ACTION REQUESTED: Approve the start of a public involvement period to receive input on the proposed amendments to the 2016-2025 Transportation Improvement Program (TIP) and the 2040 Metropolitan Transportation Plan (MTP), as well as the draft air quality conformity determination report. TCC RECOMMENDATION: At its November 2015 meeting, the TCC unanimously recommended that the MPO approve the start of a public involvement process. BACKGROUND: • A conformity determination is required for the MTP amendments. • Final action is anticipated for January 2016. • The attached memorandum provides more details.

7. Legislative Changes to NCDOT Warren Cooksey

ACTION REQUESTED: FYI BACKGROUND: • This year’s legislative session in general, and the new State budget in particular, brought

significant changes to NCDOT, particularly regarding revenues and budget authority. • Using information presented to the State Board of Transportation, details of those changes

will be provided. • Information provided will explain the need for several of the TIP amendments being

requested in the following agenda item. 8. 2016-2025 Transportation Improvement Program (TIP) Amendments

b. City LYNX Gold Line (TE-4905) Amendment Neil Burke ACTION REQUESTED: Amend the TIP to include a corrected cost estimate. TCC RECOMMENDATION: At its November meeting, the TCC unanimously recommended that the MPO adopt the amendment.

c. STP-DA Share on Bicycle and Pedestrian Projects Amendments Neil Burke ACTION REQUESTED: Amend the TIP to correct errors in total project costs shown in the adopted TIP. TCC RECOMMENDATION: At its November meeting, the TCC unanimously recommended that the MPO adopt the amendments.

ATTACHMENT: Memorandum. 9. LYNX Silver Line/Southeast Corridor Transit Study Jason Lawrence

ACTION REQUESTED: FYI

BACKGROUND: • CATS is currently conducting a rail alternative analysis and transit study for the LYNX Silver

Line and Southeast Corridor. • The study area extends approximately 13.5 miles from center city Charlotte to

Mecklenburg/Union County line. • The study will define a fixed rail guideway alignment, provide an interim bus transit strategy

that utilizes the future Independence Blvd managed lanes and develop land development strategies to protect and preserve the fixed guideway alignment.

• The CRTPO will be asked to endorse a locally preferred alternate in 2016. 10. Metropolitan Transit Commission Representation John Joye

ACTION REQUESTED: FYI

BACKGROUND: • The MPO bylaws require that the Metropolitan Transit Commission’s (MTC) MPO

representative be a voting member of the MTC. The TCC bylaws require that the MTC’s representative be the Chief Transit Officer.

• The MTC took action at its October 28 meeting to approve the appointment of the Executive Director of CATS (Chief Transit Officer) to serve on the MPO board and to request that the MPO consider changing its bylaws to allow the Chief Transit Officer to serve as voting member of the MPO.

• The MPO will need to consider changing its bylaws.

ACTION REQUESTED: FYI

BACKGROUND: • Entry of the CRTPO’s P4.0 projects into the SPOT database is complete. • Two local contribution letters have been submitted:

o Charlotte: Eastway Drive/Shamrock Drive intersection improvement o Mooresville: I-77/Cornelius Road interchange

• A review of the next steps in the P4.0 process will be provided.

BACKGROUND: • The Unified Planning Work Program (UPWP) is adopted annually in accordance with joint

Federal Highway Administration/Federal Transit Administration (FHWA/FTA) transportation planning guidelines.

• The UPWP describes the planning activities that are anticipated for the coming fiscal year and documents the allocation of state and federal funds associated with each planning activity.

• An update on the preparation of the FY 2017 UPWP will be provided.

Call to Order

MPO Chairwoman Sarah McAulay called the October 2015 CRTPO meeting to order at 6:00 PM. She introduced John Lewis, the new CATS chief operating officer. Mr. Lewis briefly addressed the board and stated that he looked forward to working with the MPO.

2. Adoption of the Agenda

Summary: Chairwoman McAulay asked if there were items to be added to the agenda or changed. None were identified. Motion: Ken Robertson made a motion to adopt the agenda as presented. Gary Savoie seconded the motion. Upon being put to a vote, the motion was unanimously approved.

3. Citizen Comment Period Two people addressed the MPO. 1. Billy Packer: Mr. Packer addressed the board about agenda item #6, Mt. Holly Road Thoroughfare Plan

Amendment. He urged the board to amend the Thoroughfare Plan as recommended by the Technical Coordinating Committee (TCC).

2. Ralph Messera: Mr. Messera also addressed the board about agenda item #6. He urged the board to not amend the Thoroughfare Plan until a study is completed to determine if an alternate route is feasible.

4. Ethics Awareness & Conflict of Interest Reminder

Mr. Cook read the ethics awareness and conflict of interest reminder to the MPO. Michael Johnson requested to be recused from agenda item #6, Mt. Holly Road Thoroughfare Plan Amendment. No other board members identified conflicts.

Motion:

Vi Lyles made a motion to recuse Mr. Johnson from agenda item #6. Ned Curran seconded the motion. Upon being put to a vote, the motion was unanimously approved.

5. Approval of Minutes

Summary: Chairwoman McAulay requested action on the September 2015 meeting minutes.

Motion: Mr. Curran made a motion to approve the September 2015 meeting minutes. Woody Washam seconded the motion. Upon being put to a vote, the September 2015 meeting minutes were unanimously approved.

6. Mt. Holly Road Thoroughfare Plan Amendment

Summary: Mr. Steinman stated that the requested action was to amend the Thoroughfare Plan to remove a proposed extension of Mt. Holly Road, from Mt. Holly-Huntersville Road to the Catawba River. The issues that led to the requested action were described. It was noted that the Gaston-Clcveland-Lincoln MPO had removed its portion of the project from its Comprehensive Transportation Plan. Public involvement activities were described, including a May 21, 2015 public meeting. The TCC voted by a margin of 16 to 7 to recommend to the MPO that it take the requested action. Motion: Ms. Lyles made a motion to follow the TCC’s recommendation and delete the proposed extension of Mt. Holly Road, from Mt. Holly-Huntersville Road to the Catawba River, from the Thoroughfare Plan. Upon being put to a vote, 47 votes were cast in favor of the motion, and three votes were cast in opposition. The opposition votes were cast by Huntersville-2 and Mineral Springs-1. The motion passed.

7. Prioritization 4.0

Presenter: Neil Burke Summary: Mr. Burke provided information to the MPO via a Power Point presentation, the contents of which are incorporated into the minutes. The requested action was to endorse the list of recommended Prioritization 4.0 project submittals. An overview of public involvement activities was provided. 180 comments were received, all of which stated support for I-77 general purpose lanes. Nearly all the comments referenced a draft 2017 TIP; however, comments were being sought on a list of projects to be submitted for P4.0 scoring. A draft TIP is not scheduled to be released until December 2016. The presentation then moved to a discussion of the MPO’s direction at the September meeting that the TCC evaluate alternatives to the Highway project list that was presented at that time. Based upon the MPO’s comments, the TCC reconsidered its recommendation and was now recommending the following changes:

The TCC did not recommend any additional changes to the Highway list. Non-highway projects were reviewed. Mr. Burke noted changes to the Aviation project list involving Statesville Airport projects. Two new projects were added, one project description was changed and two other projects were combined into a single project. The TCC unanimously recommended that the MPO endorse the project lists.

Motion: Mr. Johnson made a motion to accept the TCC’s recommendation and endorse the list of P4.0 project submittals. Mayor Richardson seconded the motion. Upon being put to a vote, the motion passed unanimously.

8. 2016-2025 TIP & 2040 MTP Amendment List Presenter: Robert Cook Summary: Mr. Cook stated that the requested action was for the board to endorse a list of Transportation Improvement Program (TIP) and 2040 Metropolitan Transportation Plan (MTP) amendments. The chart below lists the reasons why amendments were being considered. The issue was being brought to the board for its endorsement to ensure that the proposed amendments were acceptable before proceeding with additional work. If acceptable, work would continue and the subject would be brought back before the board in November to request the start of a public involvement process. It was stated that the TCC voted unanimously to recommend that the MPO endorse the proposed amendments.

$4 million in STP-DA funds were allocated to this project earlier this year to complete preliminary engineering and environmental documents. It has since determined that the funds would be better utilized by applying the funding to TIP project U-4714C. The Monroe City Council has endorsed the transfer of funds.

N/A NC 115 Two-Way Pair-implement a two-way pair travel pattern on NC 115 and Main St. in Huntersville between Fourth St. and Mt. Holly-Huntersville Road.

9. Comprehensive Transportation Plan

Presenter: Robert Cook Summary: Mr. Cook provided information to the MPO via a Power Point presentation, the contents of which are incorporated into the minutes. The presentation’s purpose was to follow up on a September presentation that

notified the board of the formation of a CTP Work Group, by providing an overview of the CTP. The following topics were discussed:

• What is a CTP and why is it important? • How the CTP is different from the Thoroughfare Plan • The CTPs relationship to other CRTPO plans • Work currently underway on the CTP, and a schedule for future activity.

Staff’s goal is to request that the MPO officially approve the start of a public engagement effort in February or March 2016 and to adopt the CTP maps in summer 2016.

10. Upcoming Agenda Items Presenter: Robert Cook Summary: Mr. Cook stated that November’s agenda will include a request to officially start a public involvement process for the MTP and TIP amendments, as well as the draft air quality conformity determination report. A review of the FY 2017 UPWP will also be provided. The CRTPO’s quadrennial certification review by the FHWA and FTA will take place on December 15-16. The review’s purpose is to determine that the MPO is implementing a continuous, cooperative and comprehensive transportation planning process. There will be an opportunity for the board members to meet with FHWA and FTA representatives on December 15. A public meeting will be held later that evening to hear public input.

BACKGROUND: The STP-DA funding amounts for the sixteen bicycle and pedestrian projects that were approved by the MPO are reduced in the TIP to account for local match. Thus, the costs in the TIP do not accurately reflect total project costs. Staff has worked with the NCDOT-TIP Unit to correct the errors. The TIP amendments will be approved by NCDOT as administrative modifications. TCC RECOMMENDATION: The TCC unanimously recommended that the MPO consider approving the amendments during its November 5 meeting.

Dear Madam Chairperson,

This letter is written on behalf of the Metropolitan Transit Commission (MTC), which by unanimous vote on October 28th authorized me, as Vice-Chair of the MTC, to make the below request of the Charlotte Regional Transportation Planning Organization (CRTPO).

As you may recall, the MTC previously requested, and CR TPO kindly granted, a change in CRTPO by-laws to allow the MTC to be represented on CRTPO by any voting member of the MTC, regardless of whether that MTC member was an elected official or not.

That accommodation has been greatly appreciated and has aided the MTC Chair in the appointment of the MTC's representative and an alternate. However, the nature of the MTC's membership, (being the Chief Elected Official and the Manager of eight local gover1llllents within Mecklenbw-g county as well as a Nmth Carolina Depmtment ofTranspottation Board Member), creates a great deal of overlap with the representative membership of CRTPO. The potential for dual representation is a fe11ile ground for apparent conflicts of interest to arise.

h1 order to facilitate the avoidance of any such apparent conflicts of interest, the MTC requests CRTPO to amend its by-laws to allow, in the discretion of the MTC Chair, the MTC to be represented by its Chief Transit Official.

The MTC has been advised that such representation is not inconsistent with the October I 0, 2013 Memorandum of Understanding that governs CRTPO, but that it appears the bylaws of CRTPO and its Technical Coordinating Committee (TCC) would require mnendment in order to fulfill this req nest.

Currently, the MTC Chief Transit Official is listed as a member of the TCC in the TCC by­laws, although the actual representation is provided by the Charlotte Area Trm1sit System (CATS) Transit Planning Manager, who is listed in the TCC membership list. The MTC requests that CRTPO consider amending the TCC by-laws to ratify actual practice and list the CATS Transit Pla1ming Manager as its member on behalf of the MTC, in lieu of the Chief Transit Official.

Additionally, the CRTPO by-laws currently call for the MTC to be represented by a voting member of the MTC. The MTC requests that CRTPO consider amending the CRTPO by-laws
