TERMS AND CONDITIONS OF SALESupplyAll orders are accepted subject to:

a. Credit limit control

b. The av ailability of stock

c. The prices and VAT rate ruling at time of despatch

d. The minimum carriage paid order Ireland is €50 and below this carriage will be charged at €5.00.

e. The risk (but not ownership) passing to the purchaser on deliv ery

f . All sizes and dimensions being approximate.

Retention of Title

All goods supplied shall remain LMS property until pay ment in f ull of all sums owing to us hav e been achiev ed in accordance with these Terms and Conditions ofSale.

In def ault of pay ment by the purchaser when lawf ully demanded, an employ ee of the Company or a duly authorised agent of the Company shall be entitled toenter the premises of the purchaser and recov er those of the Company ’s goods that are av ailable.

Payment

Pay ment terms are net 30 day s f rom the inv oice date.

Failure to pay within 60 day s of the inv oice date will result in the immediate withdrawal of credit f acilities. No f urther deliv eries will be made until the ov erdueamount is paid in f ull.

Debts unpaid within 90 day s of the inv oice date will be ref erred to our Solicitor. No f urther goods will be released until the outstanding debt is paid in f ull.

All transactions are subject to credit limit controls. The VAT is included within the credit limit.

Special Orders

Orders f or items, which are not included in our ex stock assortment (i.e. they are not listed in our current Trade Price Lists), may be specially ordered on thepurchaser’s behalf direct ex Factory . The supply of such orders is, in addition to those terms stated abov e, subject to: -

a. Conf irmation in writing

b. Av ailability ex Factory stock

c. Deliv ery between 4-12 weeks but cannot be guaranteed unless specially adv ised.

NOTE: The return f or credit of non-stock goods (excluding damaged or f aulty goods) cannot be accepted.

Claims

Claims f or undeliv ered, missing, damaged or f aulty goods must be made in writing within 7day s of inv oice date. The Company will not accept liability f orconsequential loss or loss of prof it that may arise through late notif ication.

Return of Goods

No goods will be accepted f or return without prior authorisation of the LMS Sales Of f ice .

The unauthorised return of goods risks ref usal and the goods may be returned carriage f orward, to the sender.

All goods being returned should be adequately packed and consigned at y our risk. Any goods returned which are not receiv ed in a re-saleable condition because ofdamage in transit will not be credited.
