At its regular meeting of 24 February 1976, the SussexCounty Council awarded the above referenced contract to HudsonTransfer & Construction Company, Incorporated for the annuallump sum amount of $64,980 as contained in your proposal of17 February 1976.
Enclosed herewith are four (4) copies of the abovereferenced contract. Kindly have all copies of the contractexecuted by the President of Hudson Transfer & Construction Com-pany, Incorporated as indicated on the Contract Agreement andBond Agreement* When this has been accomplished, please forwardthe contracts to your bonding company to complete execution ofthe Bond Agreement.
State of Delaware law stipulates that Power of Attorneyfor the surety agent be attached to each copy of the contract,and in the event it is issued out of the State, the contractsmust be countersigned by a Resident Delaware Agent of the Bondingcompany.

Information of each landfill site includes:opening dates, acres per landfill, depth of cells or heightof lifts, usable space, unusable space, used space to date,percentage used to date, percent unusable, total volumeof material to end of year 1977, total volume of materialfirst quarter and second quarter 1978, and total cubic yardsspace used first two quarters 1978.
Enclosed are the plots of the six landfill sites, showingutilized areas, pit in use, cell being prepared, date cellcompleted, date second quarter, repair of final cover.

The Sussex County Council will receive sealed-bid proposalsfrom interested private contractors until 11:00 a.m., Tues-day morning, February 13, 1979, at which time the SussexCounty Council will publicly open all bid proposals received.
To aid you with the bid proposal openings, I am listing thefollowing information for your presentation to the SussexCounty Council at the Tuesday meeting.
1. The present contractor is Hudson Transfer & Const.Co., Inc., Harbeson, Delaware.
2, The existing contract term begin on April 1, 1976and ends on March 31, 1979.
3. The annual payments for the existing contract fromApril 1, 1976 to March 31, 1979 is $64,980.00.
4. The Engineerfs Estimate for the annual payment forthe proposed contract term from April 1, 1979 toMarch 31, 1982 is $85,500,00. A break down of howthis figure was arrived at, is attached.

Transfer Station Number 5, near Laurel, Delaware.
ITEM NO.:
1. Bid on volumes of household trash to be transferred from
Transfer Station Number 5, near Laurel, Delaware, to Landfill
Number 1, near Bridgeville, Delaware, trash from public users
and vehicles with capacities of 4.7 cubic yards or less.
2. Bid on volumes from public users and vehicles with
capacities of 4.7 cubic yards or less, plus half of the
volumes from the Towns of Delmar and Laurel, Delaware, to
be transferred to the Bridgeville, Delaware Landfill Number 1,
3. Bid on the total volume of household trash from the entire
old Landfill Number 5 area which is to be transferred to

This is my recommendation for a final and close out paymentof the work at Landfill site #5, Laurel, Delaware.
Pages 1-8 to my opinion was work completed on the old or pre-vious contract. LF5-76 and should not be considered for payment.

After review of the close out bill dated January 23, 1980 for LandfillNo. 5, 'Mr. Argo and myself are prepared to agree that the total close outcost to Hudson Transfer is $62,402.36, of which, the County has already paidHudson Transfer $31,500.00. At this point, the County is prepared to issuea check for $30,902,36 to complete the contract for this landfill.
After reviewing the bill, we feel the following charges are eligiblecosts to the County:
Crawler Loader $47,520.00Supervisor 2,041.66Insurance Coverage 1,288.13Performance Bond "512.60Excavator 11,040.00 _Total $62,402.36Credit - 31,500.00
Balance Due $30,902.36
If this figure is acceptable, please contact Mr. Argo, who will authorizepayment of the balance due.
You have submitted to the County a total bill of $58,674.79 for-close outof this landfill. Upon review of the various items that went into the 'makeupof this bill, we are not satisfied that these are eligible costs and, therefore,are not prepared to recommend payment to the level you have proposed.

It is my understanding that as of yesterday afternoon you have requestedan extension to use our landfill site # 5 for your Dupont Waste materials, fora period of one more year.
Before this matter can be taken under consideration, the bill balance of§350,00 will have to be paid in full. Our clerk billed you at 300 a cubicyard instead of the agreed amount of 850 a cubic yard. As you know there was700 cubic yards deposited for the month of June.
We would appreciat4 a check in the amount of §350.00 by return mail, sothat your account will be paid in full up to date when it comes time for theCounty Co&il to make their decision.
We regret very much this error on our part, and sorry that you did notnotice that the amount of the bill was muc-^fless when the amount of cubic yards,was increased by almost 200 cubic yards.over the previous month. Please acceptour apology.

This is to confirm our telephone .conversation of this dateregarding Consolidated Contractors request for continued uae of- ..Sussex County Landfill Site #5 for disposal of nylon wastes fromthe DuPont Company Nylon Plant in Seaford.
It is my understanding that you are satisfied with the oper-ation and payment scale which has been in effect for the past fourmonths and would continue to handle any and all nylon wastes fromDuPont in a similar manner for another year if so instructed.
This matter will be presented to the Sussex County Councilon 6 August for its consideration and a decision will be forthcoming.Enclosed is a copy of a letter informing Consolidated Contractors ofthe status of their request. ~~
After speaking with you on the phone, I contacted ConsolidatedContractors regarding their anticipated volume of nylon wastes fromDuPont and found that 500 cubic yards per month is_a typical amount.The 1300 cubic yards estimated by the landfill attendant for Julywas due to machine breakdowns at the Seaford plant and represents themaximum monthly volume expected for the coming year.
Finally, I checked with the Landfill Office. and your checkfor June for the DuPont nylon wastes will be forthcoming in the nextweek.

At their 6 August meeting, Sussex County Councilconsidered your request for a one year extension until.31 July 1975 for the use of the referenced landfill fordisposal of nylon waste. Council believes you should findand arrange for other disposal facilities in a much shortertime and, therefore, passed a motion granting yo~u an ad-ditional extension of sixty (60) days, ending 30 Septem-ber 1974, for depositing nylon waste at the referencedsite. The same charges will remain in effect for thatextension.
County Council is not anxious to continue with ex-tensions for use of this site and you are advised to makeevery effort to arrange for other means of disposal withinthis aforementioned extension, which they granted.

Dear Mr. Henry: :
We represent Consolidated Contractors, Inc. withrespect to their efforts to obtain the necessary zoning andhealth department approvals for a land fill in WicomicoCounty, Maryland. We have approached this problem in twosteps, the first of which was to get the necessary specialexception from the Wicomico County zoning authorities.We have received such a special exception and include acopy herewith. Our next st'ep is to acquire a "permit fromthe health'department if such is required, and there issome question about whether or not the permit "is required.
We are progressing on that matter and find wehave not been able to get in touch with the health departmentauthorities with respect to this matter to establish anaccurate time schedule. I will do so as soon ~as possibleso that we can give you some idea of how much time is in-volved with obtaining these permits if such are required.
If you need any more information concerning thisn itter, please let me know.

The Delaware Solid Waiaste Authority has been conducting a study of theamount of solid waste gersnerated in Sussex County. A weighing program wasstarted in May, 1983 at tnnie Bridgeville Landfill, which is owned and operatedby the Sussex County government. Ever since the Millsboro Landfill was closed,all of the waste from Susssex County has been disposed at the Bridgeville Land-fill.
Attached is a table -*-which provides detailed information about the amountof waste generated by the various municipalities in Sussex County. You mayfind this information usef-zul*
In addition, a summaryy sheet estimates a range of costs for each munici-pality for Fiscal Year 19855, starting July 1, 1984. The Authority will be ableto project the actual cost . after it receives bids for the construction and op-eration of the landfill.

Before this matter can be taken under consideration, the bill balance of$350.00 will have to be paid in full. Our clerk billed you at 300 a cubicyard instead of the agreed amount of 85C a cubic yard. As you know there was700 cubic yards deposited for the month of June.
We would appreciate a check in the amount of §350,00 by return mail, sothat your account will be paid in full up to date when it comes time for theCounty Cotfcil to make their decision.

This matter will be presented, to the "Sussex County Councilon 6 August for its consideration and a decision will be forthcoming.Enclosed is a copy of a letter informing Consolidated Contractors ofthe status of their request.
After speaking with you on the phone, I contacted ConsolidatedContractors regarding their anticipated volume of nylon wastes fromDuPont and found that 5"00 cubic yards per month is a typical amount.The 1300 cubic-yards estimated by the landfill attendant for Julywas due .to-machine breakdowns at the Seaford.plant and represents themaximum monthly volume, expected for the coming year.
• Finally, I checked with the Landfill Office and your checkfor June for the DuPont nylon wastes will- be forthcoming* in the next.week.

The same charges will remain in effect for thatextension.
-County Council is not anxious to continue with ex-tensions for use of this site and you are advised to makeevery effort to arrange for other means of disposal withinthis aforementioned extension, which they granted.

It has come to our attention that the June billingfor the above referenced waste deposited at Sussex CountyLandfill Site No. 5 was in error.
You were originally billed incorrectly on 12 July at$.30 per cubic yard for the 700 cubic yards which you depositedat the site. A letter dated 31 July explaining that errorcited a balance due of $350.00. Your payment of that amountbrought your total payment for June up to $560.00. This rep-resents an $.80 per cubic yard fee rather than the $.85 per cubicyard charge formerly agreed upon.

NYLON IN TRASH
Effective immediately no nylon yarn,ribbon, flake, chunk,drip, etc. is to be put into any compactor or other con-
tainer not designated for nylon. Several containers will bespotted around the Plant for deposit of nylon or "it can bedeposited at other specified locations for-pickup by consolidatedcontractors.
It is imperative that we keep nylon out of our trash. Ifwe do not, the county will close its landfills to us.
Containers for nylon (painted blue) will be placed at:
• BCF pad (for BCF and Staple)
• 610 pad (for Salt/Flake, Process Services, R & Dand Process)
• East of East Dow Condensate Room (for N-16, StapleSpin and Tech.)
• South of EMR Lab (for R & D and Process)
Nylon in drums or boxes will also be picked up from the 610pad and warehouse 6, Door 11.
We will be paying a premium to landfill the nylon; non-nylon materials should not be put in nylon containers unless itis too costly to separate.

1. DuPont wants to separate yarn and plop (solid polymer) from othertrash-will amount to 7-20% of .present incoming volume.
2. Separation put into effect 6 November and will take one week toimplement. Filer will call and let us know when separated loadsbegin corning in.
3. Robert Miller proposes preparing "BM Area for nylon waste and placingrest of separated trash in MA" Pit.
4. DuPont expects about 3 loads (36-yard container) of plop and yarnmixture per week.
5. In small volumes, plop can be sold to be ground into powder. Butat present no market for all of this. (Efficient operation willresult in less plop anyway).
6. Yarn nylon waste - either contaminated or experimental
7. Check new Solid Waste Reg. for classification of nylon waste
8. Notify contractor of separated loads and observe process.
9. Requested Robert Miller to obtain letter from Md Envir. Controlconcerning disposition and reason for holdup in getting permitfor Sharptown Site. Apparently Consolidated Contractors will notget permit by 30 November 1974 expiration of Sussex County permit.

Dear Mr. Miller:
The Sussex County Engineer, Mr. William C, Henry, hasasked me to inform you that all past due bills shall bepaid in full before he can present your application fora renewal of your landfill permit for disposal of nylonwaste to the Sussex County Council. Your current permitwill expire on 17 December 1975.
It will also be recommended to the Sussex County Councilthat any new permit, when and if it is issued, containthe following conditions.
d) The per cubic yard disposal rate for nylon wastewill be $0.85 until 1 April 1976; at that timethe disposal rate will be subject to either anincrease or decrease.
(2) All bills issued for payment under the permitmust be paid within 30 days of the date of thebills; if not, the permit will be revoked.

At its meeting of 25 November 1975, the Sussex CountyCouncil approved the renewal of your permit for the disposal ofnylon waste at Sussex County Landfill Number 5, near Laurel,Delaware. This' permit renewal is good for one (1) year and willexpire on 17 December 1976.
In approving the permit renewal, the Sussex CountyCouncil made the following conditions a part of the permit.
(1) The per cubic yard disposal rate fornylon waste shall be $0.85 until1 April 1976; this rate will be subjectto change effective 2 April 1976.

the following motion: " .
"That the permit to Consolidated Contractors, Inc. tohaul nylon waste to Landfill No. 5 be renewed for oneyear beginning December 15, 1976 with the followingstipulations:
1. The charge will be ninety cents (90*) per cubicyard with five cents (5*) retained by the County.
2. That they keep the account current and they will.be billed at the end of each month with twenty (20)days from the date of invoice for account to be paidor permit will be automatically terminated."
The motion was adopted unanimously.
Please inform Consolidated Contractors of Council's decision with
a copy o-f that letter sent to Mr. Hudson, Landfill Contractor, and to

Dear Mr. Miller:
At its meeting of December 14, 1976, the Sussex County Councilapproved the renewal of your permit for the disposal of nylonwaste at Sussex County Landfill number 5, near Laurel, Del-aware.This permit renewal is good for one (1) year and will expire onDecember 15, 1977.
In approving the permit renewal, the Sussex County Council made thefollowing conditions a part of the permit.
(1) The per cubic yard disposal rate for nylon waste shallbe (§0.90) ninety cents per cubic yard.
(2) All bills issued by Sussex County for payment of nylonwaste disposal under this permit shall be paid withintwenty (20) days of the date of the Sussex County invoice;if payment has not been made by the end of this period,the permit shall be suspended.

DATE: November 29, 1979
Eastern Disposal, Inc. would like to renew their permit withthe County, for the continuance of .disposal of nylon wasteat Landfill site #1, Bridgeville. Their present permit ex-pires December 15, 1979. I see no reason for not renewingthis permit, but would insert the following stipulations;that they keep the account current and they will be billedat the end of each month with 20 days from the. date of invoicefor account to be paid or permit will be automatically termi-nated. The account is paid in full at the present time. TheCounty now receives ($1.00) per cubic yard for__material onthis permit and ($.85) of this amount goes to the Landfillcontractor. This needs County Council action as soon aspossible.

We have approached th;is problem in twosteps, the first of which was to get the necessary specialexception from the Wicomico County zoning authorities.We have received such a special exception and include acopy herewith. Our next st'ep is to acquire a ..permit fromthe health department if such is required, and there issome question about whether or not the permit is required.
We are progressing on that matter and find wehave not been able to get in touch with the health departmentauthorities with respect to this matter to establish anaccurate time schedule. I will do so as soon as possibleso that we can give you some idea of how much time is in-volved with obtaining these permits if such are required.

Pursuant to your recent request, attached please find a reprintof the Sussex County property maps for the land area surround-ing Sussex County Landfill No. 5 near" Laurel, Delaware. Theexisting Sussex County Landfill No. 5 property was purchasedfrom Mr. William J. Hopkins, Jr.
Taking property line buffer zones into account, approximatelysix (6) acres of land are presently used each year for solidwaste disposal at Sussex County Landfill No. 5.
Chances are that for any new solid waste disposal .systemimplemented in Sussex County to meet the%current State ofDelaware Solid..Waste Disposal Regulation, leachate collectionfacilities will no_t be constructed at Sussex County LandfillNo. 5. The construction of such facilities, if they are tooccur at any existing landfills, would be at either SussexCounty Landfill No. 1 near Bridgeyille or Sussex County LandfillNo. 2 near Millsboro. However, an entirely new site may bechosen in the Georgetown, vicinity for such a system when and ifit is implemented. More than likely any future solid wastedisposal facilities constructed at Sussex County Landfill No. 5in accordance with the current State of Delaware Solid WasteDisposal Regulation will be in the form of a transfer station.
The meeting between the Sussex County Council and the DelawareSolid Waste Authority on Wednesday morning, September 29, 1976should help to begin clearing the way in answering the ques-tions which are indirectly presented above.

the . following motion:
"That the permit to Consolidated Contractors, Inc. tohaul nylon waste to Landfill- No. 5 be renewed for oneyear beginning December 15, 1976 with the followingstipulations:
1. The charge will be ninety cents (90C) per cubicyard with five cents (5C) retained by the County.

Also at this time, he informed me that he would have his son,Wayne, take care of these problems at once.
Based on this conversation and providing you agree, 1 amrequesting that we do not write to Mr. Hudson on this matter,Instead, I will simply keep the letters I have prepared on filealong with the pictures and if I find nothing is done toresolve these problems then I will be forced to recommendfurther action.

It has been brought to my attention that a lot of trucks,pickups and cars with loose trash are still coming into theLandfills. It is the desire o.f the County Council that wecrack down on some of these violators by first giving thema warning slip and taking down their tag number the firstoffense. Should the same vehicle return with no attemptto correct the problem of having loose trash covered, theirtag number should be turned in to the Landfill Constable forfurther action. All.persons with loose trash such as gar-bage, paper, bottles, cans, etc., should be persuaded thatall trash should be placed in plastic bags, as our signsalready state.

This Warning Notice to you means if there is no correctivemeasures taken by you (or the company you are affiliated with)there will be some legal action taken should you return tothe Landfill and still be in violation of having loos-e trashuncovered. Sussex County Disposal regulations states; Allhousehold solid waste, trash and refuse shall be transportedto the site in covered containers, enclosed vehicles or cover-ed open vehicles to prevent deposit of refuse on the publichighways. The Delaware Litter Control Law states; It is theintention of this act to end littering on public or privateproperty, including bodies of water, as a threat to the healthand safety of the citizens of this state. Litter shall includeall rubbish, waste material, refuse, cans, bottles, garbage,trash, debris, or other discarded materials of every kind anddescription.
Penalties:Any person violating the provisions of this act, shall be guiltyof n misdemeanor and upon conviction thereof shall be punishedby a fine o"f not less than 100 dollars nor more than five hundreddollars for each violation; except that in the discretion of thecourt any such person may be directed by the Judge of the Courtto pick up and remove from any public street or-highway or publicor private right-of-way, or public beach, stream bank, or publicpark any and all litter deposited thereon by anyone prior to thedate of execution of sentence.

Public Collectors, Private Haulers and Special permits total incometo the County for year 1978 was $15,751.51. These monies came fromthe sale of license to the Public Collectors, Private Hauler fees .for permits and special permits, whom were charged 30<p per cubicyard for the material brought into the Landfill.
