    No.S.O.51/HAI/2012/S.87/2012. In exercise of t he powers conferred by section 87 of t he

    Haryana Registration and Regulation of Societies Act, 2012 (Act 1 of 2012), the Governor of

    Haryana hereby makes the f o l lowings rules, namely : -

    Short t it le 1. These rules may be called t he Haryana Regist rat ion and Regulat ion of Societ ies Rules, 2012.

    Definitions 2. (1) In these rules, unless t he context otherw ise requires -

    ( i ) Act means the Haryana Registration and Regulation of Societies Act, 2012( Act 1 of 2012);

    ( i i ) Appendix means an Appendix annexed to these rules;( i i i ) Formmeans form appended t o t hese rules.(2) The words and expressions used but not defined shall have the same meaning as

    assigned to t hem in t he Act.

    3 (1) An associat ion of persons desirous of regist ering it self as a Societ y, shall fi l e an

    appl icat ion in Form I with the Distr ict Registrar concerned for approval of the name of

    the Society under sub section (1) of section 8 of the Act, proposing three names in

    order of pr ior i ty and i t shal l be accompanied by the fee set out in the Schedule of Fee

    as ment ioned in Appendix-I.

    (2) The District Registrar shall process the application keeping in view the provisions

    contained in section 7 of the Act and approve the name fol lowing the pr ior i ty stated in

    the appl icat ion and communicate the same in Form 1-A. In case the District Registrar

    does not f ind t he proposed name f i t for approval , he shal l comm unicate t he reasons for

    refusal of approval of the name and direct ing the appl icant to propose al ternatenames.

    (3) The name approved by the Distr ict Registrar shal l remain val id for a per iod of one

    hundred eighty days from the date of issue of letter of approval and the appl icant shal l

    be required t o regist er t he Society under t he said name wit h in such per iod. In case t he

    Society is not registered under the approved name with in the st ipulated per iod, the

    approval shall l apse.

    (4) The Dist r ict Regist rar shal l not approve t he same name for any other appl icant dur ing

    the val id i ty per iod of the name approved ear l ier .

    4. An appl icat ion for t he regist rat i on of a Society under sub section (2) of sect ion 8 o f the

    Act shal l be made to the Distr ict Registrar concerned in Form-II a longwi th the

    documents speci f ied therein and shal l be accompanied by the fee set out in the

    Schedule of Fees as given at Appendix-1 .

    5. The Dist r ict Regist rar shal l i ssue a cert i f i cate of regist rat i on of t he Society wi t h in seven

    working days in Form-III in t erms of provisions contained in sub secti on (1) of sect ion 9

    of t he Act .

    6. Every Society registered by the Distr ict Registrar shal l be al lotted a unique number,

    which shal l comprise the in i t ia ls of the State, the Distr ict Code, the Year of

    Regist rat i on and t he Regist rat ion Number in Form-III .

    7. (1) The Distr ict Registrar shal l cause to be maintained an alphabetical index of the

    Societies registered by him in Form -IV.

    (2) The District Registrar shall thereafter assign a page or pages for each Society in the

    register of Societies in Form -V and maintain the same updated at a l l t imes in

    t erms of t he provisions contained in sub secti on (1) of sect ion 9 of t he Act.

    8. (1) Every exist ing Society shal l apply to the Distr ict Registrar for a l lotment of a new

    registrat ion number in Form-VI wi t h in a per iod o f one year f rom t he date o f coming

    in to f o rce o f the Act w i thout any fee or w i t h in next six months on payment o f f ee

    setout in the Schedule of fees contained in Appendix-I in terms of provisions

    contained in sub section (4) of sect ion 9 of the Act. The Society shal l f i le

    app l ica t ion and submi t the requ is i te documents a longwi th a cer t i f i ca te f rom the

    of f ice-bearer du ly au thor ized by the Govern ing Body to the e f fect tha t the

    Memorandum and the Byelaws of the Society, as being presented before the

    Dist r ict Regist rar , conform t o the provisions of t he Act and the model byel aws.

    (2) Aft er scrut iny of the appl icat ion and t he document s f i l ed by t he exist ing Society,

    t he Dist r ict Regist rar shal l a l lot a new regist rat i on number under rule 6 and issue a

    f resh cer t i f i ca te o f r egist ra t ion in FormVII.

    (3) Al l appl icat ions received for a l lotm ent of a new regist rat i on number may be

    examined and kept separately. The process of a l lotment of new registrat ion

    numbers shal l commence after expiry of the per iod of one year or the extended

    per iod , i f any.

    9. (a) Wit hin the same distr ict

    (1) The information perta in ing to change of registered off ice of a Society shal l be f i led

    with the Distr ict Registrar in Form-VIII alongwith a cert i f ied copy of the resolut ion

    change.

    (2) The Distr ict Registrar shal l take on record the change of address, make the

    necessary endorsement on the or ig inal cert i f icate of registrat ion as wel l as in the

    regist er of societ ies and return t he or ig inal cert i f i cate t o the Society.

    (b) outside the distr ict

    (1) In case of change of registered off ice from one distr ict to another d istr ict, the

    appl icat ion perta in ing to change of registered off ice shal l be f i led in Form VIII-A

    wi th the Registrar of the Distr ict in which the Society is registered alongwith a

    cert i f ied copy of the resolut ion of the Governing Body, cert i f icate of registrat ion in

    or ig inal , a longwi t h fee ment ioned in Appendix 1 .

    (2) The Dist r ict Regist rar shal l in t he f i rst inst ance examine the appl icat ion and ver i f y

    that the Society has f i led al l the documents and returns due from i t as on the day.

    Upon his sat isfact ion, he shal l record his No Object ion in Form VIII-B t o t h e

    appl icat ion and endorse the Societys or ig inal f i le contain ing al l the documents,

    wi th due pagination, to h is counterpart for recording the shi f t ing of the registered

    off ice of the appl icant society and issue of a new registrat ion cert i f icate. The

    Distr ict Registrar shal l a lso record such event in the register of Societ ies

    maintained in his off ice and shal l retain one set of the vi ta l documents in h is

    off ice. A copy of the endorsement to the Distr ict registrar of the new Distr ict shal la lso be sent t o the appl icant Society f or i t s inform ation;

    (3) The Dist r ict Regist rar of the dist r ict t o which the regist ered off ice of the Society

    has been resolved to be shi f t ed shal l , on receipt of t he document f i le of t he Society

    from his counterpart, take on record the said documents and issue a fresh

    cer t i f i ca t ion o f reg is t ra t ion to the Socie ty wi th in a per iod o f th i r ty days f rom the

    date o f rece ip t o f documents wh i le re ta in ing the year o f i ts reg is t ra t ion in tact as

    per the fo rmat in Form VIII-C.

    10. (a) By the Societ y of it s own-

    (1) The General body shall pass a special resolution authorizing any office-bearer or

    mem ber of t he Governing Body of t he Society t o make an appl icat ion t o the Dist r ict

    Registrar for approval of an al ternate name as per procedure prescr ibed for

    approval of name under r u le 3.

    (2) Upon approval of the new name, the appl icant shal l f i le an appl icat ion in Form IX

    for change of name along with the fee as set out in Schedule of fee in Appendix-I,

    and the Distr ict Registrar shal l a l low and register the same in terms of provisions

    contained in sub-section (1) of section 12 of the Act and shall issue a fresh

    cer t i f i ca te o f reg ist ra t ion in Form IX-A.

    (b) By the order of Registrar

    (1) Where the Registrar issues directions to a Society for change of i ts name in terms of

    sub-section (1) of section 13 of the Act , the Governing Body shall place such

    direct ions before the General Body or Col legium, as the case may be, for

    implementation of such direct ions and passing a special resolut ion for change of

    name of t he Society as direct ed by t he Regist rar .

    (2) The General body or Collegium shall pass a special resolution authorizing any office

    bearer or member of the Governing Body to make an appl icat ion in FormIX t o t h e

    Distr ict Registrar for approval of an al ternate name as per procedure la id down

    under ru le 3.

    (3) Upon approval of the al ternate name, the author ized representat ive shal l f i le an

    appl icat ion for change of name, which shal l be al lowed by the Distr ict Registrar ,

    who shal l issue a fresh cert i f icate of regist rat ion in Form IX-B.

    11. (1) Every Society shal l prescr ibe in i t s byelaws t he manner of appl icat ion for

    admitt ing members to the Society and the competent author i ty to decide such

    applications as per Form-X. The payment of membership fee shal l be made by the

    appl icant f rom his bank account t hrough a Bank Inst rument (Demand Draft / Pay

    Order/ Cheque) and in no case be accept ed in cash.

    (2) Every Society shal l issue an identi ty card to every person admitted as a member

    contain ing the part iculars given in Form-XI in terms of section 17 of the Act. The

    Society may decide about the val id i ty or renewal of such identi ty card at such

    int ervals as deemed appropr iat e.

    112. The regist er of mem bers in t erms of sub secti on 1 of secti on 18 shal l be m aintained by

    t he Society in Form-XII. In case t he t otal num ber of m embers is more t han 300, i t shal l

    prescr ibe in i ts byelaws the consti tut ion of e lectoral col leges and shal l , in addi t ion,

    maintain a register of the electoral col leges and the members elected by each of such

    elect oral col leges in Form-XIII and regist er of col l egium in Form-XIV.

    13. Every Society shal l f i le an updated l ist of members with the Distr ict Registrar ,

    separately showing inclusions and delet ions, i f any, dur ing t he preceding f inancial year

    in Form-XV within sixty days of the close of the f inancial year in compl iance of the

    provisions contained in sub-section (3) of section 18 of the Act, in physical or e lectronic

    mode.

    14. Where the Distr ict Registrar decides to ver i fy the credentia ls and genuineness of

    members in exercise of powers conferred under sub-section (5) of section 21 of the

    Act, he shal l f o l low t he process as under: -

    ( i ) in case the number of mem bers is less t hen one t housand, cause individual notices

    to be sent to such members by registered post at the address contained in the

    register of members maintained by the Society in the f i rst instance cal l ing upon

    them to appear before him along with support ing identi ty documents as per the

    schedule (date and t ime) as may be indicated in such not ice;

    ( i i ) where the number of members whose credent ia ls are t o be ver i f i ed exceeds one

    t housand, cause the issue of a publ ic notice addressed to t he members

    indicating his decision to ver i fy the genuineness of the members with a view to

    informing them to appear before him at such t ime and place as to be indicated in

    t he individual notices;

    ( i i i ) t ake a decision on accepting the genuineness or otherw ise of the member s

    appear ing before him ;

    ( iv) aft er complet ing the process under sub-clause ( i ) above and wit h a view t o

    informing the left out members, he shal l cause another publ ic notice to be

    issued, which shal l be a second opportuni ty, cal l ing upon al l the left out

    memb ers t o appear before him as per t he schedule indicated t herein;

    (v) where a member is not able to present h im sel f in person on the date so f ixed by

    t he Dist r ict Regist rar , for what soever reasons, h is name shal l be included in a l ist

    of defunct members with no voting r ights for a per iod of one year. The

    membership in such case may be revived and activated as soon as he appears in

    person before the Distr ict Registrar wi th in such per iod of one year. In case the

    member does not appear in person before the Distr ict Registrar inspi te of two

    opportuni t ies grant ed to him, h is name shal l be st ruck off t he regist er of

    members;

    (vi ) t he proceedings under t h is ru le shal l be conducted at t he expense of t he Society.

    15. The contents of the Memorandum and the Bye- laws shal l be prepared in accordance

    with the provisions contained in sections 24 and 25 of the Act. The Society shal l

    general ly fo l low the model memorandum and the byelaws set out in Appendix-I, II and

    III of t hese rules.

    t hat such addi t ions or omissions are not inconsistent wi t h t he provisions of t he Act and

    these rules.

    16. Sub-section (3) of Section 29 of the Act provides for the quorum for meetings of the

    General Body/ Col legium t o be not les than 40% of t he tot al member s of t he Society. In

    case the minimum stipulated quorum is not present in the meeting of the General

    Body/ Col legium so convened, t he meet ing shal l be adjourned t o anot her date, of

    which a proper notice shall be issued.

    17. (1) Any amendment in t he Memorandum and t he Bye laws resolved by t he Society

    shal l be f i led in t he off ice of t he Dist r ict Regist rar in t erms of sub-secti on (3) of

    section 26 in Form-XVI alongwith the fee mentioned in Appendix 1 prescr ibed

    fee and cert i f i ed copy of t he Special Resolut ion.

    (2) The Dist r ict Regist rar shal l regist er such amendment in t erms of sub-section (3)

    of section 26 and comm unicate t he same t o t he Society i n Form XVI-A.

    (3) In case t he Dist r ict Regist rar refuses t o regist er t he said amendment , he shal l

    communicate the reasons for such reject ion to the Society wi th in the t ime

    speci f ied therefor.

    18. (1) Where a Society has more than three hundred members and i t is required to

    consti tute electoral col leges in accordance with sub-section (3) of section 32 of

    the Act, i t shal l decide on the number of e lectoral col leges, not exceeding three

    hundred, to be created so as to include maximum part ic ipation of members. Thenumber of e lectoral col leges should be at least f ive t imes the number of members

    ( including the off ice-bearers) of the Governing Body . Guidel ines and I l lustrat ions

    given in Appendix-2 may be ref erred f or guidance purposes in t h is behal f.

    (2) the consti tut ion of an electoral col lege may be determined by a Society fo l lowing

    any one or a mix o f t he fo l lowing cr i te r ia ,

    (a) on the basis of st ra ight numbers, i .e. Membership No. 1 to 30 const i t ut ing

    one col lege, Membership No. 31 to 60 const i t ut i ng anot her Col lege and so on

    and so for t h; or

    (b) on the basis of geographical spread of the m embers i .e. m embers resid ing in

    Ward 1& 2 of a Municipal Town or Vi l lages X Y and z consti tut ing one

    elect oral col lege and so on and so for t h; or

    (c ) on the basis of prof essional or qual i f icat i on cr i ter i a i .e. an elector al col lege

    consisting of Advocates, another college consisting of Professionals (Doctors,

    CAs, Engineers, Architects etc.), sti l l another college consisting of Post-

    graduates, another college consisting of graduates, another consisting of

    persons belonging to the teaching profession, another one consisting of social

    workers and so on and so for t h, or

    (d) On t he basis of sizes/ categor ies of dw el l ing uni ts in the case of Societ i es

    formed in pursuance to the Haryana Apartment Ownership Act ( I l lustrat ion 4

    in Appendix-2 may be referred).

    19. (1) Every Societ y shall maint ain a register showi ng t he names, addresses and

    occupations of t he persons appointed/ e lect ed as t he off ice-bearers/ mem bers

    of the Governing Body in Form No. XVII and shal l f i le a l ist of e lected off ice

    bearers/ mem bers of Governing Body wit h t he Dist r ict Regist rar wi t h in a per iod

    of th i r ty days f rom the date o f appo in tment or e lect ion o f o f f i ce bearers as

    required under clause ( i ) of sub sect ion (4) of sect ion 33 of t he Act .

    (2) Every change in t he mem bers of the Governing body shal l be f i l ed wit h Dist r ict

    Registrar in Form XVII-A within th i r ty days from the date of such change as

    required under clause ( i i ) of sub sect ion (4) of section 33.

    (3) Every Society shal l f i l e an annual ret urn of updated l ist of off ice-

    bearers/ member s of t he Governing Body wit h the Dist r ict Regist rar , separat ely

    showing inclusions and delet ions, i f any, dur i ng the pr eceding f inancial year in

    Form XVII-B, within sixty days of close of the f inancial year in compl iance with

    t he provision contained in clause ( i i i ) of sub secti on (4) of sect ion 33 of t he Act.

    20. Remunerati on or the Honorarium to be paid to the Administrator/ Retur ning

    Officer/ Observer/ the adhoc Committee/ and the members of the Committee

    constituted to assist the Administrator

    A. In case of appointment of t he Administ rat or/ Returning Of f icer / Observer/ Adhoc

    Commit t ee by t he Dist r ict Regist rar under sub-sect ions (10) and (11) of sect ion 39

    of t he Act:

    (1) Wherever t he person appointed as t he Administ rat or/ Ret urning Off icer/ Observer

    is in act ive service of the Government or a statutory body, he shal l not draw

    any remuneration but may be paid honorar ium for such addi t ional

    responsibi l i t ies. However, where a ret i red person is appointed as the

    Administ rator, he may be paid remunerat ion for h is services.

    (2) The remunerat ion or honorar ium under sub-rule (1) above may be decided and

    det ermined t o be paid ei ther on l ump-sum basis or on mont hly basis l inked w it h

    t he del iverables, as considered appropr iat e and just i f ied.

    (3) The remunerat ion or the honorar ium, as t he case may be, shal l be det ermined by

    a Commit tee compr is ing o f t he fo l lowing;-

    ( i ) Deputy Comm issioner of the concerned dist r ict as Chairman;( i i ) Sub-di visional Magistr at e as Member ;( i i i ) District Registrar, as the Member-Secretary.

    (4) Whi le determin ing t he remunerat ion or the honorar ium, t he Commit tee sha l l take

    int o account t he nature of responsibi l i t ies, t he size of operat ions of t he Society,

    the t ime and e f fo r t requ i red to manage t he a f fa i rs of the Socie ty , t he Socie ty s

    f inancial posi t ion and i ts capaci ty to pay. However, such remuneration for an

    Administrator should general ly not exceed the last pay drawn by him minus the

    pension in the case of a ret i red person and the honorar ium should not exceed

    20% of t he gross pay of a serv ing per son.

    (5) Simi l ar ly, t he Commi t t ee headed by the Deputy Commi ssioner may also determi ne

    the rem unerat i on / honorar ium for the m embers o f an Adhoc Commit t ee ,

    wherever appointed, keeping in view the nature of responsibi l i t ies, the size of

    operations of the Society, the t ime and effor t required to manage the affa irs of

    t he Society, t he Society s f i nancial posi t ion and i t s capaci ty t o pay.

    B. In case of appoint ment of the Administ rat or/ Returning Of f icer/ Observer/ a

    Commit t ee t o assist t he Administ rat or by t he Registr ar General under sub-sect ion

    (3) of Sect ion 56 of t he Act and sub-sect ion(4) of sect ion 68 of t he Act :

    (1) Wherever t he person appointed as t he Administ rat or/ Ret urning Off icer/ Observer

    is in act ive service of the Government or a statutory body, he shal l not draw

    any remuneration but may be paid honorar ium for such addi t ional

    responsibi l i t ies. However, where a ret i red person is appointed as the

    Administ rator, he may be paid remunerat ion for h is services.

    (2) The remunerat ion or honorar ium under sub-rule (1) above may be decided and

    det ermined t o be paid ei ther on l ump-sum basis or on mont hly basis l inked w it h

    t he del iverables, as considered appropr iat e and just i f ied.

    a Committee comprising of the fo l lowing;

    ( i ) Regist rar General of Societ ies as t he Chairman;( i i ) Registrar of Societies, as the Member-Secretary;( i i i ) Sr. Accounts Off icer in t he Off ice of Direct or Indust r ies & Commer ce.

    (4) Whi le determin ing t he remunerat ion or the honorar ium, t he Commit tee sha l l take

    int o account t he nature of responsibi l i t ies, t he size of operat ions of t he Society,

    21. Every Society shal l keep and m aintain t he f o l lowi ng books of account s, namely:-

    ( i ) cash book showing dai ly receipt and expenditur e, and t he balance at t he end of

    each day;

    ( i i ) rece ip t book, conta in ing fo rms in dup l icate / counter - fo i ls , one o f each se t to

    be issued with detai ls for money received by the Society and other to serve as

    counter fo i l ;

    ( i i i ) voucher s f i le, contain ing al l vouchers for contingent and other expenditure

    incurred by t he Society, numbered ser ia l ly and f i led chronological ly;

    ( iv) ledger showing consol idated and separate account of a l l i t ems of receipt and

    expenditure;

    (v) any other books/ r egist ers/ sub- ledgers as deemed appropr iate by t he

    Governing Body.

    22. (1) Every entr y in t he books of account required t o be kept in t erms of secti on 47of t he Act shal l be made as and when any t ransaction t akes place.

    (2) On receipt of any money, in cash or by cheque or any other inst rument , a

    receipt recording the purpose of such receipt (e.g. membership fee or annual

    subscr ipt ion or donation et c.) shal l be pr epared by the Society im mediat ely and

    del ivered to the payer.

    (3) Any voucher, duly signed by t he payee in t oken of any payment or expenditure

    incurred, shal l be obtained by the Society at the t ime any payment is made to

    him and such voucher shal l be immediately f i led in the f i le maintained for the

    purpose.

    23. The accounts, returns and registers of the Society speci f ied in the Act and these rules

    shal l be ver i f ied by any tw o off i ce-bearers/ mem bers of t he Governing Body of t he

    Society and in each such account, return and register, the fo l lowing declarat ion shal l

    be endorsed by such off ice-bearers/ mem ber of Governing Body in t oken of t he

    ver i f i ca t ion , namely : -

    24. (1) Every Societ y shall hold it s Annual General Meeting wi t hin a peri od of six

    months of the close of the f inancial year for approval and adoption of i ts duly

    audi ted annual account s.

    (2) The annual ret urn of the l ist of mem bers of t he Society as speci f ied under sub-

    section (3) of section 18 and clause (i) of sub-section (1) of section 50 shall be

    f i led in Form-XV within a per iod of sixty days of the close of the f inancial year

    or th i r ty days after holding the Annual General Meeting, whichever is ear l ier ,

    a longwit h fee as mentioned in Appendix 1.

    (3) The annual ret urn of t he l ist of memb ers of t he Col legium as speci f ied under

    clause ( i i ) of sub-section (1) of section 50 shal l be f i led in Form-XIV wi th in a

    per iod of t h i r t y days of holding t he Annual General Meeti ng of t he Society.

    25. (1) Where one or more Societ i es resolve t o amalgamat e t hemselves int o one Society

    in accordance wit h t he provisions contained in sub-secti on (1) of section 51, or

    a Society r esolves t o divide i t sel f int o tw o or more societ ies in accordance wit h

    the provisions contained in sub-section (2) of section 51 of the Act, the said

    Societies or Society shall prepare a Scheme of amalgamation or division, as the

    (5) The Dist r ict Regist rar shal l cancel t he regist rat i on of t he amalgamat ing

    Societ ies and shal l issue a cert i f icate of registrat ion of the new Society.

    Simi l ar ly, in case of d ivision, he shal l regist er t he new Societ i es created by w ay

    of d ivision.

    (6) In case t he amalgamating Societ ies are regist ered wi t h di f ferent Dist r ict

    Registrars, the newly amalgamated Society shal l be registered by the Distr ict

    Regist rar w here t he Society resolves t o maint ain i t s regist ered off ice.

    26. Any person can inspect any document kept by the Registrar after payment of fee as

    mentioned in Appendix 1 and obtain copies thereof after deposi t ing the fee as

    ment ioned in Appendix 1.

    27. Where an Adhoc Committee or Administrator is appointed by the Distr ict Registrar in

    exercise of powers under sub-section (10) of section 39, and it is considered expedient

    by the Distr ict Registrar on a request from the Society ( i .e. the Administrator or the

    adhoc Commi t t ee) t o appoint an observer to oversee the proceedings of t he meeting

    of General Body or Col legium, and/ or a Ret urning Off icer f or conducting t he elect i ons

    of t he Col legium or the Governing Body, he may appoint ret urning off icer or observer,

    who shal l be an off icer gazetted or equivalent, serving or ret i red off icer of the State or

    Centr al Government / any st atut ory author i t y to d ischarge such duties.

    28 The maximum remuneration or honorar ium for a Returning Off icer may be f ixed by the

    committee consti tuted in accordance with ru le 20 (A) (3) of these rules, whi le i t may

    be f i xed at an al l inclusive amount not exceeding Rs. 1,000/ - in case of an observer.

    These expenses shall be borne by t he Societ y concerned.

    29. (1) Where an Administ rator is appointed by t he Regist rar General in exercise of

    powers under sub-section (2) of section 56, or the Government in exercise of

    powers under sub-section(1) of section 68 of the Act, and there is need for

    appointment of a Committee to assist the Administrator, the concerned

    author i t y may appoint such commi t t ee, i f considered expedient or on t he

    request of the Administrator, as the case may be, to assist the Administrator in

    managing the af fa irs of t he Society.

    (2) The Commi t t ee appointed under sub-rule (1) above may comprise of such

    number of m embers as is minim al ly required, but not exceeding f i ve in al l .

    (3) The mem bers of t he Commi t t ee may pref erably be drawn fr om t he area in

    which the Society carr ies out i ts operations and should be persons of eminence

    with establ ished credentia ls in publ ic l i fe. The Committee may also include

    subject experts in Legal and Accounts matters (such as a practising Advocate

    and/ or a pract is ing Charter ed Accountant or a person having ret i red w it h

    exper ience in accounting and administrat ive matters) . The Registrar General

    may general ly avoid appoint ing any such person as a member of t he Commi t t ee

    who may have direct int erest i n the aff a irs of t he Society.

    30. In the event of a need for an interpretat ion of any of the provisions under these rules

    or lack of cl ar i t y or ambigui t y in any provision contained in t hese rules, or any si t uation

    not having been speci f ical ly addressed under these rules, the Government shal l be

    competent to issue the requisi te interpretat ion, clar i f icat ion or address any unforeseen

    si t uation by way of a Government Order.

    31. The fees payable for var ious purposes defined under t he Act and t he Rules made there

    under are prescribed in schedule of fees in Appendix -1.

    Appendix -2

    General Guidelines and illustrat ions for determination of the number of electoral

    colleges and it s relationship wi th the const it ut ion of t he Governing Bodies

    (Reference rule 18)

    General Guidelines:

    1. An exist ing Society, wi t h more t han 300 mem bers, shal l be required t o carve out

    elect oral col leges in accordance wit h t he provisions contained in Secti on 32 of t he

    Act read with rule 18, unless i t opts to exercise other options avai lable under sub-

    secti on (1) of secti on 30 and sub-secti on (1) of secti on 32 of t he Act. Carving out of

    electoral col leges may involve two major chal lenges i .e. determination of the

    electoral col leges and the al location of members to an electoral col lege. The

    Governing Body of such Society is expected to define the cr i ter ia for creation of

    the electoral col leges. It is for the Governing Body of the Society to determine the

    same and also introduce a process of sett l ing any objections from the members.

    However, once f inal ized, the consti tut ion of an electoral col lege should remain

    intact for al l t imes to come and the inter-se al location of members should not

    change unless there is outgo and fresh induction of members in respect of an

    electoral col lege. Once f inal ized, these shal l become a part and parcel of the

    byelaws of a Society.

    2. Where a Society, regist ered aft er t he coming int o force of t his Act, decides t o keep

    its membership at more than 300, i t shal l prescribe the mode and manner of

    creation of i ts electoral col leges and the method and process of al location of

    memb ers to an elect oral col lege in i t s byelaws.

    3. Illustrations:

    Illustration 1:

    Suppose a Society has 21,000 members and it decides to constitute a Collegium

    consisting of 300 members which shal l entai l creation of 300 electoral col leges.

    Normal ly, each of the electoral col leges should comprise of an average number of

    21,000/ 300 = 70 mem bers. However, t he Society m ay carve out 70 elector al

    col leges in a manner t hat t he number of members of an electoral is wit hin +/ -

    (10%) of t he average number .

    Illustration 2:

    Suppose a Society has 10,000 members and it decides to constitute a Collegium

    consisting of 250 members which shal l entai l creation of 250 electoral col leges.

    Normal ly, each of the electoral col leges should comprise of an average number of

    10,000/ 250 = 40 mem bers. However, t he Society m ay carve out 40 elector al

    col leges in a manner that the number of members of an electoral col lege is within

    +/ - (10%) of t he average number.

    Illustration 3:

    Suppose a Society has 1,000 members and it is required to constitute a Collegium.

    The Byelaws of the Society also provide for a Governing Body of 21 members

    (including the off ice-bearers). In such a case, the strength of the Col legium must

    not be less t han 5 t im es of t he st rength of t he Governing Body i .e. 105. In case t he

    Governing Body consists of 11 members ( including the off ice-bearers), the

    Col legium must com prise of no less t han 55 elect oral col leges i . e. f ive t imes of t he

    st rength of t he Governing Body.

    Illust rat ion 4: In the case of a Group Housing Society

    There is a Group Housing Society comprising of about 900 members. The Complex

    has common infrastructure faci l i t ies even though i t may have, say, four di fferent

    categories of dwell ing units depending on the size of such dwell ing Units. Such a

    Society shal l have t he f ol lowing opt ions:

    (a) The Society shal l have four dist inct groups of member s, say, A , B , C

    and D categories, l inked with the sizes of dwel l ing Units. Further, A

    category may have 120 DUs, B category may have 240 DUs, C Category

    may have 360 DUs, and D cat egory have t he balance 180 DUs. The Societ y

    may decide to consti tute a Col legium consisting of 300 members, i .e. an

    electoral col lege of 3 members each ensuring proportionate representationto each group. In case the Society decides to create a Collegium of 180

    members, the proportionate representation shal l be based on 5 members.

    In order to ensure that each of the Groups is also represented on the

    Governing Body, the Society may decide to earmark the number of

    posi t ions of the Governing Body to include representatives of each Group

    on the Governing Body; or

    (b) To divide i t sel f into more t han one society under sub-sect ion (2) of sect ion

    51 of the Act, each based on the size of dwell ing Units. In such a case,

    t here may be one parent Society f or t he housing complex as a whole t o look

    after the management of common indivisible infrastructure faci l i t ies and

    services and the individual societies of each group may be responsible formanagement of t he common services for each group. There shal l have to be

    a relationship defined between the Parent Society and the individual

    societi es in such a case in order t o m eet t he corresponding responsibi l i t ies

    for t he common services and obl igations. The elect ed/ nominat ed

    representatives from the di fferent Societies shal l consti tute the Governing

    Body of t he Parent Societ y in such case.
