I , THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, -do hereby make the following Regulations under the Trade Marks Act 1905, to come into operation forthwith. 1 9 0 6 . Definitions. 3. I n these R e g u l a t i o n s : —

" T h e A c t " means the Trade Marks Act 1 9 0 5 . " T h e Official J o u r n a l " m e a n s the A u s t r a l i a n Official J o u r n a l of"

T r a d e M a r k s .

Classification of goods.

4. (1) T h e Class i f icat ion o f g o o d s for the purposes o f the A c t and t h e s e R e g u l a t i o n s shal l b e as set out in the F i r s t Schedule .

(2) I f any doubt arises as to the c l a s s to w h i c h any p a r t i c u l a r descr ip­tion o f goods b e l o n g s , it shal l b e determined b y t h e R e g i s t r a r .

Fees. 5. (1) T h e F e e s to be p a i d in connect ion wi th a p p l i c a t i o n s , registrations,,, and other matters under t h e A c t a n d these R e g u l a t i o n s , shal l b e as set out in the S e c o n d S c h e d u l e .

(2) F e e s must be p a i d in cash.

(3 R e g i s t r a t i o n o f a t r a d e m a r k , or series o f t r a d e m a r k s , s h a l l not: be effected unti l the prescr ibed reg is trat ion fees h a v e been p a i d .

Forms. 6 . T h e F o r m s c o n t a i n e d in the T h i r d S c h e d u l e m a y b e used in any p r o c e e d i n g or matter under the A c t or these R e g u l a t i o n s to which they are a p p r o p r i a t e , b u t m a y b e modi f ied , as d irected b y the R e g i s t r a r , to meet p a r t i c u l a r c a s e s .

Hours of business.

7. E x c e p t in the case o f h o l i d a y s o b s e r v e d under the Commonwealth Public Service Act 1 9 0 2 , the T r a d e M a r k s Office shal l b e open to the p u b l i c on w e e k d a y s (other than S a t u r d a y s ) f rom 10 a . m . to 4 p . m . , a n d on S a t u r d a y s f r o m 10 a.m. t o N o o n .

Address for service.

8. I f the R e g i s t r a r so requires , every a p p l i c a n t or opponent shal l state an a d d r e s s for service a t some p l a c e in or near to the c i ty in w h i c h , the T r a d e M a r k s Office is s i tuate .

Address for service of foreign proprietor.

9. T h e R e g i s t r a r m a y r e q u i r e the propr ietor of a registered trade­m a r k w h o does not reside o r c a r r y on business w i t h i n A u s t r a l i a to g i v e an a d d r e s s f o r service wi th in A u s t r a l i a , a n d in such case such a d d r e s s -m a y b e treated as the actual a d d r e s s o f the propr ie tor f o r a l l purposes connected w i t h such t rade m a r k .

Size, &c, of documents.

10. S u b j e c t to any direct ions f r o m t i m e to t ime g iven by the R e g i s t r a r , a l l a p p l i c a t i o n s , notices,, s tatements , counter-statements , representat ions of m a r k s , p a p e r s h a v i n g representat ions affixed, a n d other d o c u m e n t s required: b y the A c t or R e g u l a t i o n s t o be l e f t at or sent t o the T r a d e M a r k s Office or a sub-office, s h a l l b e u p o n f o o l s c a p p a p e r o f a size o f 13 inches b y 8 inches , a n d shal l h a v e on the l e f t thereof a m a r g i n o f not less than one inch a n d a h a l f .

1 1 . A n y a p p l i c a n t , o p p o n e n t , or p r o p r i e t o r , m a y a p p o i n t some person res iding in A u s t r a l i a to b e h is agent t o represent h i m in re lat ion to a trade­m a r k , either g e n e r a l l y or f o r any specified p u r p o s e .

PART II.—REGISTRATION OF TRADE MARKS.

DIVISION I .—APPLICATIONS.

Requisites of application.

1 5 . A n a p p l i c a t i o n f o r the reg is t rat ion o f a t r a d e m a r k m u s t b e m a d e in w r i t i n g , a n d must set out the n a m e a n d a d d r e s s o f the a p p l i c a n t , and his a d d r e s s f o r service , a n d m u s t conta in a representat ion o f the t r a d e mark, and be a c c o m p a n i e d b y t w e l v e a d d i t i o n a l r e p r e s e n t a t i o n s thereof , which shall be f a c s i m i l e s o f the representat ion c o n t a i n e d in the a p p l i c a ­tion. S e v e n o f the a d d i t i o n a l representat ions a r e to b e affixed as h e r e a f t e r p r o v i d e d , a n d five unaffixed.

Signature of applications.

16. ( 1 ) A n a p p l i c a t i o n m u s t b e s i g n e d b y the a p p l i c a n t Or b y a n a g e n t on his b e h a l f , but the f o l l o w i n g s h a l l b e s u f f i c i e n t : —

(a) If the application is made by a firm, the firm's signature thereto may be made by any member of the firm.

(b) If the application is made by a body corporate or an associa­tion, it may be signed by a director or by the secretary or

some p r i n c i p a l officer thereof , on b e h a l f o f the body cor­p o r a t e or assoc iat ion.

(2) W h e r e an a p p l i c a t i o n i s s i g n e d b y an a g e n t on b e h a l f o f the a p p l i ­cant, the a p p l i c a t i o n m u s t be a c o o m p a n i e d by an author i ty b y the appl icant to the agent .

Representations of trade marks.

1 7 . ( 1 ) W h e r e p o s s i b l e , a representat ion of the t r a d e m a r k must be affixed t o the square in the f o r m o f a p p l i c a t i o n .

(2) W h e r e the representat ion exceeds the square in size, the representa­tion must b e m o u n t e d on l inen, a n d p a r t o f the m o u n t i n g affixed t o the square, a n d the rest f o l d e d over .

Representation in special cases.

1 8 . W h e r e the representat ion cannot b e affixed to the square in the f o r m o f a p p l i c a t i o n , a s p e c i m e n or c o p y o f the t r a d e m a r k m a y be l o d g e d wi th the a p p l i c a t i o n e i ther in f u l l size or on a r e d u c e d scale , and in such manner and f o r m as the R e g i s t r a r d irects .

Foreign words. 19 . W h e r e a t r a d e m a r k conta ins w o r d s other t h a n E n g l i s h w o r d s or in other than R o m a n c h a r a c t e r s , a t rans lat ion o f the w o r d s sha l l , i f the R e g i s t r a r so requires , b e i n d o r s e d on or affixed to the a p p l i c a t i o n , and each a d d i t i o n a l representat ion o f the t r a d e m a r k l o d g e d w i t h it .

Representations of a series of trade marks.

20. W h e r e an a p p l i c a t i o n r e l a t e s to a series o f t r a d e m a r k s , a representa­tion o f e a c h t r a d e m a r k , o f t h e series shal l b e affixed as, a f o r e s a i d to the f o r m o f a p p l i c a t i o n , and to each o f t h e a c c o m p a n y i n g F o r m s C .

Registrar may require fresh representation.

2 1 . T h e R e g i s t r a r m a y , i f dissat is f ied w i t h the representat ion of a t r a d e mark , require a f r e s h representat ion , e i ther b e f o r e h e proceeds w i t h the a p p l i c a t i o n , or b e f o r e he registers the t r a d e m a r k .

Form of application.

22. T h e a p p l i c a t i o n m a y be in such o f t h e F o r m s B , B I , or B 2 , as is a p p l i c a b l e t o t h e case , b u t in t h e case o f appl ica t ions i n f o r m B 2 , a dec la­ration in the F o r m D must a c c o m p a n y the a p p l i c a t i o n .

Applications when lodged to be indorsed with actual time of lodgment.

23. E v e r y a p p l i c a t i o n for reg is trat ion of a trade m a r k shall be indorsed with the actual t ime of its rece ipt , e i ther at the T r a d e M a r k s Office or at a Sub-office. F o r the purposes o f this R e g u l a t i o n , the t ime at w h i c h an a p p l i c a t i o n is l o d g e d in a S t a t e , a c c o r d i n g to the s t a n d a r d or l e g a l t ime in that State , shal l be reckoned as the actual t i m e of lodgment o f the a p p l i c a t i o n .

Manner of recording application .

24. A p p l i c a t i o n s f o r registration, of t r a d e m a r k s sent by p r e p a i d letter t h r o u g h the post, sha l l , as f a r as p r a c t i c a b l e , be recorded in the order in w h i c h the letters conta in ing them w e r e d e l i v e r e d at the T r a d e M a r k s Office or Sub-of f ice; or in the case o f letters d e l i v e r e d at the same t ime, in the order in w h i c h they are o p e n e d .

Acknowledg­ment of application.

2 5 . O n receipt o f the a p p l i c a t i o n the R e g i s t r a r shal l furn ish t h e a p p l i c a n t w i t h an a c k n o w l e d g m e n t thereof .

Acceptance of application.

26. I f , a f ter cons ider ing the E x a m i n e r ' s report , the R e g i s t r a r is of opinion that the t r a d e m a r k is in c o m p l i a n c e w i t h the A c t and n o b a r to its registrat ion exists , he shal l accept the a p p l i c a t i o n .

Notice of refusal. 27. I f the R e g i s t r a r is o f opinion that t h e t r a d e m a r k is not in com­

pl iance w i t h the A c t or that some b a r to its registrat ion exists he shall g ive notice thereof to the a p p l i c a n t . T h e notice shal l state the g r o u n d s o f the R e g i s t r a r ' s opinion and shal l i n f o r m the a p p l i c a n t that h e is ent i t led to b e h e a r d p e r s o n a l l y or by his agent b e f o r e the R e g i s t r a r deals w i t h the a p p l i c a t i o n .

Notice of application for hearing.

28. W i t h i n f o u r t e e n d a y s f r o m the receipt o f the notice or such fur ther t i m e as is fixed b y the not ice , the a p p l i c a n t shal l not i fy to the R e g i s t r a r whether or not he desires to b e h e a r d upon the mat ter , a n d in d e f a u l t o f his do ing so the appl icat ion s h a l l be deemed to be abandoned.

Notice of hearing.

29. I f t h e a p p l i c a n t notifies the R e g i s t r a r that he desires to be h e a r d the R e g i s t r a r shal l fix a t ime for the h e a r i n g , a n d s h a l l g i v e to the a p p l i ­c a n t not less t h a n ten d a y s ' not ice o f the time so fixed, a n d i f the a p p l i c a n t f a i l s to a p p e a r p e r s o n a l l y , or b y his agent , at the time fixed for the h e a r i n g , the a p p l i c a t i o n s h a l l b e deemed to be a b a n d o n e d .

Hearing. 30. O n the h e a r i n g , the R e g i s t r a r shal l hear the a p p l i c a n t , a n d shal l consider the a p p l i c a t i o n , and s h a l l d e c i d e w h e t h e r to accept it wi th or w i t h ­out modif icat ions or condit ions, or to r e f u s e i t .

Advertisement of application.

3 1 . E v e r y a p p l i c a t i o n for the registrat ion of a t r a d e m a r k w h i c h has been a c c e p t e d s h a l l be advert ised by the R e g i s t r a r in the Official J o u r n a l .

Means of advertising trade mark to be supplied.

3 2 . F o r the purposes o f the a d v e r t i s e m e n t the a p p l i c a n t m a y be required to f u r n i s h a b l o c k or e l e c t r o t y p e (or more than one, i f neces­sary) o f the t rade m a r k , o f such dimensions as is d irected b y the R e g i s t r a r , or such other i n f o r m a t i o n or m e a n s o f advert is ing the t rade m a r k as is required by the R e g i s t r a r ; a n d the R e g i s t r a r , i f dissatisf ied w i t h any b lock or e l e c t r o t y p e furnished b y the a p p l i c a n t m a y require a fresh b l o c k or e l e c t r o t y p e b e f o r e proceeding w i t h the advert isement .

Advertisement of series.

33. W h e n an a p p l i c a t i o n re lates to a series of t r a d e m a r k s , the a p p l i c a n t m a y b e required to furnish a w o o d b l o c k or e l e c t r o t y p e (or m o r e than one, i f necessary) o f any or o f each o f the t rade m a r k s const i tut ing the s e r i e s ; a n d the R e g i s t r a r m a y , i f he th inks fit, insert w i t h the advert isement o f the a p p l i c a t i o n a s tatement o f the e x t e n t to w h i c h the several t rade m a r k s differ f r o m one another.

Action where representation of trade mark not advertised.

34. I f no representat ion o f the t r a d e m a r k is inserted in connect ion w i t h the advert isement , or i f the t r a d e m a r k is l imi ted to a p a r t i c u l a r colour or colours, and in a l l cases in w h i c h he deems it des i rable , the R e g i s t r a r shall state in the advert isement the p lace where a specimen or representat ion of the t rade m a r k is depos i ted for exhibit ion.

D I V I S I O N 3 . — O P P O S I T I O N . Notice of opposition.

35. A notice o f o p p o s i t i o n to the reg is t rat ion of a trade m a r k m a y be in accordance w i t h F o r m F , a n d s h a l l b e s i g n e d b y or on b e h a l f o f the o p p o n e n t .

Opposition on the ground of trade mark already on the register.

36. W h e r e a g r o u n d o f o p p o s i t i o n t o the reg is t rat ion of a t r a d e m a r k is that i t is ident ica l w i t h a t r a d e m a r k a l r e a d y regis tered under the A c t or a S t a t e T r a d e M a r k s A c t , in respect o f the l ike goods or c l a s s o f goods , or so near ly resembles the latter t r a d e m a r k as to b e l i k e l y t o deceive, the notice shal l state the date o f reg is trat ion, and the number of the registered t r a d e m a r k .

Evidence 37. I n any case o f oppos i t ion to the reg is t rat ion o f a t r a d e m a r k the R e g i s t r a r m a y , at the request o f the part ies or otherwise , order that all or any p a r t o f the e v i d e n c e shal l be taken viva voce or by affidavit a n d may g i v e such direct ions as are required in that b e h a l f , b u t , in the absence o f any direction b y the R e g i s t r a r , the ev idence in any such case shal l be b y d e c l a r a t i o n and shal l be g iven as f o l l o w s : —

(a) Within one month after the receipt of the counter-statement the opponent shall leave at the Trade Marks Office the evidence

h e a d d u c e s in s u p p o r t o f his o p p o s i t i o n , and del iver to the a p p l i c a n t copies thereof .

(b) Within one month after the delivery to the applicant of the opponent's evidence, the applicant shall leave at the Trade

M a r k s Office his ev idence in answer , and del iver to the o p p o n e n t copies thereof .

(c) Within fourteen days after the delivery of the applicant's evidence the opponent shall leave at the Trade Marks Office his evidence

in r e p l y , a n d de l iver to the a p p l i c a n t copies thereof . T h e last-ment ioned evidence s h a l l b e confined to matters str ict ly in reply .

(d) No further evidence shall be left on either side except by leave of the Registrar upon the written consent of the parties or by

spec ia l l e a v e o f t h e R e g i s t r a r g i v e n on an a p p l i c a t i o n m a d e to h im. E i t h e r p a r t y m a k i n g the a p p l i c a t i o n shal l g i v e notice t h e r e o f to the o p p o s i t e p a r t y , w h o shal l b e entit led to o p p o s e t h e a p p l i c a t i o n . A p p l i c a t i o n for leave to l o d g e further ev idence shal l b e a c c o m p a n i e d b y t h e prescr ibed fee .

(e) Where exhibits are referred to in a declaration, but are not at­tached thereto, the party adducing the evidence shall either

f u r n i s h copies or impress ions t h e r e o f to the other p a r t y , or send the o r i g i n a l s to t h e T r a d e M a r k s Office. T h e or ig inals must , i f the R e g i s t r a r so requires , b e p r o d u c e d at t h e hear ing .

Failure by opponent to lodge declara­tions.

38. I f the o p p o n e n t f a i l s , w i t h i n the time a l l o w e d , to leave declarat ions in s u p p o r t o f his o p p o s i t i o n , or to state that he intends t o rely on the f a c t s stated in the not ice o f oppos i t ion , the o p p o s i t i o n shall be deemed to h a v e been a b a n d o n e d .

Failure by applicant to lodge declara­tions.

39. I f the a p p l i c a n t f a i l s , w i t h i n the t ime a l l o w e d , t o l o d g e dec larat ions in answer to o p p o n e n t ' s dec larat ions in s u p p o r t o f the opposi t ion, or to s tate that he intends to r e l y u p o n the documents l o d g e d wi th the a p p l i c a ­tion, the a p p l i c a t i o n shal l be d e e m e d to h a v e been a b a n d o n e d .

Appointment of time for hearing.

40. O n the c o m p l e t i o n o f the e v i d e n c e the R e g i s t r a r shal l a p p o i n t a

t ime f o r the h e a r i n g o f the case , and shal l g ive the parties at least seven

d a y s ' notice o f t h e appointment .

Service of copies.

5 3 . I f the a p p e l l a n t or respondent lodges any d e c l a r a t i o n or document w i t h the L a w Officer, h e shal l serve a copy thereof on the R e g i s t r a r , a n d on the oppos i te par ty .

Transmission of documents.

54. T h e R e g i s t r a r shal l f o r w a r d to the L a w Officer a l l documents u s e d i n the case a n d e v i d e n c e g i v e n b e f o r e h im.

Directions by Law Officer.

55. T h e L a w Officer m a y g i v e such direct ions ( i f any) as he th inks fit with respect to the h e a r i n g of the a p p e a l .

Hearing of appeal.

56. Seven d a y s ' not ice of the t i m e and p lace a p p o i n t e d f o r the h e a r i n g , or such shorter notice as the L a w Officer in any p a r t i c u l a r case directs , s h a l l be g iven to the R e g i s t r a r and to the parties.

Evidence. 57. S u b j e c t t o the direct ion and l e a v e o f the L a w Officer, the ev idence to b e used on the a p p e a l to t h e L a w Officer shal l b e the s a m e as that u s e d at the h e a r i n g b e f o r e the R e g i s t r a r .

Notice of. appeal.

58. W h e n any person intends to a p p e a l to the C o u r t f r o m a decis ion o f t h e R e g i s t r a r , or the L a w Officer, h e s h a l l , wi th in one month f r o m the d a t e of the decision a p p e a l e d aga inst , send notice o f a p p e a l i n w r i t i n g set t ing out the g r o u n d s o f a p p e a l to t h e R e g i s t r a r and to t h e o p p o s i t e p a r t y a n d file a COPY o f the notice in the C o u r t .

Service of copies.

59. I f the a p p e l l a n t or respondent files any affidavit or document in the C o u r t , h e shal l serve a copy thereof on the R e g i s t r a r , a n d on the opposi te party .

Transmission of documents.
