Chapter - I
Brief account of violence againstWomen in Jharkhand
From times immemorial, women have been at the receiving end ofmale dominated society. Despite the march of time and not withstandingground-breaking advances in science and technology , women continueto be subjected to violence and torture for a variety of reasons. Infact,violence against women is the manifestation of a historically unequal powerrelationship between men and women . It is a conditioned response andis not natural or born of biological determinism . The recorded data ofthe last few decades of this millenium shows frightening signals in therelentlessly soaring graph of violence against women . To the olden daysviolence against women was the result of the prevalent atmosphere ofignorance and feudalism , today violence against women is an uncontrolablephenomenon which is a direct result of the rapid urbanisation, industrialisationand structural adjustment programmes which are changing the socio-economic scenario of our country.
Women are vulnerable to acts of violence in the family , in the communityand by the state . Marital , cruelty , dowry murders , child abuse , incestand battering are some of the common forms of violence that womenface in the family. The community metes out rape , sexual harassment ,eve-teasing , traffiking and sexual discrimination to the women . Custodialviolence and institutional deprivations are two forms of violence metedout by the state.
In Jharkhand, a large number of groups and grass root level organisationshave been involved in understanding the different dimensions of violenceagainst women. These groups at their own level have been supportingand empowering women, enabling them to resist gender based violenceby providing legal, emotional and psychological support . Some groupshave also focussed on countering violence against women at the locallevel by strengthening community based responses and redressal systems.Besides, there are number of women forums at the state, districts andat blocks level for taking collective action to counter violence.
On the other hand, the state policy on women has also articulatedthe need to recognise all forms of violence against women as a centraldevelopment concern and building public opinion as well as taking effectiveaction against the perpetrators of such violence. The state has also startedseveral departments as a response to counter violence against women.In two year old Jharkhand State, the police department has initiated to
start Family Councelling Center and Women Cell in nine selected districtsin first phase . Mahila thana and Dowry Advisory Cell has also been runningin all districts attached with Superintendent of Police Office . In additionto, there are certain other institutions such as Mahila Battalion Head Quarter,State Women Commission, etc. which are in the process . However inspiteof affirmative policies and programmes by the government and initiativesby NGO’s , it is evident that systemetic and sustained work is required atvarious levels to minimise gender discrimination and end gender basedviolence.
SAMADHAN , Ranchi (Jharkhand) initiated the work on the ResourceDirectory of institutions and organisations working for violence againstwomen in the state of Jharkhand, with support from UNIFEM , New Delhi.In this directory main focus has been given on mapping support servicesprovided by the government , semi-government , private and NGO’s workingespecially in the field of councelling , legal aid , alternative shelters , skilltraining , marketting & credit . Similarly organisations working on HIV /AIDS and Traffiking are also given importance in this Directory.
A broad overview of the range of support services for violence againstwomen reveals some concern on the part of the state as well as the NGOsector to address the issue of violence against women. Most of theorganisations are involved in addressing broader issues of women’sdevelopment and empowerment . They are collaborating with differentgovernment departments and are implementing various projects andprogrammes . A common strategy used by most groups for strengtheningwomen’s economic opportunities is the formation of Self Help Groups(SHG’s)
One of the major activity of the women wing of organisations is totake up the issue of violence such as the case related to desertion , rape,bigamy , dowry , domestic violence, compensation, divorce property, witchcraftetc. These women try to solve the cases by putting it before Mahila Samiti/ Mandal or in Panchayat meetings . But most of the groups do not haveaccess to the government services , so they are helpless if the case isnot solved at local level . However most of the victim women are neededshelter. In Jharkhand, there is a severe lack of an ideal and good supportservices regarding shelters for the victim of violence both at governmentand at NGO level . The insensitivity of the enforcement agencies , andjudiciary also has an impact on women seeking these services . Most ofthe women even do not know about the services provided by the governmentand therefore publicity of such institutions is equally essential . Finallythe study clearly indicates there is a need of systematically documentationand disemmination of the various efforts that have been made at differentlevels to counter violence against women.

Dowry & Dowry Deaths :- Dowry deaths as being one where a womandies of burns or other injuries within seven years of her marriage andthere is evidence of cruelty and harassment by the husband or any relativeof her husband , “ for or in connection with any demand for dowry “. Harassmentin itself can be cause for considerable agony , anguish and trauma formarried women whereas the Cruelty may cause a women to commit suicideor ‘cause grave injuries or danger of life , limb or health’ , whether mentalor physical of the women and harassment related to property demands.
Witchcraft :- In the tribal belt of Jharkhand the incidence of witchcraft isvery common . In a majority of the cases , it is found the real motive ofthe killers was to grab property or to settle personal scores with the victimfamily . In order to garner support for their nefarious activities , villagersparticularly influential people brand female member of a particular familyas a witch so that they could get the support of their co-villagers in houndingout or killing the victims family. The villagers believe that the women brandedas witch are responsible for the illness , death , drought and despirethat is overwhelming the lives of the communities women .
Caste & Class Conflicts :- In Jharkhand caste politics play a very importantrole in any violence . In this state not only the number of castes and sub-castes is very large , but the politicisation of each caste or caste grouphas left specific imprint on the political process of the State . Infact , thepolitics has been characterised by a four fold division – forward – castes,backward-castes , harijan and tribals . Narrowness of caste feeling hascontributed a lot to the occcurence of violence in the society . The feelingof casticism and the awareness among the low and the middle classeshas mainly led to caste-conflict and tensions . The class conflicts dependson the process of production and the economic infra-structure . The societyhas been clearly divided into two classes ie. The haves and the havenots . The awareness amongst the have nots has been broken the oldrelational norms and they are ready to get their economic positions andother rights in society by hook or crook . Infact it has opened a new vistain the field of violence and it is the women who are the ultimate victims.
Communal Violence :- Communal violence is more visible in urban areasas compared to caste violence taking place in rural areas , though withits acceleration in recent years, it may spread to rural areas also. Earlierit was generally thought that riots takes place between the Hindu andthe Muslim communities . But the recent development of attacks on minoritiesmay take the serious shape of violence.
Chapter - II
Definition and types of ViolenceThe term “ violence against women “ following the declaration of UN
Commission on the Status of Women (1993) is usually defined as “ anyact of gender based violence that results in or is likely to result in physical,sexual or psychological harm or suffering to women , including threatssuch as acts , coercion or arbitrary deprivations of liberty , whether occuringin public or private life and violence of human rights of women in situationsof armed conflict. Violence is also defined as a physical act of aggressionof one individual or group against another or other.
Violence against women should be viewed as one of the most crucialsocial mechanisms by which they are forced into a subordinate position.It is a manifestation of unequal power relations , which has led to men’sdomination over and discriminitation against women. Thus violence againstwomen is their inferior status in male-dominated society-educationally ,economically , politically and socially-there are other factors responsibletoo. The increasing criminalisation of society , media images of violence,inadequate means to address the cause and consequences of violence,poor enforcement of legal provisions , unabashed consumerism anderosion of traditional values have all added to it.
Types of ViolenceSexual Harassment :- Sexual harassment ranges from teasing andmolestation to violent sexual abuse. It is a subject on which women acrossall class and age groups can be readily mobilized. In many areas powerfulland upper caste groups often target poor dalit women. Sexual abuse andother forms of viloence are often used to inflict political lessons and tocrush dissent. Criminal law does not use the term sexual harassmentbut speaks instead of outraging the modesty of a women. Recently thesupreme court has laid down certain guidelines as preventive measuresagainst sexual harassment and has direct employes to put certainmechanisms in place.
Rape :- It is the most violent , abrupt and physically painful instance ofmale aggression. At the physical level , it represents an invasion of person;at the psychological , it results often in deep trauma, shame and guilt.Marital rape is excluded from the definition except when it is committedon a girl below 12 years of age. In addition , although the law prohibitsevidence on the antecedents of the accused , it applies a different yardstickfor women when such antecedents are often brought into prove cases

Domestic Violence :- The term domestic violence is wide and encompassesin its scope the types of violence resorted to within the home. The overhelmingmajority of victims of domestic violence are woman. Domestic violencenot only includes conduct which amount to cruelty on a woman by herhusband or any of his relative but also includes any act which is unbecomingof the dignity of the woman. The woman are brutally beaten or abused byher husband or in-laws.
Trafficking of women :- Trafficking in women and children is one of theworst and most brazen and abuses of human rights. Trafficking is thelegal or illegal moment of women and children by force or through otherforms of coercion for the purpose of exploitation and for the considerationof economic and other benefits. Migration, especially illegal migration thoughdistinct and separate is integrally connected to trafficking.

Non-Government Services for Women
CounsellingThis chapter gives details of organisations providing counsellingservices for women.
q Organisations that have counselling centres or provide counsellingon a regular basis have been included in this chapter.
q Most organisation provide counselling services in the followingsituations - family disputes and violence, marital problems,mental illness, health problem, mother and child care, education,government welfare programmes, HIV / AIDS, prostitution,trafficking etc.
q Family disputes and violence cover marital disputes and domesticviolence as well as problems faced by women in their natalhomes, as unwed, separated, divorced, widowed sisters /daughter and mothers being harassed by children / othersfor property and other reasons.
q The organisation providing counselling for drug addicts / alcoholicshave been included in this chapter.
q Information on some organisation dealing with cases of adoptionare also included.
q For each organisation the address, phone number, issuesaddressed, persons counselled, days & timings and theirstrategy to tackle the problem are given.
q Most of the organisations do not charge any fee for counsellingservices.
q Panchayati Raj and Self Help Group are the common activitiesundertaken by all organisation, so it is not mentioned in thischapter.

Legal Aid
This chapter gives details of organisations providing legalaid services for women.
q Organisations that have legal aid centres or provide legalservices on a regular basis have been included.
q Organisations mentioned in this chapter, provide support inthe areas of legal councelling, preparation of case relateddoucuments, lawyer's assistance, lawyer's fees, assist forfighting cases in court, bear court expenses and settle casesthrough Lok Adalat etc.
q Most organisations have a fixed day and timing for providinglegal aid and these have been included in this chapter. Howeversome organisations do not have a fixed day or time andprovides legal aid whenever it is required.
q For each organisation, the address, phone number, criteria,types of cases addressed, timings, nature of assistanceand procedure strategy and methods to solve the problems.
q Most organisations do not take any fee for legal aid services.

Shelter
This chapter gives details of organisation that provide shelterto women.
q Detailed informations on different kinds of shelters short stayhomes, working women's hostels, special shelters and oldage homes. This has been done with the objectives of addressingall possible kinds of crisis situations that women face andcovering women of all age groups.
q For each organisation the name of the home, address, phonenumbers, capacity, criteria, duration of stay, with/withoutchildren etc. are mentioned.
q Old age homes which provide shelter to abandoned elderlywomen, have been indicated separately.
q Under special shelter, shelter for destitutes, unwed mother,handicapped orphan, adolescent girl etc. have been mentionedseparately.
q There is a severe shortage of all kinds of shelters for womenand these are basic constraints in all those that do exist.
q There are very few options for married women with children,who are facing violence in their home, but cannot leave forwant of shelter. Even where they do, there are age limits.Short stay homes are free and accomodate women for amaximum of three years.

A large number of organisations provide skill training ona regular basis.
