In 2009 the ADL called on theDepartment of Homeland Securityto extradite John Demjanjuk so thathe could stand trial in Germany formurder. The Munich ProsecutorsOffice issued an arrest warrant forDemjanjuk on 29,000 counts of ac-cessory to murder for his time as a

guard at the Nazi Sobibor deathcamp in Poland from Marchthrough September 1943.

Howard A. Levy, ADLs Cleve-land Regional Chairman, issued thefollowing statement:

Demjanjuk served the Nazi re-gime in many concentration campsand was a willing participant in theprocess that asphyxiated thousandsof Jews at Sobibor.

Without arguing over the fac-ticity of any of the above, when Ivisit the website for Steven Spiel-bergs Shoah Foundation I find

videos where I can watch Jews whowere interned at Auschwitz chatabout their collaboration asSonderkommandoin the mass mur-der there of a million or so Jews ingas chambers. They willingly speakof how they were active partici-pants in the Holocaust:See:http://tinyurl.com/n43h6z5. Inthese video recordings, producedand promoted by Mr. Spielberg,these Jewish confessions of collab-

oration with Nazis in the massmurder of Jews, the issue of prose-cution for war crimes does notarise.

Perhaps you can help clarify thisquestion: The Jewish Anti-Defamation League holds that

when there is evidence that aUkrainian collaborated with Nazisor participated in the Holocaust heshould be prosecuted as a war crim-inal. At the same time it appearsthat when a Jewish Sonderkom-

mando who states openly on cam-era that he collaborated with Nazisand participated in the Holocaust

there is no call to prosecute theSonder-kommando. Why is that?

I would appreciate any clarifica-tion you might be able to offerabout what appears to be a scenarioin which ADL supports one stand-

back children. And when the bun-ker was already so filled theycouldnt put no more people, nomore ... they made the kids crawlon the top of the heads, all the wayin there, just kept on pushing themin, to fill them all in. When thedoor was slammed behind them,

was a thick door, was about sixinches thick. I built it myself and Iknow what its like: three bolts,three iron bars were across. . . .

Ms. Bloomfield, please. Are weon the same page here? Sam notonly worked in the gas chamber/

I would like to ask you to clarifyyour perspective, and that of theUSHMM.

You acknowledge that JohnDemjanjuk was convicted of play-ing a role in the deaths of morethan 28,000 Jews. You do not saywhat his role was. It appears that hewas a guard at the Sobibor camp.

Sam Itzkowitz, according to hisown eyewitness testimony, playeda role in the deaths of millions inthe gas chambers of Auschwitz. So-- you condemn a man who osten-sibly played a role in the deaths of

28,000, while you feature on yourMuseum Webpage, in a favorablelight, a man who confesses oncamera that he played a role in thedeaths of millions.

I am writing to comment on aFebruary 6th article by RichardSimon, The Search for the LostNazi Diary, regarding the recov-

The pages of the Rosenberg dia-ry have been posted on the UnitedStates Holocaust Museums web-page. One can read and translatethe document for oneself. I did thisand found that the article incorrect-ly translated the important diary en-tries of September 12, 1941.

The article read: On Sept. 12,1941, he [Rosenberg] wrote that

Germany had obtained reports indi-cating that Soviet leader Josef Sta-lin planned to send 400,000 cap-tured Germans to Siberia. Rosen-berg equated the move with mur-der, adding, All of us felt the ha-tred against Moscow swell upagain. If Stalin carried out the

plan, he wrote, Germany will pun-

ish the Jews of Central Europe forthis. This reading of Rosenberg

implies that Rosenberg was fulmi-nating against Jews and plan-ning vengeance against them. Thatis a false reading, and quite mis-

leading. Here is my translation:

As the reports came in thatStalin now was also going to expelthe remaining 400,000 Volga Ger-mans to Siberia, that is, to murderthem, the hatred of Moscow wasimmediately reawakened in all of

us. I issued advice to take a very

Indeed, Rosenberg was horrifiedat Stalins plans to deport hundredsof thousands of Volga Germans(where did captured Germanscome from? It appears to be an in-vention) but he was furious atMoscow, not at Central EuropeanJews. He proposed a possible way

of saving the Volga Germans: Aradio address broadcast to Russia,England, and the United Statesbased on the hope that Jewishgroups would influence Moscownot to deport the Volga Germans. Itwas the recent boasts ofSchertok [Moshe Shertok] of great

Jewish influence on Moskau London Washington that seemedto inspire the plan.

Rosenberg even goes on to dis-cuss the history of anti-Germanpogroms by the Russians. Thus, a

correct reading of the Diary doesnot cast Rosenberg as plottingvengeance or punishment againstCentral European Jews, nor blam-ing them for the plight of the VolgaGermans. He is grasping at strawsto try to prevent a massacre of theVolga Germans. This is a signifi-

cantly different motive thanclaimed in the article.

Because the Diary gives us a ra-re insight into the thinking of theleaders of the Third Reich in Sep-tember 1941, a formative period in

the still unclear development ofGerman policies toward CentralEuropean Jews, it is imperative thattranslations be accurate. The diaryentry itself can be seen athttp://collections.ushmm.org/view/2001.62.14, page 607. Google orYahoo translation sites provide apretty good understanding for Eng-

lish speakers. We should thank theUnited States Holocaust MemorialMuseum for posting original doc-uments on line.

Eric Delcroix, my former law-yer, has just reminded me that thelate humorist Pierre Desproges(1939-1988), in a skit for the tele-vision show Le Tribunal des fla-grants dlires (The Court of in fla-grante delirio), once portrayed meas an unnameable character, un-nameable at least for the Frenchjustice system. Announcing the ac-cuseds appearance, the court usherlet forth: Mr Faurisson!, where-upon the presiding judge sprang:No, not that name! Its forbid-den!

But that was only a comedy skit.Most recently, French judicial

reality has become stranger thanfiction.

According to an AFP press re-lease, on Wednesday, February 12,2014, in a case brought against himby the union of Jewish students of

France (UEJF), the humorist Dieu-donn was ordered to remove twopassages from his New Years Evevideo 2014 sera lanne de la que-nelle (2014 will be the year of thequenelle), posted on his YouTubeaccount and viewable athttp://www.youtube.com/watch?v=0r4YQ54PazA&bpctr=1392482451.http://tinyurl.com/n7pxqn4

The decision imposes on Dieu-donn a fine of 500 euros per dayof delay in withdrawing either ofthe passages after five days fromservice of the ruling (AFP).

So here I am, deprived of a sur-name and even of a Christian name.

Blood Libels, Gas LibelsAnd the Difference between Them

or much of recent historymuch has been written, and

read, of the blood libel on theJewish people spread among thepopulaces of Europe and the coun-tries elsewhere populated by Euro-peans. The story has countless vari-ants, most of them involving theabduction of non-Jewish babies forritual slaughter in which some useor other is made of the blood of thevictims. Thus, the blood libeljoining many other tales demoniz-ing the Jews among the non-Jewswho pass these stories about amongthemselvesall of this long beforethat Internet that seems to so facili-tate such passing about of stories.

The stories are, of course, vig-orously denounced by both Jewsand non-Jews seeking to promotecomity among the races and ethnic-ities that forever will characterizeand divide us humans who sharePlanet Earth. The stories are, un-doubtedly, false at least on a nu-merical basis: for every real casebearing the slightest resemblance tothe myth, there appear to be a hun-dred recountings of this instance, orthat occurrence, that must havebeen the Jews, or else it was thoseGypsies. Or where is the baby,anyway? It is the very essence ofintergroup antipathy and, yes, libel.

But more recently, after the in-credible carnage and devastationcentered on the Germany of WorldWar II, another libel has arisen,or been fomented, against the peo-ple who lost their nationhood in

that holocaust: the Germans. Thisinfinitely variegated set of mythsholds that, chiefly in places theGermans conquered and occupied,these same Germans together withindigenous anti-Jewish collabora-tors, designed, erected, manned,and operated satanic mills of a sortnever before or since offered up forcontemplation by the informed,caring publics around the world:gas chambers.

These installations embodied aphantasmagoric extension of thegas technologies that made theirfirst, lethal appearance on the pub-lic stage during World War I in theuncontrollably blunt weapon ofpoison gas in combat. Millions ofsoldiers, including Hitler himself,reported themselves temporarily orpermanently blinded or maimed bythis creeping, invisible killer thatleft no visible wounds on its vic-tims, even those it killed. It was ef-fective in the pursuit of combatmissions only incidentally; at leastas often, it set its own side back inoffensives and, subject as it was tothe whims of the weather, waslargely ineffective. This did not, ofcourse, prevent millions of combatveterans on both sides from claim-ing harm from its effects. A core ofthese claims was valid.

By the time of World War II,anticipated developments of thesetechnologies exploiting the gaseousstate of matter led both sides toequip their bomb shelters with ex-tensive provisions to protect against

aerially delivered bombs bearingthe noxious vapors, including fil-ters, hermetic sealing, and pneu-matic pumps situated so as to expelany lethal traces that might other-wise invade the inevitable chinks inevery structure of any usable size.

Germans have long demonstrat-ed an enviable lead in the relatedtechnologies of chemistry andphysics that govern the mastery ofgasses, liquids, and even solids.They have likewise demonstrated apotentially incriminating masteryof related technologies such asmedicine and war. These virtuosi-ties have made the Germans invit-ing targets for accusations that theyhave harnessed naturaland devil-ishly unnaturalforces for the pur-suit of goals ascribed to them byothers, such as the annihilation ofgroups of people they feel haveharmed their society.

Thus, through the agency of in-superable armed force and theatri-cal productions such as the Nurem-berg Tribunal, an image has foreverbeen branded on the consciousnessof the world of dungeons such asPoe could never in his most fiend-ish fantasies have conceived, intowhich were infused gases such ascarbon monoxide and hydrogen cy-anide to quickly, if not painlessly,kill millions of people. The sameconfabulation, already taxed be-yond the limits of technologicaland physicalpossibility, is thenoutdone with explanations explain-ing the traceless disposal of the re-

mains of those millions in cremato-ria.

The MaterialsBoth legends play heavily on

materials extracted from the bodies

of the victims. What the Jewswanted most in the legend aboutthem was the blood of the Gentilebabies. It seems that, in some ver-sions, they drank the blood, eitherstraight or mixed with wine, in aSatanic sacrament. In other ver-sions, the blood was mixed into theingredients of the sacramental mat-zoh, an unleavened baked good notknown among the Gentiles, some-how not discoloring the end prod-

uct, though undoubtedly the imageof crimson matzoh is not discour-aged, either.

The blood meme is echoed inthe libels against the Germans, asin a since-discredited case wherePolish children were drained oftheir blood for transfusion intoGerman troops who had beenwounded in battle. But the domi-nant theme concerning parts of thevictims of the Holocaust concerns

hair, the removal of which entailedneither harm nor even pain to thevictims. There is not the slightestdoubt that the Germans shearedmost of the hair off most of theheads of inductees into their camps,nor is there any doubt that doing sogreatly reduced the propagation ofthe deadly lice that spread typhusamong the camps occupants.

Whether the Germans gatheredand used this hair to any purpose

(hair is a standard component offelt, for example) is not so clearlyrecorded, but the notion that it wasused to weave socks for subma-riners is today the object of indul-gent chuckles among the informed.Likewise disproven are fantastic ta-les of the use of human skin for

producing leather or, if interesting-ly tattooed, lampshades, and theuse of human fat for the productionof soap.

The Bodies

Mass graves are found of theCroatian victims of Titos partisansfrom the movable slaughter throughSlovenia of 1945, and thousands ofcorpses, still resplendent in theiruniforms of Napoleons GrandeArme of 1812, have been un-earthed outside Vilnius, Lithuania,but of those millions of victims ofNazi Germany? Little, very little,and much of what is found, con-tendable as to whether they were

guerillas, prisoners or war, reprisalvictims, or other of the unbearablytragic human detritus that alwaysspews from the bowels of the de-mon War. There were the bone-grinding machines, since exposedas mere producers of gravel forhighway construction, but aboveall, there were the Crematoria.These, sorry for the extermination-ists to say, have been overworkedfar past the point of Hercules flush-

ing the Augean Stables, disposingof millions of corpses consumingthe time and fuel normally requiredfor some few thousands. The GasLibel on the Germans has requiredthat the remains of the slaughteredmillions, never found in any num-bers, thus be somehow made todisappearthe technological andphysical limits of reality bedamned.

Mass graves are alleged to exist

at numerous sites, including Ausch-witz, Majdanek, Sobibor, and eventhe Ravine at Babi Yar of everlast-ing memory. But true forensic in-vestigations of these sites havebeen prevented by a number of fac-tors, including high ground waterlevels that would inevitably have

precluded such interments in thefirst place, and Talmudic proscrip-tions against disturbing the re-mains of the faithful [allegedly]buried on the sites.

Under the laws of many Euro-

pean countries, the two libels occu-py mirror-image positions. Publicdenunciation of the Blood Libel isso routine and so frequent it is stul-tifying, while any voice giving itthe slightest shred of credit lands itsowner to be charged before a courtin very short order. Contrariwise,pious reinforcement of the Gas Li-bel is sanctified by the loftiest ofhumanistic virtue, while any ques-tioning or analysis of it again lands

the skeptic before a judge likely tohand down a sentence of years ofimprisonment.

Germans, like people every-where, entertained various sympa-thies toward people they knew andpeoples they had only heard about.The sympathies of non-JewishGermans, and some Jews, were cer-tainly negative toward one another.That much is undeniable. But thenthere is the Gas Meme. It is a dis-

gusting form of science fiction. Nosuch gas chambers, and indeed, nosuch gases have ever been devised,not deliberately, nor indeed acci-dentally.

It is a Hatred Meme contrived toaggrandize the fortunes of thosepersons who claim to have es-caped that Holocaust (this one hasa capital H) launched againstthem bythose Germans. Andtheir descendants. Not only the de-

scendants of the perpetrators, butthose of the victims, forever elud-ing their Barbarian tormenters inrefuges such as Israel and the Unit-ed States. It is from those redoubtsthat they ceaselessly launch as-saults against not just those Ger-mans who have been faithfully pay-

ing reparations these 61 years, butagainst those who would defend(the vast majority of) todays Ger-mans against the calumny of theblood libel that has dogged and im-poverished them through their en-

tire lifetimes.Such assaults on freedom of ex-

pression are unjust in their ownright, if for no more than the over-weening power it places in thehands of the State. It should remain

legal to intone memories of thoseGerman crimes even where it can-not be shown that they were com-mitted, just as it should remain le-gal to intone memories of the cen-turies-old tradition of Jewish sad-

ism. At the same time it should be-come legal to reject the anti-German Gas Libel as it is to rejectthe anti-Jewish Blood Libel whereeither or both is susceptible to hon-est, competent inquiry into the per-

tinent facts that remain available tous.

Freedom in every directionasfar as the eye can see, as far as themind can imagine, as far as theheart can yearn. Good faith? Some-

times. Mistrust? Ever and always.Violence in the enforcement of un-just law?

Never!

Holocaust survivors go around telling Americanschool children these lies. Do you believe the womanwho claims she hid the family diamonds from the Na-zis by swallowing them over and over and retrievingthem from her excrement?

Here is an account of the tortures we inflicted oninnocent men. Edward L. van Roden, chief of the Mil-itary Justice Division in Europe, was appointed to a

commission studying claims of abuse during U.S. tri-als in Germany. He wrote:

American investigators used the following meth-ods to obtain confessions: Beatings and brutal kick-ings. Knocking out teeth and breaking jaws. Mock tri-als. Solitary confinement. Posturing as priests. Very

limited rations. Spiritual deprivation. Promises of ac-quittal. Second- and third-hand testimony was admit-ted.

Lt. Perl of the prosecutionadmitted to the court:We used persuasive methods including some vi-olence and mock trials. He further told the court thatthe cases rested on statements obtained by such meth-ods.

(Back to Van Roden:) Our investigators wouldput a black hood over the accuseds head and thenpunch him in the face with brass knuckles, kick himand beat him with rubber hoses. This was standard

operating procedure with American investigators...And we were the Good Guys. I hope anyone

*** On 18 February I celebrat-ed, if that is the right word, my84th birthday by sending my OpenLetter to Abraham Foxman re hisinterest in prosecuting men whoserved as perimeter guards at oneGerman camp or another, and hiscomplete lack of interest in prose-cuting Jewish Sonderkommandowho worked in gas chambers re-

sponsible for killing millions oftheir own folkor so the scripturegoes. It was a pleasantly distractingbit of work. Irene wanted to have abash here with all the family but Iknew I would not want to stay up. Iwas working on Abe during the day

and did not notice that she was do-ing anything special. But after itwas dark I understood she had beenbaking a turkey with a deliciousdressing, making a Waldorf salad,potato salad, and choco-flan, a two-layer desert with custard on top andchocolate cake on the bottom. Anephew was here and he built afogata (a camp fire) inside our

closed patio and we had our dinneroutside on a cold night gatheredaround the fire. With the twogrand-kids, there were only the fiveof us. It was swell.

*** David Merlin called my cellwhen I was up in the hills on a dirtroad, returning from seeing Palomawhere she is interned. In the mo-ment I was standing outside the carin a falling rain making my ownwater and looking out over theocean only a mile away. Merlin haddiscovered that the USHMM haduploaded all the Kempner docu-

ments onto their website, photos ofthe documents themselves withtranscriptions in German to oneside. This is exactly what we urgedUSHMM chief archivist HenryMayer to do two months earlierwith Merlins piece on the Rosen-

berg Diaries. Merlin was verypleased. Our suggestion, whichwe had addressed to Mayer him-self, was copied to his associates atthe Museum and to the staffs ofHolocaust centers and museums

around the country. Merlin sug-gests that the Museum uploaded thedocuments because that letter toMayer was posted on our Blog. Idemurred a bit. Surely the projectwas already in process when weaddressed that issue. But the fact ofthe matter is that CODOH andSmiths Blog are monitored dailyby those people. They do want toknow what we are doing becausewhen we mess with their work we

do so with real care in a way thatconsistently compromises them. AsI stood there in the falling water, Irealized again how important theBlog actually is. Not because a mil-lion people go there to read it, butbecause the people important to theIndustry go there to read it.

And then the other day I was in-formed that the Simon WiesenthalCenter is now following me onTwitter. Why would that be? Be-

What exactly is your point? Youdont see a difference between aprisoner, in order to survive, col-laborating versus someone work-ing at a concentration camp as asoldier, with a gun? If I may: A soldier is not a freeman. If he does not follow orders,he is shot. What good will hisgun do him? He will be executed.Short and simple, a time-honoredtradition. Not only by German mili-tary, but by US military. Pleasetake a moment to think what will

happen to the U.S. soldier in Af-ghanistan who refuses to follow or-ders in the face of the enemy.

I think you are most likely well-intentioned, but it does not appearthat you have taken even a moment

to consider how it is with soldiersin real life. Has it not occurred toyou to consider what it means for asonderkommando, to survive, thathe will spend weeks, months col-laborating with his bosses in massmurder and genocide to save him-self? I can imagine that some of uswill do that, but I cannot imaginewhy those of us who do should betreated with respect, or be trusted,or felt sorry for.

Its really a matter here of look-ing at an issue that academics andothers have declared to be taboo tolook at. As I have it on the headeron my Blog, it is an issue of aca-demic group-think. Dont go alongwith it. You will find out many in-teresting and personally valuableinsights into these issues.

Im perfectly willing to be con-vinced that I am wrong about anyof this.

Not at all the sameand not en-tirely true, either. A prisoner is notthe same as a military person fol-lowing commands. The degree ofagency is worlds apart. You are be-ing dishonest because you wouldlike there to be doubt about theculpability of participants and theestablished facts of the Holocaust.

That would appear to be the ex-tent of the back and forth betweenProfessor Church and myself,which took place two nights ago. Ican see a couple three places whereI could have been more careful,more accurate. One example wouldbe Churchs remarks about being asolder with a gun and being an un-armed prisoner are two differentthings. They are. But their lifechoices appear to be the same. it is my role to question such mat-

ters as the Sonderkommando, theUSHMM and so on. It is suggestedthat my work should be to focus onFree Speech, on laws against revi-sionism internationally, on the per-secution of revisionists, and on thetaboo against looking into these is-sues.

I see the technical logic of this

argument. CODOH was founded toencourage Open Debate on theHolocaust question. Open debate isimpossible without free speech, afree press. Still, I think there ismore than one way to skin the cat(to coin a phrase).

One way to focus on FreeSpeech issues is to simply say whatcannot be said, what is prohibitedto say, and to urge others to do thesame. I am going to speculate thatthere is not one professor in the

U.S. of America who has ever sug-gested that work-Jews (Sonder-kommando) who collaborate withNazis to murder hundreds of thou-sands of children in camps such asAuschwitz should be prosecuted.Why not? I am going to ask, if theyare as much accessories to massmurder as the camp guard whonever killed anyone, or the Germansoldier who worked as a cook inthe camp kitchen, why should they

not be prosecuted? Thats FreeSpeech in action. You just say it.

The idea here is not to argue thatwork-Jews should be prosecuted,but to ask academics, media andbureaucrats to state openly, clearly,why they should not be. Its a ques-tion that they have never ad-dressed, and so far as I am aware, aquestion that we have never ad-dressed.
