U.S. Army Corps of Engineers (USACE)Regulatory Role and Authority
USACE is the federal agency responsible for administering Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899.
USACE regulates the discharge of dredged or fill material into all jurisdictional waters of the United States and structures in, over and under waters of the United States.
USACE permit decisions are “federal actions” and must comply with the National Environmental Policy Act (NEPA).

Cooperating Agency Status
The Nuclear Regulatory Commission (NRC) is the “Lead Agency” in the preparation of this Environmental Impact Statement (EIS).
USACE is a “Cooperating Agency” in the preparation of the EIS.
The final EIS will serve as the primary environmental document on which USACE permit decisions will be based for this proposed project.

Comments received at this meeting will be considered in the preparation of the draft EIS and subsequent permit decisions.

USACE Permit Decisions
USACE Public Notice will coincide with the publication of the draft environmental impact statement. The Public Notice will be posted at the following website:

The USACE permit decision on the proposed project will be made after the Final EIS has been completed but will likely precede NRC combined license decision.
Combined License
o Florida Power & Light (FPL) has applied for combined licenses (COLs) for two new nuclear units (Units 6 & 7) at the Turkey Point Site.
o A combined license gives authorization to build & operate a new nuclear unit.
o Units 6 & 7, if approved, would be built on the same site as Turkey Point Units 1 - 5.
o There are two NRC reviews for the TurkeyPoint COL application – safety and environmental.
o There will also be a formal hearing on the two reviews.

Getting Involved in the Hearing
oPetition to Interveneo Deadline to file is August 17, 2010, see the June 18, 2010
Federal Register Notice (75 FR 34777).
oDigital certificate or waiver required for filing a petition.
o Instructions for e-filing are in the hearing notice or at www.nrc.gov/site-help/e-submittals.html.
oAllow 5 business days for obtaining the digital certificate.
National Environmental Policy Act
oNEPA requires Federal agencies to use a systematic approach to consider environmental impacts.
oAn Environmental Impact Statement (EIS) is required for major Federal actions that may significantly affect the quality of the human environment.
o Issuing a combined license is considered a major Federal action.

Environmental Review
o NRC is reviewing the combined license application and is the lead agency.
o U.S. Army Corps of Engineers, Jacksonville District is reviewing a Corps permit application for Units 6 & 7 and is a cooperating agency on the environmental review and preparationof the EIS.
o The NRC and Corps staff make up the review team.

Review Process & Schedule
o Published Federal Register notice June 15, 2010.
o Scoping period from June 15 to August 16, 2010; scoping meetings today in Homestead.
o Expect to publish draft EIS inOctober 2011.
o There will be a 75-day comment period on the Draft EIS.
o Final EIS expected to be published in October 2012.
