(b) Functions of the Secretary of Commerce and the Secretary of Agriculture Tranfwerred to tle Secretary of State; Exceptione.-The fune- tions of the Secretary of Commerce with respect to the Foreign Commerce Service and the functions of the Secretary of Agriculture with respect to the Foreign Agricultural Service (other than functions with respect to such services pertaining to activities in the United States and to the compilation, publication and dissemination of information) are hereby transferred to, and shall be exercised by, the Secretary of State, except and provided that under regulations pre- scribed y the President- (1) The Secretary of State shall bause to be made such investi- gations relating to commercial and industrial conditions and activities in foreign countries and such other specific investiga- tions relating to foreign commerce as the Secretary of Commerce shall determine to be in the public interest, and shall report to the Secretary of Commerce the results of, and the information secured through, such investigations. He shall also cause to be made such investigations relating to world competition and demand for agricultural products, to production, marketing and disposi- tion of such products in foreign countries, and to larm manage- ment and other phases of agricultural industry in foreign countries, and shall conduct abroad such activities (including the demon- stration of standards for cotton wheat, and other American agricultural products), as the secretary of Agriculture shall determine to be in the public interest, and shall report to the Secretary of Agriculture the results of, and the information secured through, such investigations and activities. (2) The Secretary of Commerce may from time to time when he deems it in the public interest designate any officer in his De-. partment to render temporary service under the provisions of and subject to the conditions named in, section 5 of the Act of March 3, 1927, (44 Stat. 186). 1431. PART 1.-DEPARTMENTS

SECTIoN 1. State Department.-Transfers and consolidations relat-ing to the Department of State are hereby effected as follows:

(a) Foreigni Commerce Service and Foreign Agriculural Service.-The Foreign Commerce Service of the United States and its functionsin the Bureau of Foreign and Domestic Commerce of the Departmentof Commerce and the Foreign Agricultural Service of the UnitedStates and its functions as established by the Act of June 5, 1930 (46Stat. 4?0), in the Department of Agricuture are hereby transferredto the Department of State and shall be consolidated with andadministered as a part of the Foreign Service of the United Statesunder the direction and supervision of the Secretary of State.

(4) Federal Prison Industries, JInc.-The Federal Prison IndustriesInc. (together with its Board of Directors) and its functions are herebytransferred to the Department of Justice and shall be administeredunder the general direction and supervision of the Attorney Qeneral,

(b) National Training School for Boi.-The National TrainingSchool for Boys and its functions (including the functions of its Boardof Trustees) are hereby transferred to the Department of Justice andshall be administered by the Direetor of the Bureau of Prisons, underthe direction and supervision of the Attorney General.

SEC. 4. Department of the fiterior.-Transfors, consolidations, andabolition relating to the Department of" the Ifiterior are hetbbyeffected as follows:

(a) Functions of the National Bituminous Coal Commission Trans-ferred.-The functions of the National Bituminous Coal Commission i(including the functions of the members of the Commission) are hereby ttransferred to the Secretary of the Interior to be administered underhis direction and supervision by such division, bureau, or office in theDepartment of the Interior as the Secretary shall determine.

(b) National Bituminous Coal Commission Abolished.-The NationalBituminous Coal Commission and the offices of the members thereofare hereby abolished and the outstanding affairs of the Commissionshall be wound up by the Secretary of the Interior.

(c) Office of Consumers' Counsel Abolished and Functions Trans-ferred.-The office of Consumers' Counsel of the National Bitumipous anCoal Commission is hereby abolished and its functions are transferred tto, and shall be administered in, the Office of the Solicitor of the De-partment of the Interior under the direction and supervision of theSecretary of the Interior.

(d) Bureau of Insular Affaire.-The Bureau of Insular Affairs of the AWar Department and its functions are hereby transferred to theADepartment of the Interior and shall be consolidated with the Divisionof Territories and Island Possessionsin the Department of the Interiorand administered in such Division under the direction and supervisionof the Secretary of the Interior. The office of the Chief of the Bureauand offices subordinate thereto provided for in section 14 of the Act 181'of June 4, 1920 (41 Stat. 769), are hereby abolished and all of the 4functions of such offices are transferred to, and shall be exercised by,the Director of the Division of Territories and Island Possessions.

(e) Bureau of Fi8heries.-The Bureau of Fisheries in the Depart- ment of Commerce and its functions are hereby transferred to theDepartment of the Interior and shall be administered in that Depart-ment under the direction and supervision of the Secretary oftheInterior. The functions of the Secretary of Commerce relating to theprotection of fur seals and other fur-bearing animals, to the supervisionof the Pribilof Islands and the care of the natives thereof and to theWhaling Treaty Act, are hereby transferred to, and shall ie exercisdby, the Secretary of the Interior.

Bureau of Biological Survey.-The Bureau of Biological Survey th eDepartment of Agriculture and its functions are hereby trans- sferred to the Department of the Interior and shall be administered ihthat Department under the direction and supervision of the Secretary

(i) Mount Ruehmore National Memorial Commiesion.-The MountRushmore National Memorial Commission and its functions are herebytransferred to the National Park Service in the Department of theInterior. The functions vested in the Commission by section 3 and4 (&) of the Act of June 15, 1938, (e. 402, 52 Stat. 694) shall continueto be exercised by the Commission. All other functions of the MountRushmore National Memorial Commission shall be administered bythe National Park Service under the direction and supervision. of theSecretary of the Interior.

SEO. 5. Department of Agriculture: Rural Eleer~faion Adminie-tration T'raserred.-The Rural Electrification Administration and itsfunctions and activities are hereby transferred to the Department ofAgriculture and shall be administered in that Department by theAdministrator of the Rural Electrification Administration under thegeneral direction and supervision of the Secretary of Agriculture.

SEo. 6. Department of Commerce: Transfer of Inland WaterwaysCorporation.-The Inland Waterways Corporation and all of its func-tions and obligations are hereby transferred to the Department ofCommerce and shall be administered in that Department under thesupervision and direction of the Secretary of Commerce. The capitalstock of the Corporation shall continue to be held for the UnitedStates by the Secretary of the Treasury, but all other functions, rightsprivileges, and powers and all duties and liabilities of the Secretary ofWar relating to the Inland Waterways Corporation are hereby trans-ferred to, and shall be exercised, performed and discharged by, theSecretary of Commerce. The Secretary of commerce shall be sAbsti-tuted for the Secretary of War as, and shall be deemed to be, theincorporator of the Inland Waterways Corporation.

PAnT 2.-INDEPENDENT AGENCIES

SECTIoN 201. Federal Seourity Agency.-Transfers and consolida-tions relating to the Federal Security Agency are hereby effected asfollows:

(a) Radio Seroice and United States Film service Traferred.-Thefunctions of the Radio Division and the United States FilmServiceof- the National Eereney Conill are hereby transferred to the

Federal Security Agency and shall be administered in the Office ofEducation under the direction and supervision of the Federal SecurityAdministrator.

(b) American Printing House for the Blind.-The functions of theSecretary of the Treasury with respect to the administration of theappropriations for the American Printing House for the Blind (exceptthe function relating to the perpetual trust fund) are hereby trans-ferred to the Federal Security Agency and shall be administeredunder the direction and supervision of the Federal Security Adminis-trator. The annual report and vouchers required to be furnishedto the Secretary of the Treaury by the trustees of the AmericanPrinting House for the Blind shall be furnished to the Federal SecurityAdministrator.

SEQ. 202. National Arcives.-Transfers, consolidations and aboli-tions relating to the National Archives are hereby effected as follows:

(a) Funcions of Codefication Board Tranferred.-The functions ofthe Codification Board, established by the Act of June 19, 1937 (50Stat. 804), are hereby transferred to the National Ardhives and shallbe consolidated in that ageno with the functions of the Division ofthe Federal Register and shall be administered by such Division underthe direction and supervision of the Archivist.

(b) Codication Board Abolished.-The Codification Board is herebyabolished and its outstanding affairs shall be wound up by the Archi-vist through the Division of the Federal Register in the NationalArchives.

PART 8.-EXECUTIVE OFFICE OF THE PRESIDENT

SECTION 301. Transfers and abolitions relating to the ExecutiveOffice of the Pxesident are hereby effected as follows:

(a) Functions of, Naional Emergency Council Transferred.-Allfunctions of the National Emergency Council other than those relatingto Radio Service and Film Service (transferred by section 201(a) ofthis plan to the Federal Security Ageney) are hereby transferred tothe Executive Office of the President and shall be administered underthe direction and supervision of the President.

(6) National Emergency Council Abolished.-The National Emer-gency Council is hereby abolished and its outstanding affairs shall bewound up under the direction and supervision of the President.

PART 4.-GENERAL PROVISIONS

SEC. 401. Transer of Funedion of Heads of Departments--Exceptas otherwise provided in this Plan, the functions of the head of anyDepartment relating to the administration of any agency or functiontransferred from his Department by this Plan, are hereby transferred

to, and shall be exercised by, the head of the department or agencyto which such transferred agency or function is transferred bythisPlan.

SEo. 402. the administration of the functions transferred to his department oragency shall be retransferred under existing law to other positions inthe Government service, or separated from the service subject to theprovisions of section 10 (a) of the Reorganization Act of 1939.

SEC. 403. TraOfe of Funds.-So much of the unexpended balancesof appropriations, allocations, or other funds available for the use ofany agency in the exercise of any function transferred by this Plan, orfor the use of the head of any department or agency in the exercise ofany function so transferred, as the Director of the Bureau of theBudget with the approval of the President shall determine, shall betransferred to the department or agency concerned for use in connee-tion with the exercise of the function so transferred. In determiningthe amount to be transferred the Director of the Bureau of theBudget may include an amount to provide for the liquidation ofobligations incurred against such appropriations, allocations, or otherfunds prior to the transfer: Provide, That the use of the unexpendedbalances of approprations, allocations, or other funds transferred bythis section shall be subject to the provisions of section 4(d)(3) andsection 9 of the Reorganization Act of 1939.

SEC. 404. Transfer of Functions Relating to Personnel.-Except asprohibited by section 3(b) of the Reorganization Act of 1939, allfunctions relating to the appointment, x of compensation, trans-fer, promotion, demotion, suspension, or dismissal of persons to orfrom offices and positions in any department vested by law in anyofficer of such department other than the head thereof are herebytransferred to the head of such department and shall be administeredunder his direction and supervision by such division, bureau, office,or persons as he shall determine.
