We .understand that the Sunshine Ordinance Task Force recently received a letter from Sandy Close, the Executive Director of New America Media ("NAM"). Under Administrative Code Section 67.30(a}, one seat on the Sunshine Ordinance Task Force must be held by a "journalist from a racial/ethnic-minority-owned news organization and shall be appointed from individuals whose names have been submitted by New California Media [now named NAM]." Ms. Close's letter explains that NAM would like to relinquish its nominating authority under the Administrative Code and cede that authority to the Northern California Chapter of the Society of Professional Journalists ("SPJ"). Under the Sunshine Ordinance, SPJ is already responsible for nominating two other seats on the Task Force. Ms. Close's letter raises the question whether NAM may give its nominating authority to SPJ.

Because the Sunshine Ordinance expressly grants the authority to NAM, only NAM may exercise the authority-unless the ordinance is amended. The provision in question was added to the Sunshine Ordinance by the voters in 1999 as part of Proposition G; it was not in the original Sunshine Ordinance enacted by the Board of Supervisors in 1993. Because the voters approved this provision, only the voters may amend it to grant the nominating power to a different organization. NAM must remain the nominating body unless the voters amend the ordinance. But to minimize the burden of participating in the nomination process, NAM may work out an arrangement with the SPJ or any other organization, where NAM would retain its formal nominating authority but SPJ or another organization would handle the workload of finding and vetting nominees, subject to NAM's final approval.
