08 HEROESThe Leland Booster Club promotes their annual Denim to Diamonds dinner coming up this month. Be sure to support this wonderfully classy event with so much thought and planning. Definitely purchase a ticket and attend for an evening of fun and a fabulous auction if you are able. If not, you can still provide auction items for the raffle or even simply donate to the school to keep their sports programs top notch.
10 FITNESS IN THE SPOTLIGHTLindsay Barker from Mission Fitness expands his morning bootcamp for women to a second offering for those who are not able to attend at the break of dawn. Now besides the 5:30AM classes, you can sign up for his fabulous 4 and 6 week bootcamps starting at 9:30AM, or schedule him for personal training and/or nutritional programs.
11 LEGAL EASEJay Landrum shares clarification regarding the “what and why” behind the ‘legality’ of unlocking cellular phones. He also explains ‘jailbreaking’ your smart phone. Is it legal? Read on...
12 LEADERS All hands on deck at Graystone Elementary School as the school is preparing for this year’s annual Spring Walkathon Celebration. Make sure to read the details and find out how you can be a part of their fundraiser to cover costs for important educational programs the disctrict does not offer.
18 KID’S HEALTH Dr. Pete and Dr. Michelle Contini debate the age decision required for parents of students entering kindergarten who have birthdays that dwell on the border of “attending this year” vs. “waiting another year.” This is a controversial and important issue, so consult your pediatrician and other important individuals who know your child.

As the former co-founder of a creative design firm, I can’t help but admire
fashion and am wildly attracted to spring colors.Working with Jill Amen to choose an outfit for this issue (from The Studio boutique) was a great perk, and who better to capture it than the talented Charlene Chavez, as we enjoyed her downtown studio in its urban industrial setting, capturing the fashion essence.
Get your family excited and ready for the warm weather. Dan Chapman, manager of the Almaden Swim & Racquet Club, is reaching out to Almaden residents to promote their lovely swim and tennis facilities. The Almaden Country Club still has various social memberships available to the right prospects,
which include fine dining, family activities such as swimming, tennis, and ocassional golf as well as, full memberships with all the benefits you expect from a highend country club, for the serious golfer. Spring marks the beginning of event season and sure enough both Leland High School and Graystone Elementary School are reaching out to promote their social fundraisers, so be sure to read about these if you are interested in supporting them by your presence or with a donation. Parents in our community work very hard to supplement where the school district lacks. Make sure to also view our Save the Date events, as that is designed for Almaden residents reaching out to other Almaden residents for support, business or social reasons to promote their events. Please make sure to take the time to view each and every advertisement as the businesses in this magazine put forth great effort to design and create their ads and promotions to reach out to you. Is there a business you want to see added to the
magazine, or anything added to an advertisement already in place? Just let them knowor email me. They love to hear from you and to know that you saw their ad in 95120 Magazine to gauge effectiveness so be sure to make them aware. Visit them, give them your business when you have the need for their services and remind them you saw their ad in the 95120 Magazine! I recently heard from Maria who is new to the area, about listing local crimes. I know there is a lot of crime awareness happening currently and politicians are trying to put a finger on the pulse now, so keep the activisim, awareness and communications rolling. It is terrible that there are so many home and auto break-ins lately, but I think we are moving in the right direction to find a solution, but we have a long way to go. I began an ALMADEN CRIME WATCH group at www.95120lifestyle.com, so those concerned can join and share ideas and perhaps post crime reports, for review.

The Leland High School Booster Club will be holding its 5th annual “Denim To Diamonds” fundraiser at the Almaden Country Club on April 27, 2013 from 6:00PM to 11:00PM and
we want you to join us or provide a donation. Purchase your ticket today at www.lelandhsboosterclub.com to enjoy the festivities the volunteer Booster Club board has spent so much time planning. The evening will include cocktails, a fabulous dinner by the renown ACC chef, energetic dancing, casino gaming tables, a silent and live auction, and an exciting raffle for attendees, all while making new friends or visiting with old ones. It is a wonderful and fun evening out here in our own Almaden community, and your contributions will help foster continued athletic excellence.
As most already know, California’s public school system is struggling to make ends meet and the costs of maintaining 42 varsity and junior varsity high school athletic programs as well as all the facilities are great. Leland Boosters works hard to provide funds for the high school in three different categories: annual commitments, capital improvements to the facilities and individual team requests. The Booster Club has an annual commitment of approximately $50,000 in key areas such as $20,000 for coaching stipends not paid for by SJUSD, $10,000 for the Athletic Trainer’s salary and supplies, $10,000 for uniforms, $8,000 for scholarships for graduating seniors awarded for athletic, academic, leadership and character excellence (Pat Tillman, Raymond Leland,

Gordon Leland and Leland Character Awards), and $2,000 for the popular Athlete Appreciation pizza lunches (Fall, Winter and Spring). Capital improvements for the Leland campus always come with large price tags. Leland Booster Club tries hard to support these needs as well. Capital improvements in the last 5 years have included the football stadium press box renovation, new weight room equipment, main gym sound system, scoreboards and floor graphics, a scorekeeper’s table and gym chairs for team use, a trainer cart to give our athletic trainer easy access to all fields, a custodial golf cart, replacement of the floor in the mini gym, storage sheds throughout campus, an ice machine for the training room, a BBQ for the snack shack in Tillman stadium, and the building and installation of the Athletic Field Gateway (archway) located near the tennis courts. Leland Boosters continues to make efforts to support individual team needs as identified by the coaches throughout the year. Examples of these purchases in the last few years are soccer goals, field hockey goals, tennis nets, volleyball nets, swimming and diving record board, roll away cage, tarps, and protective screens for baseball, boys lacrosse helmets, a JUGS machine and replacement helmets, shoulder pads, jerseys, etc. for football, and coaching clinics for a variety of sports. Leland High School is very fortunate to have a dedicated and experienced coaching staff, extremely talented players, and a wonderfully supportive Almaden community. Leland Booster Club works very hard to provide what is needed each year and we need you to continue this tradition. Please join us in helping Leland High School maintain its history of producing strong teams, talented players, and most importantly, quality young men and women. Thank you for your support and we look forward to seeing you at a game or competition this spring. For more information on Denim to Diamonds and how you can offer support, please go to www.lelandhsboosterclub.com or contact our event chairperson Barb Asplund at [email protected].
“The Booster Club was thrilled when Barb Asplund agreed to be the D2D Chair this year. Thanks to Barb and her committee, it looks like the event is going to be a homerun and one you certainly don’t want to miss.” Scott McLaughlin, Leland Booster President

As the first in my circle of friends to get a smartphone, I recall spending hours identifying the phone that best fit my needs…only to then discover that virtually every phone that I had found was not available to me. My
provider either did not offer those phones at all or they did not offer them in my zip code. That was when I first realized cell phones were “locked,” making them unavailable to be used on other wireless carrier networks. As technology improved, users learned how to unlock those phones, allowing them to be used with other wireless carriers. So, if you don’t like your service with one carrier, you can take your phone to another carrier. That sounds like it’s OK, right? Well, not any more. In an October 2012 ruling issued by the Librarian of Congress, it is now illegal to unlock your cell phone (technically, it’s illegal as of January 26, 2012, since there was a grace period). In 2006, the Librarian created an exemption within the Digital Millennium Copyright Act (the “DMCA”), deciding that unlocking phones should be exempted from the DMCA. But in 2012, after reviewing the issue again, the rule changed. Why? The Librarian now believes since more unlocked phones are available for purchase, the exemption is no longer required. For example, the iPhone 5 is sold unlocked. Also, a number of electronics retailers sell a variety of unlocked phones. Another reason is the Ninth Circuit Court of Appeals has held that you do not own the software that operates your phone – you only have a license to use it. As a result, you don’t have the right to modify that software. Why unlock? If travelling internationally, by switching out the SIM card with a prepaid SIM card in another country, you can use your phone on the local network and not be gouged with high roaming charges from a U.S. service provider. Now some good news: This new prohibition on unlocking only applies to phones purchased on or after October 28, 2012. Used phones can still be unlocked, and you will still be able to buy certain phones not locked by the carrier. Buying an unlocked phone may cost you a lot more initially…a new iPhone might be $200 with a 2-year contract, but it may cost you over $600 if bought unlocked. Over the long run, though, the locked phone could cost you more. It is possible that some carriers will allow you to unlock your phone, either temporarily (such as when you have to travel) or if your contract has expired. But not all of them will under all circumstances. What if you unlock it and you get caught? Since it’s a new ruling, we will need to see. While I doubt someone from the government will show up and con-fiscate your phone, you could have your service cancelled, void your warranty, and/or be sued under the DMCA. While we don’t know how carriers will act based on this new ruling, it’s clear they are in a better position to take action if you do unlock your device in violation of the DMCA. What is jailbreaking? “Jailbreaking” your phone allows you to run applica-tions which were unavailable on your phone previously. For example, if an app is not available through iTunes, you can jailbreak your phone and then you will be able to obtain and use that app. While jailbreaking sounds illegal, it is not (at least for phones!) It’s perfectly legal under the DMCA, at least for now. Jailbreak-ing is very easily done by downloading software and running that program. No mechanical or hardware modifications are required. If you need help, just ask your 14 year old…chances are, he’s already done it to his own phone!

Graystone Elementary School
Graystone Elementary Home & School Club’s Spring Celebration Walkathon is their second largest fundraiser of the school year. This year’s theme is “Save Our School.” The school community
will be ‘kicking off’ the celebration with a Pep Rally on April 4th at 1:45pm. This year San Jose Hot Country 95.3 KRTY will be at the Pep Rally to encourage and help cheer the students on. May 10th is the Graystone Elementary’s big Spring Celebration Walkathon. During the day, each class will have one hour to walk. Then they can start walking again from 3:00-7:00pm while the parents and the Almaden community are invited to attend all the festivities, catch up with each other and watch the Graystone students raise funds. This event is to save programs such as Science, Art Vistas, Music, Computer Lab and the Library. There will be a raffle and small silent auction. Ice cream and other snack shack treats will be available for purchase. Be sure to bring your appetite, as Almaden Valley Pop Warner Football and Cheer will be selling your favorite BBQ food and will also be having sign-ups. The event will also include a “not to miss” Spring Boutique showcasing local home-based businesses and talented local artisans. If you have a home based business and want to participate in our Spring Boutique contact Jene Biester at [email protected]. All Graystone families and friends are
invited. Many volunteers will be needed before, during, and after this event. For more information, please contact us at [email protected]. This year with all the budget cuts in the San Jose Unified School District, the Spring Celebration Walkathon Fund Raiser is more important than ever. The dedicated parents volunteering to steer this annual fundraiser, are goal oriented and have been working dilligently to ensure sucess. Graystone
Elementary is very lucky to have the following chairs working on this event: Carolyn Amey, Spring Celebration chair; Michelle Curley, walkathon chair; Holly Case, auction chair; Denise Salisbury, class art project auction chair; Anne-Marie Nijssen & Maylee Pham, Teacher Time Auction Chairs; Christina Cotton, raffle chair; Jene Biester, home-based boutique, chair; Christina Johnson, pep rally chair; Katrina Healy, BBQ; and Sandi Geringer, Publicity. “We are looking forward to our very own Darren McDonald, Assistant Principal, as our MC for the Event. The Spring Celebration has always been a family fun event for our Community. To continue with that theme we are hoping to bring the KRTY Truck back the day of the event. We hope to see all of you there and thank you in advance for your
continued support whether volunteering, donating, or becoming a corporate sponsor.” Carolyn Amey

What Does a Realtor Really Do?

A good real estate agent’s primary responsibility is to explain what you should expect as you go through the process of selling or buying a home. Knowing in advance to what you are agreeing is critical for your security and peace of mind. There are over fifty pages of binding agreements that will be put in front of you for your signature(s) and “Sign here, initial there”, may not be in your best interest. Many people read the return policy of a retail store for a $15 purchase more carefully than understanding what they are signing when they buy or sell a $1,000,000 home. Peace of mind is knowing what can happen and what to avoid. This is where I earn my money. I am the number one agent in the area; just ask my clients.

March marks the beginning of kindergarten registration season. For pediatricians in the area that means writer’s cramp from fill-ing out all those school forms. For the kids, comes the dreaded
“Kindergarten Cocktail” of shots they have to receive. And for some parents, it means having to make the difficult decision, on whether to send their not quite five-year old child to kindergarten or waiting until the following year.
By moving the cut off birthdate from December 1 to September 1, the San Jose Unified School District seemed to be solving that problem. In the end, however, this simply shifted the age curve by a few months so that the youngest kids in each grade are the June-August birthdays instead of September-December birthdays. There is no remedy for the fact that there will still always be younger and older kids in every class.
While some parents are happy to wait, others might want to get there child in to kindergarten as quickly as possible either for financial reasons (no more paying for childcare) or because they believe their child is bright enough to make it in kindergarten or they feel their child will have a “leg up” by start-ing early.
The research on this matter has been divided. Some studies have shown that younger children may be better off in a kindergarten, where the standards are higher, versus an extra year in a daycare/pre-school setting. Yet, a recent study in the journal Pediatrics showed that kids who are in the youngest 1/3 of a class are more likely to be diagnosed with and treated for ADHD.
The age at which a child starts kindergarten has a ripple effect throughout the remainder of their school years and perhaps in to adult hood, that parents need to consider. That precocious child, who just turned 5, who is entering kindergarten will be barely 14 when starting high school. They will probably be the last of their friends to get a driver’s license (bummer for them, maybe not so much for you.) Because he/she is younger, it is likely that they will begin to develop later than their grade peers, which can be emotionally stressful for boys and girls alike. Athletically, they may be at a disadvantage as they will be younger and likely smaller and weaker than most of their grade peers. Being younger, they may lack the emotional or intellectual maturity to handle the increased academic demands of middle school or high school. And, when it comes time for college that child will be just barely 18 as you get them settled in their dorm room.
The fact is, most kids who have just turned five before the start of kindergar-ten are ready to go, and should go. And most of those kids will do just fine throughout their school years, academically, socially and emotionally. But for those kids who, for one reason or another, just don’t seem ready to go to kindergarten, giving them that extra year, may make all the difference in the world.
