The Online Protection and Enforcement of Digital Trade Act will build on the existing legal framework for resolving trade infractions of tangible goods to enforce copyright and trademark infringement of digital goods such as music, movies and other intellectual property. Through the International Trade Commission, violations of digital trade can be investigated and websites found to be “willfully” and “primarily” infringing on copyright material can be shut down. The ITC will create a transparent and adversarial process where all parties would receive due process and IP rules can be consistently applied. Neither the Stop Online Piracy Act in the House nor the Protect IP Act in the Senate allow for similar due process. “The OPEN act meets the same publicly-stated goals as SOPA or Protect IP without causing massive damage to the Internet,” Wyden said. “I’ve long said that IP infringement is a problem that needs to be addressed, but these other bills tread deeply into online censorship and blacklisting in order to protect intellectual property. There is a better way. The OPEN act expands the ability of the ITC to investigate IP infringement -- providing a forum for due process without messing with the inner workings of the Internet. The same goals are met, without the collateral damage SOPA and Protect IP will leave in their wake.” “The internet continues to be a driving force for innovation and economic growth in our country.Any legislation affecting the internet must be carefully considered – we cannot afford unintended consequences,” Moran said. “The proposals currently under consideration by Congress raise serious Constitutional and security concerns and include provisions that effectively chill investment in innovation. Unlike Protect IP and SOPA, the OPEN Act provides a clear and consistent system of due process and does not compromise the secure operation of the internet through filtering. The OPEN Act also utilizes the expertise of the ITC to make certain monetary resources to rogue foreign websites are shut down upon violations of intellectual property rights. Whether you are a high-tech entrepreneur, a small business owner, or simply an American with a good idea, an open web facilitates innovation as an open marketplace for goods and services.” “The Internet allows entrepreneurs in America and around the world to create ground-breaking companies and fuel economic growth,” said Cantwell. “That’s why we’re leading a bipartisan effort to pass the OPEN Act. The OPEN Act addresses the same challenges as the PROTECT Act, while protecting freedom of speech, innovation and security Andy Taylor, writing in the Montgomery County Chronicle, says “When most residents in eastern Montgomery County awaken each morning, they have Sam Atherton and Ken McNickle to thank when warm water spews from their showers . . .” Atherton is general manager of Public Wholesale Water District #4 at Big Hill Lake, and according to the Chronicle, will retire at the end of December after 28 years of Moran co-sponsors legislation to protect online intellectual property on the Internet. Wilson County native to retire after 28 years as manager of Big Hill water district #4 Representatives from the Kansas Small Business Development Center at Pittsburg State University will be in Independence on Tuesday, Jan. 10, for free individual counseling sessions at the International Mall, 325 N. Penn from 1-3 p.m. Local residents interested in developing new or existing businesses, and existing businesses interested in discussing their financing and other assistance needs, can meet with KSBDC counselors, whose assistance is confidential and provided without charge. The KSBDC is part of the Business and Technology Institute at PSU and provides one-stop managerial, financial and technical assistance to individuals and businesses in southeast Kansas. Subsequent counseling will be scheduled on an as-needed basis, will involve follow-up visits by KSBDC/BTI personnel as necessary, and will be tailored to the needs of the business. A native of Wilson County, Atherton grew up east of Fredonia, and graduated from school here.

He was hired by Montgomery County as assistant water manager/operator in 1984 without any experience in water treatment. But he had experience in construction from working for Newton Construction at Altoona, and

that was what the newly-formed water district was looking for.

Atherton caught on to water-treatment quickly and, the Chronicle writes, “since the day Atherton turned on the valves that opened the water lines to the customers, the water plant has processed more than 8.59 billion gallons of water.” Atherton can take pride in the fact that state and federal regulators have never rejected a water sample from District #4 in the years he has been working for the district.

The water district attained the coveted “Best Tasting Water in the Nation” award in 2003, from the National Rural Water Association after earning a similar honor from the Kansas Rural Water Association.

Wilson County native to retire after 28 years as manager of Big Hill water district #4

Representatives from the Kansas Small Business Development Center at Pittsburg State University will be in Independence on Tuesday, Jan. 10, for free individual counseling sessions at the International Mall, 325 N. Penn from 1-3 p.m.

Local residents interested in developing new or existing businesses, and existing businesses interested in discussing their financing and other assistance needs, can meet with KSBDC counselors, whose assistance is confidential and provided without charge.

The KSBDC is part of the Business and Technology Institute at PSU and provides one-stop managerial, financial and technical assistance to individuals and businesses in

southeast Kansas. All business functional areas can be discussed at length. Subsequent counseling will be scheduled on an as-needed basis, will involve follow-up visits by KSBDC/BTI personnel as necessary, and will be tailored to the needs of the business.

Small business counseling coming to Independence Jan. 10

Members of the First Christian Church in Fredonia, 303 N. 7th, will serve a community dinner on Christmas Day for those who otherwise would not share the holiday with family or friends. Dinners also will be delivered to those who cannot get out.
