1.0 Introduction 1.1 Background A Supplementary Planning Document (SPD) on Sustainable Design and Construction has been produced to expand on Policies 34 (Renewable Energy in Major Development) and 35 (Sustainable Design and Construction), of the Council’s Adopted Unitary Development Plan (UDP). This document is the Sustainability Appraisal (SA) / Strategic Environmental Assessment (SEA) to that SPD. Under the Planning and Compulsory Purchase Act 2004 the system of producing a development plan (i.e. the Lambeth UDP), has been replaced with Local Development Frameworks (LDF). In this system, SPDs expand on policies in Development Plan Documents (DPDs). As Lambeth has only recently adopted its UDP the SPDs being produced expand on policies in the UDP. The Council has produced the following SPDs:

• Safer Built Environments,

• Shopfronts and Signage,

• Section 106 Planning Obligations,

• Design Guidance on Residential Extensions and Alterations, and

• Guidance and Standards for Housing Development and House Conversions

There is a requirement for SAs to be carried out on SPDs. 1.2 Strategic Environmental Assessment and Sustainability Appraisal An SEA is the systematic identification and evaluation of a plan or programme. The SEA directive is European legislation. In November 2005 guidance was published by the Government which gave their approach to SEA which is to incorporate the requirements of the SEA Directive into the SA process. This document uses the combined SEA/SA process but will be referred to in this document as SA. SAs and SEAs are statutory requirements for LDFs. Sustainability Appraisals (SAs) are a requirement of the Planning and Compulsory Purchase Act 2004. An SA considers the social, environmental and economic impacts and effects of the proposed plan. Through the SA sustainable development is promoted as all potential sustainability measures are taken into account. Government guidance promotes a 5 stage appraisal process. The figure below shows this process and how the production of an SPD relates to the process.

� Community involvement is an essential part of the SA process and the contribution of the public and stakeholders is valued by the Council. This document has been through a six week consultation along with the SPD. Both documents were sent to statutory bodies, interested parties and stakeholders as advised by national guidance and stated in the Council’s Statement of Community Involvement (SCI).

It is a requirement of the SEA regulations that the likely significant environmental effects of the following issues are assessed:

• Biodiversity (including flora and fauna),

• Climate,

• Cultural heritage (including archaeology),

• Human Health,

• Landscape,

• Material assets,

• Population,

• Soil,

• Water, and

• The interrelationship between the above factors. Additionally there is a requirement for the items below to be included in the environmental report:

• The outline of the contents,

• The main objectives of the plan,

• Relationship with other plans and programmes,

• Relevant aspects of the state of the environment, and

• Likely evolution without the implementation of the plan. The draft SPD provides guidance on the Council’s requirements for sustainability to be incorporated into the design of developments in the Borough. As a result this SA considers all of the environmental effects listed above.

2.0 Background 2.1 SPD Objectives and Content Lambeth Council is committed to mitigating the effects of climate change caused by new development in the borough as specified in:

• Planning and Climate Change - Supplement to PPS 1 Creating Sustainable Communities

• PPS 12 - Local Development Frameworks

• PPS 22 - Renewable Energy

• PPS 25 - Development and Flood Risk

• Code for Sustainable Homes

• Draft PPS on Climate Change

• Towards Zero Carbon Development. The Council requires all development to show by means of a Sustainability Assessment how they incorporate sustainable design and construction principles. The draft SPD amplifies Policies 34 (Renewable Energy in Major Development) and 35 (Sustainable Design and Construction). It gives guidance on the Council’s preferred methodology for Sustainability Assessments. The document also clarifies the information required in an Energy Statement (for Policy 34) and states what should be included in a Sustainability Assessment (for Policy 35) and defines which types of development (including new build and refurbishment) require consideration The draft SPD includes the following sections which give specific guidance on the standards and requirements that the Council expects development to reach.

• Sustainable Design and Construction (including: Site Appraisal, Site Layout and Orientation, Materials, Water, Demolition, Energy Efficiency, Living Roofs and Walls),

• Renewable Energy Technologies, and

• Permitted Development

3.0 Appraisal Methodology 3.1 Approach adopted to the SA The SPD expands on Policies 34 and 35, clarifying what the Council requires in terms of sustainable design and construction and renewable energy. 3.2 When the SA was carried out The SA was initially carried out by the Council in January 2008. Being an iterative process, the SA was subsequently revised to allow the sections of the

draft SPD that were amended following public consultation to be appraised against the SA objectives. This was undertaken in June 2008. At this time the SA framework was also revised in the light of comments received from English Heritage and the Environment Agency during the consultation process. Specifically, two new SA objectives were included: - Protecting and enhancing the Borough’s historic environment; and - To reduce the risk and minimise the impact of flooding. UDP Policies 34 and 35 and the guidance contained within the SPD have now been appraised against the revised SA framework. 3.3 Who was consulted The SA and SPD were available for public consultation and published on the Lambeth website. There was a 6 week consultation period in line with Lambeth’s Statement of Community involvement and SA/SEA regulations. As required by the Strategic Environmental Assessment (SEA) Directive (Article 6(2)), the SA was referred to the three Consultation Bodies with environmental responsibilities namely, Natural England (formerly the Countryside Agency and English Nature), English Heritage, and the Environment Agency. 3.3 Scoping Report A Scoping Report for the SEA of the adopted UDP was carried out by the Council in 2002. The SA Objectives in the appraisal were based on that work. An additional objective relating to climate change was added in line with government best practice.

4.0 Sustainability Objectives The issues listed in Table 4.1.1 have been sourced from the related plans and programmes. The plans and programmes listed supplement and update the plans and programmes set out in the 2002 scoping report. PPS 3 – Housing (2006)

The protection of the historic environment will need to be taken fully into account in the formulation of policies, The concept of sustainable development has particular relevance to the preservation of the historic environment, which by its nature is irreplaceable. Achieving a proper balance between the special interest of a listed building and proposals for alterations or extensions is demanding and should always be based on specialist expertise; but it is rarely impossible,

Need to ensure protection and enhancement of the archaeology and cultural heritage of the borough. Archaeological remains should be seen as a finite and non-renewable resource, in many cases highly fragile and vulnerable to damage and destruction, appropriate management is therefore essential.

Promote renewable energy technologies through positive policies that require a percentage of the energy to be used in new residential, commercial or industrial proposals to come from on-site renewables. States that the benefit of renewable energy projects must be given significant weight as material considerations. Installation should not make the development unviable either technically or financially.

PPS 22 – Renewable Energy - 2004

Seeks to contribute towards sustainable development by avoiding, reducing and managing flood risk. It's aims are to ensure that flood risk is taken into account at all stages in the planning process to avoid inappropriate development in areas at risk of flooding, and to direct development away from areas of highest risk. Where new development is, exceptionally, necessary in such areas, policy aims to make it safe, without increasing flood risk elsewhere, and, where possible, reducing flood risk overall.

Shows the need to secure progress against the UK’s long-term emission targets, deliver zero carbon developments, shape sustainable communities resilient to climate change, and promote innovation and investment in renewable technologies. Policies support the high energy/ carbon standards set by Building Regulations and make sure that the energy supply of developments is gained on-site and renewably and/or from decentralised, renewable or low-carbon supplies.

Supplement to PPS1 – Planning & Climate Change (December 2007)

Sets a timetable for improving the environ-mental performance of new dwellings through the Building Regulations and the Code for Sustainable Homes.

Towards Zero Carbon Development - 2006

Confirms the Government’s intention for all new homes to be zero carbon by 2016. 4.2 Social, Economic and Environment Baseline (Data source, Lambeth Council unless otherwise stated.)

Overview Lambeth is one of a ring of local authorities which constitute Inner London. It is a Borough of many contrasts. Densely built up in the north of the Borough (Waterloo, Vauxhall and Kennington), mixed areas of Brixton, Herne Hill, Clapham and Stockwell, in the middle of the Borough and the suburbs of Streatham and Norwood in the south. Social Lambeth is one of the most diverse communities in Great Britain. 34% of Lambeth’s population are from ethnic minorities. Lambeth has the highest proportion of Black Caribbean residents of any London Borough. Over 130 languages are spoken in the Borough. Lambeth is the most accessible of the south London boroughs with tube and rail connections. Projections from the National Office of Statistics suggest that there will be a continued population increase in Lambeth to 279,500 by 2028. However, GLA data forecasts a more rapid increase, resulting in a population of 317,186 by 2028. Lambeth’s population experiences a number of socio-economic issues, including unemployment, crime and low incomes. The 2007 Index of Multiple Deprivation (IMD) places Lambeth as the fifth most deprived borough in London and 19th most deprived in England. This is worse than 2004, when the Borough was ranked 23rd in England. This is a result of relative improvements in other boroughs and a decline in Lambeth in four of the seven areas that comprise overall IMD: income; health and disability; living environment; and access to housing and barriers to services. The other three areas are employment; education, skills and training; and crime and disorder, all of which remained the same or improved. Lambeth combines areas of affluence with areas of severe poverty and deprivation. The most deprived areas are spread throughout the Borough but are particularly concentrated in Coldharbour ward, in Brixton, and in the Crown Lane areas of Knights Hill ward, in the south of the Borough. The most

affluent areas include the Thames-side part of Bishops ward and the Dulwich border area of Thurlow Park. Economics There are two major town centres in the borough:

• Brixton

• Streatham and nine district town centres of which six are shared centres with adjoining boroughs. There are approximately 7800 businesses in the borough providing 95,400 jobs. These are predominantly small businesses with 88% of them employing fewer than 25 employees. The Borough suffers from relatively high rates of unemployment – only 67% of the population of working age were classified as employed in 2006/07, compared with 69% across London and 74% nationally. The GLA have calculated (refer to Policy 3A.1) that the Borough will require a minimum of 11,000 net additional dwellings between 2007/8 and 2016/2017. This means Lambeth will require 1,100 new dwellings to be built every year for the next 10 years. Environment Lambeth contains 409.54 hectares of unrestricted open space. This works out at an average of 1.49 hectares per person (based on the 2001 census population figure). The National Playing Fields Association standard used in PPG 17 (Planning for Open Space, Sport and Recreation) sets a standard of 2.4 hectares. Lambeth has a strong historic environment with:

• 61 conservation areas,

• 450 protected trees,

• 2500 listed buildings,

• 19 buildings included on the English Heritage Buildings at Risk Register, and

• 8 historic parks and gardens. The Council is currently undertaking Conservation Area Appraisals which will give a greater understanding of each area and what makes it special. The Council has commissioned consultants to carry out the Strategic Flood Risk Assessment for the Borough. This document will be completed mid 2008. It will identify different levels of flood risk from all sources of flooding within Lambeth. In particular it will provide evidence on flood risk in preparation of the LDF.

4.3 Lambeth’s social, economic and environmental challenges. During 2006/7 over 3,000 planning applications were submitted to the Council. The draft Sustainable Design and Construction SPD will be applied to all development in the borough. The environmental, economic and social challenges that the SPD will impact on are:

• Increasing population;

• Demand for housing;

• Social deprivation; and

• Lack of open space. 4.4 SA Framework The SA framework used in this appraisal is based on the Council’s 2002 SEA Scoping Report. An objective on climate change has been added to reflect the change in government and regional guidance. SA objectives relating to the historic environment and flooding were also subsequently added following comments received on the draft SA report from English Heritage and the Environment Agency. The SA/SEA objectives are listed below:

• Ensuring safe communities.

• Promoting a healthy Borough with better health care services, reduced health inequalities and by reducing the causes of ill health.

• Making the best use of the Boroughs limited land resources.

• Ensuring everyone has the opportunity for a decent home, quiet enjoyment of that home and the protection of local amenity.

• Promoting access for all.

• Integrating planning and transport decisions to reduce the need to travel, reducing reliance on the private car and the overall level of road traffic.

• Establishing a safe, accessible and attractive transport network and which prioritises walking cycling and public transport.

• Ensuring Lambeth residents are given the best opportunities to gain education, skills and training to enable them to compete for the best jobs in Lambeth and London.

• Ensuring that there are sufficient local facilities and opportunities to meet the needs of the community and the right of cultural expression.

• Protecting and enhancing the Borough’s built environment and promoting the highest quality and more sustainable designs.

• Protecting and enhancing the Borough’s historic environment.

• Protecting and enhancing the Borough’s natural environment.

• Protecting and enhancing biodiversity.

• Ensuring that Lambeth’s parks and open spaces are of the highest quality and are places for quiet recreation and that sporting recreational and children’s play needs are met.

• Ensuring that Lambeth deals with its energy water and resource requirements in a sustainable manner minimising pollution and treating waste as a resource.

• To reduce the risk and minimise the impact of flooding.

• Reducing emissions of greenhouse gases and preparing the Borough for the unavoidable effects of climate change.

5.0 Preferred Options 5.1 How the preferred options were developed The preferred options were developed in consultation with Council members and officers from the Environment Team. Option A – No SPD The Inspectors Report on the UDP from March 2006 supported the council’s policies and suggested that an SPD which detailed methodology, standards and requirements be written to provide further clarity on Policies 34 and 35. Without an SPD the council would not be providing clarification on the expectations and requirements to be met through the policy. This would leave the policy open to misinterpretation. As a result the council would have to rely on national, and regional planning policies to support its commitment to sustainable development which may not in every case take into account local constraints. Option B – SPD The policies in the UDP would be implemented more effectively as applicants and developers know what is required of them. 5.2 Comparison of social environmental and economic effects. The SPD amplifies the following policies from the UDP

• Policy 35 Sustainable Design and Construction Appendix 1 shows the comparison of social, environmental and economic effect of the UDP Policies listed above. Appendix 2 shows the comparison for the SPD policies. Amendments were made to the draft SPD in the light of representations received during the six-week period of public consultation. Substantial changes were made to the SPD in terms of its presentation to address the comments made and improve its userability, and to reflect revisions to the Regional Spatial Strategy (London Plan) published in February 2008, and changes to permitted development rights introduced by the Government in April 2008. Being an iterative process, the revised sections of the SPD were then appraised against the SA objectives. The following symbols are used:

The analysis shows that the guidance has a beneficial effect on the promotion and installation of sustainable design and construction in the Borough. The requirement for renewable energy technologies in major development has a positive impact on mitigating the impacts of climate change in the Borough. It is expected that the effect will be both immediate and significant. 5.3 Proposed mitigation measures The draft SPD will have a significant positive impact on climate change and the level of sustainable development in the borough. No mitigation measures will be required as a result of the implementation of the guidance.

6.0 Implementation 6.1 Links to other tiers of plans and programmes Then draft SPD amplifies the policies set out in the UDP and will be linked to the emerging Lambeth LDF which will replace it. 6.2 Proposals for monitoring The Planning Service will continue to collaborate with the Environment Team to monitor applications and ensure that development fulfil the requirements of the UDP policies. The Council have commissioned consultants to carry out a Strategic Flood Risk Assessment (SFRA) which will be completed mid 2008. This document will assist the monitoring of development in the flood plain.
