These laws were promulgated and financed by the cattle barons, who are now referred to as the cattle boards, around the turn of the nineteenth century and these laws gave the boards police authority. One rare attorney, Gerry Spence, believes most judges are hostile creatures. “I have come to the belief that donning the black robe magically transforms what was once a good and generous heart into a black and gloomy void,” says he. Among the legal profession there is a poverty of learning. It's not their fault. The policy indoctrination centers we laughingly call law schools specialize in cramming statutes, case law, codes, rules, and regulations into the heads of those lucky enough to have good memories. Students who actually try to think are quickly washed out of the system. Those who survive the ordeal get briefly introduced to the Constitution at the fourth year of college. By that time they have formed their own difficult to change misconceptions. The situation is so bad that some supreme courts won't let an attorney in the door if he has fewer than five years of experience. Vol 2 No 7

brand inspection laws,

but they all originated

between the cattle

barons and grangers.

The brand inspection

laws of Montana,

Wyoming, Idaho, and Western Nebraska and

South Dakota are basically birds of the same

feather. These laws were promulgated and

financed by the cattle barons, who are now

referred to as the cattle boards, around the

turn of the nineteenth century and these laws

gave the boards police authority.

The boards’ meat inspectors came into

existence after World War II, when statutory

laws of the States were added to the boards’

jurisdiction. However, Nebraska surrendered

its sovereignty to inspect meat to the federal

government, when the federal government

illegally promulgated a law in the late 1970’s

requiring States to have the same meat

inspection standards as the USDA. This is why

Montana and Wyoming still have State meat

inspectors and small State inspected meat

plants and Nebraska does not. I maintain

these federal laws were one of the first steps

monopolists in controlling the meat packing

industry. There is an unwritten tradition, that I

don’t understand, and that is a rumor that

One might think this critique is undulyharsh. However, after decades of dealing withthem critters, this writer has yet to meet anattorney who knows what a court is. Ask them!They will bumble about a bit, then maybe utter theparty line, “Oh...yes...It's a neutral forum in whichlitigants can present their issues for justresolution,” or words to that effect.

A smattering of history reveals that courtsare not at all neutral. The real purpose of a court isto protect the interests of the king [akagovernment] and its creations such ascorporations. Only in the rare absence of suchinterests can one expect some possibility ofunbiased justice...but don't count on it. Thejudge's “black and gloomy void” in his heart willdrive him by habit to do the usual denials.

In his book, “How to Argue and WinEvery Time,” Gerry Spence writes, “Whendecision-making bodies with power are gatheredto hear our arguments, we must understand thatthe dynamic is one of war. And to the victor go thespoils. In such a contest, there is usually anopponent who speaks for power, most frequentlythe government, industry, money. Usually the

It's a well known fact that judges all theway up to the top court make a decision first, thenconstruct the logic to support it. Couple that witha strong foundation of legal ignorance, it's easy tosee why public respect for the entire legal systemis in a downward death spiral; moribund onemight say.

Abroad brush description of theAmericansystem of law is this: Law and Equity.

The word “law” without any otherqualifier, means “Common Law”. The word“Equity” covers everything else. Bureaucratslike to slice & dice the language and makeeverything complicated. Other names for equityare equity law, civil law, statutes, codes,admiralty, etc. So long as the attorneys andparties are ignorant, the judge is free to jump backand forth between the systems.

The indoctrination centers teach that caselaw is common law. Actually, case law shows theapplication of both common law and equity.Common law is simply custom and usage, i.e., thelaw of the people. The other lesser stuff is the lawof the legislature.

Sheridan County is not immune toinjustice. Because the county has such a smallpopulation, it must suffer the presence of atraveling judge, namely Russell W. Harford. Aquick check of the Martindale-Hubbell lawyerpeer review listing shows him in fourth positionof the top. He is well respected by his peers.However, a quick check of the record shows the

he, too, is victimized by his law school. He wasasked by a defendant, “Are we under equity law orcommon law?”[Note to reader: statutes are classified as equity.]RWH: “We're under stat- -- in County Court,we're a court of statutory law.”Def: “So, common law doesn't apply here,period.DWH: And we don't have equity -- we don't haveequity jurisdiction”Def: “What's the difference between equity and --what do you call it?DWH: “Well, equity and statutory law.”Def: “What's the difference?”DWH: “Our -- whatever we can do in the CountyCourt is only what's set by statute.”Def: “Well, what's equity law? That is statutorylaw. The judge simply did not know the differencebetween common law, equity law, and statutes.Yet, instead of admitting his ignorance andrecusing himself, he was going to assert the lawwithout knowing what the law is, i.e. without anygenuine understanding of the law system.

In another instance it is apparent, again,that the judge does not comprehend that statutesshould supersede policy.

Whenever a traffic citation is issued, theissuer must appear before the magistrate (judge)and make his accusation under oath that a crime(misdemeanor) has occurred. In this case, thatwas not done.

The Judicial Canons require that the judgeavoid any appearance of impropriety. He isrequired to obey the law. The defendantrequested that the case be dismissed because thecop failed to obey the law or swear before themagistrate that a law was broken. The judgerefused.

It's common knowledge among the peoplethat the main benefit to the state is money. Theywant the money. That's it. The defendant in thiscase could choose paying $148, or risk going tojail for 90 days. By putting a high risk on it, thestate is assured easy money.

The Nebraska Constitution specificallystates that the government may only govern withthe consent of the governed. If an individualpeople objects, should the government quitgoverning the individual if the individual isharming no one?

It isthe goal of the Irvine Police Service to prevent crimeand disorder, preserve the peace, protect life,property, and individual freedom; hence, thoseoffenses which threaten the health, welfare, safety,and stability of the community are given enforcementpriority at the time they are most prevailing withemphasis towards the most troublesome offenders.

It is the intended profile of the Irvine PoliceDepartment to operate within a professionalatmosphere where our actions are legal and moral,and will sustain the penetrating evaluation of thecitizens we serve. It is the philosophy of the newIrvine Police Department to be neither high nor lowprofile. More important than a subjective category,the Irvine Police Service Agency is organized to be ahighly responsive police team that is able to initiateservices quickly to relate to the indentified needs ofthe community.

Utilizing the best recruitment and selectionmethods available; alert and bright men and womenwill be asked to join our Police Service Organization.We will not tolerate police officers with negativeattitudes. All classes of cattle were in demand at Martin on October 12th and rightat a 1,000 sold. Mick McCarthy drove in from the southwest and dominated theyearling market and the eastern buyers. He bought the JF Ranch and Hodsonyearlings paying over $181. So most of the big cattle are still going from east tosouthwest.

Larry Staanf from Rock Valley, Iowa was paying $1150 for the peewees(350 to 450 wts.), and blew-out the notorious Ken Bode, who usually has themarket tied-up for these weights for a feedlot company feeding 250,000 pee wees.So, when another buyer out bids Bode, you know the market is tops. Forinstance 432 wts brought $265. Bode still bought two loads. Local buyerWeaverwent home empty. Beef Palmer and your publisher got a load apiece.

It was standing room only at Crawford’sOctober 9th anniversary calf sale. The buyers andsellers took all the available seats. The Crawfordcalf sale was strong to the end. The good 1,300.lb and up feeding cows were still $2 stronger atCrawford with Beef Palmer’s feeding cow order.I did buy a load of bulls at St. Onge. It was steadywith the Crawford market. My average bull cost atCrawford was $109 and $107.75 at St. Onge. Thethinner cows were higher in spots at St. Onge.Looking at the USDA sale reports and personallyknowing the cow business and being on the scene,it looks like you Wyoming cowboys should beheading directly west with the weigh-ups. It isstrange to me that Nebraska recognizes SouthDakota brands and allows them to go across Statelines without brand inspection, but Nebraska doesnot recognize Wyoming brands unless theWyoming cowboys have official travelingpapers?? Sounds like a conspiracy to me.
