Newsletter 2016-17 April 29, 2016 STATE PREVAILING WAGE REPEAL BILL EFFECTIVE MAY 4
H.B. 4005, a bill to repeal West Virginia’s prevailing wage statute, goes into effect May 4. On this date, construction projects that are funded with state, county, local or other government funds will no longer contain a prevailing wage rate. Contractors working on projects that contain federal funds will continue to be required to pay federal Davis-Bacon wage rates. The bill completed legislative action on February 4 with an effective date of 90 days. The Governor vetoed the bill and the West Virginia Legislature overrode the veto on February 12. There was speculation that the effective date of the bill would be 90 days from that date, or May 12. However, legislative auditors officials have stated that previous court rulings regard a governor’s veto as a recommendation and not binding. Therefore, the effective date of a bill would be from passage, not a vote to override a veto. Legislation passed in 2015 revamped the prevailing wage statute by taking prevailing wage out from the West Virginia Division of Labor and transferring wage calculation to WorkForce West Virginia. It also eliminated wage rate requirements on projects under $500,000. Legislators disagreed with the methodology for calculating rates when the new rates established were comparable to existing prevailing wage scales. One of the first bills introduced in the 2016 session was H.B. 4005 to completely repeal the prevailing wage statute. The bill passed 55-44-1 in the House and 18-16 in the Senate. The CAWV has learned that certain owners are still requesting certified payrolls on projects under $500,000. Since there was not a prevailing wage requirement on these contracts, there would be no need for certified payrolls. After May 3, it is assumed that certified payrolls will no longer be required on state, county or municipal projects. OTHER BILLS TAKE EFFECT
Other bills that will soon become effective include S.B. 474, giving the West Virginia Department of Environmental Protection the ability to conduct purchasing of products, services and construction instead of procuring through the state Purchasing Division (May 8); making West Virginia the 26th Right-to-Work state (May 5); restoring the rule relating to change orders on state construction projects (May 12); and H.B. 4009, The Letting Our Counties Act Locally Act which allows counties to fund local highway construction projects (May 12). WEST VIRGINIA'S PRIMARY ELECTION - EARLY VOTING RUNS THROUGH MAY 7 On May 10, West Virginia voters will choose nominees for a host of state offices including governor, all three members of the state's congressional delegation and members of the Board of Public Works (secretary of state, attorney general, treasurer, auditor and commissioner of agriculture). For the first time, all judges, including one seat on the West Virginia Supreme Court of Appeals, will run on a non-partisan basis and will be elected in the Primary Election. Whether you are voting a Republican or Democrat ballot, the non-partisan race for West Virginia Supreme Court is listed last on the bottom of the ballot. PRIMARY ELECTION DAY is Tuesday,

CAWV CONGRESSIONAL FLY-IN SCHEDULED FOR MAY 11
The 28th annual CAWV Congressional Fly-In will be held Wednesday, May 11. President Dan Cooperrider will lead the CAWV delegation to Washington, D. C. to meet with West Virginia’s congressional delegation on issues critical to the construction industry. “It is important that our senators and representatives see us in their offices, meeting with them face-to-face, to discuss the issues that are important to our members,” said President Cooperrider. This year’s Fly-In will again be held in conjunction with the Transportation Construction Coalition (TCC) which will include hundreds of industry people who will urge Congress to fully fund a long-term transportation bill. AGC of America and ARTBA are co-chairs of TCC. CAWV members will call on West Virginia’s delegation to fully fund the federal highway trust fund now that there is a multiyear reauthorization bill, fully fund the Clean Water and Safe Drinking Water SRFs, prohibit the use of reverse auctions in federal construction projects, and oppose EPA’s expansion of federal Clean Water Act jurisdiction, among others. For additional information, contact Mike Clowser at (304) 342-1166 or [email protected]. AGC WINS ROUND 1 AGAINST BLACKLISTING EXECUTIVE ORDER
In what may be a 12-ring bout, AGC won round one to block President Obama’s Blacklisting Executive Order. Late Thursday, the House Armed Services Committee added an AGC-backed provision to the National Defense Authorization Act—a bill that has been annually enacted into law for 54 consecutive years—that ensures the EO will not apply to Department of Defense and National Nuclear Security Administration contracts. AGC will work to expand the application of the EO government-wide when the bill hits the House floor and during consideration in the Senate. Under the EO, both prime and subcontractors must report violations of 14 federal labor laws and “equivalent” state labor laws during the previous three years, and again every six months, on federal contracts over $500,000. Prime contractors would also be responsible for evaluating the labor law violations of their subcontractors at all tiers. A single violation, or a combination of multiple violations, could lead a contracting officer to either (1) deny a prime contractor the right to compete for a federal contract; or (2) remove a prime contractor or subcontractor from an ongoing project. Such determinations would be made on an individual contracting officer basis with assistance from newly-created agency labor law compliance advisors. CAWV ANNUAL MEETING REGISTRATION PACKETS TO BE SENT NEXT WEEK The CAWV Program Committee will meet next week to finalize arrangements for the 2016 CAWV Annual Meeting, which will be held July 14-17 at The Greenbrier. “We will announce an exciting lineup of speakers and programs next week,” said Program Committee Chairman Doug Meeks. “Members will want to attend this year’s meeting to learn about the future direction of the State of West Virginia and how that will impact contractors, subcontractors and suppliers.” The Greenbrier has sold out of rooms the past three annual meetings. WVU PLANS EXPANSIONS AND IMPROVEMENTS AMID STATE FUNDING LIMBO
This week, West Virginia University announced a feasibility study regarding the potential renovation of the Mountainlair (built in 1968 and last renovated in 1989), despite the fact that lawmakers and Gov. Tomblin are faced with a $270 million budget hole in the budget year that begins July 1. With a state budget still in limbo and projected shortfalls growing with each report from Charleston, West Virginia University continues to consider costly investment, improvement and expansion. A recent report recommended that universities facing budget blows, in part, should “create public-private partnerships to sustain and strengthen research and education for the future.” WVU has already developed three housing facilities through public-private partnerships and expects a new aquatics center to be constructed by the same means. The Washington D.C. firm Brailsford & Dunlavey is expected to return study results to university leaders in October. WVU’s Board of Governors also approved recently the construction of a $2.3 million dollar engineering lab at the recently acquired Beckley campus while closing facilities in Montgomery. The lab construction is expected to be covered with WVU Research Corporation borrowed funds. WEIRTON FIRE STATION FAÇADE REPLACEMENT Bids will be accepted until 11:00 AM on 5/13/2016 for the replacement of a façade on the Weirton Fire Station. PREVENTING BACKOVERS
Road construction workers face many hazards on the job. In addition to many of the hazards present on a “traditional” construction site, road workers also need to contend with moving vehicles both in and around the job site. From 1995 through 2002, 844 fatal occupational injuries occurred at road construction sites. The majority of these fatalities, 693 (82%) cases, were reported to be transportation incidents. Fatalities involving a ground worker being struck by a vehicle or equipment accounted for 509 (73%) of the transportation incidents. Victims were as likely to be struck by construction equipment (32%) as by highway vehicles (28%). The leading cause of fatalities for workers in work zones is being run over or backed over by construction equipment. While we often worry about construction workers being killed by motorists, road workers working behind the barriers in the work zone are at equal risk of being killed by construction vehicles due to their large “blind spots.” Each month, at least one worker is killed by being backed over by a construction vehicle, often a dump truck. These deaths are completely preventable. One way to prevent these fatalities is to implement traffic patterns on jobsites to reduce the amount of backing up that is necessary and minimize the exposure of workers on foot to vehicles. This is called developing an Internal Traffic Control Plan or ITCP. There is also a lot of new technology to help prevent workers from being struck such as cameras, radar, and wearable back up alarms. AGC SUCCESSFUL IN ADVANCING CLEAN WATER TRUST FUND AND OTHER WATER INFRASTRUCTURE PROVISIONS IN SENATE WRDA BILL
AGC and its industry coalition partners in the Water Infrastructure Network have been working for a number of months to get significant water infrastructure provisions included in the 2016 Water Resources Development Act (WRDA) in the Senate. They were successful in getting many important provisions approved by the Committee. The bill creates a longtime AGC priority, a Clean Water Trust Fund, and, while this bill itself does not carry additional funding, it authorizes voluntary contributions to the trust fund. Creation of a trust fund dedicated to water infrastructure opens many new possibilities for future dedicated revenue prospects. Other provisions of note include State Revolving Fund and Water Infrastructure Financing and Innovation Act funding for cities with declared lead in water emergencies (like Flint, Mich.), reauthorizing sewer overflow control grants, new funding for technical assistance to small treatment plants, Safe Drinking Water Act compliance assistance for small disadvantaged communities, reauthorizing funding for desalination, and assistance for low-income residents when replacing lead service lines to homes. This builds on the success in getting water infrastructure provisions inserted in the Conference process in the last WRDA bill in 2014. AGC will continue to advocate for this legislation as it advances to the Senate floor. PIPELINE SAFETY BILL CLEARS HOUSE COMMITTEE
The House Transportation and Infrastructure Committee approved legislation to reauthorize the Pipeline and Hazardous Materials Safety Administration (PHMSA) and advance the cause of pipeline safety. H.R. 4937, the Protecting our Infrastructure of Pipelines and Enhancing Safety (PIPES) Act of 2016, is a four-year reauthorization that improves pipeline safety by closing gaps in federal standards. It is also designed to enhance the quality and timeliness of agency rulemakings, promote better usage of data and technology to improve pipeline safety, and provide regulatory certainty for citizens, the safety community, and the industry. The legislation was reported unanimously out of Committee for future consideration by the full House. During the committee markup process, amendments were offered that would apply new, extremely restrictive “Buy America” requirements on all pipelines permitted by PHMSA. They would establish a database that tracks the origin of pipelines put in place but defines foreign materials far too broadly. AGC weighed in with lawmakers, noting opposition to what would have been the most restrictive definition of American iron and steel at the federal level to date. The requirements would have mandated that all steel processes, including melting and pouring, take place in the US. Furthermore, the iron ore that comprises said iron and steel would have to be mined in the US. Both amendments ultimately failed to meet approval and did not make it into the final bill. SENATE APPROPRIATIONS COMMITTEE APPROVES FY2017 THUD BILL
The Senate Appropriations Committee has approved the fiscal year 2017 Transportation, Housing and Urban Development, and Related Agencies (THUD) Appropriations Bill that includes $16.9 billion in discretionary spending for the U.S. Department of Transportation (USDOT). The annual bill, which was approved 30-0, provides the discretionary spending amounts and authorizes funding for the Highway Trust Fund, among other USDOT programs. The Senate Transportation, Housing and Urban Development, and Related Agencies
Appropriations Subcommittee had previously approved the measure.
“It is important that we responsibly determine where to use limited taxpayer funding to improve the nation’s infrastructure, promote community economic growth and address housing needs,” said Senate Appropriations Committee Chairman Thad Cochran (R-Mississippi). “Senators Collins (R-Maine) and Reed (D-Rhode Island) met this challenge admirably, and I recommend
this bill to the Senate for consideration.”
USDOT will get $16.9 billion in discretionary appropriations under the bill, which allows funding to be prioritized on programs that “make transportation systems safe, efficient, and reliable.” The bill allows for $44 billion for the Highway Trust Fund “consistent with the recently-enacted surface transportation authorization bill, the FAST Act.” It also allows state departments of transportation to “repurpose old, unused earmarks for more important infrastructure projects.”
The Transportation Investment Generating Economic Recovery (TIGER) grant program is getting a boost of $25 million to $525 million under the bill. This would be the eight round of
funding for the program.
