Release of Liability, Claim Waiver and Assumption of Risk AgreementRelease and Waiver of Claims Agreement

Inconsiderationofyouruseofthisproduct,youherebyagreetothefollowing,tothefullestextentpermittedbylaw:

1)TowaiveanyandallclaimsthatyouhaveormayinthefuturehaveagainstNaishInternational,adivisionofNaluKaiIncorporated,oranyofitsagents,resultingfromuseofthisproductandanyofitscomponents;and

2)ToreleaseNaishInternational,adivisionofNaluKaiIncorporated,oranyofitsagentsfromanyandallliabilityfromanyloss,damage,injuryorexpensethatyouoranyusersofthisproductmaysuffer,orthatyournextofkinmaysuffer,asaresultoftheuseofthisproduct,duetoanycausewhatsoever,includingnegligenceorbreachofcontractonthepartofNaishInternational,adivisionofNaluKaiIncorporated,oranyofitsagents,inthedesignormanufactureofthisproduct.

Arbitration

Infurtherconsiderationofthesaletoyouofthisproductandanyofitscomponents,youherebyagreetosubmittobindingarbitrationanyandallclaims,whichyoubelieveyoumayhaveagainstNaishInternational,adivisionofNaluKaiIncorporated,oranyofitsagents,arisingfromtheuseofanyoftheNaishInternational,adivisionofNaluKaiIncorporatedequipment.ThearbitrationshallbepursuanttotherulesoftheAmericanArbitrationAssociation.

Arbitrationshallbecommencedwithinone(1)yearfromthedateonwhichanyallegedclaimfirstarose.Further,thearbitrationshallbeheldinMaui,Hawaiiunlessotherwisemutuallyagreedtobyallparties.ThesubmissiontotheAmericanArbitrationAssociationshallbelimitedandthearbitrationawardmaybeenforcedbyanycourtofcompetentjurisdiction.

Binding Effect of Agreement

Intheeventofyourdeathorincapacity,thisAgreementshallbeeffectiveandbindinguponyourheirs,nextofkin,executors,administrators,assignsandrepresentatives.

Entire Agreement

InenteringintothisAgreement,youarenotrelyinguponanyoralorwrittenrepresentationsotherthanwhatissetforthinthisagreementandUser’sGuide.

Assumption of Risk

Bypurchasing,usingandassemblingthisproduct,youareagreeingto:

1)Beboundtothetermssetforthbelow;and

2)Requireanyoneusingthisproducttobeboundbysuchterms.

Ifyouareunwillingtobeboundbytheseterms,returnthisproductbeforeuseforafullrefund.

Useofthisproductandanyofitscomponentsinvolvescertaininherentrisks,dangersandhazards,whichcanresultinseriouspersonalinjuryanddeath.Inusingthisproductyoufreelyagreetoassumeandacceptanyandallknownandunknownrisksofinjurywhileusingthisequipment.TherisksinherentinthesportcanbegreatlyreducedbyabidingtotheWarningandSafetyPrecautionslistedinthisUserGuideandusingcommonsense.

Warning and Safety PrecautionsGeneral warnings:

1)Stand-upPaddlingisadangeroussport.Useofthisproductexposestheusertounexpectedrisks,dangersandhazards.

2)Alwaysuseextremecautionwhenusingthisproduct.Neveractinacarelessmannerwhenusingthisproduct.Misuseofthisproductmayresultinseriousinjuryordeath.

3)Onlyusethisproductifyouareingoodphysicalhealth,andknowhowtoswim.

4)Youareresponsibleforyourownsafetyandthesafetyofothersaroundyouwhenusingthisproduct.

5)Ifyouareundertheageof18,youmusthavealegalguardianreadthesewarningsandsafetyprecautions.Donotusethisproductwithoutadultsupervision.

6)Donotusethisproductifyouareundertheinfluenceofalcohol,drugsormedications.

Important safety rules:

1)Beforeusingthisproduct,theusershouldtakelessonsfromacertifiedschool.Thisproductshouldnotbeusedbyanyonewhoisnotexperiencedwithstand-uppaddling.

2)AlwayswearaCoastGuardApprovedpersonalflotationdevicewhenusingthisproduct.Thisproductisnotapersonalflotationdevice.

3)Neverusethisproductwithoutapropersurfleash.Aloosestand-upboardinthewaterisextremelydangeroustoyou,andeveryonearoundyou.Failuretouseasurfleashmayresultinseriousinjuryordeath.

4)Examineyoursurfleashaftereachuse,andreplaceitifyouseeanysignofwear.

5)Alwayswearahelmetandbootieswhenusingthisproduct.

6)Alwayspaddlewithanexperiencedpartnerwhenusingthisproduct.

Weather condition & location warnings:

1)AlwaysobserveCoastGuardrulesandregulationswhenusingthisproduct.

2)Neverusethisproductinoffshorewindconditions.

3)Neverusethisproductinmorethan10knotsofwind.Usingthisproductinwindyconditionsmayresultinseriousinjuryordeath.

4)Usecautionwhencarryingthisproduct.Carryingtheboardinwindyconditionsmayresultinseriousinjurytoyourselfandothersaroundyou.

5)Neverusethisproductinthunderstormsandlightningconditions.

6)Neverusethisproductinconditionsthatarebeyondyourability(suchas,butnotlimitedto,highsurf,riptides,currents,orriverrapids).

7)Neverusethisproductnearotherboattraffic,orwatercrafts.

8)Neverusethisproductnearcrowdedbeachesorwaters.

1)Makesurethecenterfinboxiscleanandfreeofdebrisbeforeinstallingthefins.

2)Usingthescrew,slidethemetalplateallthewayforwardinthefinboxifthefintabisonthefrontofthefin,OR,slidethemetalplateallthewaybackinthefinboxifthefintabisontherearofthefin.

3)Holdingthefinatanangle,insertthemetalpinintothefinboxopening.

4)Keepingthefinatanangle,slidethefinintoposition.

5)Holdingthefinfirmly,pushthefinflushwiththefinbox.

6)Usingthescrewdriver,lineuptheholeinthemetalplatewiththeholeinthefintab.

7)Insertthescrewintothefintab. 8)Usingthescrewdriver,tightenthescrewintotheunderlyingmetalplate.

Installing the Vent Screw

1)Makesuretheventscrewholeiscleanandfreeofdebrisbeforeinstallation.

1)Loosenhexscrewsbeforeinstallingthesidefinsandmakesurethefinboxesandhexscrewheadsarecleanandfreeofdebris.

2)Holdthefinfirmlyandpushthebaseofthefinintothebox.Pushdownfirmlyuntilthefinisflushwiththeboard.

3)Insertthehexscrewkeyallthewayintothehexscrewheadtoavoidstripping.

4)Tightenthehexscrewsdownagainstthetwoposts.

WARNING: DO NOTovertightenthehexscrews.Overtighteningcancausedamagetoyourfinsystem.Thehexscrewsonlyneedtobesnugenoughtoholdafinsecurely.

5)Checktoseethatthefinissecurebygrabbingthetopthirdofthefin,lightlytrytowiggleitoutofthebox.Ifyouareabletopullthefinoutofthebox,youwillneedtotightenthehexscrewsalittlemore.

WARNING: DO NOTovertightenthehexscrews.Overtighteningcancausedamagetoyourfinsystem.ThehexscrewsonlyneedtobesnugenoughtoholdanFCSfinsecurely.

3)Insertthehandleontotheshaft.Lineuptheflatsideofhandlewiththeoutwardfacingbladewhiletheepoxyisstillwet.

5)Oncethehandlehasdried,dripabeadofepoxyaroundhandleconnectiontopreventleakage.

Handle Installation

1)Tomeasurepaddlelength,standthepaddleuprightnexttoyouwiththetipofthebladetouchingtheground.

5)Removethemaskingtape.Usingthesandingblock,sandtheendoftheshaftflatandsmoothouttheedge.

Caring for a damaged board:

Warranty PolicyNaish warrants this product to be free from major defects in material or workmanship to the original purchaser for a period of one year from the date of purchase. This warranty is subject to the following limitations:

1)Thewarrantyisvalidonlywhentheproductisregisteredonlineatwww.naishsurfing.comwithinseven(7)daysfromthedateofpurchase.

2)Thewarrantyisvalidonlywhenthisproductisusedfornormalrecreationalactivitiesanddoesnotcoverproductsusedinrentalorschooloperations.

3)Naishwillmakethefinalwarrantydetermination,whichmayrequireinspectionand/orphotosoftheequipment,whichclearlyshowthedefect(s).Ifnecessary,thisinformationmustbesenttotheNaishdistributorinyourcountrywithprepaidpostage.ProductcanbereturnedonlyifareturnauthorizationnumberisgiveninadvancebytheNaishdistributor.Thereturnauthorizationnumbermustbeclearlylabeledontheoutsideofthepackage,oritwillberefused.

4)IfaproductisdeemedtobedefectivebyNaish,thewarrantycoverstherepairorreplacementofthedefectiveproductonly.Naishwillnotberesponsibleforanycosts,losses,ordamagesincurredasaresultoflossoruseofthisproduct.

5)Thiswarrantydoesnotcoverdamagecausedbymisuse,abuse,neglect,normalwearandtearincluding,butnotlimitedto,punctures,damageduetoexcessiveheatexposure,damagecausedbyimproperhandlingandstorage,damagecausedbyuseinwavesorshorebreak,boardbreakagecausedbyfallingorcrashinginsurfconditions,ordamagecausedbyanythingotherthandefectsinmaterialandworkmanship.
