Motion for Approval of Compromise and Settlement Agreement, and in support thereof would

respectively show unto the Hearing Officer as follows:

The Division and Licensees are desirous of compromising and settling all disputes between

them relative to this administrative proceeding, In connection therewith, the parties have entered

into a Compromise and Settlement Agreement which by its terms will become effective upon

approval by the Administrative Hearing Office and the Louisiana Gami~g Control Board.

A true and correct copy of the proposed Compromise and Settlement Agreement is attached

hereto as Exhibit "An and incorporated by reference for all purposes.

WHEREFORE, PREMISES CONSmERED, The Division and Licensees respectfully

WHEREAS, the Louisiana Gaming Control Board has issued Notices of

Recommendation of Administrative Action ("Notice") to Licensees alleging certain violations of

Louisiana Gaming Control Law; and

WHEREAS, the issues raised by the said Notices are set for hearing on December 22,

20 I0, before the Louisiana Gaming Control Board Administrative Hearing Office ; and

WHEREAS, the Division and Licensees are desirous of fully and finally compromising

and settling all issues and disputes arising out of and in connection with the said Notices of

Recommendation of Administrative Action;

NOW. THEREFORE, in consideration of the foregoing, the parties hereto do hereby

agree and stipulate as follows:

Rosbortorn, Jr . d/b/a Gaming Solutions, Big Top Travel Center & Casino, LLC d/b/a Big Top

following violations:

I. Failing to notify the Division of a Louisiana Department of Insurance

investigation of member/owner Harold L. Rosbottorn, Jr., in violation of

LAC 42:XI.2417(B)(4 & 5);

ii, Failing to notify the Division of a settlement that was entered into between .

Harold L. Rosbottom, Jr . and the Louisiana Department of Insurance, in

violation of LAC 42 :XI.2417(B)(4 & 5); and

iii. Submitting an Annual Licensee Form to the Division without disclosing the

Louisiana Department of Insurance investigation and settlement, in violation

of LAC 42:XI.2405(A)(15).

2. Caddo-Bossier Gaming ce., LLC d/b/a Caddo-Bossier Gaming Co. Big 'Top

Travel Center & Casino, LLC d/b/a Big Top Travel Center & Casino, 1-220 Travel Plaza, LLC

d/b/a Goldmine Casino and Minden Truck Center. LLC d/b/a Waverly Truck Stop further admit

to submitting a Renewal Affidavit/Certifications to the Division without disclosing the Louisiana

Department of Insurance investigation, in violation of LAC 42:XI.2405(A)( 15).

TERMS AND CONDITIONS

I. In lieu of administration action, the Licensees will pay a civil penalty of

THIRTY srx THOUSAND DOLLARS and NolIOO ($36,000.00) for violating LAC

42 :X1.2405(A)(15)and LAC 42:X1.2417(B)(4 & 5).

2. The Division hereby agrees to accept the Licensees' payment of the above

stated penalty in lieu of administrative action in full and final settlement of the Notices of

Administrative Action issued on November 10,20 I0,

J . The Division reserves the right to take into consideration these admitted

violations in connection with any future investigation, violation or assessment of penalty, and in

connection with any future assessment of the Licensees and Harold L. Rosbottorn, Jr.'9

suitability,

4. The terms of this Compromise and Settlement Agreement shall be interpreted

under the laws of the state of Louisiana.

5. This Compromise and Settlement Agreement constitutes the entire agreement

between the Division and Licensees regarding the subject matter contained herein and supersedes

all prior and contemporaneous agreements, representations and understandings of the parties.

the said Motion, and it appearing to the Hearing Officer that the said Compromise and Settlement

Agreement should be approved; it is, therefore,

ORDERED, ADJUDGED, AND DECREED that the Compromise and Settlement

Agreement attached to the parties' Joint Motion for Approval of Compromise and Settlement

Agreement be, and the same is hereby, APPROVED; that the Licensees must pay THJRTY SIX

THOUSAND DOLLARS and Noll 00 ($36,000 .00) to the Division within fifteen (15) days of the

approval by the Louisiana Gaming Control Board. Failure to do so shall result in the immediate
