Dear Stakeholder

Subject: Basic Assessment for the Vopak Growth 4 Expansion Project, Durban, South

Africa

Vopak was granted an Environmental Authorisation (EA) for the Vopak Efficiency (Growth 4)

Project in December 2016 (ref. DM/0019/2016), in terms of Activity 34 and 51 of Listing Notice 1

(GN R 983; December 2014) of the Environmental Impact Assessment (EIA) Regulations, 2014,

of the National Environmental Management Act (Act No. 107 of 1998) (NEMA) as amended. This

included the expansion of the Farewell/ King Sites to increase the storage capacity of petroleum

products, base oils and chemicals from 32 000m3 by 118 000m3 to allow for a total storage

capacity of 150 000m3. Subsequently, an EA for an amendment application (related to a change

in layout and product storage) was granted in February 2018 (ref. DM/AMEND/ 0019/2017=B).

This amendment EA permits Vopak to commence with construction according to the approved

layout plan.

Vopak propose to expand the authorised total capacity by a further 12 400m3,. The layout plan

will not require alteration however, as the heights of the tanks will be extended to cater for the

additional storage capacity.

The Project will require Environmental Authorisation through a Basic Assessment (BA) in terms

of Activity 34 and 51 of Listing Notice 1 (GN R 327; April 2017 of the Environmental Impact

Assessment (EIA) Regulations, 2014 (as amended), of the National Environmental Management

Act (Act No. 107 of 1998) (NEMA) (as amended):

• GNR 327: 34: The expansion or changes to existing facilities for any process or

activity where such expansion or changes will result in the need for a permit or

licence or an amended permit or licence in terms of national or provincial legislation

governing the release of emissions or pollution.

• GNR 327: 51: The expansion of facilities for the storage, or storage and handling, of

a dangerous good, where the capacity of such storage facility will be expanded by

more than 80 cubic metres.

Notice is hereby given in terms of Section 38 (3) of the National Environmental Management: Air

Quality Act, No. 39 of 2004 of the intention of Vopak to apply for a variation to the Atmospheric

Emission Licence (AEL) as per the project description. The licensing authority is the eThekwini

Municipality. The enterprise is classified as a Subcategory 2.4 (Storage and Handling of

Petroleum Products) listed activity in terms of Section 21 of the afore=mentioned Act. The

relevant listed activity description is: Petroleum product storage tanks and product transfer

facilities, except those used for liquefied petroleum gas. Any person desiring to object to the use

of the premises for such purposes may do so with 14 (fourteen) days from the date of publication

of this notice by lodging an objection with Mr. Bruce Dale, Air Quality Officer, eThekwini Health

This notification serves to announce the commencement of the Basic Assessment (BA) process

and advise Interested and Affected Parties (I&AP) to register to be kept updated. We also invite

you to participate and comment on the process and reports disclosed as the project progresses.

Basic Assessment for the Vopak Growth 4 Expansion Project, Durban, South Africa

INVITATION TO REGISTER AND COMMENT

Vopak was granted an Environmental Authorisation (EA) for the Vopak Efficiency (Growth 4)

Project in December 2016 (ref. DM/0019/2016), in terms of Activity 34 and 51 of Listing Notice 1 (GN R 983; December

2014) of the Environmental Impact Assessment (EIA) Regulations, 2014, of the National Environmental Management

Act (Act No. 107 of 1998) (NEMA) as amended. This included the expansion of the Farewell/ King Sites to increase the

storage capacity of petroleum products, base oils and chemicals from 32 000m3 by 118 000m3 to allow for a total

storage capacity of 150 000m3. Subsequently, an EA for an amendment application (related to a change in layout and

product storage) was granted in February 2018 (ref. DM/AMEND/0019/2017-B). Vopak plans to optimise the design

of the Farewell, Blend and King sites to further increase the storage capacity by upgrading certain infrastructure;

including increasing the heights of the storage tanks.

Notice is hereby given in terms of the National Environment Management Act, 1998 (Act No. 107 of 1998) (NEMA) as

amended that Vopak will apply for an Environmental Authorisation (EA) for the proposed Growth 4 Expansion

through a Basic Assessment (BA) process where the storage capacity will be increased by 12 400m3. The project

activities trigger the following listed activities as per the amended EIA regulations (2017):

• GNR 327: 34: The expansion or changes to existing facilities for any process or activity where such expansion or changes

will result in the need for a permit or licence or an amended permit or licence in terms of national or provincial legislation

governing the release of emissions or pollution.

• GNR 327: 51: The expansion of facilities for the storage, or storage and handling, of a dangerous good, where the capacity of

such storage facility will be expanded by more than 80 cubic metres.

Notice is hereby given in terms of Section 38 (3) of the National Environmental Management: Air Quality Act, No. 39

of 2004 of the intention of Vopak to apply for a variation to the Atmospheric Emission Licence (AEL) as per the project

description. The licensing authority is the eThekwini Municipality. The enterprise is classified as a Subcategory 2.4

(Storage and Handling of Petroleum Products) listed activity in terms of Section 21 of the afore-mentioned Act. The

relevant listed activity description is: Petroleum product storage tanks and product transfer facilities, except those used for

liquefied petroleum gas. Any person desiring to object to the use of the premises for such purposes may do so with 14

(fourteen) days from the date of publication of this notice by lodging an objection with Mr. Bruce Dale, Air Quality

Officer, eThekwini Health Department on [email protected].

The competent authority for the BA is the Kwa-Zulu Natal Department of Economic Development, Tourism and

Environmental Affairs Development (KZN DEDTEA). Environmental Resources Management (ERM) has been

appointed as the independent Environmental Assessment Practitioner (EAP) to undertake the BA and associated

Public Participation Processes.

Stakeholders are invited to register as Interested and Affected Parties (I&APs) and to participate in the BA processes

by identifying issues of concern and providing suggestions to enhance benefits of the project. Registered I&APs will

be kept informed about the Project and will be notified when Basic Assessment Report will be made available for

comment.
