1.0 INTRODUCTION

Neel-Schaffer, Inc. was retained by the Mississippi State Port MSPA at Gulfport (MSPA) to prepare this Storm Water Pollution Prevention Plan (SWPPP) amendment for the filling of 24 acres of open water for construction of an on-dock Intermodal Container Transfer Facility (24 Acre Fill) which will be filed with the Mississippi Department of Environmental Quality (MDEQ), Office of Pollution Control (OPC) Environmental Permits Division. This SWPPP will cover activities associated with the 24-acre fill project. Large Construction General Permit (LCGP) MSR105737 (included as Attachment) was issued to the MSPA for storm water discharges on October 9, 2011.

Storm water runoff from construction activities can have a significant impact on water quality. As storm water flows over a construction site, it can pick up pollutants such as sediment, debris, and chemicals and transport these pollutants to a nearby storm sewer system or directly to a river, lake, or coastal water. Sedimentation can negatively impact aquatic habitat, and high volumes of runoff can cause stream bank erosion. Debris can clog waterways and potentially reach the ocean where it can negatively impact marine wildlife and impact habitat.

Construction activities are defined by the MDEQ as disturbance to the land that results in the change in topography, existing soil cover (both vegetative and non-vegetative), or the existing topography that may result in accelerated storm water runoff, leading to soil erosion and movement of sediment into surface waters or drainage systems. Examples of construction activity may include clearing, grading, filling, and excavating. Construction activity does not include routine maintenance that is performed to maintain the original line and grade, hydraulic capacity, or original purpose of the site.

Controlling turbidity outside the limits of a 750-foot mixing zone is required for compliance of the Department of the Army Permit MS96-02828-U for dredging/filling activities. The LCGP authorizes storm water discharges from construction activities. Therefore, the SWPPP contained herein for construction activities covers exposed soil that will be subjected to storm water runoff (when fill has accumulated above the water surface level).

The Prime Contractor is responsible for ensuring that appropriate best management practices (BMPs) are in place upon commencement of construction of each individual project. The purpose of the SWPPP is to identify potential contaminants to storm water, describe BMPs and control measures, and maintain compliance with the terms and conditions of the LCGP MSR105737. This SWPPP was prepared in accordance with the MDEQ SWPPP Guidance Manual for Construction Activities.

1.1 Project/Site Information

The proposed 24-Acre Fill will engage in the dredging, filling, excavating, stockpiling, and transporting of earthen materials for construction activities associated with restoration and revitalization of the Port. The total subject property encompasses approximately 204 acres, located south of the intersection of Highway 49 and Highway 90 in Gulfport, Harrison County, Mississippi. Ingress and egress from the construction site will be provided by an approximate 45-foot wide easement that will run from the existing Port to the construction site.

1.2 Contact Information

The MSPA owns the 204-acre parcel of land. Mr. Joe Conn, P.E., Director of Port Restoration, serves as representative for the MSPA.

1.3 Nature of Sequence of Construction Activity

The 24-Acre Fill consists of dredging and filling activities associated with the filling of 24 acres of open water for an on-dock Intermodal Container Transfer Facility.

1.4 Site Information

The site perimeter elevations range from +10 feet above mean sea level (AMSL) on the north extent of the proposed 24-Acre Fill area to approximately + feet AMSL at the southern extent of the proposed 24-Acre Fill area. The fill site itself is currently 10 feet below mean sea level (Mississippi Sound). Soils onsite will consist of select sand fill material.

1.5 Receiving Waters

Runoff from the site will enter the Mississippi Sound. The Mississippi Sound is not listed on MDEQ’s 303(d) list of impaired water bodies for sedimentation.

1.6 Potential Sources of Pollution

Potential sources of storm water pollution during operation of the proposed 24-Acre Fill are as follows:

Wastewater from washout of concrete;

Wastewater from washout and cleanout of paint, runoff from released oils, curing compounds, and other construction materials;

Fuels, oils, or other pollutants used in vehicle and equipment operation and maintenance;

Soaps or solvents used in vehicle and equipment maintenance;

Wastewater from sanitary facilities, including portable toilets; and

Exposed soil.

Incidental contaminants from heavy equipment and trucks, such as oil, grease, and fuel, may be present due to minor leaks, spills, or other causes. The maximum flow anticipated from this type of release is expected to be insignificant.

1.7 Allowable Storm Water Discharges

Allowable storm water discharges are as follows:

Discharges from actual fire-fighting activities;

Fire hydrant flushing;

Water used to control dust;

Potable water sources including uncontaminated water line flushing;

Routine external building wash down that does not use detergents;

Pavement wash waters where spills or leaks of toxic or hazardous materials have not occurred;

Uncontaminated air conditioning or compressor condensate;

Uncontaminated groundwater or spring water;

Foundation or footing drains where flows are not contaminated with process materials such as solvents;

Uncontaminated excavation dewatering;

Landscape irrigation; and

Water used to wash vehicles, wheel wash water, and other wash waters where detergents are not used.

1.8 Department of the Army Permit

Pursuant to Section 401 of the Federal Water Pollution Control Act (33 U.S.C. 1251, 1341), the MDEQ, OPC issued certification to fill 84 acres of open water, dredge 300,000 cubic yards of material, and construct a 900-foot by 150-foot pier extension at the Port. The Department of the Army Permit MS96-02828-U was issued on November 20, 1997, for the dredging/filling activities associated with the 24-Acre Fill. The Department of the Army Permit, MS96-02828-U allows for filling/dredging operations in three subsequent phases. Phase I and phase II have been completed. Phase III of the MSPA’s fill permit includes the filling of 24 acres of open water for an on-dock Intermodal Container Transfer Facility. Permit number MS96-02828-U requires that the turbidity outside of the limits of a 750-foot mixing zone will not exceed the ambient turbidity by more than 50 Nephelometric Turbidity Units (NTUs).

2.0 EROSION AND SEDIMENT CONTROLS

BMPs for the identified potential sources of storm water will be developed based on risk identification, assessment, and material inventory of potential sources at the 24-Acre Fill site. Typical BMPs that will be employed (included as Exhibit A, B, and C) during the 24-Acre Fill are described below.

2.1 Minimize Disturbed Area and Protect Natural Features and Soil

All construction activities will be limited to the 204-acre footprint described in Section 1.0. All construction limits will be staked and/or flagged by a surveyor. The Prime Contractor will minimize the disturbance of steep slopes. Sensitive areas will be fenced off and plants that are to remain will be flagged as needed. The need to maintain access to adjacent properties will be controlled by security fencing. Stockpiles will be maintained and protected throughout the duration of the project. Stockpiles will not be placed in paved areas where concentrated storm water flows. There is no identified top soil that will be salvaged on this project.

2.2 24-Acre Fill Phase Construction Activity

The 24-Acre Fill will be constructed in six phases. The first four phases consist of dredging down to -20 AMSL and then filling to +1.25 AMSL. Phases five and six cover filling of the 24-Acre Fill up to +4 AMSL. The SWPPP contained herein covers activities when fill has accumulated above the water surface level.

2.3 Control Storm Water Flow onto and through the Project

The property adjacent to the site, which will be under construction, does not have topography or a coefficient of runoff that will direct any significant amount of flow toward the 24-Acre Fill Area. Therefore, storm water control will be limited to the quantity of runoff from the site itself. Storm water onsite will exit the site via sheet flow or will be absorbed back into the fill material.

2.4 Stabilize Soils

Due to dredging and filling activities associated with the 24-Acre Fill, it will be infeasible to maintain natural buffers around surface waters. The Prime Contractor must initiate stabilization measures on disturbed areas as soon as practicable, but no more than 14 days after construction activity has temporarily or permanently ceased, except where earth disturbing activity will resume within 14 days from cessation. Stabilization of benches and slopes onsite will be accomplished by armoring slopes with riprap rock and mulching.

Mulching is the application of plant residues such as straw or other suitable materials to the soil surface. Mulch protects the soil surface from the erosive force of raindrop impact and reduces the velocity of overland flow. Mulch also maintains the infiltration capacity of the soil. Mulch can also be used in unseeded areas to protect against erosion over the winter or until final grading and shaping can be accomplished except in areas with concentrated flow.

Wheat straw is the mostly commonly used straw, and can be spread by hand or with a mulch blower. Since the site is susceptible to blowing wind, the straw will be tacked down with a tackifier, a crimper, or a disk to prevent loss. Inspect all mulched areas periodically and after rainstorms for erosion and damage to the mulch.

2.5 Protect Slopes

Slopes will range from a 3:1 to a 5:1 onsite to minimize erosion from tidal influence. These slopes will be armored with geotextile and riprap rock at the base of all fill slopes as soon as proposed grades are achieved along the north, south, and western borders.

2.6 Establish Perimeter Controls and Sediment Barriers

Perimeter control (silt fencing and/or waddles) will be used to prevent sediment carried by sheet flow from leaving the site and entering the Mississippi Sound. Silt fencing or straw waddles will be required where runoff leaves the site in the form of sheet flow. Silt fencing/waddles slow storm water runoff and cause the deposition of sediment at the structure.

Due to the dynamic conditions of the 24-Acre Fill, Type C silt fencing with 4-foot minimum length steel t-post placed 36 inches apart with a woven wire fencing backing is recommended. Waddles are recommended to be 20” diameter straw, flax, rice, coconut fiber, or composted material wrapped with UV-degradable polypropylene netting or with biodegradable burlap, jute or coir. Silt fencing/waddles will be located away from the toe of the slope to provide sufficient space to allow a broad, flat area for sediment accumulation and maintenance activities. Silt fencing/waddles for a particular phase may be removed as soon as the phase has been stabilized.

Sediment will be removed once it has accumulated to one-half the original height of the silt fencing/waddles. Filter fabric/waddles will be replaced whenever it has deteriorated to such an extent that the effectiveness of the material is reduced. All sediment accumulated at the barrier will be removed and properly disposed of before the silt fencing/waddles are removed.

2.7 Retain Sediment Onsite

Storm water generally flows toward the Mississippi Sound. Sediment traps are not required since the single drainage area contributing to a common location on the site does not exceed ten acres.

2.8 Establish Stabilized Construction Exits

A stabilized construction access is defined as a point of entrance/exit to a construction site that is stabilized to reduce the tracking of mud and soils onto public roads by construction vehicles. A stabilized construction entrance where traffic will be entering or leaving the construction site will be implemented. The stabilized construction entrance will be a minimum of 50 feet in length and a minimum of 30 feet in width. The entrance will be maintained in a condition which will prevent tracking or flow of mud and soils onto public roads and right-of-ways. Maintenance will require periodic top dressing with 1.5 to 3.5 inch diameter stone, as conditions demand, and repair and/or cleanout of any structures that trap sediment. All materials spilled, dropped, washed, or tracked from vehicles or the site onto roadways or into storm drains will be removed immediately.

2.9 Additional BMPs

Additional and/or alternative erosion and sediment controls will be installed when existing controls prove to be ineffective in preventing sediment from leaving the site. Additional controls will include, but not be limited to, rock checks, silt fencing, waddles, and erosion control blankets. The construction of any sediment basins will require prior approval by the Project Engineer.

3.0 IMPLEMENTATION REQUIREMENTS

The Prime Contractor has been designated to implement the SWPPP when fill has accumulated above the water surface level as required by LCGP MSR105737. Failure to implement each phase of the SWPPP before construction activities begin for the subsequent phase is a violation of LCGP MSR105737 and a potential penalty of $10,000 plus economic benefit from avoided costs for not implementing controls could be assessed by the MDEQ or the EPA.

The Prime Contractor will install needed erosion controls even if the controls may be located in the way of subsequent activities, such as utility installation, grading, and/or construction.

4.0 GOOD HOUSEKEEPING BMPS

Good housekeeping BMPs will be implemented and are intended to keep the project site clean and orderly, thus minimizing the potential for contribution to storm water runoff. Good housekeeping is a key part of this project and the Prime Contractor will clean up the project site each day. All large trash items will be moved offsite as required and smaller items will be placed in a commercial dumpster located in the Prime Contractor’s construction yard.

4.1 Materials Handling and Waste Management

The following general BMPs will be implemented into the project’s good housekeeping program and will remain in place for the duration of construction activities:

Regularly pick up and dispose of garbage, debris, or waste material found in and around the 24-Acre Fill site;

Drip pans or buckets will be placed beneath hose connections during loading/unloading operations of motor fuels, as applicable;

All equipment will be inspected once every month to ensure proper working conditions; and

Inspections for leaks that could lead to discharges of chemicals or for conditions where storm water contacts raw materials, waste materials, or products will be performed monthly.

The 24-Acre Fill will comply with applicable State or local waste disposal laws.

4.2 Establish Proper Building Material Staging Areas

Drums will not typically be used at the project site. Should drums be stored, the following proper storage techniques will be followed:

Storage containers and drums will be moved away from direct traffic routes to prevent spills;

Containers will be stored on pallets, or similar devices, to prevent corrosion of the containers which can result from contact with moisture on the ground surface; and

The responsibility of hazardous material inventory will be assigned to a limited number of people who are trained to handle hazardous materials.

4.3 Designate Washout Areas

A designated concrete truck washout area will be located and maintained onsite to reduce hazardous concrete washout from entering storm water runoff.

4.4 Establish Proper Equipment/Vehicle Fueling and Maintenance Practices

Fueling operations include fuel transfers from fuel trucks to the aboveground storage tanks (ASTs), transfers from the ASTs to the trucks, and from ASTs to excavation equipment. A spill kit will be located at the fueling area and used in the event of a spill.

4.5 Control Equipment/Vehicle Washing

The washing of equipment will be performed only as required. The location where equipment is washed is extremely important. The location will be away from any storm water conveyances and in a grassed pervious area with minimal surface gradient that will allow for infiltration and/or evaporation of wash water as opposed to runoff. No detergents, including biodegradable detergents, will be used during the washing of equipment.

4.6 Spill Prevention and Control

Procedures for cleaning up spills or releases of potential pollutants are as follows:

Personnel involved in the clean-up will take precautions to protect personal health and safety, as outlined in the material safety data sheet (MSDS) for the spilled or released substance;

All spills and releases of potential pollutants which could potentially contaminate storm water are to be completely contained upon discovery;

The source material of the spill will be identified and contained immediately;

The spilled material will be cleaned up immediately;

The spilled or released material and all disposable contaminated equipment will be disposed of in appropriate containers; and

Non-disposable equipment will be decontaminated or disposed of in accordance with 40 CFR Parts 260-265.

In the event of a hazardous materials release, an employee will contact the responsible party onsite representing the Prime Contractor. Significant spills and leaks will be recorded on the form included as Appendix A. In the event of a small localized spill, an employee will immediately apply non-combustible sorbent material on the affected area. Arrangements will be made for subsequent proper disposal according to 40 CFR Parts 260-265. Larger spills or releases that are above the reportable quantity (see MSDS) should be reported to the applicable regulatory agency. A list of these agencies is included as Appendix B.

4.7 Employee Training

Effective management of storm water pollution requires that all Prime Contractor staff be familiar with those conditions that may cause pollution. Furthermore, day-to-day proper use of BMPs by all employees is essential for the success of the SWPPP. Employee training procedures are listed in Appendix C.

4.8 Non-Numeric Limitation Requirements

Storm water discharges should be free from:

Debris, oil, scum, and other floating materials other than in tract amounts;

Eroded materials and other materials that will settle to form objectionable deposits in receiving waters;

Suspended solids, turbidity and color at levels inconsistent with the receiving waters; and

Chemicals in concentrations that would cause violation of State Water Quality Criteria in the receiving waters.

5.0 INSPECTIONS

5.1 Inspections

Inspections of all receiving streams (if feasible), outfalls, erosion and sediment controls, and other SWPPP requirements will be performed during permit coverage using a copy of the form provided in the Large Construction Forms Package (included as Appendix D), and inspections will be performed by qualified personnel. Qualified personnel are defined by MDEQ ‘as a person knowledgeable in the principles and practice of erosion and sediment controls who possesses the skills to assess conditions at the construction site that could impact storm water quality and to assess the effectiveness of any sediment and erosion control measures selected to control the quality of storm water discharges from the construction activity.’

Inspection of storm water controls will be conducted at least weekly for a minimum of four inspections per month and as often as is necessary to ensure that appropriate erosion and sediment controls have been properly constructed and maintained and to determine if additional or alternative control measures are required. Before conducting the site inspection, the inspector should review Chapter 4, Inspector's Checklist and Troubleshooting Chart found in MDEQ's Field Manual for Erosion and Sediment Control on Construction Sites in Mississippi. The MDEQ strongly recommends that the Prime Contractor perform a "walk-through" inspection of the construction site before anticipated storm events to ensure controls are in place and will function properly. The inspections must be documented on copies of the Monthly Inspection Report and Certification Form. The Prime Contractor has been designated to conduct weekly inspections as required by LCGP MSR105737. A Prime Contractor Certification Form (included as Appendix E) will be executed and sent to MDEQ as soon as contracts are awarded. Failure to conduct weekly inspections is a violation of LCGP MSR105737 and a potential penalty of $10,000 plus economic benefit from avoided costs for not conducting inspections could be assessed by the MDEQ or the EPA. It is the Prime Contractor’s responsibility to conduct inspections at least weekly for a minimum of four inspections per month and as often as is necessary to ensure that appropriate erosion and sediment controls have been properly constructed and maintained and to determine if additional or alternative control measures are required. Implementation of corrective actions is the Prime Contractor’s responsibility.

5.2 Corrective Action Log

Based on inspection results, the site description and pollution prevention measures will be revised within this SWPPP if inadequacies are discovered. The inspection and plan review process will include timely implementation of any changes to the SWPPP. Field changes will occur within 7 calendar days following the inspection. Amendments to the SWPPP will occur within 15 business days. If existing BMPs need to be modified or if additional BMPs are necessary, implementation will be completed before the next anticipated storm event. If implementation before the next anticipated storm event is not practical, the BMPs will be implemented as soon as practical.

5.3 Falsifying Reports

Falsification of any written report required by, or in response to, a permit condition will be deemed to have violated a permit condition and is subject to the penalties provided for a violation of a permit condition pursuant to Section 49-17-43 of the Mississippi Water Pollution Control Law (Mississippi Code Ann. Sections 49-17-1 et seq.).

5.4 BMP Maintenance

The Prime Contractor is responsible for maintenance of all controls outlined in the 24-Acre Fill SWPPP as required by LCGP MSR105737. Failure to maintain controls outlined in the SWPPP is a violation of LCGP MSR105737 and a potential penalty of $10,000 plus economic benefit could be assessed by the MDEQ or the EPA.

6.0 RECORD KEEPING AND TRAINING

6.1 Recording Keeping

A copy of this SWPPP, all reports and records required by the LCGP, and all data used to complete the Notice of Intent (NOI), will be retained by the MSPA for a period of at least three

years from the date that the site has been finally stabilized and Notice of Termination (NOT) completed. A copy of this SWPPP will be retained at the construction site at all times, from the date of project initiation to the date of final construction. The SWPPP will be located in the MSPA offices after stabilization of the site.

6.2 Log of Changes to the SWPPP

Disturbed areas and storage areas that are exposed to rainfall or run-on must be inspected for evidence of, or the potential for, pollutants entering site storm water runoff. Based on inspection results, the site description and pollution prevention measures will be revised within this SWPPP if inadequacies are discovered. The inspection and plan review process will include timely implementation of any changes to the SWPPP. These changes to the field conditions will occur within seven calendar days following the inspection. If existing BMPs need to be modified or if additional BMPs are necessary, implementation will be completed before the next anticipated storm event. If implementation before the next anticipated storm event is not practical, the BMPs will be implemented as soon as practical. These records will be retained as part of the SWPPP for at least three years after the date the NOT form is filed. This SWPPP will be amended whenever there is a change in design, construction, operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to the waters of the United States and which has not otherwise been addressed in the plan, or if the SWPPP proves to be ineffective in eliminating or significantly minimizing pollutants, or to otherwise achieve the general objectives of controlling pollutants in storm water discharges. When such an amendment occurs, the MSPA will update the SWPPP document within 15 business days.

7.0 FINAL STABILIZATION

Final stabilization is achieved when uniform ground cover, without large bare areas, reaches a density of 70% of the native background vegetation cover. As soon as 70% stabilization has been achieved, a NOT form will be submitted to MDEQ to terminate LCGP MSR105737.

8.0 NONCOMPLIANCE REPORTING

8.1 Anticipated Noncompliance

The MSPA will give at least ten days advanced notice, if possible, before any planned noncompliance with permit requirements. Giving notice of planned or anticipated noncompliance does not immunize coverage recipient from enforcement action for the noncompliance.

8.2 Unanticipated Noncompliance

The MSPA or Prime Contractor will notify the MDEQ orally within 24 hours from the time he or she becomes aware of unanticipated noncompliance, which may endanger health or the environment. A written report will be provided to the MDEQ within 5 working days of the time he or she becomes aware of the circumstances leading to the unanticipated noncompliance. The report will describe the cause, the exact dates and times, steps taken or planned to reduce, eliminate, or prevent reoccurrence and, if the noncompliance has not ceased, the anticipated time for correction. The MDEQ may waive the written report on a case-by-case basis if the oral report is received within 24 hours.

9.0 UPSET CONDITIONS

An upset condition constitutes an affirmative defense to an action brought for noncompliance with technology-based permit limitations if a storm water coverage recipient demonstrates, through properly signed, contemporaneous operating logs, or other relevant evidence, that:

An upset condition occurred and the storm water coverage recipient can identify the specific cause(s) of the upset;

The permitted 24-Acre Fill site was being properly operated at the time of the upset;

The storm water coverage recipient submitted notices; and

The storm water coverage recipient took remedial measures. In any enforcement proceeding, the storm water coverage recipient has the burden of proof that an upset occurred. No determination made during administrative review of claims that noncompliance was caused by an upset, and before an action for noncompliance is initiated, will be considered a final administrative action subject to judicial review.

10.0 CONTINUATION OF EXPIRED GENERAL PERMIT

The 24-Acre Fill is scheduled to extend beyond the expiration date of the LCGP. If this permit is not reissued prior to the expiration date, the permit will be administratively continued and remain in force and effect. Permit coverage will remain in force until the earliest of:

Re-coverage occurs under the reissued general permit;

Submittal of a Request for Termination and receipt of written concurrence;

Issuance of an individual permit for the 24-Acre Fill's discharge; or

A formal permit decision by the Permit Board to not reissue the general permit, at which time the MSPA must seek coverage under an alternative general permit or an individual permit.

11.0 STATE OF MISSISSIPPI WATER QUALITY STANDARDS

In addition to complying with LCGP MSR105737, the Prime Contractor is responsible for ensuring that the site does not violate State of Mississippi Water Quality Standards. The Mississippi Commission on Environmental Quality Regulation WPC-2 states that:

Waters shall be free from materials attributable to municipal, industrial, agricultural or other discharges producing color, odor, taste, total suspended or dissolved solids, sediment, turbidity, or other conditions in such a degree as to create a nuisance, render the waters injurious to public health, recreation or to aquatic life and wildlife or adversely affect the palatability of fish, aesthetic quality, or impair the waters for any designated use. The turbidity outside the limits of a 750-foot mixing zone shall not exceed the background turbidity at the time of discharge by more than 50 Nephelometric Turbidity Units (NTU).

Additional or alternative controls not mentioned above such as flocculants may be required to meet State of Mississippi Water Quality Standards.

12.0 APPLICATION OF FLOCCULANTS

Any flocculant application, which deviates from the criteria specified below, must receive written approval from the MDEQ prior to being implemented. Requests for approval must be in writing and describe the deviation, explain the justification for the deviation, and provide supporting documentation demonstrating that such deviation will achieve equivalent performance to the criteria listed below:

Polymer flocculants for treating turbidity in construction site storm water discharges must meet the following minimum criteria;

o Only use an anionic Polyacrylamide (PAM) polymer;

o Polymer must contain less than 0.05% free acrylamide;

o Polymer must be non-toxic to fish and other aquatic organisms;

o Polymer must be selected for site specific soil conditions (i.e., jar test);

o Systems utilizing polymer flocculants to treat turbidity from construction site storm water discharges must meet the following minimum criteria;

o Polymer must be introduced through turbulent mixing into the storm water upstream of sedimentation BMPs;

o Sedimentation basin must be constructed in accordance with the criteria specified in ACT5, T-5 (2)(A) of LCGP MSR105737;

o Polymer must be applied in accordance with manufacturer's instructions; and

o There must be no discharge of undissolved polymer, clumps of polymer, and/or unsettled flocculant material.

13.0 COMPLYING WITH LOCAL STORM WATER ORDINANCES

This SWPPP is in compliance with the City of Gulfport storm water ordinances. The MSPA or Prime Contractor will make this SWPPP available to the local MSPA and/or allow site access, upon request.
