117 HEREAS by an Aet passed in the session of parliament holden on the twenty-third and twentyshy~ if fourth years of Her present Majestys reign inti~uled An Actfor re1ulatinri tile Sale of Grown Lands and fotmiddot otker purposes It IS amongst other thmgs enaeted that It shall be lawful for the Governor in Council upon the petition of not less than ten occupiers of not less than five hundreamp acres of adjacent purchased land to proclaim that any Crown lands within five miles of such purchased land (the area of such Crown lands not being more than three times the area of the purehased land) shall be a Common for the use of such occupiers of the said purchased land as shall cultivate at least onemiddot fourth of his or their purchased hnd ahd every such common shall be called a Farmers Common provided that nothing in the now reciting section shall be deemed or taken to prevent any such lands from being sold under the said Act upon the application of persons desirous of pnrchasing the same and it is also enacted that the Governor in Council shall have full power from time to time to make any rules and regulations for imposing any condiLions or limitatIons on the exercise of the right of common upon any Farmers Common And whereas the occupiers of purchased land in or near the localities hereinafter mentioned have petitioned for Farmers Commons in accordshyance with the said Act Now therefore J Sir Henry Barldy the Governor of Victoria with the advice of the Executive Council do hereby proclaim the Crown lands hereinafter described to be FARMERS COlIOlONS for the use of the occupiers of purchased land within the meaning and intention and subject to the provisions of the said Act and also under and subject to such cOliditions or limitations on the exercise of the right of common as may be hereafter prescribed that is to sayshy
