1 Spectrophotometry and pH-metry equipment for enhanced laboratory experiments Equipment description This application is for funds to purchase pHmetry and spectrophotometry equipment for use in teaching in the programs of the Department of Chemistry and Biomolecular Sciences (CBMS). The instruments will also have application in graduate and postgraduate research training and they will be available to other departments as and when needed. Spectrophotometry is the quantitative measurement of the reflection or transmission properties of a material as a function of wavelength. It is more specific than the general term electromagnetic spectroscopy in that spectrophotometry deals with visible light, near-ultraviolet, and near-infrared, but does not cover time-resolved spectroscopic techniques. In Chemistry and Biomolecular Sciences, spectrophotometers in the ultraviolet and visible range are used extensively for the measurement of absorption spectra, quantitative determination of biomolecules present at very low concentration (typically in the parts per million or ppm range), to monitor separation of complex mixtures from chromatographic separation techniques and to determine the kinetic constants associated with very high efficacy enzyme reactions occurring in the cell. The funds requested are to purchase four additional Shimadzu spectrophotometers and to extend the capability of currently available spectrophotometers to provide complete functionality ultraviolet range experiments and kinetics experiments (quartz cuvettes, kinetics software package and printers). The currently available 10 dot-matrix printers are obsolete, and besides breaking down during lab sessions, their cartridges are also obsolete, leaving us to constantly look for unreliable “fake” cartridges. We therefore request replacement of all printers to the one that is supported by the Shimadzu spectrophotometer. A pH meter is an electronic instrument used for measuring the pH (acidity or alkalinity) of a liquid (though special probes are sometimes used to measure the pH of semi-solid substances). A typical pH meter consists of a special measuring probe (a glass electrode) connected to an electronic meter that measures and displays the pH reading. In biochemistry, pH-metry is used to understand the acid-base properties of biological molecules and follow reaction kinetics involving acids and bases. The funds requested are to provide additional pH-metry equipment (pHmeters, electrodes, stir bars and micro-burettes) so that updated laboratory experiments can be incorporated into the teaching curriculum. The comprehensive spectrophotometric and pHmetric experiments that the equipment will make accessible to our students will benefit them enormously in the work place (industry or research) where instrumental methods of biomolecular sample analysis are the norm. Besides the work-readiness of our graduates, these techniques align with the Sustainability and Ethical Practice imperatives of Macquarie University as they require much smaller sample volumes and less sample preparation, reducing the use of reagents. Waste is thus minimized, and it will move the department further towards Green Science principles.

Student learning enhancement Within CBMS, spectrophotometry and pH-metry are used extensively in CBMS223 as well as in BIOL210/CBMS215 and CBMS308/CBMS332/CBMS337/ CBMS330 (CBMS Capstone unit) as well as Masters level units (including CBMS832), spanning Biomolecular Sciences, Chemistry, Biology and Biotechnology. The extent of use of the technique varies from one unit to another, but it is never less than two practical sessions during a semester, and sometimes much more than this. For CBMS223 alone, based on 2012 enrollment numbers of 212, the total student-hours of use would be in the order of 2544 per year for spectrophotometry and 1272 per year for pHmetry. In addition to this use at the coursework programs, these instruments are routinely used by postgraduate research students in their research projects. CBMS currently has only 8 functional pHmetry setups and 10 spectrophotometers capable of kinetics experiments for teaching purposes but with increasing enrolments in our units, this small number of instruments is proving to be a limiting factor to our ability to provide a good learning experience for our students. The quality of the student experience is being degraded by overcrowding at the instruments. Students are required to work in groups of upto four round a single instrument/setup. This makes the work area crowded and thus accident-prone, students do not have sufficient time to operate the instrument for themselves, and the "observing" students (those who are not operating the instrument) become disengaged from the learning process. In other cases, students are required to wait a considerable time before they can "run their samples" because of the number of students needing to use the same Instrument/setup. This delay may adversely affect the other components of their experiment. For staff, timetabling is an issue, with multiple units wishing to make use of the instruments and causing a significant amount of administrative work in trying to ensure equitable access for all teaching units. Since 1996, BIOL223, now CBMS223 has had five 4-hour practical classes, with several experiments run in each lab session, resulting in a stressful outcome for the students, suggesting the requirement for a more streamlined approach to shorter (3-hour sessions) but more focused experiments, run over 6 sessions. With increasing student enrollments, and to synchronize better with the Biology units using the same labs, optimize timetabling, minimize the preparation time and technical assistance required, we have managed to recast the practical classes into six 3-hour laboratory sessions but require additional pH-metry setups as well as software, equipment and printers to enhance the spectrophotometry setup. The additional spectrophotometers will be available for all other CBMS units (including CBMS332/832 - MBiotech, of ~50 students) in the recently renovated E7B labs, which overlap with CBMS223, making equipment scarce and difficult to transport as these are extremely heavy (leading to OH&S issues for technical staff) and very sensitive, precluding frequent moving between buildings. The budgeted items will address our equipment deficiencies, and will be available for a maximum class size of 256, relieving most of the pressure described above, by reducing the group size to two students, which is the good number for learning purposes, and reduce waiting times for these instruments. A further benefit of purchasing these items is that they represent the latest in industry-standard equipment. They represent exactly the types of instruments (and associated

analysis software and methods) that our graduates are likely to encounter when they enter the workplace. It is therefore of benefit to Macquarie's reputation (from graduate experience survey responses) to provide our coursework and research students a "work-ready" experience. It is appropriate that we have teaching tools that can both teach the principles and skills that we want our graduates to have, and are also seen to be relevant to our graduate's workplace experience. Alignment with University-wide objectives The equipment requested will directly support the following goals of the Macquarie University's Academic Plan: Provide an inspiring educational experience: These instruments will help us to

"deliver relevant, future-focussed and high quality programs" and "prepare students for the future" as discussed above. These additional instruments will provide an improved in-depth learning experience with the programs already providing “intellectually challenging learning experiences”

As topics of study, pH-metry and spectrophotmetry are perhaps the most intellectually challenging, and improved access to these equipment will enhance students' comprehension of several biochemical/chemical/biological/biotechnological concepts and topics.

Build and maintain a high quality, safe and sustainable physical and social

environment: The overcrowding described above will be relieved, allowing us to "ensure a safe, positive and supportive experience and environment", and further "develop the University's physical and virtual environments to provide a quality learning experience". The new instruments will strongly complement the recently refurbished teaching laboratories in which they will be situated.

Enhance research performance: These instruments provide good research

platforms, at the undergraduate, graduate and postgraduate level. This adds to our goal of developing a "pervasive research culture and an ethical approach to research and scholarly activities". These instruments will be used for undergraduate and Masters research-based projects and in Honours, MPhil and PhD projects. They will add to our fostering of "world-class research in targeted areas and [provision of] world-class research training".

Project Management and Budget We are requesting $47,955, with relevant quotations attached and summarized below, but will negotiate further with the suppliers for the best price for the minimum package, in order to increase the value of the package by negotiating on additional features such as extra licences for the software, additional accessories, etc. There may also be changes in the exchange rate, which at the moment is very favourable for us, but the cost of the instruments may increase if the Australian dollar devalues relative the American dollar.

Quotations (ex-GST) have been received from the major reputable Australian suppliers of laboratory instruments in Australia. The costs are as follows for the two experimental setups: pHmetry: $9,127 spectrophotometry: $38,868 Total: $47,995 The breakdown of the setup costs is shown below: pH-metry 1. pHmeters

There are unlikely to be any extra costs associated with these instruments. There are no infrastructure or mechanical works required for there installation. Ongoing regular maintenance is trivial and can be performed in-house. The warranties provided with the instruments are more than adequate to cover any failures in the instruments. Also, the models selected here are either the ones currently available in our lab or newer versions of the same, which have proven to be robust and problem-free. Specifically, those requested through this grant application are specially designed for ruggedness and hassle-free operation in a teaching situation. Some staff and technical members of the department are very familiar with the operation of these instruments and can provide ongoing oversight, training and regular calibration and maintenance. The incorporation of the instruments into our teaching programs is straightforward and will be essentially invisible to the operation of the teaching experiments. As soon as the instruments are supplied, they can be installed in the teaching laboratories and be available for use. While CBMS223 has already developed new teaching experiments to utilize the full capabilities of these instruments, there will be opportunities for other units to do the same, which will constitute the long term benefit of acquiring these instruments, which extends beyond the period of this grant application. Outcome and Evaluation As discussed above, the presence of these instruments will allow us to provide a high quality learning experience through the provision of modern instrumentation aligned with current commercial practice and academic research. It should result in improved

undergraduate student satisfaction by relieving over-crowding in undergraduate and Masters teaching laboratories, and supporting Macquarie University’s reputation as a modern and forward-looking institution. As far as students are concerned this is typically only obvious in the negative - if the instruments are inadequate and the learning conditions are poor, the students feel dissatisfaction, while if sufficient instruments are available and updated, and the learning conditions are good, the students typically do not "see" this unless a direct comparison to poorer conditions can be shown. The increase in instrumentation will contribute to an improvement in sustainable teaching through easier management of laboratory-based teaching, reduced timetabling difficulties, alignment with current and future workforce and postgraduate training practices. The instruments should also provide improved postgraduate student satisfaction through increased access to instrumentation. Surveying students on their opinions about the presence of the instruments within a teaching experiment is not particularly useful as the students have no baseline against which to compare their response. As we have already incorporates these instruments within our programs, the addition of more/enhanced instruments can only fundamentally change the teaching method by making shorter, in-depth laboratory sessions feasible. In order to compare before-and-after experiences in specific experiments, we will enlist current CBMS post-graduate students to carry out the new 3-hour experiments and compare it to their experience with the current intense 4-hour sessions (details in Appendix 1). We believe it will be valuable to ask teaching staff (lecturers, demonstrators and technical staff) for their opinion concerning the usefulness of the increased instrumentation, as they will have a long term view of the learning experience of the students, and they will be able to evaluate the change in that experience. They will be able to comment on the improvement in their ability to manage the classes through easier timetabling of experiments, reduced demand for individual instruments, etc. Individual Honours and postgraduate research students may also be contacted for their opinion regarding improved access to equipment. We propose that the evaluation method will be to ask staff involved in teaching which uses these instruments and targeted undergraduate, graduate and postgraduate students for their opinion on the use of the instruments. This polling will take the form of a questionnaire, with the responses summarized for inclusion in the final grant report. We are happy to consider a different methodology if that is deemed appropriate.

Appendix 1: Suggested questions for before/after comparison of laboratory experiments from post-graduate students. We already have a number of HDR students in CBMS and in Biology, who went through the 4-hour CBMS223 labs and a number of HDR students who are/were tutors for the same. We are going to request them to basically run the experiments in cohorts during next year's 3-year labs (two extra setups) and compare their experiences on a. comprehension of the theory b. ease of experimentation c. ability to impart a learning experience (as a tutor). A questionnaire expanding on the LEU questions, addressing specifically laboratory classes will be used: Laboratories & Practicals LPU01 The laboratory sessions helped me to link classroom/textbook theory and practice. LPU05 The practical sessions were valuable for my understanding of this unit. LPU08 Laboratory/practical sessions were a valuable component of this unit. LPU10 Practical sessions were well organised. LPU11 The organisation of material presented in the laboratory sessions assisted my understanding of the unit. Group Work GWU01 The team work exercises have assisted my learning in this unit. GWU02 Group work was integrated successfully into this unit. Graduate Capabilities GCU08 In this unit, I learnt how to work effectively in a team. GCU09 This unit gave me the chance to enhance my critical thinking skills. GCU10 This unit related subject material to real life situations. GCU12 This unit developed my problem solving skills. GCU13 By solving problems in this unit, I gained a better understanding of the unit content. GCU17 This unit helped me to plan my work efficiently. GCU18 This unit gave me the opportunity to enhance my interpersonal skills. GCU24 This unit enhanced my analytical skills. These 15 questions will be adapted for comparing 4-hours labs vs. 3-hr labs.

1. These conditions shall apply to all goods sold by Shimadzu Scientific

(Oceania) Pty Ltd (“Shimadzu”) to the purchaser of such goods ("the Purchaser") unless

varied in writing by a duly authorised representative of Shimadzu

under, in connection with, or arising out of these terms and conditions at the same time

and in the same manner as the amount on which the GST is calculated is paid.

3.3 If the purchaser has been granted credit facilities by Shimadzu, the price of the goods is

due and payable in accordance with the terms and conditions of those credit facilities.

3.4 Unless otherwise agreed in writing by Shimadzu, payment shall be made in full within 30

days from the date of the invoices. For consumable and small ex

payment is to be 30 days from delivery. The time of payment is of the essence of the

contract; all payments must be made on or before the due date as a condition precedent

to future deliveries under this or any other contract.

Delivery

4.1 Shimadzu will use its best endeavours to fulfil any accepted orders but reserves the right

to cancel any order relating to any item or items which in the opinion of Shimadzu is

impractical or uneconomic to produce or supply.

4.2 Shimadzu will use its best endeavours to make delivery at the time specified in an

accepted order (if a time is specified) but will not be responsible for any loss or damage

sustained by the Purchaser or any other person, by reason of any delay in delivery, supply

or completion or any failure to fulfil an order or make delivery, howsoever caused.

Shimadzu may suspend delivery, supply or completion and/or terminate the contract in

the event of a delay or failure to deliver caused by labour dispute or acts of force majeure

including but not limited to acts of God, war, lightening, fire, earthquake, storm, flood,

explosion, unavailability or delay in availability of equipment, materials or transport, and

any other cause of these kinds or otherwise which is not within the control of Shimadzu.

Claims

5.1 Shimadzu is not responsible for any loss or damage to goods in transit including but not

limited to all types of property, pecuniary or other loss or damage including consequential

loss or damage. Shimadzu will render to the Purchaser such assistance as may be

necessary to press claims on carriers provided the Purchaser notifies Shimadzu and

carriers in writing immediately the loss or damage is discovered on receipt of goods and

lodges a claim to the carrier within 3 days of the date of receipt of the goods.

5.2 Claims for goods supplied in error, or for discrepancies in quantities delivered,

accepted unless made within five commercial days of receipt of order.

6. Requests to return stock for credit are at the sole discretion of Shimadzu and will only be

considered when: a) The request is made by the original purchaser; b)

purchased from Shimadzu and the relevant invoice is quoted; c) The goods are in original

condition; d) The goods were purchased within the previous six months; e) Freight is

prepaid; and f) The goods have more than three months before expiry

Installation

7. In case of equipment which Shimadzu or the manufacturer undertakes to install, it shall be

the Purchaser's responsibility to provide any service utilities required, (eg. electrical power

outlets, water outlets, drains, compressed air line, gas supplies, etc). If special handling

equipment is required, such as heavy lift gear for movement of equipment to and/or at

the installation site, the cost of hiring or using such equipment and any associated charges

will be additional to the Purchaser's account. Installation will be made at the time of

delivery or as soon as practicable thereafter, and the equipment will be at the Purchaser's

risk from the time of delivery. Unless otherwise mutually agreed, Shimadzu's

responsibility to install such equipment may cease if the installation is deferred by the

Purchaser.

Warranty and limitation of liability

8.1 Shimadzu warrants that all goods sold are free from defects in materials and workmanship

at the date of dispatch by Shimadzu. Any defect in workmanship or materials occurring

within 12 months from the date of invoice or acceptance in the case of installations, will

be replaced or repaired free of charge for components provided the parts are returned to

Shimadzu at the Purchaser's expense. In the case of equipment installed at the

Purchaser's site, all travel expenses and travelling time may be charged at ruling rates

applicable. However, because Shimadzu does not have control over the manner in which

the goods are used after purchase, the warranty does not apply to electronic tubes,

lamps, seals, check valves, illumination sources, items wholly or partly of glass, silica or

ceramic material, thermocouples, batteries, electrical elements and other items

considered as consumables, nor does it cover the repair of any fault or the replacement of

any defective part resulting from negligence or malpractice of the Purchaser or its

servants.

excluded in relation to the goods and any services provided by Shimadzu and, to the

extent permitted by law, and subject only to express exceptions contained in these terms

and conditions Shimadzu will not be liable for any loss, damage, injury or death which the

Purchaser or any other party sustains, incurs or is liable for, arising directly or indirectly

from the supply of goods by Shimadzu, the promotion or sale of the goods by the

Purchaser, or the provision of services by Shimadzu, or out of the negligence of Shimadzu.

In the event of any statutory claims that cannot be excluded Shimadzu's liability shall, at

Shimadzu's opinion, be limited to:

a) The replacement of the goods or the supply of equivalent goods; or

b) The repair of the goods; or

c) The payment of the cost of replacing the goods or of acquiring equivalent goods;

d) The payment of the cost of having the goods repaired; or

e) In the case of services, the supply of the services again, or, the payment of the cost

of having the services supplied again.

8.5 The warranty and any other express warranties given by Shimadzu shall be void if the

Purchaser undertakes any unauthorised modification or servicing of the equipment other

than that deemed "normal user maintenance" as specified in the operation manual of the

equipment.

Risk and Title

9.1 The risk on the goods shall pass to the Purchaser immediately upon dispatch of the goods

by Shimadzu (unless otherwise agreed) but title in them shall not pass to the Purchaser

until the Purchaser has discharged all outstanding indebtedness to Shimadzu in respect of

the goods or any other amounts owing to Shimadzu.

9.2 Until payment in full of such indebtedness has been made, the Purchaser acknowledges

and agrees that:

a) The goods supplied are held by the Purchaser as bailee;

b) The Purchaser must store the goods supplied in such a way that it is clear that they are the

property of Shimadzu;

c) Shimadzu may at any time terminate this contract and the bailment and the Purchaser

hereby irrevocably gives Shimadzu, its agents and servants, leave and licence without the

necessity of giving any notice to enter on and into any premises occupied by the Purchaser

to search for and remove any of the goods supplied to or in which Shimadzu has

as aforesaid without in any way being liable to the Purchaser or any person or company

claiming through the Purchaser and if the goods or any of them are wholly or partially

attached to or incorporated in any other goods, Shimadzu may where pract

or sever in any way whatsoever as may be necessary to remove the goods;

d) If the goods are sold, the Purchaser acknowledges that such a sale is by the Purchaser as

bailee for and on behalf of Shimadzu and the Purchaser must hold the procee

sale in a separate account on trust for Shimadzu and identified as such in the books of the

Purchaser.

Indemnity

10. If the Purchaser breaches any of these conditions which apply to it wholly or partly,

including without limitation, failing to accept the goods delivered, the Purchaser shall

indemnify and shall hold Shimadzu harmless from any and all loss, costs and damages

incurred by Shimadzu on account of such breach including but not limited to all taxes,

charges and costs, including product storage costs.

Interest

11.1 The Purchaser must pay interest to Shimadzu where payment is not made by the due

date. Interest is payable on any of the amounts owing due and payable, but unpaid

(including interest payable under this claim but unpaid), f

11.2 The rate of interest will be the sum of 2% plus (the Westpac 90 day bank bill rate as

to investigate the credit worthiness of the Purchaser from time to time including (but

without limiting the generality of the foregoing) the making of inquiries of persons

nominated as trade referees, the bankers of the Purchaser or any other credit providers

(the information sources) or credit reporting agencies and the Purchaser hereby

authorises the information sources to disclose to Shimadzu such information concerning

the Purchaser which is requested by Shimadzu.

Governing Law

13. This Contract shall be governed by and construed in accordance with the laws in force in

Delivery

4.1 Shimadzu will use its best endeavours to fulfil any accepted orders but reserves the right

4.2 Shimadzu will use its best endeavours to make delivery at the time specified in an

accepted order (if a time is specified) but will not be responsible for any loss or damage

sustained by the Purchaser or any other person, by reason of any delay in delivery

or completion or any failure to fulfil an order or make delivery, howsoever caused.

Shimadzu may suspend delivery, supply or completion and/or terminate the contract in

the event of a delay or failure to deliver caused by labour dispute or acts of

including but not limited to acts of God, war, lightening, fire, earthquake, storm, flood,

explosion, unavailability or delay in availability of equipment, materials or transport, and

any other cause of these kinds or otherwise which is not within the control of Shimadzu.

Claims

5.1 Shimadzu is not responsible for any loss or damage to goods in transit including but not

limited to all types of property, pecuniary or other loss or damage including consequential

loss or damage. Shimadzu will render to the Purchaser such assistance as may be

necessary to press claims on carriers provided the Purchaser notifies Shimadzu and the

carriers in writing immediately the loss or damage is discovered on receipt of goods and

lodges a claim to the carrier within 3 days of the date of receipt of the goods.

5.2 Claims for goods supplied in error, or for discrepancies in quantities delivered, will not be

accepted unless made within five commercial days of receipt of order.

Returns

6. Requests to return stock for credit are at the sole discretion of Shimadzu and will only be

considered when: a) The request is made by the original purchaser; b) The goods were

purchased from Shimadzu and the relevant invoice is quoted; c) The goods are in original

condition; d) The goods were purchased within the previous six months; e) Freight is

prepaid; and f) The goods have more than three months before expiry.

Installation

7. In case of equipment which Shimadzu or the manufacturer undertakes to install, it shall be

the Purchaser's responsibility to provide any service utilities required, (eg. electrical power

outlets, water outlets, drains, compressed air line, gas supplies, et

equipment is required, such as heavy lift gear for movement of equipment to and/or at

the installation site, the cost of hiring or using such equipment and any associated charges

will be additional to the Purchaser's account. Installation will be made at the time of

delivery or as soon as practicable thereafter, and the equipment will be at the Purchaser's

risk from the time of delivery. Unless otherwise mutually agreed, Shimadzu's

responsibility to install such equipment may cease if the installation is deferred by the

Purchaser.

Warranty and limitation of liability

8.1 Shimadzu warrants that all goods sold are free from defects in materials and workmanship

at the date of dispatch by Shimadzu. Any defect in workmanship or

within 12 months from the date of invoice or acceptance in the case of installations, will

be replaced or repaired free of charge for components provided the parts are returned to

Shimadzu at the Purchaser's expense. In the case of equi

Purchaser's site, all travel expenses and travelling time may be charged at ruling rates

applicable. However, because Shimadzu does not have control over the manner in which

the goods are used after purchase, the warranty does not ap

lamps, seals, check valves, illumination sources, items wholly or partly of glass, silica or

ceramic material, thermocouples, batteries, electrical elements and other items

considered as consumables, nor does it cover the repair of any fault or the replacement of

GENERAL CONDITIONS OF SALE

These conditions shall apply to all goods sold by Shimadzu Scientific Instruments

(Oceania) Pty Ltd (“Shimadzu”) to the purchaser of such goods ("the Purchaser") unless

Orders cannot be modified or cancelled after acceptance except with the written consent

a) The replacement of the goods or the supply of equivalent goods; or

b) The repair of the goods; or

c) The payment of the cost of replacing the goods or of acquiring equivalent goods;

d) The payment of the cost of having the goods repaired; or

e) In the case of services, the supply of the services again, or, the payment of the cost

of having the services supplied again.

8.5 The warranty and any other express warranties given by Shimadzu shall be void if the

Purchaser undertakes any unauthorised modification or servicing of the equipment other

than that deemed "normal user maintenance" as specified

Risk and Title

9.1 The risk on the goods shall pass to the Purchaser immediately upon dispatch of the goods

by Shimadzu (unless otherwise agreed) but title in them shall not pass to the Purchaser

until the Purchaser has discharged all outstanding indebtedness to Shimadzu in respect of

the goods or any other amounts owing to Shimadzu.

9.2 Until payment in full of such indebtedness has been made, the Purchaser acknowledges

and agrees that:

a) The goods supplied are held by the Purchaser as bailee;

b) The Purchaser must store the goods supplied in such a way that it is clear that they are the

property of Shimadzu;

c) Shimadzu may at any time terminate this contract and the bailment and the Purchaser

hereby irrevocably gives Shimadzu, its agents and servants, leave and licence without the

necessity of giving any notice to enter on and into any premises occupied by the Purchaser

to search for and remove any of the goods supplied to or in which Shimadzu has property

as aforesaid without in any way being liable to the Purchaser or any person or company

claiming through the Purchaser and if the goods or any of them are wholly or partially

attached to or incorporated in any other goods, Shimadzu may where practical disc

or sever in any way whatsoever as may be necessary to remove the goods;

d) If the goods are sold, the Purchaser acknowledges that such a sale is by the Purchaser as

bailee for and on behalf of Shimadzu and the Purchaser must hold the proceeds of suc

sale in a separate account on trust for Shimadzu and identified as such in the books of the

Purchaser.

Indemnity

10. If the Purchaser breaches any of these conditions which apply to it wholly or partly,

including without limitation, failing to accept

indemnify and shall hold Shimadzu harmless from any and all loss, costs and damages

incurred by Shimadzu on account of such breach including but not limited to all taxes,

charges and costs, including product storage costs.

Interest

11.1 The Purchaser must pay interest to Shimadzu where payment is not made by the due

date. Interest is payable on any of the amounts owing due and payable, but unpaid

(including interest payable under this claim but unpaid), from and in

for payment to the date of actual payment (as well as before judgement);

11.2 The rate of interest will be the sum of 2% plus (the Westpac 90 day bank bill rate as

published in the Australian Financial Review) calculated with reference with the successive

periods of 30 days commencing on the day following the due date for payment. I

accrues from day to day and may be compounded by Shimadzu at 30 day intervals.

Credit Reporting

12. Where goods are supplied to the Purchaser on credit the Purchaser irrevocably authorises

Shimadzu, its employees and agents to make such inquiries

to investigate the credit worthiness of the Purchaser from time to time including (but

without limiting the generality of the foregoing) the making of inquiries of persons

nominated as trade referees, the bankers of the Purchas

authorises the information sources to disclose to Shimadzu such information concerning

the Purchaser which is requested by Shimadzu.
