About this report  

In  preparation  for  the  “GHS  Stocktaking  Workshop  for  Southeast,  East,  and 

Central Asia”, Beijing, China from 15‐17 September 2010, a report on the status 

of implementation of the GHS in the region was been prepared as a background 

paper and workshop input.   

 

The report was prepared by the Nihon University  (Tokyo) and Korea University 

(Seoul),  in  collaboration with  UNITAR  and  ILO.  The  collaborators  thank  those 

individuals who replied to the survey to help compile the report.  

The  preliminary  results  were  presented  at  the  workshop  and  finalized 

afterwards, based on feedback received.

Status of the GHS Implementation in Southeast, East and Central Asia

I. Executive Summary This report presents the results of a survey conducted on the status of preparation for implementation of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) in countries of South-east, East and Central Asia undertaken during mid-2010. A questionnaire was distributed to counties in ASEAN (Brunei Darussalam, Cambodia, Indonesia, Lao People’s Democratic Republic, Malaysia, Myanmar, Philippines, Singapore, Thailand and Vietnam), Central Asia (Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, Uzbekistan), Mongolia, China, Japan and Korea by Nihon University and Korea University. Key points for the survey related to seven items:

1. Lead ministry for GHS 2. Other engaged ministries or coordination or committee (for GHS

implementation) 3. Current legal status (covering different sectors) 4. Transition or phase-in periods from existing systems to GHS 5. Training and capacity building activities 6. Plans for 2011-2012 7. Others (Building approach, International cooperation on GHS implementation).

Six out of ten countries in ASEAN and Japan responded to the questionnaire. Concerning the counties that not to answer the questionnaire (Brunei Darussalam, Indonesia, Lao People’s Democratic Republic and Myanmar), the status of GHS implementation is referred to through the UNECE website (http://www.unece.org/trans/danger/publi/ghs/implementation_e.html). For Central Asia, Mongolia, China and Korea, a survey was done by sending a questionnaire to the contact person listed as the GHS focal point. Three out of five Central Asia Countries, Mongolia, China and Korea respond to the questionnaire. Concerning the counties not to respond to the questionnaire (Kyrgyzstan, and

Uzbekistan) for the status of GHS implementation was referred to APEC, UNECE, WSSD websites1-6) and the Russian GHS standards7-8). The results of this survey are summarized as follows:

Most of the countries surveyed have designated a GHS committee consisting of the ministries concerned.

There is no country to introduce the GHS for all four sectors (industry, agriculture, transport, consumers) at the present time (August 2010).

Six countries (Indonesia, Malaysia, Philippines, Singapore, Thailand and Vietnam) of ASEAN have prepared or considered to implement the GHS. Japan has implemented the GHS partly for industrial sector.

There are big discrepancies among ASEAN in capacity building: Indonesia, Malaysia, Philippines, Singapore and Thailand reported activities for that. The implementation of GHS in Korea has been led by the Minster of Employment & Labor and Environment, MOL (Minster of Employment & Labor) transition period is until June 30, 2010 for substances, and June 30, 2013 for mixtures.MOE (Minster of Environment) implemented from July 1, 2008 for newly designated toxic chemicals. For existing toxic chemicals: single substances until July 1, 2011 and mixtures until July 1, 2013.

China is expected to implement the GHS classification and labelling for new chemicals from 15 October 2010 but there is no timesheet for full implementation of GHS in China

Mongolia, Kazakhstan, Tajikistan, and Turkmenistan are preparing to enact a law related to GHS implementation. Commonwealth of Independent States (CIS) such as Russia, counties in Central Asia, and 12 counties including Azerbaijan and Belarus have adapted the GHS, but information regarding the current status of GHS implementation is not available.

Five standards for GHS Classification (Classification of chemicals. General requirements, Classification of chemicals for physical hazards. Testing substances, Classification of chemicals for health hazards, Classification of mixtures for environmental hazards, Classification of chemicals for environmental hazards. Testing substances) in CIS (Commonwealth of Independent States) will be in force starting 1 January 2011. 9)

These conclusions reflect that the GHS implementation process, while in progress, is at an early stage in the region and that further capacity building support for developing and transition countries will be required. The status of the GHS implementation for each sector in the counties surveyed is summarized in Table 1.

II. Introduction The GHS was issued as a recommendation from the United Nations 2003, though it was delayed from the target year 2000 adopted by the Agenda 21, UNCED 1992. Some countries or regions have implemented or considered to implement the GHS after 2008, the target year for the GHS by the WSSD in 2002. The GHS implementation by the EU (CLP regulations) in 2009 gave a big impetus to other regions or countries, especially to those trading with the EU. Now implementation of the GHS is an urgent matter worldwide. The GHS workshop that was held at Beijing, from 15 to 17 September 2010 shared experiences and information from this region. This survey was undertaken to update the status of the GHS implementation in ASEAN (Brunei Darussalam, Cambodia, Indonesia, Lao People’s Democratic Republic, Malaysia, Myanmar, Philippines, Singapore, Thai and Vietnam), Central Asia (Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, and Uzbekistan), China, Korea and Japan. For ASEAN and Japan, it was done by sending a questionnaire to the contact person listed by UNITAR. Six out of ten responded to the questionnaire. Concerning the counties not to answer the questionnaire (Brunei Darussalam, Indonesia, Lao PDR and Myanmar) the status of GHS implementation is referred to UNECE website. The main reason not to get response from those countries seems to be an ambiguous E-mail address of a contact person. For Central Asia, Mongolia, China and Korea, it was done by sending a questionnaire to the contact person listed by GHS focal point. Three out of five Central Asia countries, Mongolia, China and Korea responded to the questionnaire. Concerning the counties not to answer the questionnaire (Kyrgyzstan, and Uzbekistan) the status of GHS implementation is referred to APEC, UNECE, and WSSD website 1-6). Kyrgyzstan, and Uzbekistan have not responded the questionnaire, and it was not easy to collect data or information related to the status of GHS implementation for these countries on the official website of each governments 10-15). However, we found that Commonwealth of Independent States (CIS) including Kyrgyzstan, and Uzbekistan adopted the Russian GHS standard 9, 16).

III. Results of the survey (Status of each country)

For international transport of dangerous goods, see Implementation through international legal instruments, recommendations, codes and guidelines. Brunei Darussalam is in the process of undertaking a situation and gap analysis to review the current chemical management system as a whole. Several challenges are needed to both chemicals management and GHS implementation. First, present regulations are confined to pesticides. Second, controls on other chemicals are based on institutional measures, where a number of various agencies deal with chemicals, but need further coordination. Third, the majority of industry is small and medium size enterprises which lack capacity. Fourth, labelling awareness among stakeholders and users is low. There are opportunities for GHS implementation, but the first step is to review the overall chemical management system.

1. Lead ministry for GHS The Ministry of Environment is a lead agency for coordinating, facilitating and disseminating only with regard to informing to all relating agencies dealing with GHS. However, during the implementation, the key ministry (4-main ministries like MAFF. MIME, MPWT, and MoC) who is the lead agency working and direct dealing to their own field such as Agriculture, industry, transport, and consumer product 2. Main relevant legislation:

GHS will be nationally implemented under a Presidential Decree. The final draft of the decree has already been completed and it is currently under revision under the responsibility of the Ministry of Law and Human Rights. It is expected that other pieces of national legislation for chemicals management will be revised to be in line with the Presidential Decree.

GHS implementation milestones (all sectors)

National legislation for land transport of dangerous goods in Indonesia is based on the 14th revised edition of the UN Model Regulations and entered into force on 1 January 2007. GHS targeted chemical substances in the Industrial Safety and Health Act includes 16items of physical dangerousness, 11 items of health and environment about all Hazardous substances and mixtures. But there are exceptional materials of GHS application in this law. Those are solidified end products as substances of less than 1% of Hazardous (carcinogens 0.1% or less), as the substances which is no concern of being exposed to targeted chemical substances included the products when the Hazardous workers handles the product (carcinogens is the GHS target), pharmaceuticals, cosmetics, food and consumer devices etc.

2) Ministry of Environment (Toxic Chemicals Control Act) 23):

The Ministry of Environment revised the Toxic Chemicals Control Act which was revised by GHS standards for display methods of the toxic chemicals on the containers, packaging etc. 6 main information(product name, symbol, signal language, Hazardous stationery, preventive measures stationery, provider information) are displayed on the containers, packaging of toxic chemicals, and all Hazardous of toxic chemicals are classified and displayed by increased Hazardous items (16->27, 16 kinds of physical dangerousness, 11 kinds of health and environment Hazardous), and the display standard is revised in order to add increased information smoothly, and the display methods is stipulated differently by the format of container

3) National Emergency Management Agency (Safety Control of Dangerous Substances Act)24) : The standard about classification and Labelling of hazardous materials was revised as 2008-18 which is issued in November 2008 by National Emergency Management Agency.

(1) Article 3 shall determine the classification standard of the dangerousness of hazardous materials; the dangerousness of hazardous materials are classified as 16 items such as explosive materials or explosives by dangerousness, and health environment Hazardous follows the standard of “regulations about classification standard and display of toxic chemicals” by the National Institute of Environmental Research. (2) Article 4 shall determine the standards of warning sign which should be attached on the containers which store the dangerousness. The items which shall be indicated on the outside of the containers which store the dangerousness provide product information, pictures letters, signal language, risk phrases, the preventive measures phrases, sign method of provider information, the background color of the cover, dangerousness and warning sign of dangerousness of picture letters warning. (3) Article 5 shall determine the Hazardous classification standard and labelling cover method of chemical substances; the classification standard of 15 items except explosives or gunpowder and display methods of materials are provided by physical dangerousness.

Lao People's Democratic Republic has drafted the Hazardous Chemical Strategic Plan for 2006-2020 and the Hazardous Chemical Action Plan for 2006-2010. These Plans are designed to provide a framework for the safe and effective management of chemicals. In terms of the GHS, Lao People's Democratic Republic has begun to draft a project proposal and has set up a National Steering Committee. The results of the comprehensibility training (held in October 2006) as well as those of the situation and gap analysis were used for the development of GHS implementation activities during 2007. For international transport of dangerous goods, see Implementation through international legal instruments, recommendations, codes and guidelines. Myanmar established the National Commission for Environmental Affairs, in 1990. Among its programs, Myanmar has adopted Agenda 21, one part of which is to promote the environmentally sound management of toxic chemicals and hazardous waste. There is no specific institution assigned to the task of overall management of chemicals and waste, but there are a number of existing frameworks in legislation, classification and labelling standards that could accommodate the GHS. Myanmar is currently preparing to revise existing legislation and administrative procedures to implement the GHS.

implementation) In 2004, a GHS Multi-Sectoral Committee was initially formed based on the recommendation during the 2nd APEC Chemical Dialogue in Malaysia in September 2004. It was composed of concerned government agencies, the chemical industry association and the academe. In 2005, under the BOI-UNITAR Training and Capacity Building for the Implementation of the Globally Harmonized System of Classification and Labelling (GHS) in the Philippines Phase I Project, a GHS National Implementation Committee was also formed, composed of a larger group of thirty (30) concerned government agencies, six (6) industry associations, and five (5) public interest and labor organizations (PILOs) and academic and professional organizations.

3. Current legal status (covering different sectors)

The GHS Joint Administrative Order of 2009 (GHS JAO), which covers the different sectors affected by the GHS, was formulated since there are already existing legislations in the Philippines that could incorporate the GHS provisions. The GHS JAO requires implementing agencies to draft or revise the Implementing Rules and Regulations (IRRs) of their respective laws to incorporate the provisions of GHS. It also specifies the duties and responsibilities of the GHS implementing and coordinating government agencies in the adoption of GHS. The DOTC will implement GHS through the UN Model Regulations on the Transport of Dangerous for air and sea transportation in the Philippines. The IRRs of the following laws are being revised/need to be revised: 1) Toxic Substances and Hazardous and Nuclear Waste Control Act of 1990 - for

industrial chemicals; 2) Rule 1090 of the Occupational Safety and Health Standards (OSHS) entitled

“Hazardous Materials” - for GHS implementation in the workplace; 3) Food and Drug Administration Act of 2009 – for consumer chemicals; 4) Article V of the Fertilizer and Pesticide Authority Rules and Regulations - for

pesticides; 5) Revised Fire Code of the Philippines - for emergency response.

4. Transition or phase-in periods from existing systems to GHS

It was agreed during the GHS National Review and Planning Workshop in February 2008 that the implementation of GHS for industrial chemicals would start

with single chemicals which are listed in the PCL (Priority Chemical List) of the Chemical Control Act and those single chemical substances with high production volume. It was expected that the transition period for GHS implementation will be three years. However, the revised IRR of the Toxic Substances and Hazardous and Nuclear Waste Control Act of 1990 is still being finalized by EMB.

5. Training and capacity building activities (2006 – 2010)

1) The Board of Investments has conducted a Training Seminar/Workshop on

Basic and Intermediate GHS for seventy two (72) employees of concerned government agencies in December 2009. The Occupational Safety and Health Center (OSHC) and Environmental Management Bureau (EMB) have conducted lectures/learning sessions on Basic GHS in Metro Manila and several regions of the Philippines from 2006 to date.

2) SPIK, the chemical industry association, conducted several , Intermediate and

Advanced training/workshops for mostly SMEs and non-SPIK member companies composed of manufacturers, importers, distributors, traders, retailers, repackers, transporters, emergency responders, chemistry students and faculty, and government regulators from 2006 to April 2010. It also conducted in-house trainings on GHS labelling and preparation of Safety Data Sheets (SDS) for some of its member companies.

3) Info sessions and conferences on GHS conducted by the civil society groups: Trade Union Congress of the Philippines (TUCP), Pesticide Action Network (PAN), Phils., Nationwide Association of Consumers, Inc. (NACI) in 2006 to 2007.

4) IEC materials on GHS such as pictogram, posters, brochures, resource CD and chemical safety tips were reproduced and distributed by the government, industry and civil society. Information campaign thru tri-media: radio, TV and focus group discussions and media releases were also made to broaden the reach for public awareness.

6. Plans for 2011 - 2012

The Philippines will implement the GHS activities under Phase II of the BOI-UNITAR Training and Capacity Building for the Implementation of the Globally Harmonized System of Classification and Labelling (GHS) in the Philippines Project.

Moreover, Subcommittee on Policy and Plan, under Thailand’s National Coordinating Committee on Chemicals Management, an inter-ministerial body with the participation of related business, academia, public interest and labour organizations, has been responsible for the development of National Strategic Plan on Chemicals Management (NSPCM). The Subcommittee on Policy and Plan on Chemicals Management has endorsed the integration of GHS into the NSPCM.

IV. Conclusions and Recommendations The conclusions and recommendations drawn from the results of this survey and the information of the various websites are as follows: • Most countries surveyed have no comprehensive system to classify and label

chemicals. This means that the GHS is very new to those Asian countries. The way to implement the GHS or to set up a support system in those countries would be different from that in the EU or USA.

• There are some countries implementing the TDG, but mainly for air and sea

transport. Land transportation in Asian countries would have another issue to implement the GHS or the TDG.

• Capacity building activities for the GHS are still somewhat limited. Further human

resources and budgetary support in Asian countries would be needed for popularization of the GHS in all sectors.

• A GHS focal point or contact person seems unavailable in some countries.

Strengthening the current network or making a new network for the GHS should be undertaken. Regional workshops (such as the one in Beijing) or training courses could be utilized for this purpose.

• It is encouraged that information regarding the status of GHS implementation,

information on web-sites, and lists of focal points in each country should be translated into English.

• The GHS hazard classification results from some countries are different from each other, even for the same chemical25). Therefore, discussions between countries or multilateral discussions with international organization would be needed for better harmonization of classification and indication of chemical substances at regional and international level in the future.

• A gap analyses for regulations, SDS, and current labelling systems among countries

may be necessary, and the timing and level of introduction of the GHS based on the gap analyses should be considered.
