MEMORANDUM for the enactment of Law no. 185/2017 by prolonging this law in accordance with

Government Emergency Ordinance no. 88/December 06, 2017 and by exempting the medical practice settings that provide family medicine, specialist medicine and dental

services, from the implementation of Law no. 185/2017 on quality assurance in the health system

In our country, the "Organisation and operation of doctor's offices" is made in accordance with Law no. 124/1998 and of Government's Emergency Ordinance no. 153/2003 on the rules for the organisation and operation of doctor's offices, as well as with Law no. 31/1990.

The forms of organising the profession of doctor as a liberal profession under the law in force for doctors licensed to practice medicine, in providers of medical services with or without legal personality, are as follows: - Independent doctor's offices /Romanian: Cabinete Medicale Individuale/ - Grouped doctor's offices /Romanian: Cabinete Medicale Grupate/ - Associated doctor's offices /Romanian: Cabinete Medicale Asociate/ - Medical professional partnership IRomanian: Societate Civilá Medicalã/ - Healthcare facilities with legal personality .-.. which are established in accordance with Law no. .31/1990 and will opetate under the law (Government's. Emergency Ordinance no124/1998,republis.bed).

CNAS through the County Health Insurance Authorities /Romanian: Casele de Asigurári de Sánátate Judefene, GJAS/ and the one of the City of Bucharest, 41 these practices have entered into agreements with thE ift..........

The College of Doctors and the colkge'of Dentists delivers the first permit, which is issued based On the proof of inembeichip witklhe , College! of Doctors, proof of doctor's office address and only after checking the existence of minimum equipment requirements of the doctor's office.

DSP will check the existence of minimum equipment requirements needed for the operation of doctor's office, of minimum space requirements and operation circuits in accordance with the medical services provided.

After obtaining the authorisation from thq College of Doctorand the Health Permit for operation from DSP it is issued the document establishing the doctor's office, L e. the

Certificate of Registration in the Single Register of Doctor's Offices /Romanian. Registrul Unic al Cabinetelor Medicale/.

For doctor's offices that have entered into agreements with CJAS, an assessment of the entire practice will be made and an official document will be drafted - Assessment Report /Romanian: Decizia de Evaluaret

_..411 three approvals have a high cost, fixed fees, and controls are carried out by persons accredited in this respect.

In our opinion, the establishing of another body to verify "quality", "quality management" and the operation of doctor's offices is unnecessary; there is an overlap of an abusive legislation over the existing one, i. e. Law no. 12411998, Law no. 15312003, and Law no. 31/1990.

Family medicine, dental medicine and specialist medicine practices are privately-owned practices ensuring quality in the health system, and the already existing approval and control structures are sufficient. These doctor's offices do not represent ambulatories of any other establishments, they are privately-owned practices protected by the Romanian laws.

The obligations under Law no. 185/2017 concern the following subjects of law: - healthcare facilities - entities with or without legal personality whose purpose of activity is the provision of medical care, at any of its levels, irrespective of the form of ownership; - ambulatory care facilities - entities with or without legal personality, irrespective of the form of ownership, which provide outpatient care services. It follows from these definitions that the provisions of the law will apply to all healthcare providers, i. e. all doctors who practice independently, irrespective of the form of organisation: independent doctor's office, grouped doctor's office, associated doctor's office, medical professional partnership, limited liability company, joint stock company etc.

The obligations set out in the legislative act representing the subject of this review are particularly onerous for doctors who practice independently. Moreover, there was no transparency of decision-making, and there was no public debate In accordance with the 2014 -,2020 National Strategy, it is necessary to reduce the pressure on hospitals and solve patients' health issues at the base of the pyramid, with the allocation of EU money accessed by the Romanian Government, Romania being a EU Member State since 2007.

The implementation of Law no 185/2017 requires the following steps 1 Submission of documentation to ANMCS, which implies the registration and proof of payment of the accreditation fee, a fee whose amount is currently unknown. 2. Training and hiringof personnel with qualified management duties. 3 Conclusion of a contract with a consulting services provider approved by ANMCS. 4 Request for assessment - only when the assessed facility meets all the conditions under the law, including the existence of a quality management structure or the duties of the

structure are being fulfilled by a legal representative or by persons (employees) appointed by them who have completed the ANMCS quality management course. 5. Assessment activity - it is mandatory to provide the assessment team with the documents required to validate the information confirming the meeting of the requirements of the accreditation standards. 6. The ANMCS President orders the resumption of the process and the classification of the assessed facility to another category of accreditation following the assessment by the structure of the assessment report.

7. If the assessment report was positive and the facility was accredited, the steps below will follow: - Monitoring, meaning the compliance of the accredited facility with the requirements of the standards and other legal provisions for the entire period of validity of the accreditation in successive stages: - checking the level of the monitoring indicators of the accreditation - adverse event - sentinel/catastrophic event - "near miss" event - monitoring visit - at the office of the facility Monitoring will be carried out: 1. Yearly - by RZM -monitoring stage intermediate report (area office) 2.; Every six months 3. Unexpected visit - at any time during accreditation 4. Permanently -of the adverse effects occurred 5. Permanently - of the authorised structures of the medical facility If monitoring revealsnonconformities, the plan for meeting the monitoring criteria (requirements) will; be prepared within 3; months from service the facility has to correct the nonconformities and submit to RZM the completed measures - if 75% has not been met, it is commenced the monitoring visit (announced, at least 2 ANMCS employees) and it is prepared a report, within 5 days of completing the visit. If the final report includes uncorrectable nonconformities and if less than 75% of the validation scheme is completed, the final report of the monitoring stage will propose the commencement of re-assessment, which means full resumption of the procedure.

As it is well-known, at present, as mentioned above, there is already a requirement for a substantial assessment by CJAS, which is intended to ensure the very quality of medical services, the criteria of which include, inter alia, the obligation to maintain malpractice insurance for an insured risk up to EUR 100000. Additionally, it is necessary to comply with demanding requirements in view of DSP approval, regarding, inter alia, the equipment used in the medical facility, including maintenance services provided by accredited entities approved by GJAS. The above are currently mandatory conditions for concluding the contract for provision of medical services with CJAS. The Romanian College of Doctors require al doctors to undergo 200 hours of continuous medical training over, 5 years,, this representing an average of 40 hours a year, obtained by attending national and international conferences, congresses incurring registration, accommodation and transport costs

Law no 185/2017 imposes exaggerated obligations, additional to the requirements already requested upon the conclusion of the contract, which also ensure the quality of the medical services provided

Thus, there already exist control structures ensuring the quality of medical services. ANMCS, as a new institution, was unnecessarily and abusively established, through the re-approval of previous assessments, controlled so far by the Public Health Department and the Health Insurance Authorities. From the law representing the subject herein, there do not follow clearly and unequivocally the financial implications presumed by the regulated assessment and accreditation (approval and accreditation fees, if the travels in the territory are borne by the beneficiary, including the costs for transport, accommodation and daily allowance etc.). Of high importance is the fact that the law does not make clear the assessment and accreditation criteria and rules, which have not been stipulated so far. However, one may infer from this legislative act that through this regulation it is necessary to establish certain structures in the medical practice settings which burden the salary budget and requires the conclusion of highly expensive contracts with several consulting firms.

It is known that in a state founded on the rule of law any act of reform to be established by a legislative act requires an impact analysis at social level.

In the present case, this has not happened, and from the analysis of Law no. 185/2017 it follows a negative impact that risks endangering even the right to access to health services, a right recognized and promoted by the Constitution of the World Health Organisation. the European Social Charter.. the Convention on the Rights of the Child and, last but not least, a right advocated by the European Union at the level of strategy on health.

The SOCIAL importance of this accreditation is crucial in Romania for both healthcare providers and patients: a) What will happen in the rural and small urban areas? Patients will no longer benefit from medical services, because small-size providers - family doctors, dentists etc. will not be able to meet the costs for accreditation, assessment, re-assessment, monitoring, re-accreditation etc. and will be eliminated. b) The existence of healthcare providers that are accredited in different manners, the introduction of a "classification" (with more or fewer stars, as for accommodation facilities) is a threat to the healthcare of the Romanian population, and healthcare is a national security issue, meaning that every patient, on the Romanian territory is entitled through the Constitution to quality healthcare.

Thus, with regard to the provisions of Law no. 185/2017, we will further indicate that: - From the presented legal rules no concrete form to ensure great er safety for patients ensues; - The subjects of law to which the quality management certification requirement is aimed at are in a non-djfferentiated manner, medical facilities with beds and all other types of medical facilities, without taking into account the distinctions required between the two types; - Family medicine, specialist medicine and dental practices will be subjected to multiple assessment, accreditation, re-assessment, monitoring, re-accreditation procedures, as complex as those applied to medicalfacilities with beds; - The terms and conditions in which these procedures are to take place are not stipulated in the law; ,

- Accreditation will be made in accordance with standards that are not known, although the consequences will be significant for the competitive market once medical facilities will be categorizedfoiowing this process; - There is a danger of legal instabiityalso in respect of the de facto situation in which the need for reassessment is required, and the bodies authorised to require it are not known, or the reasons why ANMCS itself would require re-assessment, after having accredited a doctor's office based on its own procedure;

--It is required the obligation to undergo a procedure that has not been stipulated by the law and for which fees whose value is not known are charged; - The requirement to train personnel qualified in quality management in healthcare involves costs that are unknown and limit the free market of training services to ANMCS; - The access to the free market of quality management consulting services is also limited, as it is approved only the 'contract concluded with a consulting services provider authorised by ANMCS; - The accreditation/re-accreditation procedure is difficult and endless, being followed by monitoring that can lead to the resumption of the full procedure, with additional costs, and by paying an additional fee to ANMCS.

This results in legal and financial instabilityfor healthcare facilities and in the violation of the right of access to health services for patients,, who,, are at risk of no longer being able to benefit from medical services paid or partially paid within the health insurance system, because such facilities become ineligible in the system.

The logical and legal analysis does not show, the protection and safety of the patient.

The previous legal regulations in the field, namely those underlying the arrangement and fitting conditions of doctor's officçs required for their, approval and authorisation by the Romanian College of Doctors/College of Dentists in Romania, and by the Public Health Directorate respectively,, are sufficient.

To medical practice settings that are in a contractual relationship with the health insurance authority is added the assessment required and performed by CJAS itself with the aim of ensuring the quality of medical services.

Patient protection in respect of medical treatment remains exclusively the malpractice insurance policy mandatory for all doctors, in accordance with Law no 95/2006 on healthcare reform, with subsequent amendments and completions.

From all these aspects it follows, in our opinion, that the legislative act that would benefit the patients by ensuring thequality of care would cause a major disservice to both patients and doctors, that it is abusive, creating bottlenecks and imbalances in the health services market.

Many doctor's offices will cease to exist and the exodus of doctors, especially of those in rural and small town areas, will increase.

Primary, specialist and dental healthcare facilities do not need a classification on accrethtdlion JtegoriLs ( 'as dc.SmLd by Law no 185 for the purpose of accreditation), because in these health L IlL taLilitics only one type of medical services is provided (a different situation from the one existing in hospit1s).

Thus, accreditation in the case of primary medicine, sccialist medicine and dental medicine is a parallel proure, therefote liii.. necessary time -consuming,: and costly which will definitely, decrease the quality of medical services in these healthcare acilities.

To emphasize once again the abusive and 1tilin nature of accreditation for primary medicine, dental medicine and specialist medicine practices. I quote: \j-t. l3 In order to enter the assessment process for accreditation purposes, it is

necessary to have a quality management structure for medical services in the structure of the healthcare fitci lilies. So, under chronic underfundinii, a small healthcare facility, with no more than 2 employees as our practices are, is required to establish a quality management structure for medical services.

Thus, Law no. 185/2017 fails to meet the requirements of clarity and predictability that any legislative act must meet in order to ensure .the stability of the legislative system and of the regulated activity. The implementation of the provisions of this legislative act will ultimately lead to a

unsustainable expenses by the medical facilities in question, as well as a growing bureaucracy, which will undoubtedly lead to a decrease in the time spent in consultations with patients an essential aspect in providing a quality medical act

Thus, instead of achieving the purpose Of Law no. 185/2017, namely quality assurance, in the health system, the quality of the medical act will decrease, as more than 70% of doctor's offices will have to give up to exercise the profession in this way, due to the excessive costs and bureaucracy involved with meeting the requirements of the legislative act in question. In fact, the implementation of the law in question represents interference in the free exercise of medical professions, as well as in the right to work, as guaranteed by the Romanian Constitution in Art. 41.

Taking into account the reasons set out above and the example of the European Union law, we are requesting herein the exemption from this highly onerous process, which may be regarded as an excessive bureaucratic and tie lege ferenda approach, of the medical practice settings providing family, dental and specialist medicine services. The existing and above mentioned legislative acts effectively ensure the quality of the medical act on a free competitive market, with the observance of the right of access to healthcare services, a right recognized at national, European and international level for every human being.

There was and there is no need of this abusive legislative act.

In conclusion, our opinion is that it is necessary to exempt medical practice settings providing family, dental and specialist, medicine services from the implementation of the provisions of Law no. 18512017 on quality assurance in the health system - independent doctor's offices,, grouped doctor's offices, associated doctor's offices, medical
