CONFERENCES
The Court shall schedule a preliminary conference upon compliance with the requirement of 22 NYCRR Par. 202.12(a).
Counsel seeking an adjournment of a scheduled conference date must first obtain a list of available adjourned dates fromall other parties and then provide that list to the Court at the time the request for adjournment is made. If an adjournmentis permitted, the requesting party shall notify all parties of the adjourned date scheduled by the Court.
Attorneys appearing at the conference must be fully conversant with all facets of the case and fully authorized to act onbehalf of the client.
The plaintiff must, and defendant may, supply to the Court a brief typewritten statement of facts giving rise to the action,the contested issues, special and general damages, foreseeable legal and evidentiary problems and any other relevantmatter. Copies of any statement supplied to the Court also must be provided to opposing counsel.
MOTIONS AND SPECIAL PROCEEDINGS
When filed with the initial Request for Judicial Intervention, the case will be randomly assigned to an IAS Justice andthe motion will be scheduled for the next available motion term scheduled for the assigned Judge. After initialassignment, motions will be made returnable at the next available motion term scheduled for the assigned Judge.
Section 202.8 of the Rules of Court provide that all motions are to be submitted unless otherwise ordered by the Court. The IAS Justices of this district have exercised their discretion to require oral argument on all motions except thosewhich are uncontested and those which, although contested, are returnable on a date designated as a submitted motionterm by the assigned Justice. Parties seeking to submit contested motions must obtain the consent of the assigned Justice.
Summary judgment motions must be filed no later than sixty (60) days after the date when the Trial Note of Issue is filed. Permission to file such motions thereafter must be obtained from the IAS Justice for good cause shown [CPLR 3212(a)].
With the exception of Broome County, motion papers, including affidavits of service and memoranda of law, must befiled with the Court Clerk at least eight (8) days before the return date. Answering papers, including affidavits of serviceand memoranda of law, must be filed with the Court Clerk or Chambers of the assigned Judge at least two (2) days beforethe return date.

EX PARTE APPLICATIONS
After Index and RJI Numbers have been obtained, Ex Parte matters may be presented to the assigned Judge in Chambers. Where granted, the papers shall thereafter be filed with the Court Clerk.
TRIALS
Trials will be scheduled by the Judge at or after the pretrial conference. Marked pleadings and trial memoranda, if any,shall be filed with the Court two (2) business days prior to the scheduled trial date.
UNCONTESTED MATRIMONIALS
Uncontested matrimonials shall be filed with the Court Clerk who, in turn, shall deliver them to Chambers as they arereceived. (Rev. 12/06)

SPECIAL BROOME COUNTY CIVIL & CRIMINAL FILING RULES
The Broome County Supreme and County Courts are conducting a pilot project for the New York State CourtSystem in an effort to make Civil and Criminal records more readily available to the Public and to the Bar. The project will, in time, make digitized copies of the court’s Civil and Criminal records available on theInternet. In the planning phase of this project, the following Rules were developed in an effort to minimizethe use of these records for identity theft and to protect, as appropriate, sensitive or confidential information.
ADMINISTRATIVE ORDER OF THECHIEF ADMINISTRATOR OF THE COURTS
Pursuant to the authority vested in me, and upon consultation with Hon. Anthony V. Cardona,Presiding Justice of the Appellate Division, Third Judicial Department, I hereby establish in Supreme Courtand County Court in Broome County, effective immediately, a pilot program for electronic remote access tocourt records in those courts, which shall be governed by the following rules:
1. Application
(a) Except as set forth below, these rules shall apply to all court records of the Broome CountySupreme and County Courts other than those records that are confidential, such as recordsin matrimonial actions, or to which access is otherwise restricted by law or by order of thecourt.
(b) These rules shall not apply to court records in Article 81 proceedings or cases that includeinformation identifying any victim of a sex offense.
(c) These rules shall apply to court records in criminal proceedings, but section 3 of these rulesshall apply only upon resolution of the proceeding in the trial court.
(d) The Unified Court System may suspend these rules as to any case where any party is notrepresented by an attorney at the time of his or her first filing with the court in the case.
(e) The Unified Court System may suspend these rules as to particular court records where itsapplication would be burdensome due to the volume of the court filing or othercircumstances.
2. Definitions
(a) “Court record” means:
(1) Any document, information, or other item that is collected, received, or maintainedby a clerk of a court in connection with a judicial proceeding. It does not includenotes, drafts, and other work products prepared by a judge, or for a judge by courtstaff. It also does not include transcripts of depositions or court proceedings unlessthey are filed as part of a motion, brief, or other request for action by the court.

(2) Any index, calendar, docket, register of actions, or information in a casemanagement system, created by or prepared by the court or a clerk of a court thatis related to a judicial proceeding. It does not include notes, comments or otherwork products prepared by a judge or court staff for internal administrative use.
(b) “Individually identifiable health information” means any information that is created orreceived by a health care provider, health insurer, or employer and relates to an individual’spast, present, or future physical or mental health or condition or the provision of health careto the individual.
(c) “Individually identifiable health information sheet” means a cover sheet filed along with anycourt record containing individually identifiable health information. The individualidentifiable health information sheet is a form promulgated by the court.
(d) “Remote access” means that ability of the public to electronically search, inspect, or copyinformation in a court record without the need to physically visit the facility where the courtrecord is maintained.
(e) “Application to Restrict Remote Access” means an application filed along with any courtrecord (or with reference to any court record previously filed) containing information towhich restriction from remote access is being requested.
3. Remote Access
(a) Court records in the Broome County Supreme and County Courts may be made accessibleto the public by remote access over the Internet pursuant to these rules.
(b) In cases before the Broome County Supreme and County Courts, documents containingindividually identifiable health information shall be listed on an individually identifiablehealth information sheet submitted by and signed by counsel upon filing with the court. Such documents shall not be made available to the public by remote access unless otherwiseordered by the court.
(c) A request to limit public access to information in a court record to a facility where the recordis physically maintained may be made by any party to a case, an individual identified in thecourt record, or on the court’s own initiative. The court may, for good cause shown, limitthe manner of public access. Applications for restriction from remote access should be madeat the time of filing on a form promulgated by the court.
4. Omission of Personal Identifiers from Court Records
The following personal identifiers shall not be included in filings subject to these rules in the Broome CountySupreme and County Courts, except in the manner set forth below when the identifiers are relevant to thecase, or unless otherwise ordered by the court or required by law:
(a) Social Security numbers. If the social security number is relevant, only the last four digitsshould be used, except where a full social security number is required to be supplied to thecourt by law.

(b) Financial account numbers and credit and debit card numbers. If these numbers are relevant,only the last four digits should be used.
(c) Names of minor children. If the name of the minor child is relevant, only the initial shouldbe used.
(d) Birth dates of adults. Only the year should be used unless the full birth date is relevant.
(e) Driver’s license number. If a driver’s license is relevant, only the last three digits of thenumber should be used.
(f) Telephone numbers, unless required by CPLR 2101(d).
5. Fees for Access
A fee may be charged for remote access to court records consistent with law and with the cost of providingsuch access.

JUDICIAL THREATS
ALL THREATS AGAINST JUDGES SHOULD BE REPORTED IMMEDIATELY
TO:
1. Your Public Safety Supervisor (Sergeant) , who will:
º Notify the local Security Coordinator
º Notify the threatened party and the appropriate Court Staff.
º Notify the Local Law Enforcement Authorities if there is imminent
concern.
º Notify one of the below:

2. If your Public Safety Supervisor is not available: Notify your local Security
