I, the undersigned, being duly sworn, state that all facts contained in this Complaint and Affidavit, known by me or told to me by other reliable persons form the basis for mybelief that the defendant committed this crime

State all facts and persons relied upon supporting elements of alleged crime

THE DEFENDANT WAS STOPPED FOR A VIOLATION OF THE OPEN CONTAINER LAW. THE VIOLATION WAS OBSERVED ON IRA AVENUE APPROXIMATELY 14 MILE SOUTH OF 350TH STREET. THE TRAFFIC STOP WAS INITIATED JUST SOUTH OF D-59 ON IRA AVENUE. A PROBABLE CAUSE SEARCH WAS CONDUCTED. SITTING IN PLAIN VIEW IN THE CONSOLE BETWEEN THE FRONT SEATS WAS A SMALL ZIP LOCK BAG CONTAINING A WHITE POWDERY SUBSTANCE. ANOTHER BAG WAS FOUND IN A SUITCASE ON THE REAR SEAT. ALSO LOCATED WAS A PIPE USED TO SMOKE MARIJUANA.

6. Defendant is entitled to a preliminary hearing unless waived, which hearing is held to determine whether sufficient evidence exists to justify further prosecution of the Defendant as charged.
