MARISA MURPHY " Marisa has collected HOA dues from all but 3 Solar Ranch homeowners: - Greg Clifton - Brad McMillan - Bruno Bloom " Question arose on whether we have made the $100 HOA filing (there may be no articles of incorporation for our Solar Ranch filings) " Our HOA may not be registered with the state of Colorado through DORA. According to the DORA website . . . “In addition to the annual Secretary of State Registration, HOAs are required to register with the Colorado Division of Real Estate once per year. An HOA who fails to register timely, renew or pay the required fee may be precluded from imposing or enforcing a lien for assessments. Colorado HB 13-1134 (2013) requires all common interest communities to register with the HOA Information Office and Resource Center, including those which were created before July 1, 1992. The following business was then discussed:! MARISA MURPHY

" Marisa has collected HOA dues from all but 3 Solar Ranch homeowners:- Greg Clifton- Brad McMillan - Bruno Bloom

" Question arose on whether we have made the $100 HOA filing (there may be no articles ofincorporation for our Solar Ranch filings)

" Our HOA may not be registered with the state of Colorado through DORA. " Check with our HOA attorney Rodney Fitzhugh to see if our HOA must register with any entityother than the Colorado Secretary of State (House Bill 13-1276)

" Check our Articles of Incorporation for Solar Ranch! MOWING.

" Martine, who contract-mowed for Solar Ranch last year has already picked up some debris andmowed this year ($27.50 per hour). Nick motioned that the HOA pay Martine for his work thisyear but we still bid out a competitively bid mowing contract. Marisa indicated that she hadtalked with Martine about this bidding process.

" ACTION ITEMS: Nick will talk with Danny Powers regarding yard waste pickup and willows(relative to a discussion about the Ridgway picking up yard waste).- It was confirmed that Ridgway does pick up yard waste (branches, cut plants, grass

clippings)- It was confirmed that Ridgway does NOT pick up either noxious weeds or cut willow

(willow will clog up the chipper)! DITCH

" Don has picked up a Parshall Flume with 6" throat. (This device measures our ditch water flow. We must install a new flume as the old flume was in poor condition. The Dallas Ditch Companyhas a “ditch rider” this year so we must have this device or our water rights may be terminateduntil the Parshall Flume is replaced. Nick, Don, and Chris Haaland will install it). Donpresented Marisa with bills for the Parshall Flume as well as ditch work which was recentlycompleted (Chris Haaland initiated this).

" Marisa has paid the HOA ditch bills! MOWING. As previously stated, we need to look for another mowing source so we can

competitively bid out a mowing contract." ACTION ITEM: Pat is checking with Lori regarding the Montrose cutting service she uses.

! TABERNASH TREE REMOVAL. Bo Nerlen, homeowner of home on Lot 86D, 595 Sabeta Drive, isrequesting HOA Board support related to cutting down a tree on public right of way. The tree blocksaccess to his garage/driveway on the Tabernash side. MOTION made by Chris to send a letter to thetown supporting removal of the tree. Nick seconded the motion which unanimously carried.

! WEEDS/MOWING" Greenway access. Nick again brought up the need to clear the green way access north of Katy and

Robin’s house. During the 13 March 2014 meeting, the board unanimously agreed that the greenway access trail along with the irrigation ditch that runs between LOTS 44 and 45 should be cut. Currently, the trail is inaccessible and the ditch flow east is effectively blocked. Nick had talked toTown Manager Jen Coates who, in looking up the plats, believed that our HOA should maintain a15" right-of-way for general public access on this easement. Again, after Chris made the MOTIONand Pat seconded it, the Board unanimously approved clearing this area. Nick will begin clearingthis next week. He will also notify Robin and Katey.

" WEED MANAGEMENT:- ACTION ITEM: Nick will contact Ron Malbry, the Ouray County Weed Manger, to set up a

weed identification training session. The goal is to have this conducted in Solar Ranch and at anoptimum time for weed identification. Pat, Frank, Don, Marisa and Nick all indicated an interestin attending.

- ACTION ITEM: Don will contact Sabeta homeowner Krista Javoronok regarding mowing herproperty (Pat brought up mowing issue).

- Regarding future mowing, the HOA Board will contact Martine when future mowing is needed(until a new mowing contract is awarded)

! ARC (Architectural Review Committee)" Frank and Ursula, attending this meeting, are both architects and both desire to become ARC

members. Chris MOTIONED to expand the ARC to five members. Nick seconded the motion andthe Board unanimously approved this. Additionally, it was agreed that any ARC approval shouldrequire at least three member members in attendance for a quorum with 2 of 3 votes for approval (or3 of 5 votes for approval).

" Don indicated that there will be an ARC meeting on 3 June 2014. " Future building in Solar Ranch (? pending):

- Don Fagan–garage on property also requiring a second garage driveway cut- Thomas Wilson addition

- Randy Smith property" Chris said there will be a “redline” ARC guideline available in September for January/February

2015 HOA meeting. It will be a “simplified” document containing appeal procedures (appealdecision to be made by the HOA Board).

" A brief discussion ensued related to town building standards and HOA ARC standards. (Again, itwas stated that the Declaration Amendment must be verified by consulting attorney RodneyFitzhugh.)

! NOTE: No security deposit for Kate Clements home.! DITCH/IRRIGATION

" Chris Haaland suggested we move location of Parshall Flume, when we install it, to Solar RanchProperty. It is currently on the very south end of South Amelia Street.

" Don and Nick will work on a “gate” for ditch split for Solar Ranch ditch splits 2 and 3 (2 feeds thehomes between Sabeta/Tabernash while 3 feeds the homes on the north side of Tabernash).

" It was stated that the Solar Ranch ditch water will be equally proportioned between all three ditchfeeds by an alternating schedule (this is the only way to ensure a fair and balanced flow to all . . . awater schedule will be announced at a future date).

" Additional ditch work is needed behind Marisa’s house. Don and Nick will meet with Marisa at09:00 on Saturday morning, 24 May 2014 to look at this area on the west end of ditch 1.

" ACTION ITEM: Nick will meet with Jen Coates regarding the Solar Ranch ditches which head easttoward the soccer fields

! MAILBOXES" ACTION ITEM: We need to talk with the postmistress regarding total Solar Ranch mailboxes in

use." ACTION ITEM: Nick will survey all Solar Ranch homes and lots (both Solar Ranch 1 [Chipeta]

and 2 [Tabernash, Sabeta]) to obtain an approximate estimate of all mailboxes needed." Our HOA needs to meet with the Solar Ranch 1 HOA as they must split costs when more mailboxes

are purchased. (We also need to meet with Solar Ranch 1 HOA on prairie dogs, ditch, fencing, andother common community concerns).

! MISCELLANEOUS" We still owe Peter Hackett $300 for “Rodenator” use. However, we cannot pay him until we

receive an invoice." ACTION ITEM: Don will check with Pat Willits to obtain Solar Ranch lot plats. These plats would

be posted on our website." It was reconfirmed that since the wooden fences belong to the HOA and not the individual lots, if

they are decayed or otherwise in ill-repair, it is permissible to remove them." REMINDER: Prairie dog committee needs to meet soon.

! Nick made a MOTION to end the meeting at 20:50. Marisa seconded that motion which carried.

The time/place of next Solar Ranch HOA Board meeting will be determined at a future time, probably inlate July.
