Please take the time to read it thoroughly. It will answer many questions that you may have. STANDARD CONSTRUCTION PROCEDURES For the construction of New Custom Homes

This is your “phase by phase” guide through the construction process. Please take the time to read it thoroughly. It will answer many questions that you may have. The Construction Period will commence after all interim construction financing has been approved and lot has been closed, contracts have been approved and signed, plans and specs have been finalized and approved, structural engineering has been performed, building permits have been secured, and Home Builder's risk insurance has been activated.

F.) THE “DESIGN SPEC SHEET” AS MENTIONED HEREIN IS A JOB SPECIFIC DOCUMENT

THAT CONTAINS THE CUSTOM ROOM BY ROOM SPECIFICATIONS FOR SPECIFIC BUILD TO SUIT PROJECTS. THIS DOCUMENT IS PREPARED AS A FUNCTION OF FINAL CONTRACT PREPARATION AND DEFINITION OF FINAL SPECS FOR EACH INDIVIDUAL PROJECT.

BRICK SELECTION We strongly recommend that you make your brick selections as soon as possible after the contract has been signed. Some brick selections have a delivery time of up to 4 months. We want to get the brick on order quickly to avoid any costly construction delays. The best method for selecting brick is to simply take a leisurely drive through some nice neighborhoods and look for homes that have a brick that you like. Remember that the mortar color and application represents about 30% of what you actually see. When you have found 3 to 4 homes you like, simply call us with the addresses and we will send our brick sales person by to identify the bricks. Once the brick has been identified, we will contact you with pricing and availability information. After you have made your final selection, we will place the order and wait for delivery. EXCAVATION Lot will be excavated, graded, filled, compacted and stabilized as required to provide proper and adequate support for foundation and proper drainage away from house. If available, pre-existing Geo-Technical Soil Testing and Structural Engineering information will be used to determine the type of foundation most suitable for the particular lot and soil type. Lot excavation will be performed by a competent and reputable Excavation Contractor. Tree removal will be performed only if absolutely necessary for placement of foundation, flatwork or proper lot drainage. Otherwise every tree of significant size will be preserved, as per the tree ordinances of the particular municipality in which the home is being built. All debris will be hauled away after excavation has been completed. FOUNDATION FORMS Set and stake off wood foundation forms on excavated pad site as per plans and specs. A "form survey" will be performed by a Registered Land Surveyor to determine proper placement of forms on building site. If foundation piers are required by the Structural Engineer, they will be installed immediately following the Home Builder's form survey approval. Otherwise the Plumbing Rough In phase will begin next. PLUMBING ROUGH IN Rough In (placement of all "in ground" components) Plumbing Locations as per plan. At the Home Builder’s discretion, all plumbing rough in components will consist of copper tubing and/or polyethylene tubing water supply lines and PVC drain waste and sewer lines, properly designed and installed by a licensed, competent, and reputable Plumbing Contractor. It is our standard policy to install the primary water lines “below slab”. The remaining water lines will be installed “above slab”. Quantity and placement of all components will be as indicated on plans or as otherwise specified in the Design Spec. Sheet. Plumbing rough in components and installation will meet and exceed all I.B.C. (INTERNATIONAL BUILDING CODE) specifications and requirements as well as all normal and acceptable industry standards. FOUNDATION The Foundation for you home will be constructed specifically as designed by the Structural Foundation Engineer. Foundation design will be post-tensioned cable and/or steel reinforced, monolithic concrete slab on grade construction. Structural grade beams will be dug to the deeper of; a.) a minimum of 24" deep or; b.) to a minimum of 6" into undisturbed soil (any pre-existing soil below the excavation depth) as specified by the Structural Engineer. Foundation specifications and components will be designed and engineered by a registered Structural Engineer to meet and exceed all recommendations of the Post Tension Institute, all International Building Codes ( I.B.C.) as well as all normal and acceptable industry standards. Specifics of foundation members and techniques will be subject exclusively to the discretion and expertise of the Home Builder and participating Structural Engineers and Contractors. Mandatory Geo-Technical Soil Testing and Structural Engineering information will be used to determine the type of foundation most suitable for the particular lot and soil type. Piers will be installed only if required by the Structural Engineer. Standard concrete mix is a minimum of 4 sack, 3000 p.s.i.(or greater) @ 28 days. Installation will be performed by a competent and reputable Foundation Contractor. Foundation components and installation will meet and exceed all I.B.C. (INTERNATIONAL BUILDING CODE) specifications and requirements as well as all normal and acceptable industry standards.

Please be advised; Cast in place Concrete can, may and most likely will crack. This is a common and normal condition caused by the natural expansion and contraction of materials and undulations in the sub-strata soil layers beneath the Foundation. Foundation cracks are normal and inherent to Concrete Slabs, Sidewalks and Driveways and are not warrantable. Note: It is customary for the Geo-Technical Soils Report to be obtained by the sub-division Developer as required by the City Building Officials and participating Structural Engineers. However, if a pre-existing Geo-Technical Soils Report is not available, unless otherwise agreed to as a condition of this contract, the Home Builder will obtain a Soils Report at the owner/purchaser’s expense. Notes:

1. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT DOCUMENTS.

WOOD FRAME STRUCTURE Structural components will be standard/typical wood frame construction materials and will be designed to meet and exceed all local, state, and I.B.C. building codes as well as all normal and acceptable industry standards. Wall plate framing will consist of 2" x 4" or 2" x 6" (as per plan) ‘Wolmanized’ treated bottom plates. Exterior wall bottom plates will be anchored to the Foundation using ‘J’-Bolts @ a minimum of 6' O.C. Exterior and interior bottom plates will also be nailed with hardened concrete nails at a minimum of 36" O.C. Exterior wall framing encompassing the living (heat & A/C areas) of the home will be of 2" x 6" stud construction @ 24” on center. Wall stud framing will be 2" x 4" or 2" x 6" (as per plan) stud grade finger joint studs @ a maximum spacing of 16" or 24” on center, 2" x 4" or 2" x 6" (as per plan) construction grade double top plate material. Multi-stud support posts will be placed under all point load locations such as beams, major roof bracing, double joists etc. All other wall components such as headers, fire blocking, bracing, etc., to comply with I.B.C. building codes. Standard exterior wall sheathing will be ½", 4' x 8', O.S.B. plywood. Floor systems will consist of engineered webbed floor trusses. Standard Floor decking will be 23/32" X 4’ X 8’, tongue & groove Orange Flooring glued and nailed with ‘ring shank’ nails. Home Builder may elect to use engineered “Truss Joists/T.J.I’s” for floor joists over the Garage area. Standard siding & soffits to be 7/16" ‘TrimCraft’ Masonite or comparable. Standard fascia boards, window trims, frieze boards or other trim materials to be 3/4" ‘TrimCraft’ Masonite or comparable. Other Wood Frame members, such as joists, rafters, beams, girders, headers, stiff backs, purlins, collar ties, hips, valleys, ridges, struts, etc. will comply with the span table requirements for residential wood frame construction and all I.B.C. specifications and requirements. Installation will be performed by a competent and reputable Framing Contractor. Pre-engineered manufactured wood components will be used in the construction of the home. Structural component installation will meet and exceed all I.B.C. specifications and requirements, all manufacturer specifications and requirements as well as all normal and acceptable industry standards. Specifics of the framing members and techniques, including their size, design, layout or integration will be subject exclusively to the discretion and expertise of the Home Builder and participating Structural Engineers and Contractors. HOME BUILDER RESERVES THE EXCLUSIVE RIGHT TO INSTALL ALTERNATIVE WOOD FRAME COMPONENTS WHICH ARE DEEMED TO BE A BETTER APPLICATION BASED ON HOME BUILDER'S EXPERTISE.

2. “RADIANT BARRIER” ROOF DECKING WILL BE INSTALLED ON ENTIRE HOUSE. 3. SILL SEAL FOUNDATION GASKET WILL BE INSTALLED UNDER EXTERIOR BOTTOM

PLATES. 4. R-3.5 DOUBLE RADIANT BARRIER SHEATHING APPLIED TO ALL EXPOSED WALLS IN

THE ATTIC AREA. 5. VAPOR BARRIER HOUSEWRAP MATERIAL WILL BE INSTALLED. 6. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT

DOCUMENTS. APPLIANCE SELECTION Go ahead and make your appliance selections as soon as you begin to see the Framing going up. This lead time will insure that your selections are made well in advance of the cabinet/mechanical walk-thru. The Cabinet Builder will need your selections before he can design your cabinets. ROOFING Roofing will be a standard/typical high quality, "Weathered Wood" color or similar Metric Laminated Asphalt Shingles. Minimum 30 Year Limited Warranty, multidimensional, composition fiberglass mat shingle material laid over 15 lb. felt paper and attached to ½" O.S.B. wafer board or plywood decking/underlayment. Installation will be performed by a competent and reputable Roofing Contractor. Roofing materials and application will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Notes:

1. COPPER ROOF FINIALS CAN BE INSTALLED UPON REQUEST. INSTALLATION WILL REQUIRE HOME OWNERS ACCEPTANCE OF ANY AND ALL LIABILITY RELATED TO, AS WELL AS AGREEMENT TO AND ACKNOWLEDGEMENT OF THE POTENTIAL FOR LIGHTNING STRIKE AS A RESULT OF INSTALLATION OF COPPER FINIALS ON THE ROOF. HOME OWNER HEREBY RELEASES HOME BUILDER OF ANY AND ALL LIABILITY WITH REGARD TO THE POTENTIAL FOR OR DAMAGE RESULTING FROM LIGHTING STRIKE.

2. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT DOCUMENTS.

WINDOWS Standard windows will be high quality aluminum frame construction with double glazed insulated Low-E glass. Standard frame color is dark bronze. Divided light design or other as shown on the plans. Clear plate glass or obscure glass windows will be installed above the Master Bath Tub area unless otherwise specified prior to ordering. Window construction and design will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Installation will be performed by a competent, and reputable Framing Contractor and will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards. If “glass block” is call for on the plans, all "glass block" units will be acrylic blocks set in an aluminum frame unless otherwise specified below.

Aluminum windows can, will and do condensate on the inside of the window. This is a normal and uncontrollable condition caused the heat/cold variation between inside and outside temperatures and is not warrantable. In the same way that an ice cold drink in a glass sweats, aluminum windows will do the same thing. This is a very rare occurrence and usually only happens in the peak winter months when the heat/cold variation between inside and outside temperatures reaches the dew point. If this is not an acceptable attribute in your home, then please do not select aluminum windows. Wood or Vinyl window products are available at an extra charge, but are not standard installation. Color selections are available upon request, but must be received prior to commencement of framing or ordering of products and may be subject to an extra charge. Skylights: Not standard unless shown on plan. ALL WINDOW OPENING SIZES, LOCATION AND CONFIGURATION WILL BE AS SHOWN ON PLANS. DIVIDED LIGHT MUTTON BARS WILL BE INSTALLED AS PER PLAN. Notes:

1. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT DOCUMENTS.

EXTERIOR DOORS Exterior doors will be high quality insulated fiberglass, wood or steel clad, shop built, pre-hung units with wood jamb sides, aluminum thresholds, brass plated hinges, double insulated low-E glass, (or solid panel), weather stripping and will be bored for double lock sets. Door construction and design will meet and exceed all I.B.C., codes as well as all normal and acceptable industry standards. Installation will be performed by a competent, and reputable Framing Contractor or Exterior Door Installer and will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards. Please be advised; Pre-hung door units are manufactured by a qualified door manufacturing facility and are pre-built prior to delivery to the job site. The Home Builder does not construct the door units. Manufactured door units are built to specifications required by the International; Building Code. Please be advised; Exterior Doors are not 100% airtight and some minimal airflow around the weather stripping is normal and unavoidable. Minimal airflow around the weather stripping is not a warrantable item. Notes:

1. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT DOCUMENTS.

HOME OWNER WALK-THRU After the Framing is substantially complete, we will contact you for a walk-thru to discuss cabinets, electrical and lighting placement, stereo, intercom or any other selected applicable components as well as changes or additions that must be addressed prior to sheet rock. PLUMBING TOP OUT Top Out of all plumbing locations as per plan. At the Home Builder’s discretion, all Plumbing components will consist of copper tubing and/or polyethylene tubing water supply lines, PVC drain waste and sewer lines and polyethylene and steel gas supply system, properly designed and installed by a licensed, competent, and reputable Plumbing Contractor. Quantity and placement of all components will be as indicated on plans or as otherwise specified in the Design Spec. Sheet.

Plumbing to include the connection of all heat units to gas (if applicable). Homes with more than 3 bathrooms will include 2 - 50 gallon high efficiency hot water heaters. Water Heaters will be installed in the garage (or as indicated on the plans). Plumbing components and installation will meet and exceed all I.B.C. (INTERNATIONAL BUILDING CODE) specifications and requirements as well as all normal and acceptable industry standards. Notes: COMPLETE PLUMBING SYSTEM INCLUDES:

1. GAS PIPING SYSTEM: (contingent upon availability of gas to project) 2 Gas Heat Units, 1 Gas Cooktop, 1 Gas supplied Wood Burning Fireplace, 2 Gas Hot Water Heaters.

2. HOT WATER SYSTEM: 2 Gas Hot Water Heaters. 1 Hot Water Circulating System - Loop to All Sinks, Tubs, Showers & Washer Faucets as per Plan. System to include all necessary piping, valves & connections etc. required to meet I.B.C. Codes.

3. COLD WATER SYSTEM: Municipal Water Supply, Exterior Hose Bibbs, Refrigerator line at Kitchen, Commodes, Sinks, Tubs/Showers, Washer Connection, Dishwasher Connection. System to include all necessary piping, valves & connections etc. required to meet I.B.C. Codes.

4. PVC DRAIN WASTE SYSTEM: Public Sewer Service or Private, on site Aerobic Septic System. Service to include all necessary piping, valves & connections etc. as required to meet I.B.C. Codes. All other fixtures as per plan.

5. MISCELLANEOUS: Install Tub protectors. Any and all other piping, strapping, insulation, valves, connections, couplings, blocking, etc. required to meet I.B.C. Codes and to provide proper service to any and all components as indicated on the plans but not otherwise mentioned or addressed herein.

6. FROST PROOF SPIGOTS TO BE USED AT ALL OUTDOOR FAUCETS. 7. ALL SINKS, COMMODES AND TUBS WILL BE THE SAME OR SIMILAR TO MODEL HOMES. 8. THE WORD “FIXTURE” AS STATED HEREIN REFERS ONLY TO THOSE ITEMS INSTALLED

AFTER SHEETROCK. 9. ALL PLUMBING RELATED FIXTURES AND COMPONENTS WILL BE THE PROVIDENTIAL

STANDARD AND WILL BE THE SAME OR SIMILAR TO MODEL HOMES. 10. THE STANDARD PROVIDENTIAL FIXTURE COLOR/FINISH FOR ALL FAUCETS IS OIL

RUBBED BRONZE. 11. SHOWER HEADS W/ SINGLE HANDLE FAUCETS WILL BE INSTALLED IN OWNER’S BATH

SHOWER. 12. INSTALL JETTED TUB IN MASTER BATHROOM. 13. IF APPLICABLE - ALL GAS LINES WILL BE "OMEGAFLEX TRACPIPE" FLEXIBLE

STAINLESS STEEL PIPING MATERIAL OR COMPARABLE. 14. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT

DOCUMENTS. ELECTRICAL See Electrical layout on plans. Electrical system components will consist of insulated copper wiring, switches, plugs and outlets designed to meet and exceed all I.B.C. specifications. Standard quantity and placement of all electrical outlets, receptacles and fixtures will be as indicated on plans in accordance with I.B.C. codes. Placement of additional electrical outlets, receptacles and fixtures will be determined by Buyer & Home Builder at time of walk-through. Any fixtures not otherwise indicated on plans or in accordance with I.B.C. codes, will be subject to an extra charge. Installation will be performed by a licensed, competent, and reputable electrical Contractor. Circuitry to be designed by an electrician to adequately accommodate the entire system according to all International Building Codes.

Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. All plugs & switches to be standard white, almond or ivory colored Decora style unless otherwise specified. Mid Sized outlet and switch covers will be installed on all plugs and switches throughout entire house. At the discretion of the Home Builder, certain wall plugs will be placed in the Base Boards of the homes for greater aesthetic appeal. Additional cost of any dimmer type switches will be added to the budget of the Lighting allowance. Electrical Package includes pre-wire for T.V. & telephone, however installation will be performed by an audio/video specialist, not by the electrician. Recessed can lighting, exhaust fans, vent lights, plug and switch outlet boxes or any other component that requires installation prior to placement of the sheet rock is a part of the electrical package, not the lighting package. Electrical Package includes wiring for door chimes, weather-proof exterior plugs, up lights, flood lights, porch & patio lighting, etc. as per plans. Notes:

1. ELECTRICAL POWER SUPPLY PANEL AND ALL ASSOCIATED COMPONENT WIRING. 2. TRIM OUT AND FIXTURE INSTALLATION OF ALL ASSOCIATED COMPONENTS. 3. FRONT PORCH LIGHT TO BE A RECESSED CAN LIGHT FIXTURE. 4. DECORA (rocker type) SWITCHES THROUGHOUT ENTIRE HOUSE. 5. OVER AND UNDER CABINET LIGHTING IN KITCHEN. 6. SMOKE DETECTORS AS REQUIRED BY CITY BUILDING CODES. 7. WALK THRU W/HOME OWNER WILL DETERMINE EXACT LOCATION OF ALL FIXTURES

AND COMPONENTS. 8. “ALMOND” COLOR MID SIZED OUTLET AND SWITCH COVERS ON ALL PLUGS AND

SWITCHES. 9. AUTOMATIC DOOR SWITCH TO BE INSTALLED ON PANTRY DOOR ONLY. 10. INSTALL 1 FLOOR PLUG IN FAMILY ROOM. 11. INSTALL 1 FLOOR PLUG IN STUDY/LIBRARY 12. INSTALL PLUG OVER FIREPLACE MANTLE. 13. ALL RECESSED CAN LIGHTING WILL BE FLUORESCENT LOW HEAT BULBS COMPLIANT

WITH THE MOST RECENT ENERGY CODE. 14. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT

DOCUMENTS. HEAT AND A/C At the discretion of the Home Builder and as is necessary to meet the construction budget for the home, all Heaters and Air Conditioners will be either Trane/American Standard, Lennox or Carrier or comparable name brand with a S.E.E.R. rating of FOURTEEN (14). Duct work will be insulated flex duct materials all of which will be installed by a licensed and reputable Mechanical Contractor. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Heat & A/C exchanger units will be installed in the attic. Notes:

This is a common and normal condition caused by the natural expansion and contraction of materials and undulations in the sub-strata soil layers beneath the Foundation. Although we do allow the use of pocket doors if our customers desire to have them, we specifically disclaim any warranty due to the inherent problems which are typically associated with pocket doors. These inherent problems include, but are not limited to; scraping, rubbing, sticking, warping, jamming and scratching of paint. Notes:

Shrinkage cracks in caulking will be re-caulked one time only during the warranty period. If Faux Paint or Wall Glazing applications are being used on your project please understand that these applications are performed “by hand”. Faux Painting cannot be “touched up” without creating an obvious re-glazed appearance. If this is not a desired effect, then please do not select Faux Painting as an application on your home. ☺ Ceramic tile will be installed (where applicable) at all showers or tub/shower surrounds, fireplace surround, kitchen back splashes, floors and at all other areas as indicated on the plans and noted on the Design Specification Sheet, within the financial parameters set forth on the Allowance Sheet. Installation will be performed by a competent and reputable Contractor. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Pricing is based on 6 X 6, 6 X 12 or 12 X 12 shower “ceramic” wall tiles and 12 X 12 straight laid “ceramic” floor tile. All other sizes, patterns or applications are subject to an extra charge. Other materials such as ‘Granite”, Marble” or “Travertine” are subject to an extra charge. If other materials such as ‘Granite”, Marble” or “Travertine” are used, it shall be explicitly understood that these are non-synthetic, natural earthen materials which have inherent imperfections. FLOOR COVERINGS

☺ Flooring will include either plush or trackless style carpeting (or other as selected by Buyer), laid over ½" padding, as noted on the plans and the Design Specification Sheet. Ceramic Tile and/or Wood Flooring will be installed where applicable, as noted on the plans and the Design Specification Sheet and within the financial parameters set forth on the Allowance Sheet. Cost of all types of flooring as set forth on the Allowance Sheet includes all floor preparation, adhesives, grout, transition strips, tack strips, padding, shoe molding, labor and any other incidental expense relative to flooring. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Color and style selections to be made by Buyer. All Flooring subject to the financial parameters set forth on the Allowance Sheet Notes:

1. TYPICALLY, HAND SCRAPED WOOD FLOORING WILL BE INSTALLED IN THE ENTRY FOYER, FAMILY ROOM AND THE LIBRARY/STUDY.

PLUMBING FIXTURES Set selected plumbing fixtures at all plumbing locations as per plan. Plumbing to include the installation of all related appliances, i.e.; dishwasher & disposal, and the connection of all heat units to gas. Homes with more than 3 bathrooms will include 2 - 50 gallon high efficiency hot water heaters. Water Heaters will be installed in the garage. Plumbing components and installation will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards.

HARDWARE Standard hardware items will be Oil Rubbed Bronze (or comparably priced) fixtures as selected by the Home Owner. “Hardware” includes such items as; all door handle sets and locks, deadbolts, cabinets pulls, towel bars & rings, T.P. holders, hinges, closet accessories, etc., etc.. Quantity, size, brand, or specific type of hardware to be selected by Buyer/Home Builder and subject to the financial parameters set forth on the Allowance Sheet. Installation will be performed by a competent and reputable Interior Trim Contractor. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Notes:

1. TYPICALLY, ALL WALK THROUGH DOOR HINGES WILL BE COLOR MATCHED TO DOOR HARDWARE WITH STANDARD OIL RUBBED BRONZE COLOR.

Wallpaper will be selected by Buyer/Home Builder and will be of the highest quality that can possibly be obtained within the financial parameters set forth on the Allowance Sheet. Installation will be performed by a competent and reputable Wallpaper Installer. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Caulking of wallpaper edges is available at an extra charge, but is not part of the standard wallpaper application process. Color and style selections to be made by Buyer. LIGHTING

☺ Lighting & Electrical fixtures will be selected by Buyer/Home Builder and will be of the highest quality that can possibly be obtained within the financial parameters set forth on the Allowance Sheet. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Installation will be performed by a competent and reputable Electrical Contractor. Placement, size, and quantity of fixtures will be as per plans and specs and/or determined prior to the time Electrical Contractor begins job. Note: Lighting fixtures include only those items which mount outside or “on the surface” of the sheet rock. Items such as recessed can lighting, exhaust fans, vent lights, plug and switch outlet boxes or any other component that requires installation prior to placement of the sheet rock is a part of the electrical package, not the lighting package. Color and style selections to be made by Buyer. Notes:

DRIVEWAYS & SIDEWALKS - “FLATWORK”

☺ Concrete “flatwork” is defined as any concrete application that is not a part of the foundation. I.E.; Porches and Covered Patios are usually part of the foundation. Non-covered patios, driveways, driveway approach from street, city sidewalks, lead walk to front porch or any other walkways are defined as “flatwork”. Concrete flatwork will be designed by Home Builder prior to placement as necessary to conform to topography of lot and the Plot Plan. Installation will be performed by a competent and reputable Foundation Contractor. Flatwork components and installation will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards. Lead walk to front porch and all other flatwork shall be standard grey ‘broomed’ or ‘salted’ finish. (Other selections or applications to other areas, such as stamped, colored, exposed aggregate or textured concrete will be subject to an extra charge.) Please be advised; Cast in place Concrete may and most likely will crack. This is a common and normal condition caused by the natural expansion and contraction of materials and undulations in the sub-strata soil layers beneath the Foundation. Foundation cracks are normal and inherent to Concrete Slabs, Sidewalks and Driveways and are not warrantable. Notes:

SPRINKLER SYSTEM Sprinkler system will be designed and installed by a licensed Irrigation Contractor as requested by Buyer. Sprinkler components and installation will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards. Notes:

1. TYPICALLY, THE LANDSCAPING PACKAGE INCLUSIVE OF ALL IRRIGATION, SHRUBS AND SOD/GRASS WILL BE THE SAME OR SIMILAR TO WHAT IS INSTALLED IN THE PROVIDENTIAL MODEL HOMES, AS SELECTED BY HOME BUILDER.

FINAL GRADING Final grade work will be performed by a reputable Excavation Contractor to meet and exceed all requirements and specifications of city engineering department and to provide proper drainage away from the foundation. Proper drainage is defined “the gravity flow discharge of sprinkler or rain water runoff away from the house and out of the yard as a result of grading slopes or drainage swales to direct water off of the building site”. Significant standing water shall not remain beyond a period of 48 hours from the time that sprinkler or rain water has fallen on or been applied to the yard. Significant standing water shall be defined as “any amount of water that is deeper than 2 inches and larger in diameter than 60 inches”. Proper grading determinations are not to be made while ground is saturated. The possibility of standing water beyond 48 hours after an unusually heavy rainfall should be anticipated. Small pockets of standing water in soil depressions are normal. FENCING Fences will be installed at request of Buyer and will be of the highest quality that can possibly be obtained within the financial parameters set forth on the Allowance Sheet. Standard fencing is 6' rough spruce set on 2.5” galvanized steel posts. Installation will be performed by a competent and reputable Fence Contractor. Fence components and installation will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards... Notes:

1. TYPICALLY, THE FENCING WILL BE THE SAME OR SIMILAR TO WHAT IS INSTALLED IN THE PROVIDENTIAL MODEL HOMES, AS SELECTED BY HOME BUILDER.

LANDSCAPING Landscaping will be designed and installed by a qualified Landscape Contractor/Designer and will be of the highest quality that can possibly be obtained within the financial parameters set forth on the Allowance Sheet. Landscaping components and installation will meet and exceed all I.B.C. specifications and requirements as well as all normal and acceptable industry standards. Landscaping components to be defined as any shrubs, bushes, plants, ground cover, or any other type of installed plant. Planted trees, sod or hydro-mulch will be installed at request of Buyer. Notes:

1. TYPICALLY, THE LANDSCAPING PACKAGE INCLUSIVE OF ALL IRRIGATION, SHRUBS AND SOD/GRASS WILL BE THE SAME OR SIMILAR TO WHAT IS INSTALLED IN THE PROVIDENTIAL MODEL HOMES, AS SELECTED BY HOME BUILDER.

GUTTERING Custom seamless aluminum guttering will be installed only upon request by Buyer. Color selection to be made by purchaser to complement the exterior paint color. Installation will be performed by a competent and reputable Guttering Contractor. Installation and materials will meet and exceed all I.B.C. codes as well as all normal and acceptable industry standards. Note: Please understand that guttering color selections are very limited. Make sure your exterior paint selection is complementary to the gutter color. Notes:

1. STANDARD STYLE GUTTERING WILL BE INSTALLED AT DRAINAGE CRITICAL AROUND ENTIRE HOUSE AND WILL BE THE SAME OR SIMILAR TO WHAT IS INSTALLED IN THE PROVIDENTIAL MODEL HOMES, AS SELECTED BY HOME BUILDER.

2. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT DOCUMENTS.

POOLS, SPAS & HOT TUBS We do not build or contract to build Pools, Spas & Hot Tubs. If you would like to have a Pool, Spa & Hot Tub built, we will give you the names of some highly recommended Pool Contractors and you may contract directly with them. Please be advised; The Pool Contractor will have to take responsibility for any an all incidental ramifications or effects to the home or the property relative to, or caused by the Pool Construction. i.e.; yard, sod, grading, drainage, sprinklers, shrubs, trees, fences, soil removal or structural effect caused by pool construction. Notes:

1. THE COST OF A FUTURE POOL, SPA OR HOT TUB ARE NOT INCLUDED IN THE CONTRACT PRICE. THE COST OF SUCH ITEMS WILL BE PRICED OUT AS SPECIFIED OR DESIRED PRIOR TO CONSTRUCTION OF SUCH ITEMS.

2. PROVIDENTIAL CUSTOM HOMES WILL PARTICIPATE WITH THE POOL COMPANY INSTALLING THE POOL HOWEVER; WE DO NOT INCLUDE SWIMMING POOLS IN OUR CONTRACT FOR THE HOME. A POOL CAN HOWEVER BE INCLUDED IN THE FINANCING SO THAT IT IS PART OF THE OVERALL PACKAGE YOU ARE PURCHASING.

RETAINING WALLS Notes:

1. THE COST OF RETAINING WALLS WILL BE INCLUDED IN THE PRICE OF THE HOME ON AN AS NEEDED BASIS.

2. OTHER “BUYER SPECIFIC” DETAILS WILL BE AS SPECIFIED IN THE FINAL CONTRACT DOCUMENTS.

GENERAL CONTRACT PROVISIONS SURVEYS A general survey of the lot will be performed prior to placement of foundation forms. A foundation form survey will be performed after forms are set. A final survey will be performed after home is complete. Survey to be performed by a registered surveying company. Survey will be ordered at the time of closing and paid for by Buyer as part of buyers closing costs.

CONTRACTORS All Contractors will be reputable and fully qualified to perform the specific function they are hired to perform. Licensed Contractors will be used for trades which require a license. Contractors will be expected to perform their duties in a workman like manner within the time frame allotted and with proper consideration for material usage and job site appearance. Note: As is typical in the Home Building Industry, all phases of the construction process are “outsourced” or “sub-contracted”. Providential Custom Homes employs only qualified and reputable sub-contractors. Providential Custom Homes has no employees. All workmen on the job site are independent, self employed sub-contractors and business owners. They are not employees of Providential Custom Homes and therefore, by law, are not subject to the normal demands or control requirements of an employer. By law, Providential Custom Homes does not have nor does it attempt to exercise any rights to dictate or control the overall schedules or work times of it’s contractors, except to the extent that it effects the overall construction schedule of our job sites. However, by law, Providential Custom Homes does have the right to control the end result of the workmanship and quality produced by its contractors and we do exercise that right. Note: If you, the Home Owner, elect to use Sub-Contractors or Suppliers which are not a part of our Building Program, please understand that we will not be responsible for errors or defects in manufacturing, supply, application, or installation of materials or components used by those Sub-Contractors or Suppliers. If a problem arises relative to Sub-Contractors or Suppliers which are not a part of our Building Program, we will rely on your intervention to help resolve the problem. We absolutely prohibit any unauthorized or un-approved Layman, Sub-Contractor, Home Builder, Inspector, Engineer, Consultant, Architect or any other Building Industry Professional from entering the job site for any reason without prior written consent. Furthermore we do hereby unequivocally reject any unsolicited opinions, evaluations, assessments, deductions, impressions, interpretations or conclusions offered by anyone as to the integrity of our workmanship without prior written consent or invitation by Providential Custom Homes to offer such proposition. PRODUCTION AND SCHEDULING As stated above, “outsourcing” or “sub-contracting” is typical in today’s Home Building Industry. The vast majority of Home Builders across this country use Sub-contractors to do the on site work instead of “employees. Employees require a tremendous amount more supervision and management and generally are not nearly as qualified as an individual Sub-contractor and his team. This method of performing the physical construction of a home is a nationwide building trend that has become the industry standard because of the ability to assemble a massive work force of individual specialized tradesmen without the burden of having “employees” doing the work.

As stated above, our Contractors are reputable and fully qualified to perform the specific function they are hired to perform. The only downside to this method of work performance is that a Sub-contractor may be working for more than one Home Builder at a time, which means there may be times when we have to wait on that Sub-contractor to finish another job before he can get to ours. This occurrence is rare, but it does happen. If it happens on your job, please be advised that we will wait on that Sub-contractor to finish instead of hiring someone else to do the work. This could result in short delays in the progress of the job, however, it has been our experience that waiting on a trusted and reliable tradesman is far better than the problems that could arise by hiring someone we’re not familiar with. The relationships we have with our Sub-contractors coupled with their knowledge of our quality requirements are what produce the desired end result.

REGULATIONS All items, and costs for such items, mentioned above will be subject to any specifications made by the Architect, Structural Engineer, Architectural Approval Committee, or City Building Department. Your signature on this contract constitutes your understanding, acknowledgment and acceptance of any and all standard, normal and accepted building practices, building codes, requirements, recommendations, specifications, and ordinances whether written, expressed or implied by any contractor, engineer, building inspector, building official, architect or other construction professional which has been selected and approved by the Home Builder to provide services, products or council on this project. ALLOWANCES An “allowance”, as referred to in this document is simply “a proportional amount of the total project price which has been allotted for a particular phase of the project of which: a); it will be necessary for the purchaser to be involved in the selection process. b.); it is not possible to determine the exact cost of a particular item during the estimation process due to uncertainties of exact quantity, type, style, or availability of the components to be used at installation”. All items listed above will be subject to cost allowances made for each particular phase as specified on the Allowance Sheet. Any cost savings derived from any particular phase of the project, as stipulated in the Allowance Sheet, will first be applied to any cost overages that may have occurred during construction on any other items as stipulated in the allowances set forth on your Allowance Sheet, before it is applied toward any additions or reductions to the overall cost of the home. Any cost overages incurred as a result of Purchaser selections or change orders will be the responsibility of the purchaser. Please Note: When making your selections, be sure to allow for sales tax. All materials and components used in the construction of a home are taxable. The allowances set forth on your Allowance Sheet are to be inclusive of sales tax. When making selections make sure that the quotes you are receiving include the sales tax. Please understand that the total price of your home includes the sales tax for all components installed. CHANGES & SELECTIONS It should be noted that any changes, alterations, or additions to the plans or the structure, whether before or after construction begins, will be subject to the discretion and expertise of the Home Builder, the City Inspector, the Structural Engineer, and any Contractors that may be involved in the specified change. All change orders must be submitted in writing. Changes will also be subject to an extra charge for services rendered in making the change. Note: Although we generally do not object to our customers making selections of materials or contractors which are outside the normal scope of our Building Program, it should be clearly understood that we cannot and will not warrant products which are supplied by a company or manufacturer which does not deliver, service and warrant what they sell or which are not approved as part of our normal Building Program. Furthermore we cannot and will not warrant the services of sub-contractors or workmen which are not approved as part of our normal Building Program. In an effort to help us provide the best service to you, please make every effort to make your selections with the suppliers listed on the Showroom List and use the contractors listed on the Sub-Contractor List which have been provided to you. WEATHER It should be noted that during the construction of a new home we are many times at the mercy of the weather. It should be clearly understood that if extenuating weather patterns persist during the construction of this home, the Home Builder will not be held responsible for delays caused by such circumstances and that the construction time allowance will be extended as necessary to complete the home, providing the original completion date has already been exceeded.

TREE PRESERVATION Tree removal will be performed only if absolutely necessary for placement of foundation, flatwork or proper lot drainage. Otherwise every tree of significant size will be preserved, as per the tree ordinances of the particular municipality in which the home is being built. However, under no circumstances, now or in the future, will the Home Builder be responsible for any tree loss, damage or death as a result of the construction process. WOOD PRODUCTS This home will be constructed using the best materials available with consideration of the monetary limitations of this contract. Natural wood products will be used throughout the entire construction process. All natural wood products used will meet or exceed all I.B.C. & I.R.C. specifications and requirements as well as all normal and acceptable industry standards. The use of natural wood products has been an industry standard in home construction for centuries because of its native availability, ease of use, tensile strength, and multi-purpose attributes. However, with all the wonderful warm qualities that natural wood provides it is still a product of nature and therefore has a few adverse attributes as well. Natural wood shrinks and swells in response to the moisture content in the air as well as heat and cold temperature variations. It splits, cracks, and warps at times even under the best of conditions. It shall be expressly understood that the Home Builder has absolutely no control over these natural occurrences and conditions beyond its ability to insure good selection and proper use of these wood materials. Home Builder shall not be responsible for any type movement, including splitting, cracking, warping, cupping or any other variation in the integrity of any wood product as a result of any condition subsequent to completion of the home including heat, cold, humidity variations in the air, or moisture content of any type or from any source. BRASS & COPPER PRODUCTS It should be noted that one of the inevitable attributes of brass or copper is tarnish due to chemical reactions to oils, salts, humidity, minerals etc. Tarnish removal and brass products maintenance are solely the responsibility of the Home Owner. HANDCRAFTED This home will be constructed using the best workmanship available with consideration of the monetary limitations of this contract. Today we live in an society where technological advancements such as computerized robotics and laser technology and in the manufacturing industry are able to deliver certain products to us that are near perfect in every sense of the word. Although today’s construction techniques have dramatically advanced and surpassed those of days gone by, home construction has always and will always require hands on, individual craftsmanship performed by workers of the construction trades. Due to the lack of cost effectiveness and extreme expense involved, there will never come a time in the Custom Home Building Industry when high-tech, computerized robotic machinery will do the on site work of constructing a house with laser like precision. As with anything that is “hand crafted”, there will always be minor imperfections, flaws and variations in the quality, consistency or appearance of the materials and workmanship. These hand crafted imperfections due to manual application of workmanship and materials are what give character to a home just as with any piece of art work. Please be aware that although stringent construction guidelines and building code regulations will be followed meticulously during the construction process to assure high quality craftsmanship and attention to detail, your home will not be physically perfect. Perfection is always found in the eye of the beholder as a result of the appreciation of the degree of difficulty, and the immense amount of effort necessary to complete a project. The overall beauty, sense of accomplishment and security found in the construction of a new home are truly what make it perfect.

BUILDING COMPONENTS Please be advised that we do not manufacture the construction components being used in your home. We make every effort to assure that, within the price and cost limitations of the contract, the very best components available are used in the construction of every home. The price and cost limitations of the contract are crucial in determining which components can or will be used. We do not automatically purchase the ultimate highest quality components. The quality of the components purchased is based on the limitations of the overall price of the home. There will always be a better product available; however that better product also has a cost associated with it. If the cost of a particular product is not conducive or consistent with the overall cost allowances for each individual phase of the project, or if its cost is considered excessive based on the overall cost allowances for each individual phase of the project, it will not be used. Instead, a product which has a price level that is conducive or consistent with the overall cost allowances for each individual phase of the project will be used. With exception to the allowance items, which the purchaser will be involved in selecting, the Home Builder reserves the sole right to make proper selections of materials and components to be used in the construction of the home. Warranty of the materials and components to be used in the construction of the home will be provided by the manufacturer as required by law. The Home Builder’s responsibility for warranty of construction materials and components to be used in the construction of the home is hereby expressly limited to the warranty provided by the manufacturer of the components and any provisions made by law concerning the manufacturer’s warranty of those products. ACTIVE SOILS It should be noted and thoroughly understood that North Texas is an area that is considered an "Active Soils' area. This means simply that this region has a high water table and expansive soil types which cause natural movements in the earth's surface. Every precaution has and will be taken in the design and construction of your home to insure that engineering requirements, construction techniques and building standards have been complied with and implemented so as to minimize or, if possible eliminate any possible foundation movement. Some minor foundation movement or settlement is normal and is to be expected. The Home Builder can not and will not be responsible for forces of nature which cause soil movements that exceed the structural limitations of the components and design of the foundation.

Please be advised; Cast in place Concrete can, may and most likely will crack. This is a common and normal condition caused by the natural expansion and contraction of materials and undulations in the sub-strata soil layers beneath the Foundation. Foundation cracks are normal and inherent to Concrete Slabs, Sidewalks and Driveways. Cracks in concrete and are not warrantable except as specifically defined in the Performance Standards adopted by the Certified Master Home Builders Program in effect on the Commencement Date.

Note: It is customary for the Geo-Technical Soils Report to be obtained by the sub-division Developer as required by the City Building Officials and participating Structural Engineers. However, if a pre-existing Geo-Technical Soils Report is not available, unless otherwise agreed to as a condition of this contract, the Home Builder will obtain a Soils Report at the owner/purchaser’s expense. EXPANSION & CONTRACTION Some expansion, contraction and movement of non-flexible construction materials due to variations in temperature and humidity levels is normal and to be expected. Some minor cracking, splitting, warping, expansion, contraction, shrinking, swelling and movement is possible and should be expected. It shall be expressly understood that the Home Builder has absolutely no control over these natural occurrences and conditions beyond it's ability to insure good selection, proper use and proper installation of building materials and that it shall not be responsible for the expansion, contraction and movement of any type of any building products as a result of heat, cold or humidity variations in the air, or moisture content of any type or from any other source.

TRCC BUILDING PERFORMANCE STANDARDS Your home is being constructed under the guidelines and performance standards of the TEXAS RESIDENTIAL CONSTRUCTION COMMISSION (TRCC), of which Providential Custom Homes is a registered member. Please read and understand the Texas Residential Construction Commission, Limited Statutory Warranty and Building and Performance Standards, a copy of which can be found at http://www.trcc.state.tx.us, which is an integrated part of this set of contractual documents. Performance of any warranty related services will be done strictly in accordance with the TRCC Residential Warranties Performance Guidelines and Limited Statutory Warranty and Building and Performance Standards mandated by the State of Texas. Although the Home Builder has continuing obligations under this warranty it should be noted that the Purchaser must provide proper care and maintenance for the home. Maintenance is not the Home Builder’s responsibility. Upon completion of your home, please ask for a Home Owner’s Manual which contains all the data you will need to properly care for your home. The responsibility of proper maintenance of the home by the Home Owner begins immediately upon substantial completion of the project. HARMFUL MOLDS Home Builder has exercised reasonable care in assuring that the Property and Improvements are free of harmful molds and other undesirable organisms; however, even utilizing modern materials, techniques and designs, any construction project can experience a problem with molds if proper maintenance procedures are not implemented. Such maintenance is a responsibility of owner. Most mold growth can be attributed to the following factors:

a. Moisture. Moisture can result from many sources including flooding, water in houseplants and high humidity from insufficient air conditioning. Regardless of its source, moisture is a key ingredient in mold growth.

b. Nutrients. Cellulose-based materials such as sheetrock, ceiling tiles, lumber, and wallpaper act as food for mold.

c. Fungal spores. Mold spores are present in all buildings, commercial and residential alike. d. Temperature. Optimal temperatures for mold growth appear to range from 65°F to 90°F. e. Time. Mold growth generally occurs within 24-48 hours after the foregoing factors are

present.

Of these factors, the only component that can be reasonably controlled is moisture. By eliminating moisture, additional mold growth can be eliminated. It is Owner’s responsibility to immediately investigate and remedy all sources of moisture, including but not limited to any standing water, puddling, dampness or excessive humidity. Such dampness or moisture often results from plumbing fittings on appliances (e.g. air conditioning units, dishwashers, washing machines, ice makers, etc.) which may loosen over time as a result of temperature change or vibration, leaks around doors or windows from seals that may become warped or displaced by normal use, and condensation on air conditioning equipment, ducts or registers. Repeated spills, such as from pet dishes, and even excess humidity, can create a breeding ground for mold. All moisture sources must be inspected regularly to identify any problems. Any significant leaks or plumbing overflows must be addressed immediately; the moisture must be dried up immediately. Minor mold growth may be effectively removed with a proper mixture of water and common household bleach.

In light of the paramount importance of regular and proper inspection and maintenance by the Owner, Home Builder shall not be responsible for any property damage, personal injury, or other loss, damage or liability, resulting directly or indirectly from mold or other harmful organisms. By taking possession of the Property and Improvements and by the signatures below, Owner acknowledges that Owner has thoroughly inspected the Property and Improvements and found them to be satisfactory and that Owner has undertaken the responsibility to perform regular and proper inspection and maintenance of the Property and Improvements so as to prevent growth of mold or other harmful organisms. For valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Owner expressly waives and releases any and all claims against Home Builder, its officers, employees, agents and subcontractors, whether for property damage, personal injury, or any other loss, damage or liability, including but not limited to, attorneys’ fees, arising now or in the future, directly or indirectly, from any mold or other harmful organism that may grow in or around the Property and Improvements after Home Builder’s completion of the Improvements and Owner agrees to obtain from any and all insurers waivers of subrogation of any such claims. PEST INFESTATIONS Pest infestations of any kind, including but not limited to insects, rodents, reptiles or any other living creature or organism that is considered to be a pest, are a maintenance item and solely the responsibility of the Home Owner to control and maintain. COST CONTROL The cost of your home has determined as a result of a meticulous and detailed cost estimation of each individual phase of the construction. The established price is simply the sum total of a series of cost estimates or bids for each individual phase of the construction process. It should be clearly understood that, after the price has been established and agreed upon, if you, the purchaser, elect to choose construction components which increase the cost allowances established in determining the original cost, the price of your home will increase accordingly. Any cost increases incurred after your financing has been secured must be paid for by you "out of pocket". What this means specifically is; you can select anything you would like to put into the home, but if the cost of that item exceeds the dollar allowances budgeted for that item, you have to pay the difference. Please help us control costs by staying "in budget" with your selections. It is our sincere desire to see that you receive a well built home at a competitive price. As always, we will make every effort to control costs and to make this entire process a pleasant experience for you. It shall be expressly understood that any cost over runs that arise as a result of the purchaser’s selections or change orders shall be the responsibility of the purchaser and shall be paid at the time that the cost has been incurred. Any cost savings derived from any particular phase of the project, as stipulated in the Allowance Sheet, will first be applied to any cost overages that may have occurred during construction on any other items as stipulated in the Allowance Sheet, before it is applied toward any additions or reductions to the overall cost of the home. OBLIGATION TO PROVIDE TIMELY COMPLAINT As a Home Owner or Home Buyer you have the right and the obligation to provide timely written complaint of any aspect of the construction process or the materials being used in the construction process which are not being used or installed in accordance with the terms and conditions of this contract. Your right and obligation to provide timely written complaint must take place on a phase by phase basis during the construction process. You have the right to inspect the property personally and notify the Home Builder of any questionable material, component or procedure being installed or performed at each stage of the process.

If you choose to waive this right and obligation or if you fail to notify the Home Builder of any questionable material, component or procedure being installed or performed during the particular phase during which the questionable material, component or procedure is being installed, it shall be assumed that your approval of any material, component or procedure relative to that particular phase of the project has been granted and that no further permission to proceed should be necessary. If the Home Builder has already proceeded to the next phase or any later phase of the project without any prior written complaint having been issued to or received by the Home Builder relative to any previous phase on the construction process, then it shall be assumed that your approval of any material, component or procedure relative to that, or any other, particular previous phase of the project has been granted and that no recourse or obligation by the Home Builder to repair or replace any questionable material, component or procedure relative to any previous phase of the project will be available or performed. Notwithstanding the above statements, the Home Builder will proceed with the construction process on a phase by phase basis according to the Home Builder’s normal construction schedule unless otherwise notified by the Home Owner. Any written complaint must be faxed or emailed to the Home Builder prior to commencement of any subsequent phase of the project. COMPLETION & MOVE IN 1. COMPLETION

“Substantial completion shall be defined as “final acceptance by the appropriate municipal authority where the Property is located and as applicable, issuance of a ‘Certificate of Occupancy’ or other evidence of completion of the Improvements”. Prior to closing we will prepare a ‘Certificate of Completion’ which will indicate that you have conducted an inspection and find the home to be substantially completed according to the Contract Documents, subject only to any provisions made by the TRCC Residential Warranties Performance Guidelines as well as any provisions made by law, both of which survive the closing. This Certificate of Completion will be signed at closing, (or prior to move in - whichever is most applicable) at which time we will also release the Mechanics Lien Contract and (the Title Company and/or the Lender will) issue clear title to you.

Home Builder reserves the right to reject any items on the punch out list that are frivolous or make demands beyond the normal and acceptable industry standards as set forth in the TRCC Residential Warranties Performance Guidelines provided as part of the Construction Contract. Service calls on warranty service items will be limited to 10 within the warranty period.

Move in will not be allowed prior to substantial completion. Full payment of any outstanding balance of the ‘Contract Price’ or any ‘Cost Over Runs’ shall be due and payable upon substantial completion of the Improvements and prior to Home Owner move in. Any past due payments will accrue interest at the maximum rate allowable by law, commencing upon completion of the project, as defined above, and accruing until such time as the balance has been paid in full. Upon substantial completion of the project the Home Owner must immediately transfer all utilities into their name. Any utility billing that occurs beyond the substantial completion date shall be the responsibility of the Home Owner”.

2. PROJECT COST ANALYSIS

Upon completion, a Project Cost Analysis will be provided to you. The Project Cost Analysis is the result of an extensive and meticulous review of any and all additional charges which may have been incurred relative to your home as a result of your selections or additions you may have made as provided for in the provisions set forth in the construction contract. Please be prepared to sign the Project Cost Analysis in the appropriate space. If the final amount shows a balance due, please submit funds in the form of a Personal or Cashier’s Check made payable to payable to Providential Custom Homes. If the final amount shows a credit due, Providential Custom Homes will submit funds in the form of a Company Check made payable to you.

3. CERTIFICATE OF COMPLETION

Upon completion, a Certificate of Completion will be provided to you acknowledging that you have inspected the home and find the residence to be substantially completed in accordance with the provisions set forth in the contract and do hereby accept the property in its completed condition. Upon payment of final draw to Home Builder, receipt of the Final Inspection or Certificate of Occupancy from the Municipal Authority, signing of this document and agreement to the terms therein, the Home Owner will then be released by the Home Builder to begin the move in process.

Please be advised that all “Punch Out Items” must be completed prior to Home Owner

move in. If you are aware of any outstanding “Punch Out Items” that need to be completed, please make sure they have been completed by the Home Builder prior to move in. “Punch Out Items” will not be completed after Home Owner move in and commencement of the 1 Year Warranty Period. Please be prepared to sign both copies and return one copy to us.

4. CLOSING/FINAL DOCUMENTS

Final closing will take place after substantial completion and completion of the final walkthrough process. If your financing was set up originally as a “One Time Close” then there will not actually be a final “closing”. However there will be a few final documents that the Bank will require for the Home Builder and the Home Owners to sign. These documents will include, but are not limited to the following;

a.) An “All Bills Paid Affidavit” will be signed and executed by the Home Builder indicating

that all bills have been paid and all funds have been properly disbursed to any and all Contractors or Suppliers who have performed a service on or for the residence. Please be advised that final payment to the Home Builder is necessary before the “All Bills Paid Affidavit” will be signed by the Home Builder.

b.) A “Mechanics Lien Release” will be signed and executed by the Home Builder indicating that all bills have been paid and that no outstanding liens or unsettled issues exist by or between any and all Contractors or Suppliers who have performed a service on or for the residence. Please be advised that final payment to the Home Builder is necessary before the “Mechanics Lien Release” will be signed by the Home Builder.

c.) A set of “Conversion Documents” will be provided by the Bank which will automatically convert the Construction Financing to a Permanent Mortgage as per the original Loan Agreement.

5. CERTIFICATE OF OCCUPANCY

We will request the Final Building Inspection from the City of TBD on __/__/__ (TBD). The Building Inspector will perform the Final Inspection and list out any comments, concerns or objections on a “Red Tag” list. We will address those comments, concerns or objections immediately and prepare to call for the re-inspection. As per the City of TBD’s requirements for re-inspection, we will have to wait 24 hours in order to call for re-inspection. Please be advised that final payment to the Home Builder is necessary before the re-inspection will be called for by the Home Builder and before the Certificate of Occupancy is released.

The Home Building business is our life and something we enjoy doing, primarily because we have the opportunity to make someone else’s life better. You can rest assured we will be working for your best interest every step of the way. That being said, please understand that we are not perfect, no human being is. Our objective is always to attempt to achieve perfection in the home building industry, however we, as members of the home building community, understand better than any one that perfection in the construction industry is absolutely impossible. The very best we can do on our very best day is to ‘strive’ for perfection, knowing that because everything we do is built by human hands, we will never attain it. The key to appreciating one’s workmanship as perfect lies in the understanding that a man’s hands, his blood, his sweat and his toil created it from nothing. MAINTENANCE Although the Contractor has continuing obligations under the TRCC Residential Warranties Performance Guidelines, the Owner must care for the Improvements, and maintenance is not the Contractor’s responsibility. The Home Owner's maintenance obligations begin on the day you move in. It is your responsibility to stay aware of any potential maintenance needs and address them immediately so as to mitigate or limit the issue from becoming worse or turning into a greater problem. ACKNOWLEDGMENTS This document correlates to all other contractual documents and is a part of an integrated set of contractual addendums. Please see ‘Design Specification Sheet’ for other selections or design parameters specific to this job. SEE CONSTRUCTION DOCUMENT ADDENDUM "A", STANDARD CONSTRUCTION PROCEDURES, FOR ALL OTHER DESIGN SPECIFICATIONS. ALL SPECIFICATIONS NOT MENTIONED HERE WILL BE NOTED OR IN THE OTHER CONTRACT ADDENDUMS AND ON THE PLANS DESIGNED FOR THIS PROJECT WHERE APPLICABLE AND APPROPRIATE. THE HOME OWNER AND THE HOME BUILDER DO HEREBY ACKNOWLEDGE AND AGREE THAT ANY ADDITIONAL REQUIREMENTS OF THE CITY OF TBD WHICH EXCEED THE SPECIFICATIONS AND NORMAL PROCEDURES OF THE HOME BUILDER AS STATED IN THE DOCUMENTATION OF THIS CONTRACT WILL BE SUBJECT TO AN EXTRA CHARGE.

THIS DOCUMENT REPRESENTS THE SPECIFICATIONS, AMENITIES, APPLICATIONS AND FEATURES TYPICALLY USED, IMPLEMENTED OR INSTALLED IN THE CONSTRUCTION OF CUSTOM HOMES BUILT BY PROVIDENTIAL CUSTOM HOMES. THESE FEATURES ARE SUBJECT TO CHANGE WITHOUT NOTICE OR OBLIGATION TO ANY PARTY. ALL FEATURES MENTIONED HEREIN WILL BE INSTALLED AT THE SOLE DISCRETION OF THE HOME BUILDER UNLESS OTHERWISE SPECIFICALLY AGREED TO IN THE SALES CONTRACT FOR ANY PARTICULAR HOME.
