Theretailenvironmentisprimarilyinfluencedbytwofactors:1)Overallset-ting (Mall commonareas);and2)Individualcomponents(Tenantstorefronts).Both affect the perception of Superstition Springs Center as a prime retail establishment.
Generally, storefront design styles are the provenance of the Tenant. TheLandlord provides input towards the full development of the design concept, promotescompatibilitywithadjacentTenantsandcommonareasandinsurescompliancewithdesigncriteria.
CriteriaapplicabletospecificareasintheMallspecifycertainrequirementssuch as the extent of vertical and horizontal projections, the use of three-dimensional form and proper material use. These criteria are intended toprovideabasisforallstorefrontstopresentmerchandiseinanexciting,pro-motionalfashion.
AllareasexposedtopublicviewaresubjecttoathoroughdesignreviewandapprovalprocessbytheLandlord.Tenantsmustaddressstorefrontandinte-riordesign,materials,colors,signageandlighting.Additionally,specificarchi-tecturalcriteria,applicabletovariouslocationsintheMall,mustbemet.
ThesecriteriaactasaguideforthedesignofallworkbyTenantsinconjunc-tionwiththeprovisionsoftheTenant’sleasewiththeLandlord.Furthermore,thesecriteriaaresubjecttorevisionbytheLandlordandtheLandlord’sinter-pretationofthesecriteriaisfinalandgoverning.AllTenantsshouldrefertotheTechnicalCriteriaforelectrical,mechanical,plumbingandlifesafetyinfor-mation.
Tenantsareencouragedtoexpresstheirownuniquedesignstatementwithintheparametersofthedesigncriteriaasoutlinedinthismanual.Thedesigncriteria calls for a three-dimensional storefront that carries into the store sales areaandisexpressiveofthemerchandisesold.
National and regional “standard” storefront concepts are respected to the extentthattheymeetthedesigncriteria.However,TenantsshouldbeawarethatsomeconceptmodificationsmightbenecessarytocomplywiththeCentercriteria.Thesame is true forproposeddesigns thatareoverly similar toa
MISSION STATEMENTneighboringTenant’sstorefrontdesign.WewishtomaketheMallasdiverseandinterestingaspossibleandenableeachTenanttomakeasingularstate-mentwiththeirdesign.
Three-dimensionalopportunitiesaffordedbythefollowingcriteriatoempha-sizecreativeanddynamicformsanddesigns.Storefrontelementsshallde-emphasizelinearorboxyformsbytheuseofrecesses,angles,curves,gablesandmaterialchangesinbothverticalandhorizontalviews.

Note: Prior to the commencement of con-struction, building and other permits shall be obtained by Tenant and posted in a prominent place within the premises. Upon the Delivery Date, Tenant shall accept delivery of the premises in an “AsIs”conditionand“WithAllFaults”andLandlordshallhavenoobligationtoimprove, remodel, alter or otherwise modify or prepare the premises for Ten-ant’s occupancy except to the extent otherwise expressly stated in the Lease Documents.Tenantherebyrepresentseachofthefollowing:
1. Tenant or its authorized representative has inspected the premises and has made all inquiries, tests and studies that it deems necessary inconnectionwithitsleasingofthepremises.
2. TenantisrelyingsolelyonTenant’sowninspection,inquiries,testsandstudies conducted in connectionwith andTenant’s own judgmentwithrespectto,theconditionofthepremisesandTenant’sleasingthereof.
3. Tenant is leasing the premises without any representations or warranties, express, impliedorstatutorybyLandlord,Landlord’s agents,brokers,finders,consultants,counsel,employees,officers,directors,sharehold-ers,partners,trusteesorbeneficiaries.
4. TheWork to be completed by Landlord, “Landlord’sWork” under theTenantLeaseshallbelimitedtothatdescribedintheforegoingsections.
5. Allotheritemsofworknotprovidedforherein,tobecompletedbyLand-lord,shallbeprovidedbytheTenantatTenant’sexpenseandishereinreferredtoas“Tenant’sWork”.
1. Tenantisrequiredtoinspect,verifyandcoordinateallfieldconditionsper-taining to the premises from the time prior to the start of its store design workandthecommencementofitsconstruction.Anyadjustmentstothework arising fromfield conditions not apparent on drawings andotherbuilding documents shall receive written approval of Landlord prior tostartofconstruction.
2. ImmediatelyfollowingtheinstallationbyLandlordofmetalstudframingdefiningthepremises,theTenantshallverifytheaccuracyofsaidinstal-lationandshallimmediatelyadviseLandlordofanydiscrepancies.Fail-ure tosonotifyLandlordshallbedeemedasacceptancebyTenantofsaidinstallationandlayout.
3. Landlordshallhavetherighttolocate,bothverticallyandhorizontally,util-itylines,airducts,flues,drains,cleanouts,sprinklermainsandvalves,andsuchotherequipmentincludingaccesspanelsforsame,withinthepremises.
4. Landlord’srighttolocateequipmentwithinthepremisesshallincludetheequipmentrequiredbyotherTenants.Landlordshallalsohavetherightto locatemechanical and other equipment on the roof over the prem-ises.

“Tenant’sWork”meansallworkofimprovementtobeundertakenuponthePremises(excludingLandlord’sWork,ifany),including,withoutlimitation,allrelateddocu-ments,permits,licenses,feesandcosts,allofwhichshallbeatthesolecostandexpenseofTenant.Tenant’sWorkshallinclude,withoutlimitation,thepurchase,installationandperformanceofthefollowing:
A. Engaging theservicesofa licensedarchitect (“Tenant’sArchitect”) toprepare thePreliminaryDocuments,ConstructionDocumentsandtheAs-BuiltDocu-ments.
B. PreparationoforiginalsandcopiesofthePreliminaryDocuments,ConstructionDocumentsandAs-BuiltDocuments.
C. FeesforplanreviewbyLandlordandlocalgovernmentalauthorities.
D. SuchotherimprovementsasLandlordshallrequirepertheLeasetobringthePremisesintofirst-classconditionbaseduponLandlord’sreasonablestandardsofappearance,materials,specifications,designcriteriaandLandlordApprovedFinalPlansfortheCenter,aswellasthatpartoftheCenterinwhichthePremisesarelocated.
LANDLORD’S WORK DEFINED
GeneralLandlord’sWorkDefined.“Landlord’sWork”meansthework,ifany,whichLandlordisexpresslyobligatedtoundertakeinaccordancewiththeLease.Landlordshallhavenoobligationtoimprove,remodel,alterorotherwisemodifyorpreparethePremisesforTenant’soccupancy.
CenterLandlord or its predecessor-in-interest has constructed the Center, and the Building and other improvements upon the Center (exclusive of improvements constructed byoronbehalfofeachpresentandpriorOccupantoftheCenter).TenanthasinspectedtheCenter,theBuilding,theutilities,thetypes,quantitiesandqualitiesoftheUtilitiesandtheothersystemsandTenanthasfoundthesametobesuitable,sufficientandinacceptableconditionforthepurposeofTenantconductingthePermittedUseuponthePremises.LandlordshallhavenoobligationtoundertakeanyworkorfurnishanyadditionalmaterialsuponanypartoftheCenterorprovideanyadditionalutilitiesorothersystemsforthebenefitofthePremises.
For thepurposeofallTenantCriteriaManuals,all references toPreliminary/Construction “Plans”areconsidered thesameasPreliminary/Construction “Docu-ments”.
