CONDITIONAL USE PERMIT

PROCEDURE: Any person seeking a conditional use permit shall first submit an application to the Planning Comm ission. Planning Commiss ion meet ings are held the second and fourth Thursday of each month. The application will be placed on the first available Planning Commiss ion meeting aqenda after review by city staff and advertising requirements in the local newspaper have been met. The City will send written notice of the application to the residents and/or property owners within a 300 foot radius of the applicant's property. A public hearing will be held before the Planning Commission to ascertain the interest in and determine the advisability of issuing the permi t. Any application with an occupancy load of 25 or more, or a cost of total site development of $250,000 or more, must be forwarded to City Council for final approval.

No approval shall be granted unless the Commission is satisfied that the applicant will meet all the conditions set forth in Title 10, Chapter 7 of the Ordinances of South Weber City, as well as any others that may be required by the Planning Commission and/or City Council. Upon approval , a permit shall be issued which states the permitted conditional use and any special conditions that apply thereto.

ORDINANCE: Please refer to South Webe r City Code Title 10, Chapter 7, when preparing your application. The City Code is available for review on the City's website www.southwebercity.com or at the City office building.

EFFECT ON PRIVATE COVENANTS AND AGREEMENTS: Title 10, Zoning Regulations , of the South Weber City ordinances shall not nullify the more restrictive provisions of private covenants and agreements entered into between private persons, but shall prevail notwithstanding such provisions which are less restricted. Enforcement of private covenants and agreements affects only the parties in interest and the responsibility therefore may not be assumed by the City or its agents.

APPEAL: In the event of disapproval or objection to any condition or limitation requirements by the Planning Commission under subsection 10-7-3A, appeal may be made to the City Council. Said appeal shall be made in writing, addressed to the Council and shall set forth specifically the matter objected to, and must be filed within ten (10) working days of the applicant being notified in writing of the Planning Commission 's decision.

In the event of disapp roval or objection to any condition or limitation requirement made by the City Council under subsection 10-7-3B, appeal may be made in writing, addressed to the Board of Adjustment and shall set forth specifically the matter objected to, and must be filed within ten (10) working days of the applicant being notified in writing of the City Council's decision.

INSPECTION: Following the issuance of a conditional use permit , the Zoning Adm inistrator shall approve an application for a building permit and shall insure that the development is undertaken and completed in compliance with said permits .

TIME LIMIT: Unless the uses and conditions prescribed in the conditional use permit are implemented within a maximum period of one year from its issuance, the conditional use permit shall expire.

BUSINESS LICENSE: If the nature of the conditional use is such that it requires a business license and a business license has not been obtained for the conditional use within one year from the date of conditional use permit issuance, the permit shall expire.

IF CONDITIONAL USE IS FOR A BUSINESS, THE FOLLOWING STATE REGULATIONS MUST BE MET:

Copy of property plat(s) showing all of the subject property, clearly marked , and all adjoining properties within 300 feet of the subject property . This can be obtained from the County Recorder's office or a copy from the plat held in the South Weber City office for a nominal fee.

Site plan (if applicable), drawn to scale, showing any and all of the following : the building lot and dimensions, building locations, landscaping, existing trees and shrubbery, off street parking facilities , vehicular and pedestrian circulat ion, location and width of abutting streets, existing and proposed grades, surface drainage, and a north arrow. In addition the plans shall include scale drawings of major exterior elevations , and proposed exterior color scheme.

A complete set of typed mailing labels listing the names and mailing addresses for owners of property within 300 feet from the outer boundary of the property, for notification. Include a list delineating the parcel/tax serial number(s) for each property owner,

Applicants must do their own research of names and parcel/ta x serial numbers , Neither South Weber City, nor Davis County Recorder's Office provides this service. Applicants may obtain the names and tax serial numbers from current property plat(s) on file at South Weber City or Davis County Recorder's Office. Mailing addresses can be obtained from the telephone book . Any addresses not found in this manner may be obtained by providing the names and tax serial numbers to the Davis County Computer Dept., Davis County Courthouse, Farmington, Utah, whereby, for a fee, they will print labels showing the names and addresses. Please be prepared to allow two to three days for this service.
