRODUCT AVAILABILITY

Contact SWAC Wholesale for availability on all products in our Price Book. All products are not always in stock or available from the manufacturer or distributor. Items marked N.S. are non stocked item’s.

WARRANTY PARTS

All warranty parts and shipping costs will be billed to the dealer. When the dealer returns to SWAC the defective part and a correctly completed SWAC Warranty Claim Form, a credit will be issued to the dealer. Please note all shipping charges related to each warranty part exchanges are the responsibility of the dealer.

TECHNICAL SERVICE

When calling for technical assistance please be prepared to supply the following information:

Model and serial number of the unit. All operating data on the unit, such as pressures, voltages, CFM being moved, etc.

In the event that the problem can not be solved over the phone, please make an appointment with the Technical Representative from SWAC to meet the installing contractor at the job site. SWAC will not visit a job site without the presence of the installing contractor.

TRAINING Prior to any training schools, SWAC will send a notice to all dealers. A registration form will be attached. To secure a place in the class, the registration form and payment for the class must be returned prior to the class date.
