Introduction

Welcome to Online Safety and Training Institute Pty Ltd (OSaTI) whose number one priority is assisting you in achieving your new qualification in a cost and time effective manner. (OSaTI) delivers your training with support that will ensure that you are able to complete your training goals as quickly as you are able to achieve them. You will receive training from passionate, qualified Trainers with substantial Industry experience in your vocational area. This ensures the training you receive is current, relevant and delivered in a way that you can understand.

All of our courses are supported by innovative student resources and excellent quality course materials. This is one of our greatest strengths and means that your learning experience will be a positive one. Online Safety and Training Institute Pty Ltd shall be renowned for having excellent student back up and support and is committed to delivering that experience. We wish you all the best in your studies and look forward to assisting you in achieving your new qualification and advancing your career.

This Student Handbook sets out the policies and procedures surrounding the training and assessment you will receive at Online Safety and Training Institute Pty Ltd.

Please read the Student Handbook prior to enrolling in any Online Safety and Training Institute Pty Ltd course.

Online Safety and Training Institute Pty Ltd is a Registered Training Organisation (RTO No. XXXXX) and is recognised by the Australian Skills Quality Authority as a deliverer of nationally recognised training.

Student Guarantee

Online Safety and Training Institute Pty Ltd guarantees that if, for whatever reason, it is unable to complete the agreed training for a student, Online Safety and Training Institute Pty Ltd will make the necessary arrangements for the training to be delivered by another Registered Training Organisation.

For other courses delivered by Training Partners as nominated and clearly identified by Online Safety and Training Institute Pty Ltd, please refer to the Online Safety and Training Institute Pty Ltd Website.

Competency Based Training

Qualifications are comprised of Units of Competency, which have been determined by the relevant industry bodies and categorised into National Competency Standards for specific industry areas.

The Standards provide a framework for training and assessment and specify what Competencies an employee at a particular level within a particular industry should be reasonably expected to achieve.

Flexibility of Delivery

Flexible delivery means providing training when it best suits the participant and / or employer. Flexible delivery focuses on your learning rather than our teaching and to provide the best possible learning experience for the participant. This means that the participant has greater control over what, when and how they learn.

Online Safety and Training Institute Pty Ltd, has two methods of delivery depending on the course. These consist of Distance and Blended deliveries.

Distance Learning (Online)

Online Safety and Training Institute Pty Ltd delivers the Training of its Distance courses in an online format. Students are provided with all learning materials, assessment tools, student forums and other resources required to complete their particular course. Students are able to work through these learning materials at their own pace.

If required, the student may contact Trainers for assistance but our Trainers will not contact students unless requested, or there are issues with the student and their potential course outcomes.

Blended Learning (Classroom and Online)

The Blended courses are delivered with an initial classroom-based component as well as a subsequent distance / online format.

Online

These courses are delivered in the Online Safety and Training Institute Pty Ltd distance / online format.

Enrolment

Online Safety and Training Institute Pty Ltd will endeavour to complete the enrolment process as quickly as possible, please allow up to five (5) business days from confirmation of your payment for enrolment.

Upon enrolment, students will receive via email course information and personalised logins.

The training and assessment resources necessary to complete the selected course are available on the online portal profile specific to each student and accessed with these personalised logins.

For students enrolled in a Blended Course, the learning and assessment materials are made available while attending the initial Classroom-based component.

Replacement Materials and or Hardcopies of Materials

For any course available from Online Safety and Training Institute Pty Ltd, students may choose to purchase a hardcopy of the learning guides and assessment workbooks for a fee of $300. If a student would prefer a high quality colour print version of the learning guides and assessment workbooks, this can be purchased for a fee of $450.

Access and Equity

Online Safety and Training Institute Pty Ltd is committed to providing opportunities to all people for advancement, regardless of their background. We support government policy initiatives and provide access to our training for all those seeking to undertake it.

We ensure that our student selection criteria are non-discriminatory and provide fair access to training for the disadvantaged.

In addition, we liaise with agencies and government departments for assistance in matters of language, literacy and numeracy difficulties if applicable to individual students.

Language, Literacy and Numeracy (LLN)

To assist in identifying any special learning needs, you are required to provide Online Safety and Training Institute Pty Ltd with information regarding your LLN requirements on your enrolment form, prior to the start of the training program.

If you do have any learning difficulties we need you to discuss these with your course trainer or facilitator either prior to course commencement or during the course, it is too late to speak up after the course results are in.

All discussions with our staff will be treated as Confidential.

Superseded Course Transitions for Enrolled Students

At times, the nationally recognised training courses delivered by Online Safety and Training Institute Pty Ltd may be superseded by an updated and or new Training Package qualification.

If applicable and required, Online Safety and Training Institute Pty Ltd will apply to add the replacement Training Package qualification to its scope as soon as practicable but no later than 12 months from the date of publication of the replacement qualification on the national register.

Course Requirements

The software requirements to ensure the course materials are accessible are as follows:

the latest versions of Word and Adobe Reader are required.

the latest version of Flash-Player.

Google Chrome or Microsoft Internet Explorer (IE) as an Internet Browser most compatible with the student portal.

The recommended speed to access all learning resources is ADSL2+, though most internet connections are sufficient.

Slower connections will suffice for the PDF learning resources; however, for any multimedia content (SCORM) degradation in quality and issues downloading may be experienced.

Unique Student Identifier (USI)

The Australian Government has a requirement for all students of Vocational Education and Training to supply a Unique Student Identifier number to their VET provider. As a VET provider Online Safety and Training Institute Pty Ltd cannot issue a certificate for a VET qualification without being supplied a student’s USI.

Exemptions to the USI requirements may apply including for international students studying offshore and outside of Australia.

For any student exempt from supplying a USI, completion results and records will not be available through the Commonwealth Registrar.

Potential Students - Visa’s

Any overseas student in Australia on a student visa must enrol with a provider who is registered on CRICOS. As Online Safety and Training Institute Pty Ltd is not a CRICOS provider, enrolments from overseas students who are in Australia on a student visa cannot be accepted.

All students who are not Australian Residents will be required to provide visa information to ensure compliance with this ASQA direction.

Assessment

Assessment is defined as the process of ‘collecting evidence and making judgments on the nature and extent of progress towards the performance requirement set out in a (competency) standard, or learning outcome, and, at the appropriate point, making a judgment as to whether competency has been achieved’.

In simple terms, Assessment is the process of collecting evidence and making judgments on whether competency has been achieved. In order to be assessed as competent (C), you will need to provide evidence which demonstrates that you have the essential knowledge and skills to successfully complete the relevant unit to the required standard. Competency is simply about demonstrating that you can do the task with confidence to the required industry standard as endorsed by the Training Package or VET accredited Course.

NOTE: An assessment of ‘Not Yet Competent’ (NYC) is not a fail.

It is simply a request for more information or further confirmation of the knowledge and skills required.

Online Safety and Training Institute Pty Ltd Assessors will provide feedback to guide your resubmission and are available for contact if required. The student will be required to successfully resubmit the assessment with the required rectifications to achieve a competent result. The student will be allowed a limit of three submissions per unit of the course. To be eligible for the qualification, the student must receive a competent result for all units of the course.

Assessment, within competency-based approaches to learning, is criterion referenced. This means it identifies an individual’s achievements of defined outcomes, rather than relating their performance to that of other learners or trainees.

Assessment methods used may include:

Demonstration.

Observation.

Work samples.

Workbook activities.

Oral presentations.

Role plays or simulation.

Projects

Principles of Assessment

Fairness The individual learner’s needs are considered in the assessment process. Where appropriate reasonable adjustments are applied by OSaTI to take into account the individual learner’s needs. OSaTI will inform the learner about the assessment process and, and provides the learner with the opportunity to challenge the result of the assessment and be reassessed if necessary.

Flexibility Assessment is flexible to the individual learner by:

reflecting the learner’s needs;

assessing competencies held by the learner no matter how or where they have been acquired; and

drawing from a range of assessment methods and using those that are appropriate to the context, the unit of competency and associated assessment requirements, and the individual.

Validity Any assessment decision of OSaTI’s is justified, based on the evidence performance of the individual learner.

Validity required:

Assessment against the unit/s of competency and the associated assessment requirements covers the broad range of skills and knowledge that are essential to competent performance;

Assessment of knowledge and skills is integrated with their practical application;

Assessment to be based on evidence that demonstrates that a learners could demonstrate these skills and knowledge in other similar situations; and

Judgement of competence is based on evidence of learner performance that is aligned to the unit/s competency and associated assessment requirements.

Reliability Evidence presented for assessment is consistently interpreted and assessment results are comparable irrespective of the assessor conducting the assessment.

Validity The assessor is assured that the learner has the skills, knowledge and attributed as described in the module or unit of competency and associated assessment requirements.

Sufficiency The assessor is assured that the quality, quantity and relevance of the assessment to enable a judgement to be made of a learner’s competency.

Authenticity The assessor is assured that the evidence presented for assessment is the learner’s own work.

Currency The assessor is assured that the assessment evidence demonstrates current competency.

This requires the assessment evidence to be from the present or the very recent past.

Rules of Evidence The assessor is assured that the student fulfils the requirements set out in the above table.

Rules of Evidence

The Rules of Evidence are closely related to the principles of assessment and provide guidance on the collection of evidence to ensure that it is valid, sufficient, authentic and current as follows:

Validity:

Addresses all aspects (skills and knowledge) of the unit(s) of competency appropriately.

Reflects all four dimensions of competency.

Provides evidence of employability skills.

Is appropriate to the AQF alignment being assessed.

Sufficiency:

Sufficiency relates to the quality and quantity of evidence assessed.

It requires collection of enough appropriate evidence to ensure that all aspects of competency have been satisfied and that competency can be demonstrated over time.

Supplementary sources of evidence may be necessary. The specific evidence requirements of each unit of competency provide advice on sufficiency.

Authenticity:

To accept evidence as authentic, an assessor must be assured that the evidence presented for assessment is the candidate’s own work.

Your assessor is required to authenticate any evidence you provide to ensure it is indeed work produced by you.

Currency:

Currency relates to the age of the evidence presented by candidates to demonstrate that they are still competent. Competency requires demonstration of current performance, so the evidence must be from either the present or the very recent past.

Continuous improvement is a fundamental focus of the VET Industry and many other industries and consequently training packages are regularly upgraded.

An assessor must be satisfied that the learner has recently performed the required competencies successfully. We advise our learners that 12 – 18 months is a good gauge of “am I current”. This is certainly not the rule of thumb as an industry or qualification that has had substantial change in the last six months would require that the candidate would be able to provide evidence of demonstrating current competence in those new competencies.

Recognition of Prior Learning

The information below explains how to apply for and the process involved in Recognition of Prior Learning; please tick the RPL box on your Enrolment Form.

After enrolment, a RPL Assessor will contact you to discuss your RPL Pathway.

Mutual Recognition

Online Safety and Training Institute Pty Ltd recognises the Australian Qualifications Framework (AQF) Qualifications and Statements of Attainment issued by any other Registered Training Organisation and provides credit for units of competency where evidenced by authenticated VET transcripts issued by an AQF authorised issuing organisation or by the Registrar.

Recognition of Prior Learning (RPL) is the determination, on an individual basis, of the skills and knowledge obtained by the learner through previous training, work experience and/or life experience. RPL is used to determine the advanced standing, within a training program, that the learner may be awarded as a result of this learning/experience. RPL assessments are primarily used to determine an individual’s starting point in a course or program.

In all cases, the onus is on the applicant to document and present a convincing case to justify a claim for RPL. Whilst Trainers and Assessors may provide guidance or assistance to the applicant, it remains the applicant’s responsibility to present his/her case to the satisfaction of the RPL assessor. Course participants seeking RPL must complete an application form, and provide documentation to support that application.

RPL Evidence

All RPL candidates must provide suitable evidence of their experience that demonstrates their current ability to meet all requirements of the units of competency they are applying for. For RPL evidence to be considered, it must meet the rules of evidence being:

Valid

Sufficient

Authentic

Current

To understand these requirements, please read the “Rules of Evidence” section of this student handbook. If you have any queries regarding whether your RPL evidence meets the requirements of the Rules of Evidence, please send your query to [email protected] .

Your assessor will assess your evidence and provide feedback.

Where you meet all requirements you will be given a result of Competent/RPL Granted for the relevant unit of competency. If there are gaps in evidence, you may be requested to provide further evidence, or be given a suggestion for gap training to address all competency requirements.

The Rules of Evidence are closely related to the principles of assessment and provide guidance on the collection of evidence to ensure that it is valid, sufficient, authentic and current as follows.

Assessment Timeframes

Online Safety and Training Institute Pty Ltd aims to provide students with assessment marking results within six (6) weeks of the student submitting their assessment. If assessment marking timeframes are extending beyond six (6) weeks (e.g. times of peak demand, holiday period, unforeseeable circumstances having arisen), any students affected will be advised by email with an estimated timeframe.

Any students who are required to resubmit assignments after assessment and who have course end dates which do not allow sufficient time, will have their end date adjusted to allow a two week period from the assessment date for the corrections to be completed and submitted.

Appeals Policy

Online Safety and Training Institute Pty Ltd supports the rights of a student to lodge an appeal against any assessment decision and will not impair that right in any way.

Online Safety and Training Institute Pty Ltd will do everything possible to address the appeal in an unbiased and professional manner.

Appeals Process

Any student wishing to appeal and assessment decision/judgment is advised to follow the steps outlined below. This information is made available to student via this Student Handbook.

Step 1. (Trainer review).

The student must contact their Assessor to discuss their assessment result and why they believe that the Assessor's judgement is incorrect showing evidence of how they have addressed the assessment criteria.

The assessor will consider the student's case and determine whether they uphold their original decision or in light of their discussions wish to alter the assessment judgement.

Where the Assessor wishes to alter the original judgement, the Assessor will put a request forward to Online Safety and Training Institute Pty Ltd Chief Executive Officer in writing, outlining the details of the changes to the students’ assessment results and reason for the change in assessment result.

The Chief Executive Officer will review the Assessor's reasoning and assessment evidence against the required benchmarks and either overturn or uphold the original decision.

Where the Assessor/Chief Executive Officer upholds the original assessment decision, the learner then has an opportunity to put in a formal written request (see step two below).

This process will be completed within 10 days.

Step 2 (Formal written request).

Where the student is unhappy with the outcome at step one, they can follow the formal appeal process outlined below:

All appeals should be committed to in writing at the earliest possible opportunity and sent by email to [email protected] for any assessment decision appeals. This will constitute a formal appeal from the student. This should only happen once step one has been completed and where the student is unhappy with the outcome of this step.

The appeal request should contain the following information:

The student's full name and number

The unit/subject being assessed

Each assessment task name/number (where the result is being disputed) including why the result should be overturned. The student should refer directly to how they believe they have met the requirement of each task in detail and referencing any evidence to support their claims.

The Chief Executive Officer of Online Safety and Training Institute Pty Ltd is informed through receipt of all student appeal emails. The Chief Executive Officer of Online Safety and Training Institute Pty Ltd will initiate a transparent, participative process to deal with the issues at hand.

Appeals are to be responded to within 10 working days of the initial application.

The Chief Executive Officer of Online Safety and Training Institute Pty Ltd may delegate responsibility for the resolution of the appeal as required. In all cases the final conclusion will be endorsed by Online Safety and Training Institute Pty Ltd Chief Executive Officer.

The student will be advised in writing of the outcome of their appeal via email.

All appeals will be handled as Staff-In-Confidence.

If the outcome is not to the satisfaction of the student, he/she may contact the Online Safety and Training Institute Pty Ltd Chief Executive Officer to discuss their concerns.

Step 3 (Independent review request).

Where the student is unhappy with the outcome at step two, they can follow the formal appeal process outlined below:

The student has the right to request a review of the appeal by an independent party.

The student will be responsible for the costs of the independent review.

Online Safety and Training Institute Pty Ltd reserves the right to nominate or agree to the independent party and will cooperate fully with this independent review.

Online Safety and Training Institute Pty Ltd will aim to complete this appeals process as quickly as possible and within a total of 60 days.

Online Safety and Training Institute Pty Ltd will keep the student informed of the progress of the appeal throughout the process.

Issuing Certificates Policy

At the completion of your training program a Qualification or Statement of Attainment will be issued to you for the Units of Competency achieved. Qualifications and Statements of Attainment will be issued in accordance with the requirements of the Australian Qualifications Framework.

Completion of the training program will include the supply of the student’s Unique Student Identifier number and payment of all course fees.

All records of Qualifications and Competency achieved are retained for a period of thirty years.

Certificates and Statements of Attainment will be processed and dispatched to the student within thirty (30) days of course completion. The student is expected to advise Online Safety and Training Institute Pty Ltd of any change of their address details.

If a student of Online Safety and Training Institute Pty Ltd requires a replacement of an issued Qualification or Statement of Attainment, there will be payable an administration fee of $100 for a Qualification Certificate and $50 for a Statement of Attainment.

Support for Trainers

Online Safety and Training Institute Pty Ltd aims to only employ or contract quality and relevant Trainer Support.

Telephone support calls from Trainers can be booked by students through direct email to the Trainer and or by emailing [email protected]. We aim to answer all student messages within 24 hours Monday to Friday however we must respond to student queries within 48 hours maximum Monday to Friday.

Online Safety and Training Institute Pty Ltd business offices will be closed for two weeks during the Christmas and New Year period. The online student portal will remain open so students can continue with their coursework and submit assessments. There will be no trainer or admin support guaranteed to be available during this time.

Student Surveys

Online Safety and Training Institute Pty Ltd’s commitment to continuous improvement, after every contact with Online Safety and Training Institute Pty Ltd by phone or email, students will receive requests to complete customer service surveys on their experience. This is an opportunity for students to provide feedback on issues that are important to them.

This service is always optional and no pressure will be brought to bear on students.

Code of Conduct

All Online Safety and Training Institute Pty Ltd participants are expected to take responsibility for their own learning and behaviour during both training and assessment. Any breaches of discipline will result in the participant being given a ‘written warning’. Further breaches will result in a participant being asked to ‘show cause’ as to why they should not be excluded from further participation in the program. A third breach will result in instant dismissal from the training environment. Where a breach is deemed as of a serious nature, as determined by the Chief Executive Officer, the student’s enrolment may be terminated. In instances of dismissal and termination of enrolment, all fees paid will be non-refundable.

Personal interaction, staff-to-student and student-to-student, is expected to be respectful. An aggressive manner or degrading and abusive language will be considered contrary to the Code of Conduct and a breach of discipline.

Following are further instances of breaches to the Code of Conduct.

Discrimination

Discrimination means treating a person less favourably than another because of a personal attribute that they may have. Under State and Federal equal opportunity laws, discrimination based on attributes is unlawful. The attributes that can initiate a discrimination claim include:

Harassment

Harassment is any behaviour which is unwelcome, offends, humiliates or intimidates the person being harassed. Harassment will not be tolerated at Online Safety and Training Institute Pty Ltd and disciplinary action will be taken against any employee or student involved in such behaviour. From a staff perspective, this may include termination of employment. From a student perspective, enrolment may be terminated and all fees paid will be non-refundable.

Examples of verbal harassment

Racist comments or jokes.

Spreading rumours.

Comments or jokes about a person’s disability, pregnancy, sexuality, age religion etc.

Threats, insults or abuse.

Offensive obscene language.

Physical Assault/Abuse

Physical Abuse is an act of another party involving contact intended to cause feelings of physical pain, injury, or other physical suffering or bodily harm. Physical abuse will not be tolerated in any shape or form and any instances of Physical Abuse will result in instant termination of the student’s enrolment.

Some examples of physical abuse include:

Striking

Punching

Pushing, pulling

Slapping

Striking with an object

Excessive pinching on the body

Kicking

Blinding a person or causing impairment of sight.

Tripping

Kneeing

Strangling

Head-butting

Placing in stress positions (tied or otherwise forced)

Cutting or otherwise exposing somebody to something sharp

Throwing or shooting a projectile.

Extension – Terms and Conditions

Extension requests must be in made writing using a Student Extension Request Form prior to the maximum course completion time.

Standard Extension

A fee of $100 will be charged for each additional month requested beyond your original course end date.

Extenuating Circumstances

To be considered for an extension outside of our standard policy (with a waiver of the $125 monthly fee), extreme hardship, extenuating circumstances, or a debilitating medical condition MUST be proven with supporting documentation that is submitted to our office for review.

To be considered for an extension outside our standard policy, you must complete the Non-Standard Extension Request Form and provide supporting documentation which may include detailed letters or documentation from medical specialists, death certificates, legal documentation, and documentation that may prove extreme hardship.

To be eligible for an extension due to a medical condition suffered by you, you must provide a medical certificate and supporting documentation that must include a Medical Information Form that is fully completed by a Medical Practitioner or a duly executed written medical authority that will allow us to obtain the information requested on the Medical Information Form. All documentation must be original documentation or copies of original documentation certified by a Justice of the Peace, and must be posted to 22/330 Wattle Street Ultimo NSW 2007 for our review.

The student can request the return of original documents.

Online Safety and Training Institute Pty Ltd will make our decision based solely on the supporting documentation provided with your Extension Request. Based on our review of the request for Extension, we may or may not grant a partial or full waiver of the monthly extension fees. Your request will be responded to in writing within 10 business days of the request being received.

Transfer Policy

Online Safety and Training Institute Pty Ltd will offer students the opportunity to transfer to another course under this Transfer Policy. Upon transferring to another course, a student relinquishes their enrolment in the original course.

Standard Transfer:

Definition

A standard transfer is where a student wishes to move their enrolment from the course they are currently enrolled into a new course. The student may transfer under standard conditions below:

For all course enrolments in courses with a classroom component (blended- delivery or full face-to-face courses), once training has commenced, no transfer to another blended-delivery course is available to participants unless the student can provide a medical certificate, or prove extreme personal hardship. In instances where students are unable to attend or complete the classroom component of the course (without providing evidence of hardship), Online Safety and Training Institute Pty Ltd will allow the student an opportunity to complete the online or distance version of the same course.

After enrolment commencement, students may change their enrolment to a different Distance course offered by Online Safety and Training Institute Pty Ltd provided the request is made within 3 months of the enrolment application, a transfer fee of $250 will be payable PLUS the difference between the original course fee paid and the full course fee (not a promotional fee) of the new course they are transferring to (where this is applicable). No refund is applicable where a student chooses to transfer to another course of lesser value.

Workshop components of a course cannot be transferred to another course enrolment.

For all distance and online courses, if a student wishes to change their enrolment to a different course offered by Online Safety and Training Institute Pty Ltd, and the request is made within three months of the student’s enrolment application, a transfer fee of $250 will be payable PLUS the difference between the original course fee paid and the full course fee (not a promotional fee) of the new course they are transferring to (where this is applicable). No refund is applicable where a student chooses to transfer to another course of lesser value.

Original course enrolments are not transferrable to another person

The original course end date is transferred to the new course, and if the student wishes to extend the new course beyond the original course enrolment expiry, extension fees will be payable in accordance with Online Safety and Training Institute Pty Ltd s Extension Policy.

Upon transferring to another course, a student relinquishes their enrolment in the original course.

Course or Workshop Commencement Transfer

Definition

A Course or Workshop Commencement Transfer is when a student wishes to transfer their Blended, Full Delivery course or workshop to the same course with a different commencement date. The student may transfer under the Course or Workshop Commencement conditions below:

A transfer fee of $250 will be payable if a student wishes to change their enrolment to another course commencement date, provided the request is received at least 14 day prior to the original course commencement. If the request is received 30 days prior to the course commencement date, no transfer fee will be payable.

The student must pay the difference between the original course fee paid and the full course fee (not a promotional fee) of the new course they are transferring to (where this is applicable).

No refund is applicable where a student chooses to transfer to another course of lesser value.

Upon transferring to another course, a student relinquishes their enrolment in the original course.

Original course enrolments are not transferrable to another person.

Non-Standard Transfers:

Definition

A Non-Standard Transfer is any transfer request that does not meet the definitions and conditions of the Standard or Course or Workshop Commencement Transfer. Where a Non- Standard transfer is granted, the conditions below apply:

Non-Standard Transfers may be offered at the discretion of Online Safety and Training Institute Pty Ltd.

The student may be liable to pay the full course fee (not promotional fee) of the new course LESS up to a maximum of sixty percent (60%) of the original course fee paid by the student, at the discretion of Online Safety and Training Institute Pty Ltd.

The original course end date is transferred to the new course, and if the student wishes to extend the new course beyond the original course enrolment expiry, extension fees will be payable in accordance with Online Safety and Training Institute Pty Ltd s Extension Policy.

Upon transferring to another course, a student relinquishes their enrolment in the original course.

Students enrolling in a Blended Delivery Course without specifying a commencement date must select this date within 6 months of the enrolment application. Students will be ineligible for a refund after a period of 90 days after the enrolment application date. Students who wish to change the start date of their blended course must give two weeks’ notice prior to course commencement, and select a new start date within 6 months of the original commencement date. These students will be ineligible for a refund after a period of 90 days from the enrolment application date. Any student, who has not selected their course commencement date within six months, will automatically be enrolled into the equivalent online Distance delivery course.

Refund Policy

Online Safety and Training Institute Pty Ltd will only provide refunds in accordance this Refund Policy. A non‐refundable administration fee of 25% of the full course fee payable (non-discounted) or a minimum of $250 (whichever is greater), will be subtracted from any refund granted under the terms and conditions outlined in this policy. This does not apply to fees and charges paid by apprentices or trainees training under a user choice or strategic purchasing program contract.

For all course enrolments in courses with a classroom component (blended-delivery or full face-to-face courses), refund requests must be in made in writing using a Refund Request Form and must be received by our office within 90 days of their enrolment application date and at least 14 days prior to commencement of the course, in which case a full refund, less the 25% administration fee or a minimum of $250 (whichever is the greater), will be given. If a refund request is received by our office in less than 14 days from the course commencement, no refund nor transfer will be granted unless we are satisfied that you are currently suffering from extreme hardship or a severely

debilitating medical condition. For all distance‐learning and online courses, a full refund less the 25% administration fee or a minimum of $250 (whichever is the greater) may be granted if we are satisfied that you have:

Made a refund request in writing using a Refund Request Form and your request is received by our office within 30 days of our office receiving your enrolment application;

The course materials have not been commenced, damaged, or marked in any way,

The course materials are returned within 7 days

Refund requests received after 30 days of our office receiving your enrolment application will not be granted unless we are satisfied that you are currently suffering from extreme hardship or a severely debilitating medical condition.

Circumstances of extreme hardship or a severely debilitating medical condition may be proven with supporting documentation that is submitted to our office for review. To be eligible for a refund due to extreme hardship, you must provide supporting documentation which may include detailed letters or

Refunds based on circumstances of extreme hardship or a severely debilitating medical condition must be received by our office within three months of your enrolment application date. We will make our decision based solely on the supporting documentation provided with your Request for Refund. Based on our review of the Request for Refund, we may or may not grant a partial or full refund.

For all courses where Work Placement is required in order to complete the course qualification, the student is responsible for finding their own Work Placement. No refund will be given where placement is not found.

Refunds will not be given for any of the following reasons:

Failure to attend a scheduled training session,

Non‐completion of assessment activities,

Change of mind about a course, or,

Other circumstances beyond our control.

Should Online Safety and Training Institute Pty Ltd cancel a course, participants are entitled to a full

refund (or pro‐rata adjusted refund), or to transfer funds to another/future course. In this event, students will be given their preferred option.

Complaints Policy

Online Safety and Training Institute Pty Ltd supports the rights of a student to lodge a grievance or complaint if a student feels they have been treated unfairly. We shall do everything possible to address grievances or complaints in an unbiased and professional manner. Complaints are welcomed as a means of ensuring that we identify and overcome problems faced by students, and provide an opportunity to improve our business and/or the delivery of our training programs.

All complaints should be submitted in writing at the earliest possible opportunity and sent by email to [email protected] once this is received it will constitute a formal complaint from the student.

The Chief Executive Officer of Online Safety and Training Institute Pty Ltd is informed through receipt of all student complaints emails and will initiate a transparent, participative process to deal with the issues at hand.

Complaints are to be resolved within 10 working days of the initial application. The Chief Executive Officer of Online Safety and Training Institute Pty Ltd may delegate responsibility for the resolution of the complaint as required. In all cases the final conclusion will be endorsed by Online Safety and Training Institute Pty Ltd’s Chief Executive Officer.

The student will be advised in writing of the outcome of their complaint via email.

Online Safety and Training Institute Pty Ltd’s Chief Executive Officer’s decision will be final. If the outcome is not to the satisfaction of the student, he/she may contact the Chief Executive Officer to discuss their concerns. The client has the option to seek outside assistance to pursue the complaint.

All complaints will be handled as Staff-In-Confidence.

Where the student remains unhappy with the outcome:

The student has the right to request a review of the appeal by an independent party.

The student will be responsible for the costs of the independent review.

Online Safety and Training Institute Pty Ltd reserves the right to nominate or agree to the independent party and will cooperate fully with this independent review.

Online Safety and Training Institute Pty Ltd will aim to complete this complaints process as quickly as possible and within a total of 60 days. Online Safety and Training Institute Pty Ltd will keep the student informed of the progress of the complaint throughout the process.

After following the internal procedures, if you still believe Online Safety and Training Institute Pty Ltd is breaching, or has breached its legal requirements, you can submit a complaint to ASQA (www.asqa.gov.au).

Except in exceptional circumstances, you must attach evidence in your complaint form showing:

That you have followed Online Safety and Training Institute Pty Ltd’s formal complaints procedure and

The response from Online Safety and Training Institute Pty Ltd.

Please note ASQA may not investigate your complaint unless it is supported by clear evidence indicating that Online Safety and Training Institute Pty Ltd is breaching (or has breached) its legislative requirements.

What Personal Information is collected

As part of the enrolment process, Online Safety and Training Institute Pty Ltd discloses why the personal information is collected and how it is to be used. Clients are informed of the Privacy Policy and their agreement to the use of their personal information on the official enrolment forms.

Use and Disclosure

Generally, Online Safety and Training Institute Pty Ltd will only use and disclose personal information:

To establish and maintain the relationship to Online Safety and Training Institute Pty Ltd

To promote and market its products and services

To provide the products and services requested from Online Safety and Training Institute Pty Ltd and other learning providers in which you enrol or apply to enrol

To promote and market the products and services of third parties elected by Online Safety and Training Institute Pty Ltd that may have products or services of interest to clients and potential customers

To administer and manage those products and services

To comply with Commonwealth and State Government laws and regulations

To report to National Registering Bodies in relation to training services provided.

Unique Student Identifier

From January 1, 2015, the Australian Government has set a requirement that all students who are enrolled in VET qualifications must apply for a Unique Student Identifier (USI) with the VET Registry System. The USI is a reference number which allows access to the records and results from all VET training completed by the individual from 1 January 2015 onward.

Overseas disclosure

We may disclose personal information to overseas recipients for the following purposes:

in order to provide our services and/or products;

for administrative or other business management purposes or:

where you have provided your consent to us disclosing your personal information to a specified third party promotional partner that is located overseas

Recipients of such disclosures for the purpose of our administrative or business management purposes are located in Indonesia, and may also be located in other countries notified to you from time to time.

By providing personal information, you consent to us disclosing your personal information to a Partner that is located overseas. Before disclosing any personal information to an overseas recipient, we take steps reasonable in the circumstances to ensure the overseas recipient complies with the Australian Privacy Principles or is bound by a substantially similar privacy scheme unless you consent to the overseas disclosure or it is otherwise required or permitted by law.

Security of personal information

We take all steps reasonable in the circumstances to ensure that the personal information we hold is protected from misuse, interference and loss and from unauthorised access, modification or disclosure. We hold personal information in both hard copy and electronic forms in secure databases on secure premises, accessible only by authorised staff.

We will destroy or de-identify personal information in circumstances where it is no longer required, unless we are otherwise required or authorised by law to retain the information.

Students have the option to request no further contact from Online Safety and Training Institute or one of Online Safety and Training Institute Pty Ltd elected third parties by clicking the “UNSUBSCRIBE” link provided on emails received.

Agents, Contractors and Other Third Parties

Our agents, contractors and other third parties, who require personal information to provide a legitimate service, are also bound by these terms of privacy to ensure that client and participant personal information remains protected at all times.

Use of Internet

The internet may be used to transmit client and participants personal information from delivery sites to other sites and to state/federal registering bodies. Security of data transmitted to state and federal registering bodies is managed by the respective bodies and we have taken all reasonable steps to protect and secure personal information when using the internet.

Data Quality

We will ensure that personal information is accurate, complete and up-to-date. Clients and participants are encouraged to assist by contacting Online Safety and Training Institute Pty Ltd and informing us of any changes.

Access to Enrolment Records

Online Safety and Training Institute Pty Ltd will not disclose enrolment information that we gather about our students to any third party (apart from those exceptions previously stated). If student information is requested by a third party we will require authority from the relevant student prior to release of any information. Students will be asked to supply their name, date of birth and address as identification before this authority can be given. This authority will be kept on the Student Profile for as long as the student endorses it.

Should staff or students seek access to their information, they will be asked to supply their name, date of birth and address as identification before this can occur. Access to student personal information is available on application through the Administration Team of Online Safety and Training Institute Pty Ltd. Access to personal information will be controlled at all times.

Privacy Concerns If you believe that we have breached the Privacy Act, the Australian Privacy Principles or any binding code under the Privacy Act, you can make a privacy complaint to us. Please direct all privacy complaints to us by email to [email protected]

At all times, privacy complaints:

will be treated seriously;

will be dealt with promptly;

will be dealt with in a confidential manner; and

will not affect your existing obligations or affect your commercial arrangements with us.

We will commence an investigation into your complaint. You will be informed of the outcome of your complaint following completion of the investigation. In the event that you are dissatisfied with the outcome of your complaint, you may refer the complaint to the Federal Office of the Australian Information Commissioner.

Cheating and Plagiarism

Online Safety and Training Institute Pty Ltd has no tolerance for plagiarism or cheating. We will strictly enforce the penalties outlined below for any student who is found to have engaged in cheating or plagiarism during any of their submitted assessment documents.

What is cheating?

Cheating within the context of the study environment, means to dishonestly present an assessment task or assessment activity as genuinely representing your own understanding of and/or ability in the subject concerned.

Some examples of cheating are:

Submitting someone else’s work as your own whether you have that person’s consent or not.

Submitting another author’s work as your own, without proper acknowledgement of the author.

To allow someone else to submit your own work as theirs.

To use any part of someone else’s work without the proper acknowledgement.

There are other forms of cheating not contained in this list. These are merely given as some examples. If you are unsure about whether any particular behaviour would constitute plagiarism or cheating, please check with your trainer prior to submitting your assessment work.

What is plagiarism?

Plagiarism is a form of cheating and includes presenting another person's or organisation’s ideas or expressions as your own. This includes, however is not limited to: copying written works such as books or journals, data or images, tables, diagrams, designs, plans, photographs, film, music, formulae, web sites and computer programs.

What are the Penalties for Plagiarism or Cheating?

If a trainer suspects that you are cheating they will investigate further to establish evidence to support their suspicion. By looking at learning resources, searching on Google and reviewing previous or current student’s work.

If evidence to support the suspicion is established your trainer will then report their concerns to Online Safety and Training Institute Pty Ltd’s Chief Executive Officer.

From there the following process will be followed:

1. The Assessor will contact you in writing outlining their concerns with your submitted work.

2. You will then have an opportunity to respond to any allegations of cheating or plagiarism.

3. If the Online Safety and Training Institute Pty Ltd’s Chief Executive Officer’s investigation confirms that you have engaged in cheating or plagiarism you will be advised of one of the following consequences:

a) If it is determined that your offence committed is minor or unintentional, you will be asked to resubmit your work and be given a formal warning in writing by Online Safety and Training Institute Pty Ltd’s Chief Executive Officer.

b) If it is determined that your offence committed is of a serious and intentional nature you will be un-enrolled in that unit immediately and have to re-enrol if you wish to complete that unit. Your result for that unit will be recorded as Not Competent. A cheating/plagiarism note will also be recorded against your student file. Notification of any such decision will be made in writing by Online Safety and Training Institute Pty Ltd’s Chief Executive Officer.

4. If the conduct is repeated or if the initial conduct is of a very serious nature (as determined by the Training Manager), such as knowingly falsifying assessment evidence, the student’s enrolment may be terminated. In cases of termination, all fees paid will be non-refundable.

What if I don’t agree with the decision?

If you disagree with the decision or the penalty imposed you are entitled to lodge an appeal. This appeal should be addressed to the Online Safety and Training Institute Pty Ltd’s Chief Executive Officer and outline your reasons for appeal and why you feel the decision to be unjust. The Online Safety and Training Institute Pty Ltd’s Chief Executive Officer will then investigate your appeal further and respond in writing within 7 business days.

How do I avoid Plagiarism or Cheating?

Students are advised to note the following advice to avoid claims of plagiarism or cheating:

Always reference other people’s work. You may quote from someone else's work (for example, from websites, textbooks, journals or other published materials) but you must always indicate the author and source of the material.

Always reference your sources.

You should name sources for any graphs, tables or specific data, which you include in your assignment.

You must not copy someone else's work and present it as your own.

You must not falsify assessment evidence.
