  • When you glance at the calendar and see that you are in the third month of the year some-times you can’t believe that Jan and Feb have already flown by. For many it is a relief just to have made it this far and survived the hard-est months of the year. Debt Counsellors have been seeing more consumers than ever apply-ing for their help and have been busy trying to assist consumers who have been stretched too thin by Repo Rate increases and petrol price hikes.

    However the new year has also meant new changes to the industry. There are new regula-tions that have been issued by the DTI Minis-ter which will change the way information is shown on your credit record. Will this make credit reports better for consumers and less useful for credit providers? Read our article to see what you think.

    Another large change for the industry, in the form of the National Credit Amendment Bill, is coming soon as the Bill passed it’s second to last hurdle recently. We catch up on where the Bill is now and what happens next in our news section.

    BDCF refuse NCR MonitoringThe Black Debt Counsellors Forum (BDCF) recently told the NCR that they were not going to cooperate with the monitoring visits by NCR staff until certain key issues (regarding how the NCR monitors Debt Counsellors) were sorted out. The NCR and BDCF recently sat down and discussed the matter. It seems they were able to come to an agreement and that there will now be better communication and education about monitoring as well as monitoring tools.     Know your rightsYou may not know it but March is Consumer Rights Education Month. The idea is for organisations like the NCR and Credit Ombud to help educate consumer about their rights. The NCR have to do so all the time because of the requirements of the NCA anyway but they are putting in extra effort this month.     DCASA announce conference dateThe annual day long Debt Counsellors Association of South Africa will be held in Gauteng, at Emperor’s Palace, on the 20th of August 2014.

    Mpho (Thekiso) Lekala leaves FNBThis month saw Mpho (Thekiso) Lekala announce her resignation from FNB. She announced that she will in fact be leaving the debt review space entirely. While not writing off the chance that we may see her again she says it is time for a change. In the wake of Mpho’s departure FNB announced changes to their escalation process for matters which exceed normal time frames or require extra attention.     The National Credit Amendment Bill moves to next phaseChanges to the NCA are underway in the form of the National Credit Amendment Bill. After much research the DTI proposed the Bill and Parliament spent weeks researching and holding public hearings about possible changes to the NCA (see the Feb 2014 issue of Debtfree DIGI). The Bill was then debated at the National Assembly and has now been passed on to the National Council of Provinces and then the President to sign into law. Once signed by the President, the Bill will be published in the Government Gazette. This means that it is officially law and has to be adhered to. Soon after that we can expect that new regulations, based on the Bill, will be published by the Minister of the DTI.

    New Regulations About the Removal of Adverse Credit Information DTI minister Rob Davies made many consumer friends this month when he announced new regulations which will make the various Credit Bureaus stop showing some negative information about consumers on their credit reports. Credit Providers are very concerned about how this will effect their ability to properly evaluate consumers credit worthiness. They have said they will now have to increase their

    cost of credit to cover the added risk. Read more about it in this issue.

    NCR advertisingThe NCR have continued to really splashed out recently with regard to advertising information about debt review and the use of Payment Distribution Agencies. Adverts have been placed in many newspapers as well as featured on the radio. The NCR have even updated their Billboard in Gauteng about the use of PDAs while under debt review.     Increased Petrol Price places consumers under strainFuel continues to climb into record high territory as prices once again rose in March. Debt Counsellors country wide are reporting higher than normal numbers of applications for help as consumers face the Repo Rate increase (0.50 %), inflation and higher transport costs.

    FOR YOU?Some love it, others hate it.

    People say it is just a political ploy to confuse consumers

    into thinking their situation has improved, others are convinced

    it will open the gateway for consumers to get work and

    accommodation. But exactly what is the credit information amnesty?

  • The term “amnesty” is a tricky one. As soon as most people here that word linked to anything about credit they assume they will not have to pay their debts, since they will receive “amnesty”.

    The official term for the “amnesty” is, in fact, the removal of adverse consumer credit information. It has been brought about by the Minister of the DTI who recently published new regulations (for the National Credit Act). These regulations are now changing the way credit bureaus show information about consumers. It also makes credit providers take action to remove past bad listings when debts are paid up.

    Will I still have to pay my debt?Unfortunately, yes. Even though some information will not be present on your credit bureau report, you will still be liable for all your existing debts.

    However remember that most debts that have not been collected on for over 3 years are prescribed (so you don’t have to pay them) and with the recent National Credit Amendment Bill soon to be in effect, it will become illegal for companies to try trick you into paying old uncollected debt that is prescribed.

    So what will change on my credit bureau report?There are many different credit bureaus in SA (see the list). While they all do things slightly different, all have ways of showing when a consumer is not paying well or at all. In fact this is quickly evident if you simply look at the month to month payment history. However some reports also include some negative

    terms such as: slow payer, delinquent, uncontactable. The reports also show when a dispute has been lodged or a matter has been handed over to legal (or written off - which often simply means sold to a debt collection company). Some Reports have in the past also had certain symbols which are shown which indicate negative things about the account or consumer. All these things will now have to change.

    Also information about past judgments which have now been paid up by the consumer will have to be removed. This will now be ongoing for all paid up judgments.

    Why?It seems the concern is that when a consumer applies for a job or accommodation and someone who knows little about finances or credit reports tries to read the consumers report and sees one of these terms they immediately decide the consumer is untrustworthy. By removing this information or making it harder to see if a consumer is and has been paying all their accounts it is hoped this will reduce the negative impact that drawing a credit bureau report can have. It is also hoped that by removing information about how in the past a consumer had many judgments which they have now paid up it will present a more accurate and positive picture. Others hope that by removing this information it will allow some who previously stood no chance of getting credit the opportunity to go apply for new debt.

    Credit Bureaus, credit providers as well as many Debt Counsellors are very worried about the possible negative effects of removing this

  • information. It will make a little more work for credit providers since they will have to now tell the credit bureaus when a judgement is paid up (ok so that is not a huge deal). It may allow credit providers to give consumers access to credit who have for many years been very irresponsible with the credit they had. They would thus be a higher risk and creditors would not know to allow for that.

    Could this result in consumers getting access to credit who wont pay it back responsibly?Well, at the moment half of all credit users are behind on payments so the reality is 50% of all consumers are bad at paying their credit. What’s the point of adding more symbols or phrases just to say that? With added guidelines on how credit providers evaluate consumers ability to repay there will be less room for granting credit to consumers who can’t or won’t pay. So it is clear that there is more of a psychological effect to the changes than anything else.

    The changes will start to come into effect on the 1st of April 2014 (no joke).

    DEALING WITH DEBT STRESS

    One of the untold elements to dealing with debt is the stress it causes. That stress feeds into all elements of your life. Sadly many people in debt soon find their relationships with family, colleagues and friend in trouble. Debt stress can soon become work stress which can put you in danger of becoming unproductive or even losing your employment. Often times

    debt stress can leave you restless or unable to sleep at night. Less rest means you are more susceptible to further stress. It is a vicious cycle!One aspect of dealing with debt therefore is learning to deal with stress as a whole. Learning how to improve in this area can stop the stress cycle and in fact can help in dealing with your debt and its causes as well.

  • Here are a few ways you can reduce your stress and not let your stress levels effect you at home and work: Lets first look at a few short term solutions to get the ball rolling.

    • Count to 10 before saying something you will regret. Really try to hold back. Quitting your job will not solve your problems. Shouting at your family will not make you a happier person.• Switch to decaff coffee or herbal tea• Listen to your favorite song. It’s a great way to take a time out and regroup• Remove yourself from the problem and go for a short walk in the fresh air• Take nice deep breaths• Have a 20 minute nap (preferably not at your desk at work though)• Hit the gym when feeling overwhelmed• Have a soothing bath with your favorite bath salts or bubbles• Learn to say No. You cant please everybody all the timeThe last one here is probably the most important. Being overloaded with too many obligations and not delegating will soon have you overwhelmed and prone to stress. In many cases asking if you can have a bit longer to accomplish a task or turning the task down is the best way to remain in control. Do not assume you are a multitasking guru.

    What about bigger/ long term solutions?

    • Talk to somebody, parent, friend, boss or professional about the pressures you face.• Always take a lunch break at work, clear your head and get some perspective. Even if you work for yourself.• Do fun things as a family, including chores, preparing meals and lunches for the next day.• Join/Start a dinner club, where each week one family hosts the meal and all contribute towards the dinner. This way you get to spend time with your friends, and have one less night on which you have to cook.• Each morning make a plan for the day where you delegate tasks and deadlines that need to be met. Why not write things down. It really works and makes you focused and productive.• Take your dog for a walk each evening or early morning to clear your head and give Fido some attention. Alternatively go for a jog. Its healthy and will help you think things over in a non pressurized environment.• Attend a Yoga or Pilates class at least once a week if you are a member of a gym.

    If you are experiencing debt stress another positive thing to do is talk to a professional, such as a Debt Counsellor. Sticking your head in the sand and ignoring the problem will not make it go away. In fact the situation will become harder and harder to deal with the longer you leave it out of control. Getting help from a professional can be a huge source of relief.

  • How long have you been a DC? I was registered in February 2010.

    What did you do before becoming a DC? I started my career as an accountant, joined the credit industry in 1995, was a credit man-ager at corporate microlending between 1999 and 03. I had my own debt collection business between 2003 and 09 and then joined debt counselling industry in 2010.

    Tell us about KZN Debt Counsellors.The company has 5 registered DCs and a staff compliment of 24. We operate from KZN.

    What do you feel makes your business a suc-cess? The consumer is at the heart of it all. Too many shortcuts and too much administrative gar-bage exist in the industry that is not part of the NCA and often the consumer is overlooked. We intentionally put the consumer at the fore and assist them within the ambits of the NCA and other available legislation. Too many DC’s are only focusing on the debt review process and forget that there is also a debt counselling process, where the DC can assist the consumer to change their behaviour to take responsibil-ity of finances and control spending.

    Where/how do you find new business/clients? Social marketing is a big contributor to our success. Personal contact with consumers is vi-tally important to establish trust. We therefore arrange and attend financial literacy and well-ness workshops to support all consumers and not only those who are financially distressed.

    What is the biggest challenge facing Debt Counsellors at the moment?

    Cooperation in the industry. DC’s have to speak with one voice. For too long the industry was represented by a select few and the voice of the bulk of DC’s was not heard. If the differ-ent factions in the debt counsellors industry, ie DCASA, ALLPro and BDCF can manage to meet eye to eye on industry challenges, the op-erational challenges can be addressed unani-mously at the Credit Industry Forum.

    What is the biggest challenge facing your consumers at the moment? Abuse by credit providers who are obstructing the purpose of the NCA. Some credit provid-ers continue with money grabbing, ignoring reasonable proposals, opposing debt review court applications on irrelevant technical as-pects, rescinding debt review court orders on technical aspects and by doing so, disrespect-ing the cooperation from a paying and loyal consumer.

    What advice do you have for consumers un-der debt review?Hang in there! Debt review is a process that was developed and enacted to offer debt re-lief. The fact that the road is tough at first must not discourage consumers from keeping up with their new payment arrangements.

  • Credit Industry Forum - updateWe wish to thank our members who were able to help us draft a response to the NCR’s call for comments to the Credit Industry Forum ( CIF) committee on withdrawal from debt review. We received many good suggestions and passed them on to the NCR/CIF. It now remains to be seen what other input they have received from other Debt Counsellors and credit providers in this regard.

    One of the seemingly positive aspects to come out of the current standing on this matter due to the Rogeur Judgement is that where consumers for no good reason stop paying the Debt Counsellors fees (or even never pay any fees at all) they will now be faced with the reality of being under debt review without a Debt Counsellor. This will mean they will have to source another Debt Counsellor to set matters right or preferably repair matters with

    the original Debt Counsellor and catch up on the debt review (or the accounts that remain under debt review). If this is clearly explained to consumers up front when applying for debt review it may reduce any abuses we have previously come across in this regard and ensure that Debt Counsellors do receive their fees for professional services rendered.

    March MeetingA NEC meeting is being held this month to discuss important matters as raised by various members. We have also invited several key industry players to join us to discuss opportunities, as well as, the challenges we are currently facing. Once again the focus at the meeting will be to streamline our operation, improve cooperation with others and refine our strategy for 2014. We hope to soon report on all the positive outcomes from the meeting and interaction with those invited.
