1 Purpose Objectivo

STANDARD 100 by OEKO-TEX® is a normative document, publishedby the International Association for Research and Testing in the fieldof Textile Ecology (OEKO-TEX®) to which the institutes listed in Ap-pendix No. 1 belong to.

O STANDARD 100 by OEKO-TEX® é um documento normativo, pu-blicado pela Associação Internacional para a Investigação e Análisesno Domínio da Ecologia Têxtil (OEKO-TEX®) à qual pertencem osinstitutos constantes do anexo 1.

If there is a discrepancy in interpretation of the two languages inthis document, then the German (or English) language has priority.

This Standard specifies the general and special conditions for grant-ing authorisation to mark textiles with the STANDARD 100 by OEKO-TEX® mark as shown in Appendix No. 2.

Esta norma define as condições gerais e especiais relativas à atri-buição da autorização para o uso do rótulo STANDARD 100 by OE-KO-TEX®, apresentado no anexo 2.

2 Applicability Campo de Aplicação

This standard is applicable for textile and leather products and arti-cles of all levels of production, including textile and non-textile ac-cessories.

Esta norma é aplicável a produtos e artigos têxteis e de couro emtodos os estados de transformação, incluindo acessórios têxteis enão têxteis.

This standard is also applicable to mattresses, feathers and downs,foams, upholstery and other materials with similar characteristics

Esta norma é também aplicável a colchões, penas e penugens, es-pumas, estofos e outros materiais de características similares.

This standard is not applicable for chemicals, auxiliaries and dyes. Esta norma não se aplica a produtos químicos, auxiliares e coran-tes.

3 Terms and definitions Termos e Definições

3.1 Harmful substances Substâncias nocivas

Harmful substances within the context of this standard refer to sub-stances which may be present in a textile product or accessory andexceed a maximum amount or which evolve during normal and pre-scribed use and exceed a maximum amount, and which may havesome kind of effect on people during normal and prescribed use andmay, according to current scientific knowledge, be injurious to hu-man health.

No contexto desta norma, são consideradas substâncias nocivas to-das aquelas que se encontram presentes num produto têxtil ouacessório em quantidade superior ao limite definido ou ainda que,durante o seu uso normal, se formem em quantidade superior à de-finida. Consideram-se ainda como nocivas aquelas que possam pro-vocar algum tipo de efeito sobre o homem e que de acordo com oconhecimento científico actual sejam prejudiciais à saúde humana.

3.2 STANDARD 100 by OEKO-TEX® mark O Rótulo STANDARD 100 by OEKO-TEX®

The STANDARD 100 by OEKO-TEX® mark "Confidence in Textiles -Tested for harmful substances according to STANDARD 100 byOEKO-TEX®" refers to marking which may be applied to a textileproduct or to an accessory if the general and special conditions forgranting authorisation are fulfilled and if authorisation to use thismark on a product has been granted by an institute or an authorisedcertification agency (Appendix 1) belonging to the International As-sociation for Research and Testing in the field of Textile Ecology(OEKO-TEX®).

O rótulo STANDARD 100 by OEKO-TEX® "Confiança nos Têxteis -Testado a substâncias nocivas segundo STANDARD 100 by OEKO--TEX®" refere-se a um rótulo que pode ser aplicado a um produtotêxtil ou acessórios, se as condições gerais e especiais forem satis-feitas e se a autorização para a utilização deste rótulo for concedidapor um dos Institutos ou por um Organismo de Certificação autoriza-do (anexo 1) pertencentes à Associação Internacional para a Investi-gação e Análises no domínio da Ecologia Têxtil (OEKO-TEX®).

The mark "Confidence in Textiles - Tested for harmful substancesaccording to STANDARD 100 by OEKO-TEX®" states that themarked product fulfils the conditions specified in this standard, andthat the product and its conformity test, as specified in this stand-ard, are under the supervision of an institute belonging to the Inter-national Association for Research and Testing in the field of TextileEcology (OEKO-TEX®).

O rótulo "Confiança nos Têxteis - Testado a substâncias nocivas se-gundo STANDARD 100 by OEKO-TEX®" indica que o produto satis-faz as condições especificadas na presente Norma e ainda que oproduto e os testes de conformidade, segundo a presente norma,estão sob a supervisão de um instituto pertencente à Associação In-ternacional para a Investigação e Análises no Âmbito da EcologiaTêxtil (OEKO-TEX®).

The mark "Confidence in Textiles - Tested for harmful substancesaccording to STANDARD 100 by OEKO-TEX®" is not a quality label.The mark relates only to the as-produced state of the textile andsays nothing about other properties of the product such as e.g. fit-ness for use, reaction to cleaning processes, physiological behav-iour in respect of clothing, properties relating to use in buildings,burning behaviour etc. Furthermore the mark does not declare any-thing regarding other quality or legal aspects, such as product safe-

The mark does not declare anything about harmful substances af-fecting single specimens of the marked textile as a result of damageduring transportation or storing (and improper cleaning proceduresthereafter), contamination caused by packaging, manipulation forsales promotion (e.g. perfuming) and inadequate sales display (e.g.outdoor presentation).

O rótulo também não dá qualquer indicação relativa às contamina-ções com substâncias nocivas que possam ter afectado um artigoindividual rotulado, como resultado de deteriorações no transporteou armazenamento (e duma limpeza subsequente não conforme),contaminação introduzida para promoção de vendas (por exemploaplicação de perfumes) ou uma deficiente exposição para venda(por exemplo, exposição ao ar livre).

In line with its importance the sign „Confidence in Textiles – Testedfor harmful substances according to STANDARD 100 by OEKO-TEX®“ is protected comprehensively as a trademark. On a world-wide basis there are applications or registrations of the label as atrademark. To strengthen its legal protection not only the label assuch, but also various device elements (e.g. the globe device ele-ment) and the words Oekotex, Oeko-tex®, or OEKO-TEX® are reg-istered as separate trademarks.

De acordo com a sua importância, a etiqueta "Confiança nos Têxteis- Testado a substâncias nocivas segundo STANDARD 100 by OEKO--TEX®" é protegida enquanto marca registada. Mundialmente exis-tem pedidos ou registos da etiqueta como marca registada. Para in-tensificar a sua protecção legal são registadas como marcas sepa-radas não só a etiqueta tal como ela é, mas também os diferenteselementos que a compõem (por exemplo o desenho do globo) etambém os termos Oekotex, OEKO-TEX ou OEKO-TEX®.

3.3 Manufacturer Fabricante

The manufacturer of a textile product and/or of accessories for thetextile product is the company producing the product or the compa-ny on behalf of which the product is being manufactured.

O fabricante de um produto têxtil e/ou acessórios é a empresa quefabrica o produto ou a empresa responsável pela ordem de fabrico.

3.4 Distributor Distribuidor

The distributor of a textile product and/or of accessories for thetextile product refers to the company selling the product as whole-sale dealer or retailer (department stores, mail-order houses, etc.).

O distribuidor de um produto têxtil e/ou acessórios é a empresa quevende os produtos como comerciante grossista ou retalhista (gran-des lojas, empresas de venda por correspondência, etc.).

3.5 Designation of product Designação do produto

The designation of the product is the name given by the manufac-turer or distributor on his labelling of the product.

A designação do produto é o nome atribuído pelo fabricante ou pelodistribuidor ao produto a certificar.

3.6 Article group Grupo de artigos

An article group is basically a combination of several articles in agroup which may be covered in the same certificate, e.g.

Um grupo de artigos é basicamente uma combinação de vários arti-gos num grupo que podem estar cobertos pelo mesmo certificado,como por exemplo:

• Textiles with physical differences only, made from well definedbasic materials

• Têxteis que apenas diferem nas características físicas e produzi-dos a partir de matérias primas bem definidas.

• Articles which are physically composed of certified products only • Artigos que são produzidos apenas com produtos certificados(utilizando processos físicos).

• Finished textiles from the same kind of fibre material (for examplethose made from cellulosic fibres, mixtures of PES and CO, ofsynthetic fibres, etc.)

• Têxteis acabados a partir do mesmo tipo de fibra (por exemplofibras celulósicas, misturas de poliéster e algodão, fibras sintéti-cas, etc.).

3.7 Product classes Classes de produtos

A product class in the context of this standard is a group of differentarticles categorised according to their (future) utilisation. In the dif-ferent product classes not only may finished articles be certified butalso their components at all stages of manufacture (fibres, yarns,fabrics) and accessories. The product classes differ generally in therequirements that the products have to fulfil and by the test meth-ods applied.

Uma classe de produtos, no contexto desta norma, é um grupo dediferentes artigos classificados de acordo com a sua utilização. Nasdiferentes classes de produto podem ser certificados não só os pro-dutos acabados mas também os seus componentes em qualquerestado de transformação (fibras, fios, tecidos) e acessórios. As clas-ses de produto diferem de um modo geral nos requisitos a cumprirpelos produtos e nos métodos de ensaio aplicados.

3.7.1 Products for babies (Product Class I) Produtos para bebé (Classe de produtos I)

tion of articles for babies and children up to the age of 36 monthswith the exception of leather clothing.

3.7.2 Products with direct contact to skin (Product Class II) Produtos em contacto directo com a pele (Classe de produtos II)

Articles with direct contact to skin are those, which are worn with alarge part of their surface in direct contact with the skin (e.g. blou-ses, shirts, underwear, matressses etc.).

Os produtos em contacto directo com a pele são todos os artigosque durante o uso uma grande parte da sua área está em contactodirecto com a pele. (exemplo: blusas, camisas, roupa interior, col-chãos etc.).

3.7.3 Products without direct contact to skin (Product ClassIII)

Produtos que não estão em contacto directo com a pele (Classe deprodutos III)

Articles without direct contact to skin are those, which are wornwith only a little part of their surface in direct contact with the skin(e.g. stuffings, etc.)

Os produtos que não estão em contacto directo com a pele são to-dos os artigos que durante o uso apenas uma pequena área está emcontacto directo com a pele. (exemplo: enchimentos, etc.).

3.7.4 Decoration material (Product Class IV) Material de decoração (Classe de produtos IV)

Decoration material in the context of this standard are all articles in-cluding initial products and accessories which are used for decora-tion such as table cloths, wall coverings, furnishing fabrics and cur-tains, upholstery fabrics, and floor coverings.

O material para decoração, no contexto desta norma, são todos osartigos, incluindo produtos iniciais e acessórios que são utilizadospara decoração como por exemplo toalhas de mesa, revestimentosde parede, tecidos para o mobiliário e cortinas, tecidos para decora-ção e revestimentos de chão.

3.8 Active chemical products Produtos químicos activos

Active chemical products in the context of this standard are all prep-arations that are incorporated into the fibre material or are applied ina later processing step to the textile product. Special requirementsfor the use of this kind of products exist for following definitions.

Produtos químicos activos, no contexto desta norma, são todos osprodutos que são incorporadas nas fibras ou que são aplicadas aoproduto têxtil durante o processamento. Existem requisitos especi-ais para a utilização deste tipo de tratamentos nas seguintes aplica-ções:

3.8.1 Biological active products Produtos biologicamente activos

Biological active products in context of this standard are those ac-tive chemical products that are used with the intention to destroy,deter, render harmless, prevent the action of, or otherwise exert acontrolling effect of any organism by chemical or biological means.

Produtos biologicamente activos no contexto desta norma são pro-dutos químicos activos utilizados com a intenção de destruir, deter,tornar inofensivo, prevenir a acção de, ou exercer um efeito contro-lador em qualquer organismo através de meios químicos ou biológi-cos.

3.8.2 Flame retardant products Produtos ignífugos

Flame retardant products in context of this standard are those activechemical products that are used with the intention to reduce theflammability and/or combustibility.

Produtos ignífugos no contexto desta norma são produtos químicosactivos utilizados com a intenção de reduzir a inflamabilidade e/ou acombustibilidade.

4 Conditions Condições

4.1 Product specific requirements Exigências específicas para os produtos

In addition to the general requirements for certification according toSTANDARD 100 by OEKO-TEX®, the product specific requirements,given in Appendix 4, have to be fulfilled by each component. Thisapproach is also valid for untypical textile products such as furni-ture, cradles, pushchairs, beds, and so on.

Além das exigências gerais para a certificação de acordo comSTANDARD 100 by OEKO-TEX®, as exigências específicas definidasno anexo 4 terão de ser cumpridas por cada um dos componentesindividuais. Esta abordagem também é válida para produtos têxteisatípicos tais como mobiliário, berços, carrinhos de bebé, camas,etc.

For new or more severe requirements an interim arrangement isvalid until 1 st of April 2016.

Para novos parâmetros ou para limites mais restritivos, estabelece--se um período de transição até 1 de Abril de 2016.

4.2 Requirements regarding the use of biological activeproducts

Exigências relativas à utilização de produtos biologicamente activos

When using biological active products it is distinguished between fi-bre materials where the biological active agents are incorporated in-to the fibres and a treatment of textiles with biological active prod-ucts in a later processing step.

Quando se usam produtos biologicamente activos eles são distin-guidos entre produtos biologicamente activos incorporados nas fi-bras e produtos biologicamente activos utilizados no tratamento detêxteis durante o seu processamento.

4.2.1 Fibre materials with biological active properties Fibras com propriedades biologicamente activas

Fibre materials with biological active properties are accepted for acertification according to STANDARD 100 by OEKO-TEX® when anassessment by OEKO-TEX® reveals, that these fibres may be usedfrom a human-ecological point of view without any restrictions.

As fibras com propriedades biologicamente activas são aceites nu-ma certificação de acordo com STANDARD 100 by OEKO-TEX®,quando uma avaliação pela associação OEKO-TEX® revele que asfibras podem ser usadas, do ponto de vista da ecologia humana,sem quaisquer restrições.

4.2.2 Finish with biological active products Acabamentos com produtos biologicamente activos

Finishes with biological active products are accepted within a certifi-cation according to STANDARD 100 by OEKO-TEX® when a thor-ough assessment by OEKO-TEX® from a human-ecological point ofview has shown that the finish carried out according to the recom-mendations of the manufacturer of the product are harmless to thehuman health.

Acabamentos com produtos biologicamente activos são aceites nu-ma certificação de acordo com STANDARD 100 by OEKO-TEX®,sempre que a avaliação pela associação OEKO-TEX® do ponto devista da ecologia humana mostrar que o acabamento quando efec-tuado de acordo com as recomendações do fabricante do produto éinofensivo para a saúde humana.

4.3 Requirements regarding the use of flame retardantproducts

Exigências relativas à utilização de produtos ignífugos

When using flame retardant products it is distinguished between fi-bre materials which receive the flame retardant properties in thespinning mass already (copolymers, additives) and a finish withflame retardant products in a later processing step.

Quando se utilizam produtos ignífugos existe uma distinção entre asfibras que recebem as propriedades ignífugas na massa (copolíme-ros, aditivos) e um acabamento com produtos ignífugos numa fasede processamento.

4.3.1 Fibre materials with flame retardant properties Fibras com propriedades ignífugas

Fibre materials with flame retardant properties are accepted for acertification according to STANDARD 100 by OEKO-TEX®, productclasses I to IV, when an assessment by OEKO-TEX® reveals, thatthese fibres may be used from a human-ecological point of viewwithout any restrictions.

As fibras com propriedades ignífugas são aceites numa certificaçãode acordo com STANDARD 100 by OEKO-TEX®, para as classes deprodutos de I a IV, quando uma avaliação pela associação OEKO--TEX® revele que as fibras podem ser usadas, do ponto de vista daecologia humana, sem quaisquer restrições.

4.3.2 Finish with flame retardant products Acabamentos com produtos ignífugas

Finishes with flame retardant products are accepted within a certifi-cation according to STANDARD 100 by OEKO-TEX®, productclasses I to IV, when a thorough assessment by OEKO-TEX® from ahuman-ecological point of view has shown that the finish carried outaccording to the recommendations of the manufacturer of the prod-uct are harmless to the human health.

Acabamentos com produtos ignífugos são aceites numa certificaçãode acordo com STANDARD 100 by OEKO-TEX®, para as classes deprodutos de I a IV, quando uma avaliação pela associação OEKO--TEX® do ponto de vista da ecologia humana mostrar que o acaba-mento efectuado de acordo com as recomendações do fabricantedo produto é inofensivo para a saúde humana.

4.4 Application Pedido de certificado

The application for the granting of authorisation to use the STAND-ARD 100 by OEKO-TEX® mark has to be made in writing on the re-spective application form to an institute or a certification agency ofthe International Association for Research and Testing in the field ofTextile Ecology (OEKO-TEX®). (See Appendix 1).

O pedido de autorização para o uso do rótulo STANDARD 100 by OE-KO-TEX® deverá ser formulado em impresso próprio a um dos Ins-titutos membros, ou a uma das agências de certificação, da Asso-ciação Internacional para a Investigação e Análises no Âmbito daEcologia Têxtil (OEKO-TEX®). (Ver Anexo 1).

4.5 Sample material Amostragem

For test purposes and as a reference the applicant should provide asufficient and representative sample of the product submitted forcertification. This is also the case for an application for renewal ofthe certificate.

O requerente deverá fornecer uma amostra, em quantidade sufici-ente e representativa, do produto destinado à certificação. Isto tam-bém se aplica no caso de um prolongamento de um certificado.

The packing instruction should be observed (see Appendix 3). As instruções de embalagem das amostras deverão ser respeitadas(ver anexo 3).

4.6 Declaration of commitment Declaração de compromisso

The applicant's declaration of commitment together with the appli-cation form are to be duly signed and must contain the followingpoints:

A declaração de compromisso deve acompanhar o pedido de certifi-cado e deverá ser devidamente assinada e conter os seguintes pon-tos:

• Liability for the details specified in the application. • Responsabilidade pelas indicações fornecidas no pedido.

• Commitment to notify the body, who granted the authorisation touse the mark, of any alteration regarding raw materials, technicalprocedures and recipes.

• Compromisso em notificar a organização que autoriza a utilizaçãodo rótulo, no caso de haver alteração em relação à matéria pri-ma, procedimentos ou processos técnicos.

• Commitment to ensure that no further marking of the producttakes place after the expiration or withdrawal of the authorisationto use the mark.

• Compromisso em assegurar que não será usado o rótulo no pro-duto após a expiração ou revogação da autorização.

4.7 Testing Ensaios

The sample material provided by the applicant, and likewise speci-mens taken at the place of manufacture, are tested by the instituteconcerned. Type and scope of testing are determined by theinstitute and depend on the type of product and on the informationabout the product, provided by the applicant.

As amostras fornecidas pelo requerente e as amostras recolhidas nolocal de fabrico são ensaiadas pelo Instituto que recebeu o pedidode certificado ou de prolongamento de certificado. A natureza e aquantidade de ensaios a efectuar são determinados pelo Instituto edependem do tipo de produto e da informação que o requerente for-nece acerca deste.

Test specimens having a non product typical odour (for example fra-grance/perufme) or an odour indicating faulty manufacture, will beexcluded from testing and no authorisation to mark these productswith the STANDARD 100 by OEKO-TEX® mark will be granted.

As amostras para ensaio com um odor não típico do produto (porexemplo fragâncias/perfumes) ou um odor que indique anomaliasna produção, serão excluídas dos ensaios e não será concedida au-torização para rotular esses produtos com STANDARD 100 by OE-KO-TEX®.

In general all individual components of an article have to be tested. Em geral todos os componentes individuais de um artigo têm queser testados.

Fibre compositions of samples may be cross-checked qualitativelyagainst information from the application, related documents anddeclarations. These tests are charged to the applicant.

A composição das fibras das amostras pode ser confirmada qualita-tivamente para comparação com as informações fornecidas no pe-dido, documentos relacionados e declarações. Estes testes são co-brados ao requerente.

If the test of a component weighing less than 1 % of the total articleis not possible due to the limited amount contained in the article,then the institute decides on its own competence, taking into con-sideration the kind of article and its use, whether additional testingmaterial has to be sent in or whether the test can be dropped. Thedecision of the institute is not contestable.

Se, por escassez, não for possível efectuar a análise de um compo-nente têxtil que pese menos de 1,0% do peso total do artigo a sercertificado, é da competência do instituto a decisão de testar ou nãoesse componente, tendo em consideração o tipo de material e o seuuso. No caso de decidir testar, o instituto pedirá material suficientepara permitir a realização dos testes necessários. A decisão do ins-tituto é incontestável.

4.8 Quality control Controlo da qualidade

The applicant shall describe to the institute the precautions he hastaken within his company to ensure that all products manufacturedand/or sold for which the authorisation to use the mark „Confidencein Textiles - Tested for harmful substances according to STANDARD100 by OEKO-TEX®“ has been granted fulfil the conditions of theSTANDARD 100 by OEKO-TEX® in the same way as the samplesthat have been sent to the institute and based on those tests the au-thorisation has been granted. The applicant shall issue a declarationof conformity in accordance with ISO 17050-1 stating that the prod-ucts manufactured and/or sold by him fulfils the conditions in theSTANDARD 100 by OEKO-TEX®.

O requerente deverá apresentar ao Instituto as medidas preventivasque leva a cabo a fim de assegurar que todos os produtos fabrica-dos e/ou comercializados que possuam autorização para usar o ró-tulo "Confiança nos Têxteis - Testado a substâncias nocivas segun-do STANDARD 100 by OEKO-TEX®" estejam efectivamente de acor-do com as condições impostas pela referida norma e com as amos-tras que foram enviadas ao Instituto, com base nos quais foi dadaautorização para usar o rótulo "Confiança nos Têxteis - Testado asubstâncias nocivas segundo STANDARD 100 by OEKO-TEX®". 4.9 Quality assurance Garantia da qualidade

The applicant shall operate and maintain an effective quality assur-ance system to ensure that products manufactured and/or sold con-form with the test sample, thereby ensuring and proving to theOEKO-TEX® institute that the products, e.g. from different lots or ofdifferent colours, are spot-checked for compliance with the STAND-ARD 100 by OEKO-TEX®.

O requerente deverá implementar um sistema de qualidade eficazde forma a garantir que os produtos fabricados e/ou comercializa-dos estão de acordo com os produtos ensaiados. O sistema deveráassegurar por exemplo que produtos provenientes de diferentes lo-tes ou de diferentes cores sejam ensaiados por amostragem paraverificar a conformidade com STANDARD 100 by OEKO-TEX®.

During the certificate’s period of validity, the institute is authorisedto undertake two random tests on certified products. The testingcosts are chargeable to the certificate holder. If random testing re-veals a deviation from the limit values on which the tests are based,an additional test will be undertaken on a different sample as acheck. The relevant costs are likewise charged to the certificateholder. If further deviations are found, the testing institute may with-draw the authorisation to label products with the STANDARD 100 byOEKO-TEX® mark with immediate effect.

Durante o período da validade do certificado, o Instituto está autori-zado a efectuar duas amostragens aleatórias a produtos certifica-dos. Os custos dos ensaios serão pagos pelo utilizador do certifica-do. Se os testes aleatórios revelarem um desvio em relação aos va-lores limite, deverá ser efectuado um ensaio adicional numa outraamostra e os encargos inerentes são também suportados pelo utili-zador do certificado. Se os desvios se confirmarem, o Instituto podecancelar de imediato a autorização do uso do rótulo STANDARD 100by OEKO-TEX®.

Before or shortly after issuing the first certificate the institute willcheck on-site the quality assurance measures in reference to thecertification process according to STANDARD 100 by OEKO-TEX®.The institute is entitled to refuse or withdraw the certificate basedon the results from this audit. The charges of this package arecharged to the certificate holder. Each company needs to bechecked at least in a three year frequency. Companies being certi-fied according to STANDARD 100 by OEKO-TEX®0/STeP by OEKO-TEX® are audited regularly and in a shorter frequency in the contextof this certification scheme and are therefore exempted from theseadditional checks and contributions.

Antes ou logo após a emissão do primeiro certificado o Instituto iráverificar no local as medidas de garantia da qualidade no que res-peita ao processo de certificação de acordo com STANDARD 100 byOEKO-TEX®. O Instituto tem o direito de recusar ou retirar o certifi-cado com base no resultados desta auditoria. Os encargos destepacote são cobrados ao portador do certificado. Cada empresa ne-cessita de ser verificada pelo menos com uma frequência de 3anos. As empresas que estão certificadas de acordo com STAN-DARD 100 by OEKO-TEX®0/STeP by OEKO-TEX® são auditadas re-gularmente e com uma frequência menor no contexto deste planode certificação e são assim isentas destas verificações e pagamen-tos adicionais.

The applicant acknowledges, that auditors from the OEKO-TEX®Association are allowed to visit and audit the certified company inreference to the certification process according to STANDARD 100by OEKO-TEX®. In case of non-compliance with the STANDARD 100by OEKO-TEX® requirements, the cost for the analytical testing(control tests) and an audit fee have to be paid by the certificateholder.

O requerente aceita que os auditores da Associação OEKO-TEX®visitem e auditem a empresa relativamente ao processo de certifi-cação STANDARD 100 by OEKO-TEX®. No caso de serem detecta-das não conformidades com os requisitos STANDARD 100 by OEKO--TEX®, os custos dos ensaios analíticos (ensaios de controlo) e oshonorários da auditoria serão pagos pelo requerente.

4.10 Conformity Conformidade

The applicant who is either manufacturing or selling goods with anSTANDARD 100 by OEKO-TEX® mark must take sole responsibilityin declaring that the product manufactured or sold complies with thelimit values for harmful substances according to STANDARD 100 byOEKO-TEX®.

O requerente que fabrica ou comercializa um produto com o rótuloSTANDARD 100 by OEKO-TEX® assumirá inteira responsabilidadeao declarar que o mesmo produto satisfaz os valores limites relati-vos a substâncias nocivas impostos pelo STANDARD 100 by OEKO--TEX®.

Acknowledgement of the reliability of the quality assurance systemof the applicant is a requirement for granting permission to use theSTANDARD 100 by OEKO-TEX® mark.

O reconhecimento da credibilidade do sistema de garantia da quali-dade na empresa do requerente é um requisito obrigatório para aautorização do uso do rótulo STANDARD 100 by OEKO-TEX®.

The applicant is responsible for assuring the quality of the certifiedproduct. He may delegate parts of the quality assurance to manu-facturers, suppliers and importers. If he does so, again the effective-ness of the quality assurance system should be notified to thetesting institute.

Compete ao requerente assegurar a qualidade do produto certifica-do. Ele pode exigir a fabricantes, fornecedores e importadores queassegurem parte do sistema de qualidade. Neste caso, a credibili-dade do sistema de qualidade deve ser demonstrada ao organismoque concede a autorização para o uso do rótulo.

The declaration of conformity must be on the conformity declarationform provided by the OEKO-TEX® Association.

Para a declaração de conformidade deverá ser usado o impressopróprio fornecido pela Associação OEKO-TEX®.

5 Marking Rótulo

5.1 Granting of authorisation Concessão da autorização

If all the conditions of this standard are satisfied, if the tests do notdemonstrate any deviations from the details provided by the appli-cant and if the test values do not exceed the given limit values, acertificate will be issued, entitling the applicant to label his productsduring the period of validity with the STANDARD 100 by OEKO-TEX®mark.

Se todas as condições descritas na presente norma forem satisfei-tas, se os ensaios não revelarem desvios às informações fornecidaspelo requerente e se os valores não excederem os limites exigidosserá emitido um certificado que autoriza o requerente a usar o rótu-lo STANDARD 100 by OEKO-TEX® nos seus produtos, durante orespectivo prazo de validade.

In the case of the limiting values and/or the examination criteria al-tering, the validity of the respective certified products will remain ef-fective for a transition period until the expiration date of the certifi-cate. Once this period has elapsed, the prevailing conditions of re-newal must be fulfilled.

No caso de haver alteração aos valores limite e/ou aos critérios deensaio, aceita-se um período de transição até ao final da validadedo certificado. Após este período, passam a ser válidas as condi-ções em vigor na data de renovação.

5.2 Limit of authorisation Duração da validade da autorização

A certified article immediately loses its authorisation to be markedwith the OEKO-TEX® mark whenever any professional physical orchemical (incl. washing and cleaning) transformation of the productis performed.

Um artigo certificado perde imediatamente a autorização de ser ro-tulada com o logotipo OEKO-TEX® sempre que qualquer transfor-mação profissional física ou química (incluindo lavagem e limpeza)seja realizada.

The authorisation to mark a product with the STANDARD 100 byOEKO-TEX® mark is limited to a maximum of one year. During theperiod of validity of the certificate the test standards and limitingvalues relevant at the time of granting the authorisation are valid. Onrequest of the applicant the starting of the authorisation can bepostponed for at most three months from the date of the test report.

A autorização da utilização do rótulo "Confiança nos Têxteis - Testa-do a substâncias nocivas segundo STANDARD 100 by OEKO-TEX®"é limitada ao máximo de um ano. Durante o período de validade docertificado, os métodos de ensaio e os valores limite relevantes nomomento da execução dos testes com vista à atribuição do rótulopermanecem válidos. A pedido do requerente o início da validade daautorização pode ser adiada no máximo 3 meses a contar da emis-são do relatório.

After the authorisation period of the STANDARD 100 by OEKO-TEX®labelling has expired, the certificate holder is entitled to apply for arenewal of the authorisation for another year. The institute deter-mines a reduced testing programme for the 1st, 2nd, 4th, 5th etc.renewal.

Quando a validade do certificado expirar, o requerente pode solicitara renovação do certificado por mais um ano. O instituto define umnúmero de ensaios mais reduzido para o 1º, 2º, 4º, 5º etc. prolonga-mentos.

The expiry date of the renewed certificate is exactly one year afterthe expiry date of the previous one.

A nova data de validade do certificado renovado é exactamente umano após a data de fim da validade do certificado anterior.

As soon as the conditions stated in the application form are no lon-ger correct, the authorisation to mark the product with the STAND-ARD 100 by OEKO-TEX® labelling expires. This is the case, whenthe institute has not been informed about modifications and cannotconfirm whether the requirements of the STANDARD 100 by OEKO-TEX® are still satisfied.

Sempre que as condições declaradas no pedido deixarem de se ve-rificar a autorização para a utilização do rótulo expira, desde que oinstituto não tenha sido informado anteriormente das alterações epor isso não possa verificar o cumprimento dos requisitos exigidospelo STANDARD 100 by OEKO-TEX®.

5.3 Withdrawal of authorisation Cessação da autorização

The authorisation to use the mark will be withdrawn if it is deter-mined by means of production controls, market controls or othermethods that the details given by the applicant are not or no longercorrect or that amendment of the applied technical and/or manufac-turing conditions was not reported immediately.

A autorização do uso do rótulo cessará se, através do controlo efec-tuado na produção, no mercado ou de outra forma, se verificar queas informações fornecidas pelo requerente não são ou deixaram deser correctas ou quando se verificar que houve alterações introduzi-das no processo de fabrico que não foram imediatamente comuni-cadas.

Authorisation will also be withdrawn when the mark does not com-ply with the conditions of this standard.

A autorização cessará também se o rótulo usado não cumprir ascondições previstas nesta norma.

The use of existing advertising materials, displays, labels, etc. islimited to two months from the time of withdrawal.

O período máximo para utilização de materiais publicitários, marca-ção dos artigos, etiquetas, etc., é limitado a dois meses a contar dadata da revogação do certificado.

If a product continues to bear an unauthorised mark after withdraw-al of authorisation, the International Association for Research andTesting in the field of Textile Ecology is – after a second warning toabstain from marking – authorised to publish the withdrawal in asuitable form.

Se um produto continuar a ser rotulado depois da cessação da auto-rização a Associação Internacional para a Investigação e Análises noÂmbito da Ecologia Têxtil está autorizada, após um segundo avisoda proibição do uso do rótulo, a publicar de forma apropriada a ces-sação da autorização.

Withdrawn certificates can be re-instated only after the cause of thewithdrawal has been corrected and measures taken are documen-ted to the certifying institute. These measures and their implemen-tation are verified by a separate audit within short period after rein-statement. This audit will be charged to the certificate holder sepa-rately.

Os certificados retirados apenas podem ser restituídos após teremsido corrigidas as causas da sua cessação e as medidas tomadasserem documentadas ao Instituto certificador. Estas medidas e asua implementação são verificadas por uma auditoria separada numcurto período após a restituição. Esta auditoria será cobrada separa-damente ao portador do certificado.

5.4 Type of marking Tipo de rótulo

After authorisation has been granted, the applicant is entitled tomark the product with one or more of the STANDARD 100 by OEKO-TEX® marks illustrated in Appendix 2.

Após a concessão da autorização, o requerente tem o direito demarcar o seu o produto com o rótulo STANDARD 100 by OEKO--TEX® usando uma ou mais das versões ilustradas no anexo 2.

The declarations with respect to the certificate number and to thetesting institute are obligatory and must correspond to the respec-tive certificate.

As declarações que referem o número e o instituto de ensaio sãoobrigatórias e devem corresponder ao respectivo certificado.

The use of any other form of inscription is not allowed. Não é permitido o uso de qualquer outra versão da etiqueta.

It must be clear in each use of the mark to which product the markrefers to. The mark may appear in collections, catalogues, etc.

If, for particular reasons, the label can only be in two colours, themark may be reproduced dichromatic with extra authorisation fromthe testing institute.

If in a particular language the use of umlaut is in use for printing orwriting, it is permissible to use, for example, "Öko-Tex®" or "Øko-Tex®" instead of "OEKO-TEX®" and in reference to "STANDARD100 by OEKO-TEX®".

The marks can be produced by the certificate holders on their own,but have to be shown to the certifying institute for approval. This ap-proval is not necessary if the films for the labels are directly orderedfrom an advertising agency authorised by OEKO-TEX®. Further in-formation is available from the institutes.

The packing of test samples should satisfy specific requirements inorder to protect the samples and to guarantee exactness and repro-ducibility of the test results.

Para assegurar a protecção das amostras e a reprodutibilidade dosresultados dos ensaios, convém que a embalagem das amostrassatisfaça certas especificações.

Individual samples must be packed in polyethylene foil or polyethy-lene bags of high tensile strength to avoid contamination during thetransport of the goods.

As amostras devem ser acondicionadas individualmente em folhasou sacos de polietileno resistente ao rasgo para evitar contamina-ções durante o transporte.

The packing should if possible be placed in a second wrappingclosed with adhesive tape.

As amostras devem ser colocadas numa segunda embalagem fe-chada com fita-cola.

Packing of samples in cardboard boxes and/or paper only is not al-lowed.
