TERMS AND CONDITIONS This Warranty is between the Seller and Buyer of the property shown on the Warranty Confirmation (“Covered Property”) and A.B. MayCompany (“Company”). Services under this Warranty are provided by Company andother such companies under their direction may be used to perform repair service on the homemechanicalsystemsoutlinedinthisWarranty.TheCompanyduringthetermofthisWarrantyandsubjecttotheconditionshereof,warrantstoSellerandBuyer(SellerandBuyerwill sometimeshereinafterbe referred to jointly as “CoveredPersons”or individually as“CoveredPerson”) to repairor replace,atCompany’sdiscretion,anycoveredapplianceorhomemechanicalsystem(plumbing,heating,airconditioning,electrical)locatedattheCoveredPropertytonormaloperationalcondition.ThisWarrantycoversonlytheappliancesandsystemswhicharenotedontheWarrantyconfirmationasbeingcoveredandwhicharelocatedontheCoveredPropertyandinnormaloperatingconditiononthefirstdateofthetermofthisWarranty.

TERM The term of this Warranty for covered appliances and systems for Seller shall commenceuponWarrantyconfirmationnumberbeingissuedbyCompanyandremainineffectfortheinitiallistingperiod(butnolongerthan180days).ThetermofthisWarrantyfor covered appliances and systems for Buyer shall be 12 months from closing date, which will commence upon full payment therefore being received by Company and Company acceptingthepaymentandissuingthisWarranty.CompanyreservestherighttoinspecttheCoveredPropertyandallcoveredappliancesandsystemsbeforeissuingthisWarranty.

SERVICE Company guarantees a response time of 24 hours on emergency service†,24hoursdaily,and7daysweekly, includingholidays,withFAST,PRIORITYserviceonallroutineservice requests. Fornon-emergencyservice requests it is theCoveredPerson’sresponsibility to provide access to the Covered Property for repairs during normal business hours.

SERVICE CALL FEES Formechanical systemsSeller – (during listing)$95.00 (or actualcharges,whichever is less) fee for each occurrence, Buyer – (after payment ofWarrantyis received in full)$75 fee foreachoccurrence. Service fee(s) shallbecharged foreachoccurrence, for items repaired or replaced under the same home mechanical system.Servicecallsfordifferenttradescannotbecombinedintoonecall.RepairsperformedunderthisWarrantywillbewarrantedfor30daysonpartsandlabor.ServicefeesareinadditiontoWarrantyFees.

ITEMS NOT COVERED HEREUNDER INCLUDE (BUT NOT LIMITED TO) THE FOLLOWING: (BUyER/SELLER) Cosmeticdefects; appliance failure resulting from rustorcorrosion;poorwaterpressureorrustinwaterwhereoriginalgalvanizedpipingisstillinplace;colororpurityofhotandcoldwatersystems;waterrecirculatingsystems;hotwaterdispensers; sewagegrinderpumpand lift station;grouting, caulking, crackedorbrokenceramic,fiberglass,simulatedmarble,granite,tubs,sinks,tile,walls,floors,subflooringandanyfixture;foundationandbuildingstructure;windowairconditioningunits;oilfurnaces;gasairconditioningsystems;outsideorundergroundpipingandcomponentsforgeothermaland/or water source heat pumps, pumps and pump components for geothermal and/or watersourceheatpumps;heating/waterheatercombinationunits;solarwaterheatingandcomponents;powerventedwaterheaters;waterheatermaintenance;generators;electricgarage door openers; built-in or sub-zero refrigerators; lighting fixtures; exhaust fans;crackedorbrokensewerlines;exteriorgaslines;fireplacesystems;intercomsystems;fire,smokeandsecurityalarmsystems;batteries;computerized/electronicmanagementsystemsforenergy,lightingsystem,securityorappliances;anddoorbellwhenpartofanintegratedintercomsystem.Itemsdamagedbyabuse,negligenceorimproperuse,hazardousortoxicmaterials;moldand/orfungus;chemicals;asbestos;ductcleaning;missingparts;detachableaccessoriesforanycovereditem.Mechanicalsystemfailuresduetolocalcodeviolations,pre-existingconditionsandconcealedorcamouflageddamage. Damageresulting fromalterations or additions made to property or grounds and damage to any item as a result of fire,flood,smoke,lightning,freeze,earthquakeorsettlingofgroundorfoundation,theft,storms, accidents, war, riots, acts of God, vandalism, improper installation, power failure or surge,pest/petdamage,neglect(includingcoilandblowercleaning)ormisuse.Septictankdrainfieldlinesandpumpswithintheseptictank.Boilersections,piping,radiators,pumpsandgauges. Treatment forwood infestation insects. Pool/Spa items not coveredwithoptionalcoverage:heaters,structuraldefects,liners,lightingsystems,cleaningequipment,anyremovableitem,undergroundelectrical,plumbingandgaslines.

LIMITATIONSThisWarrantyappliesonlytoasinglefamilyresidence.ThisWarrantydoesnot covermobile homes. ThisWarranty covers onlymatters of which the Company isadvised during the term of the applicable Warranty, and does not cover conditions which existed prior to the issuance of this Warranty, nor items that are the responsibility of the CoveredPersons.Companyisnotresponsibleformatchingcolororbrand.Unlessoptionalappliancereplacementupgrade**isincluded,replacementisbasedonbuildersstandardmakes and models. Company will not reimburse other vendors for service performed

withoutpriorapproval.Companywillnotbeliableforconsequentialdamagestopropertyor personal injury resulting from the failure of any component, system or appliance or from Company’sdelayorfailuretoprovideserviceduetoconditionsbeyondCompany’scontrolsuchas,butnotlimitedto,unavailabilityofmaterialsorlabordifficulties.Companyisnotresponsible forcodeviolationsordesign limitations insystemsorappliances. CompanywillupgradetocodeatCoveredPerson’sexpense,butsuchupgradesarenotcoveredbythisWarranty.Companywillnotberesponsibleforreplacingcombinationapplianceswhenfailure of one component does not affect operation of the remaining appliances within the unit.Ifanysystemotherwisecoveredisrenderedinoperableduetonon-availabilityofoneor more of its parts, the Company shall not be responsible for replacement of the entire non-operatingsystemorappliance.Companyshallonlyberequiredtomakeareasonableallowancebasedonthevalueofcomparableparts.However,intheeventacoolingsystemis rendered inoperable due to failure of parts which are no longer available, Company will replace defective parts with comparable parts or equipment to return the system to operatingcondition. It is theCoveredPerson’s responsibility toprovideaccess requiredtomakerepairs.Theexpenseincurredtogainaccess,ortheexpenseofrepairofdamagenecessaryinordertogainaccesssuchas,butnotlimitedtolandscaping,sheetrock,flooring,carpet,ceramictile,bathorshowerenclosuresandpavinganddamagetofinishedareassuch as paint, wallpaper and cosmetic damage resulting from any repair made under this WarrantyshallbetheresponsibilityoftheCoveredPerson.

**In the event a covered appliance is deemed to be beyond repair and the OptionalAppliance Replacement Upgrade is in effect, the Company will provide a reasonable allowance based on the replacement cost of a like appliance

LIMITS OF LIABILITy The express warranties and agreements set forth in this Warranty aretheonlyobligationsoftheCompanytotheCoveredPersonsundertheWarranty.Allother agreements, undertakings and warranties by the Company, including but not limited towarrantiesofmerchantabilityoffitnessforaparticularpurposeareexpresslyexcluded.ThisWarranty does not create, establish or confirm any obligation of Company to anypersonnotdesignatedasaCoveredPersonhereby.ThemaximumliabilityoftheCompanyunder thisAgreement shallbe$2000.00peroccurrence forBuyer, $500peroccurrenceforSellerunderthelistingplananda$500maximumcoverageforthelifeofthecontractonbluepolybutylenepipe.AppliancereplacementupgradeislimitedBuyeronlyandtoamaximumof$2000.00peroccurrenceand$4000.00peryear.Undernocircumstancesshall the company be liable for actual, incidental, or consequential damages arising out of its performance or claimed nonperformance under this Warranty, including but not limited to,liabilityfordamagetoproperty,personalinjuryordeath.InnoeventwillCompanyberesponsibleforanyloss,damage,illnessorinjuryresultingfromcondensationleaksorfrozenpipesordrains.NoticetoKansasresidents-anydisclaimersorexclusionsofthewarrantiesofmerchantabilityorwarrantiesoffitnessforaparticularpurposemaybevoidunderKansaslaw.NotwithstandinganysuchdisclaimersorexclusionsotherremediesmaybeavailabletotheconsumerunderKansaslaw.

RENEWAL AND TRANSFER At Company’s sole discretion and option, this Warrantymay be renewed for additional one year periods upon payment to the Company of the Company’stheneffectiverenewalchargefortherenewalWarrantyrequested.ThisWarrantymaybeassignedduring its termtoasubsequentpurchaserof theCoveredProperty (a“Transferee Covered Person”), but after such assignment this Warranty will only coversystems and appliances which are transferred to the Transferee Covered Person as part of thesale.ForanassignmentofthisWarrantytobeeffective,theTransfereeCoveredPersonmust,within30daysoftheclosingofthesaleoftheCoveredProperty,notifytheCompanyin writing of the sale and of the name and address of the Transferee Covered Person.Company reserves the right to inspect the Covered Property and all covered appliances and systemsbeforerenewingortransferringWarranty.

PERFORMANCE GUARANTEEThisisnotacontractofinsurance.

TERMINATION AND CANCELLATION This Warranty cannot be cancelled by Company except:1)forowner’sfailuretopayservicecallfeestoCompany’sRepresentative;2)intheevent of fraud or material misrepresentation by homeowner of any fact or circumstances relating to appliances, electrical or mechanical systems; 3) in the event the CoveredPropertyisdeterminedtobeunsafeandtheconditionsarenotcorrectedwithin30daysofnotificationinwritingbyCompany

DEFAULT If Covered Persons fail to make payment as required by this Warranty, Company may terminate the Warranty without notice to Covered Persons. Covered Personsacknowledge all services have been provided under the Agreement at a discount per the Warranty and agrees to be responsible for the full price of all services provided to date at the currentrateforlikeservicesnotprovidedunderaWarranty.SaidamountswillbebilledtoCoveredPersonsbyCompanyandaredueandpayableuponreceipt.Saidunpaidbalancewillaccrue interestat1.5%permonth. If thiswarranty is referred forcollectionor legalaction, Covered Persons agree to pay Company all interests, costs and expenses including reasonableattorney’sfeesnottoexceed15%incurredbyCompany.

ENTIRE WARRANTyThisWarrantyandtheWarrantyconfirmationconstitutestheentireWarrantybetweentheparties.Nooralrepresentationapplies.ThisWarrantyisnoteffectivefor Buyer until payment is received in full. The named Real Estate firm, in addition torepresenting the Seller/Buyer, has a business relationship with the Company to the extent that it serves as an agent for Company in the marketing and sale of this home service warranty.TheWarrantyFeepaidatclosingincludesthefullamountoffeesdueandpayableto Company for Warranty administration and service, as well as reimbursement of expenses andpaymentforservicesprovidedbytheRealEstatefirm.Anyreimbursementofexpensesand payment is based on a good faith estimate of expenses incurred and services rendered inpromoting,selling,processingandadvertisingtheWarrantyfortheCompany.PurchaseoftheWarrantyisnotaconditionforthepurchaseofthesubjectproperty.

†Anemergencyisdefinedasthefailureofacovereditemwhichmaycausepersonalinjuryorsubstantialdamagetopropertyifnotrepairedwithin24hoursofnotification.
