The above mentioned circulars for revision of pension and family pension of Armed Forces Personnel including Major rank officer in terms of Govt. orders issued as per VICPC recommendations were issued to Pension Disbursing Authorities for implementation.

The orders for revision of pension of post 1.1.96 but pre 1.1.06 retiree substantive Majors and equivalent ranks in Navy and Air Force and completed 21 years of commissioned service who were drawing pay scale of Lt. Col. or equivalent officers in Navy & Air force at the time of retirement in terms of provision contained in Para 5(a) (iii) and 5(a) (iv) of Special Army instruction 2/S/98 or corresponding instructions for Navy and Air Force has been issued vide GOI,MOD letter No. 1(13)/2009/D(Pen/Policy) dated 24.09.2012. The copy of letter is enclosed herewith for information and necessary action as Annexure-I.

The provision contained in para 5(a)(iii) and 5(a)(iv) of SAI 2/S/98 are as under-

Para 5(a)(iii):- Officers who become substantive Major on or after 1.1.96 shall be granted the scale of Pay of Lt. Col. on their stagnation for one year in the revised scale of Major. Such officer will, however, continue to draw the rank pay of Major.

Para 5(a)(iv):- As a one time measure those who become substantive major before 1.1.96 will be granted the scale of Lt. Col. on completion of 21 years of commissioned service i.e. in their 22nd year with rank pay of Major.

Since above categories of officer can not be identified by Pension Disbursing Authorities, so it has been decided to issue corrigendum PPO by Pension Sanctioning Authorities to implement above mentioned Govt. order dated 24/9/2012.

The effected officer may apply in duplicate on format enclosed as Annexure II to their pension disbursing authority (PDA). On receipt of application from pensioner/ family pensioner, the PDA will pass application after verifying relevant entries to the PCDA (O) Pune, in case of Army Officers/Naval Pay Office, Mumbai in case of Naval Officers and AFCAO, New Delhi, in case of Air Force officers on priority under intimation to pensioner/family pensioner. The full postal address of Pay Accounts Offices of Army, Navy and Air Force are given in Annexure-III.

It will be the responsibility of concerned pay Accounting Authority viz. PCDA(O) Pune/Naval pay office Mumbai/AFCAO to verify the service details of officer and confirm that the case is governed under para 5(a)(iii) or 5(a)(iv) of SAI 2/S/98 . After verification, the application of officer will be signed by PCDA (O) Pune and forwarded to concerned Pension Sanctioning Authority(PDA) at the earliest. On receipt of application Corr PPO will be issued by PSA.

3. In cases where pensioner/ family pensioner was alive as on 1st January 2006 and died subsequently, his legal heir(s) is/are also entitled to lifetime arrears with effect from 1st Jan 2006 till the date of death of pensioner. For this purpose legal heir(s) are also to apply to Pension Disbursing Agencies concerned.

It is requested that a copy of these orders / instructions should be provided to all Paying branches under your jurisdiction and they may be advised to give wide publicity so that the affected officers or Legal heirs (in case of death of officer) may fill up annexure-II (in Duplicate). The branches may further be instructed to check relevant entries and forward two countersigned copies of annexure-II to the concerned Pay Accounts Office at address given in Annexure-III to Govt. letter on priority basis.
