The Residen t agrees that in the event the refundabl e security deposit is less than the fair market value of the induce ment or incentive the balance shall be immedi ately due and payable as rent. 2. TERM:  The ter m of thi s Rental Agreement shall be for 1 year and 1 month  commencing on May 20, 2016  and ending on  June 19, 2017. After the ending date this Agreement automatically continues on a month to month basis until a new lease is executed or until either the Management or Resident termin ates this Agreement by delivering to the other a writt en 60 day notice of termination. Upon expiration of the Initial lease term, the contract automatically enters into a Month to Month Agreement which is defined at current market rate plus a  $200.00  Month to Month Fee, plus  1.8%  tax unless otherwise noted. APARTMENT RENTAL AGREEMENT (LEASE)

This Apartment Rental Agreement is made this   20th   day of   May,   2016   by and between   Foxfire Apartments   (hereinafter

referred to as "Owner") and the following person(s):

1. PAYMENTS AND PRORATIONS:   Upon execution, Resident agrees to pay the Full Monthly Rent plus Taxes (if

applicable) and any recurring monthly fees in the form of a money order or bank draft. Resident agrees to pay in advance

the total due monthly in the form of a check or money order, on or before the first calendar day of each and every month,

at the Apartment Community or at such other place as Management may designate by written notice to the Resident. IfResident chooses to transfer apartments, a transfer fee will be assessed and is subject to Management approval.

1.   In the event there is a drop box located at the Leasing Office, this drop box is provided for resident convenience only.

Please be advised that placement of payments into the drop box does not constitute payment delivery to Landlord

unless Resident's payment is in the drop box when opened by the Landlord. Until delivery, the resident bears the risk

of loss or theft of any payments put in the drop box. Rent or other related payments are not considered paid until the

funds have been accepted by the Landlord.

2.   Money Orders are used as a cash equivalent payment subject to the terms and conditions of each money order

provider. In the event of theft or loss, the money order purchaser (resident) and money order provider (Issuer) must

work through the appropriate claims processes to recover the funds. In the event payment is rendered via money

order, it must be a money order issued by  Western Union  or  Money Gram .

3.   In the event of loss or theft of any money order after accepted delivery to the Landlord, Resident agrees to cooperate

3. DEPOSITS:

1. Security Deposit:   Concurrently with the execution hereof, Resident agrees to pay Management the Security

Deposit, in full, as security for the faithful performance of Resident's obligations hereunder, Management shall be

entitled to deduct from the Security Deposit the sum of  $50.00  for each apartment key not returned by Resident upon

vacating the Premises, such amounts as may be necessary to remedy Resident's defaults in the payment of rent, other

charges equivalent to rent and utility charges, and such other amounts as may be necessary to compensate

Management for damage to the Premises occasioned by Resident's non-compliance with the provisions of paragraph 9

below. The taking or application of security as provided herein shall not preclude Management from exercising any

other available remedy for breach of the Lease or Resident's violation of the Arizona Residential Landlord and Tenant

Act. No portion of the Security Deposit may be used by Resident as a credit for rent owed prior to termination or

expiration of this Lease. Resident shall not be entitled to any interest on the Security Deposit.

2. Administrative Fee:   If applicable, Resident has paid Management the Non-Refundable Administrative Fee, which

shall not be refunded under any circumstances.

3. Conditions for Refund:   Notice: Resident must give to Management a written notice of intent to vacate, not less

than sixty (60) days  to the ending date of this Apartment Rental Agreement or  sixty (60) days  if the Apartment Rental

Agreement is on a month-to-month basis. The full term of the Apartment Rental Agreement must have ended. At the

time of move-out, all rents must be paid in Full. The Resident must leave the apartment in a clean and habitable

condition, normal wear and tear excepted. Provisions for move-out inspection will be made by Management on receipt

of the  written sixty (60) day  notice of intent to vacate. The Resident must supply Management complete information

on forwarding address for return of deposit. With full compliance with the Apartment Rental Agreement, with FULL

compliance of the Rules and Regulations or the House Rules and/or attached addendum, FULL compliance of all

applicable statutes and upon demand for return of the refundable security deposits Management may apply those

deposits to accrued rent and damages, if any, as set out in Section 3.1 above, and shall timely deliver to the Resident

any remaining balance of the refundable security deposit.

4. LATE CHARGES:   Rent is due on the 1st  day of each month. If the total monthly rent is not received by  6:00 pm on the

3rd day of any month, a late charge of  $75.00 plus 1.8% tax will be added to rent . An additional charge of $10.00 plus

1.8% tax  shall be added for each day thereafter rent remains unpaid. If rent is paid late it must be in the form of certified

funds, for example Money Order and/or Cashiers Check.

5. RETURN CHECK CHARGE:   Resident agrees to pay as additional rent an administrative fee of   $50.00   for any check

that is dishonored for payment. This fee is in addition to applicable late charges. Repayment of rent and fees and all further

payments, must be in the form of certified funds, for example Money Order and/or Cashiers Check.

6. UTILITIES:   In addition to the rent, Resident shall pay a proportional share of all public utilities charged against the

Premises including water, gas (if applicable), sewer, and garbage collection. Resident agrees to pay all required deposits

for gas and electricity and furnish Management a receipt prior to accepting occupancy.

7. INDEMNITY:   Management shall not be liable and Resident shall save Management harmless from any and all claim

losses, demands, or other liability whatsoever, for any damage or injury however suffered by or occurring to any person,

including, without limitation, guests at the Apartment Community which arise or are caused by any act of commission or

omission of the Resident, Resident's occupants, family, guests, invitee or pets. Notwithstanding anything appearing in this

paragraph to the contrary, the Resident does not agree to the exculpation or limitation of any liability of Management

arising under law or to indemnity Management for that liability or costs connected therewith.

Resident is informed that Management's insurance does not cover Resident's property, acts, or omissions, IT IS

RECOMMENDED THAT RESIDENT OBTAIN RENTER'S INSURANCE.8. ASSIGNMENT:   Resident shall not assign this Agreement or sub-let the Apartment or any part thereof.

9. CONDITION AND CARE OF PREMISES:

1.   Resident shall not change locks, paint, decorate or alter in any way the Premises without the prior written permission

from Management and shall not interfere with the quiet use and enjoyment of other residents of the community.

Further, Resident shall comply with all state statutes and city ordinances, which are applicable to the Premises and

common areas. Resident has carefully inspected the Premises and finds them to be in a clean, habitable, undamaged

condition except as may be noted on the Apartment Inspection/Check out Report. This Report will be used to

determine refund of security deposit amount at the end of Resident's tenancy.

Management shall not be liable to Resident's family, invitee and occupants for any damages to person or property

caused by the act or neglect of any other resident or non-resident at the Apartment community.

2.   Resident agrees to exercise reasonable care in the use of the Premises, furnishings and Apartment Community and to

maintain and redeliver the same in a clean and safe condition, free from damage, unsightly debris, equipment or decor.

Resident agrees to pay for all repairs, replacements and maintenance caused by negligence and willful damage and

shall be paid immediately or shall be regarded as additional rent to be paid no later than the next date on which rent is

due following such repairs. Resident shall immediately report to Management in writing when any locks, equipment,

fixtures furnishings or portion of the Premises have been damaged or are out of repair. Any damage to the Premises,

fixtures or furnishings contained therein which is not otherwise explained in writing to Management within three (3)

days after occurrence thereof, shall be presumed to have resulted from the Resident's neglect. Resident shall not allow

an inoperable vehicle to remain on the common areas or any other portion of the Apartment Community for more than

24 hours. No vehicle repairs are to be made in or on the common areas or any other portions of the Apartment

Community. Any vehicle inoperable, unlicensed, or in disrepair shall be subject to towing at the vehicle owner's

expense.

3.   Resident acknowledges that the use of the swimming pool area, the lounge, and other related amenities at the

Apartment Community being furnished without charge by Management and that no guard or other supervision over the

use of said swimming pool and facilities will be provided; and, fully understanding the risks associated with the fore

going, Management shall not be liable for any damage or injury to the Resident(s) or any other person, or to any

property, occurring on the premises, or any part thereof, or in the common areas thereof, unless such damages is the

proximate result of gross negligence or unlawful act of Management, its agency, or employee and Resident agrees to

hold Management harmless from any and all claims for damages no matter how caused, except for injury or damages

for which Management is legally responsible. Resident shall be responsible for obtaining fire, extended coverage and

liability insurance with respect to the contents of the apartment. Resident understands that Management's insurance

does not cover Resident's belongings from losses not caused by Management's negligence and Management

encourages Resident to obtain on all-risk policy in addition to marking all valuables for "Operation Identification."

10. USE:   The leased Premises shall be occupied and used only as a residential dwelling unit, any other use is prohibited.

11. ACCESS:   Resident shall allow Management access at all reasonable times to the Premises for the purpose of

inspection or to show said apartment to prospective purchasers, mortgagees, or any other persons having legitimate

interest therein, or to make necessary repairs, or improvements. Management shall give Resident at least 48 hours notice

of Management's intent to exercise its right of access except in cases of emergency, or where notice shall be impractical,

or where the Resident has abandoned the Premises or has failed to properly maintain the Premises.

12. DEFAULT:   All costs, attorney's fees, collection costs of up to 40% of outstanding balance and other expenses in

enforcing this Agreement shall be paid to the prevailing party by the losing party.

13. SUBORDINATION:   This Agreement is and shall remain subordinate of any ground lease, mortgage, trust deed, or otherencumbrance or security instrument now existing or hereafter to be placed upon the Premises and to any modifications,

extensions, replacements and advances in connection therewith.

14. ABANDONMENT:   If the resident abandons his tenancy, as defined in A.R.R. #33-1370(H), and the management

reasonably determines the cost of removing, storing and selling the Resident's personal property would exceed the amount

that would be realized from the sale thereof, Management may, at is option, destroy or otherwise dispose of the Resident's

property.

15. NON-WAIVER:   Failure of Management to insist upon the strict performance of the terms covenants and conditions

herein contained shall not be deemed a waiver of any of Management's rights or remedies herein. If any court declares a

particular provision of this Agreement to be invalid or illegal, all other terms of this Agreement will remain in effect and both

Management and Resident will continue to be bound by them.

16. BINDING EFFECT:   This Agreement shall be binding upon and inure to the benefit of the heirs, executors,

administrators, successors and assigns of the Management and Resident.

17. DISCLOSURE OF MANAGEMENT AND NOTICES: Foxfire Apartments, with offices at  1701 E. Eighth St, Tempe,

AZ 85281, is authorized to act on behalf of the owner of the Apartment Community for purposes of service of process and

for receiving or receipting notices or demands. To be effective, all notices, demands and other communications directed to

Management shall be in writing and personally delivered during office hours, or mailed by certified mail, return receipt

requested to the above address, or to the resident manager at his/her office in the Apartment Community. Service of legal

process should be made upon Management through its statutory agent, as registered with the Arizona Corporation

Commission.

18. FIRE, CASUALTY AND TAKING:   In the event the Premises shall be damaged or destroyed by fire, casually or taking,

the monthly rent payable hereunder by Resident shall be reduced or abated to the extent that such damage or destruction

renders the Premises untenantable, until such time as the Premises, or what remain thereof after a taking, shall have been

repaired or restored to a tenantable condition. Nothing contained herein, however, shall require or be deemed to require

Management or the owner of the Apartment Community so to restore or repair the Premises.19. TERMINATION:   If Resident terminates the term of agreement for any reason, the Resident shall be obligated to give

sixty (60) days written notice, as stated above. In addition to the  rent due for the notice period the Resident must  pay

a buy-out fee equal to $1,000.00 for a 1x1; $1,200.00 for a 2x1; $1,400.00 for a 2x2; $1,600.00 for a 3x2, and must

repay all concessions received.  The buy-out fee will be due at time of move-out. Further, the Resident shall be obligated

to pay any move-in incentives given at time of move-in as per section 1.1. The Resident also agrees to leave apartment

clean and undamaged, less normal wear and tear.

20.  Properties will be presented in compliance with Federal, State and Local Fair Housing laws and regulations. Residents

may obtain a free copy of the Arizona Residential Landlord and Tenant Act from the Secretary of State's office.

Special/Forcible detainer action or civil litigation that the parties waive their rights to a jury and agree that the matter may

be heard by a judge.

22. ORIGINALS AND ATTACHMENTS.   This Lease Contract has been executed in multiple originals, with original

signatures--one for you and one or more for us. Our rules and community policies, if any, will be attached to the Lease

Contract and given to you at signing. When an Inventory and Condition form is completed, both you and we should retain a

copy. The items checked below are attached to this Lease Contract and are binding even if not initialed or signed.

APARTMENT SECURITY ACKNOWLEDGMENT AND RELEASE

I agree that I will inspect Apartment  #213 and determine, to my satisfaction, that the smoke detectors, door locks and latches,

and other security devices in the Apartment are adequate and in good working order. I agree to inspect and test each of these

items and to give Owner prompt written notice if I determine that any of them need repair or replacement. I understand these

items will be checked by Owner or Agent upon move in only, unless otherwise requested by me in writing.

I agree that Owner may alter or cancel any patrol service without notice and that Owner has no obligation or liability for the

acts or omissions of any agent of any patrol service which may be engaged by Owner.

I recognize that Owner does not guarantee or assure my personal security and that Owner's efforts are voluntary and are done

in an effort to reduce the risk of crime in the community. I agree that furnishing of the safety devices and patrol service will not

AUTOMATIC GATE ENTRY SYSTEM

• Visitors drive up to the telephone entry system at the entrance of the property.

• Your telephone number has been programmed into the memory of the entry system.

• Your name and assigned code number are listed on the entry system directory at the entrance.

• When a visitor enters your code number, or selects your name and presses the call button the system will dial your home

phone number. Your phone will ring and you will be in communication with the visitor at the gate.

**Note: The code number is not your apartment number and cannot reveal your phone number.

• If you wish to admit the visitor, press or dial "9" on your telephone. The entry system will then open the gate.

**Note: On short duration tone phones, press the "9" several times.

• If you do not wish to admit the guest, simply hang up.

• The entry system permits conversation for about one minute and then will disconnect automatically. A short beep will notify

you of ten seconds remaining.

• Residents will be issued gate cards to gain access. Please treat cards with great care. The lessees will be responsible forreturning ALL gate access cards listed below. Gate cards are issued from the office. There will be a fee of  $0.00 to replace

Please be advised that we have carefully inspected your new apartment home prior to your taking occupancy. The unit has

been inspected by our craftsmen who are knowledgeable about bug infestation. At the time the unit has been delivered to you,

we warrant that it is free of bed bugs.

You can help us help you in the future as follows:

1.   Please do not accept furniture from third parties unless it is brand new.

2.   Do not bring furniture or other items into your home that you have found at a dumpster site. More than likely these items

are infested with bed bugs and that is why the previous owner threw them away.

3.   Please dispose of all trash in your apartment on a regular basis rather than having it sit in the unit.

4.   Please note that friends and relatives can bring in bed bugs unknowingly. It is a proven fact that bed bugs can attach

themselves to individual's shoes, clothing and other items. If they come to visit you and sit on your couch, that is sufficient

to cause an infestation.

5.   We recommend that you purchase covers that zip over your box spring and mattresses. These are available at most

department stores, hardware stores and pharmacies. By installing these on your mattresses and box springs, you deprive

bed bugs of a location to breed and they will not be able to spread.

6.   In the event of infestation in your apartment, you need to notify the rental office immediately so that we can remediate

these problems. Be advised that there is an initial one time charge of $300.00 and a possible additional charge of $30.00

per month for these treatments which you will be responsible for. You will also need to cooperate with our treatment

personnel, including explicitly following the directions for preparation given to you prior to treatment and possibly disposing

of any infested furniture if necessary to remedy the problem.

7.   Upon vacating the apartment a licensed exterminator will certify that the apartment is free of bed bugs. The cost of  $0.00

for this certification will be charged to the outgoing resident.

While the list above is not totally complete as to how to avoid bed bugs, the rental office will be happy to discuss this issue with

you in the future.

COMMUNITY POLICIES1.   If the resident should want to transfer from one apartment to another or from one community to another, during occupancy, there

is a NON-REFUNDABLE fee due prior to possession of the new apartment being given. The fee structure is based on the size of

the apartment the resident is transferring from and a new Lease Agreement must be signed. The fee is assigned as follows:

One Bedroom: $400

Two Bedroom: $450Three Bedroom: $500

In addition to the transfer fee, each Resident will also pay a new Security Deposit and other fees as required under the

Lease/Agreement and Transfer Policy.

2.   Insurance coverage maintained by the Management does not protect residents from loss of personal property by theft, fire, water

damage, etc. Each Resident is advised to obtain a policy of Renter's Insurance protecting his household goods and personal

property.

3.   Please limit your speed within the apartment community to 10  mph.

4.   Unsightly cars (such as cars with flats, broken windows, etc.) will not be permitted in or around the premises. Any vehicles that are

improperly parked, inoperable, expired license plates, expired inspection stickers, or unlicensed may be towed away at the

expense of the vehicle's owner. Resident agrees to abide by parking regulations, to notify and to require guests to abide by such

parking regulations. Please do not wash or repair your car on the property. Do not empty car ashtrays onto the parking lot.

5.   Do not hang bathing suits, brooms, mops, rugs, etc. on your balcony, patio or in the front of your apartment. No signs or

advertising notices of any kind shall be attached to any part of the outside of the building. There will be no aluminum foil, sheets,

blankets or any type of coverings over the windows to darken rooms; however, you may purchase white window shades at most

dime or discount stores that will serve the same purpose and still maintain the uniformity of the apartment complex. You may hang

your own drapes PROVIDED THEY HAVE A WHITE BACKING.

6.   Entrances, hallways, walks, lawns and other public areas shall not be obstructed or used for any purpose other than ingress and

egress.

7.   The use of charcoal barbecue grills and gas fired grills on porches, decks, balconies and patios of multi-family residences are

prohibited. All grills must be used a minimum of  fifteen (15) feet   from a structure. The storage of gas bottles from the gas fired

grills (either attached or unattached) in the structure and on balconies is prohibited. Charcoal grills may be stored on porches,

decks, balconies and patios provided the charcoal is completely extinguished. DO NOT place ashes or coals from grill in paper

bags, cardboard boxes, etc. and store on porches, balconies or patios. Make sure the ashes and coals are completely soakedwith water and place them in the outside dumpster. Barbecue grills or any type of grill for cooking purposes are permitted on the

ground floor of this community and must be placed   fifteen (15) feet   from the buildings. This regulation is for the safety of the

Lessors as well as the safety of all of the residents.

8.   Resident shall cooperate with the owner's efforts at pest control. This may include among other things, occupant emptying and

cleaning cabinets, drawers and closets pulling furniture away from walls and allowing exterminators to enter and treat the

apartment.

9.   The equipment in the bathrooms and kitchens shall not be used for any purposes other than those for which they were

constructed. No sweeping, rubbish, rags, disposable diapers, sanitary napkins, tampons, ashes, or other obstructive substances

shall be thrown therein. Do not place metal, string, grease, coffee grounds, nut shells, glass, olive or fruit pits, corn cobs, paper,

wire, bones, or non-food in disposal. Resident shall be held responsible for any repairs or damage resulting from the misuse of

such equipment and shall reimburse Management for necessary expenses incurred in the repair of such equipment. Portable

washers or dryers not approved in writing by the Management are prohibited.10.  Your apartment is your home, but it is not a house. Please be considerate of your neighbor. Resident's are required to control the

volume of stereos, TV's and musical devices within the apartments to the extent that they do not disturb residents of other

apartments. Noisy or disorderly conduct, annoying or disturbing other residents will NOT be permitted.

11.   If there are coin-operated laundry facilities located on the property. Please report machines which are not operating properly to the

office. Please do not use the laundry trash dispensers for your household trash. We appreciate your help in keeping our laundry

facilities clean.

12.  Residents may use nails and regular hangers when hanging pictures, mirrors, etc. Please DO NOT use the adhesive hangers,

since they damage the sheet rock on the walls.

13.  Trash containers are located at various places in the community. These dumpsters are provided for your convenience. However,do not place trash on the ground if these are full. Simply proceed to the next closest dumpster to dispose of your trash.

14.  No locks shall be changed or added in any way, to any door except with prior written consent of Owner or Management. There

shall be a charge for replacing lost keys and for keys Resident fails to return.

15.  The attaching of TV or CB antennas to apartment buildings is prohibited without written authorization of Management.

16.  Management approved and recognized solicitors will have in their possessions written authorization from the Resident Manager.

Please notify unauthorized solicitors to leave the community grounds, and then notify the Management Office.

17.  If you want us to allow someone to enter your apartment, we must have written permission. Just drop a note to us stating who to

let in and what date to expect them. PERMISSION MUST BE IN WRITING. Visitors must show proper identification. These

policies are to be strictly observed and will be enforced by Management. We hope all residents will understand that these policies

have been made for their pleasure and convenience in order that this property may maintain a reputation for quality living. Please

help us to maintain this reputation. The Management reserves the right to make such other reasonable rules as shall in the

 judgment of Management, from time to time become necessary to protect the care and cleanliness of the premises and for thepreservation of good order therein.

APARTMENT RENTAL AGREEMENT - CRIME FREE ADDENDUM

In consideration of the execution or renewal of a lease of the dwelling unit identified in the lease, Owner and Resident agree

as follows:

Resident, any member(s) of the resident's household, a guest or any other person affiliated with the resident at or near the

resident premises:

1.   Shall not engage in criminal activity, including drug related criminal activity, on or near the said premises.

"Drug related criminal activity" means the illegal manufacture, sale, distribution, use, or possession with intent to

manufacture, sell, distribute, or use of a controlled substance (as defined in Section 102 of the Controlled Substance Act

[21 U.S.C. 802]).

2. Shall not engage in any act intended to facilitate criminal activity.

3. Will not permit the dwelling unit to be used for, or to facilitate criminal activity.

4. Shall not engage in the unlawful manufacturing, selling, using, storing, keeping, or giving of a controlled

substance as defined in A.R.S. 13-3451, at any locations, whether on or near the dwelling unit premises.

5. Shall not engage in any illegal activity, including prostitution  as defined in A.R.S. 13-3211,   criminal street gang

activity  as defined in A.R.S. 13-105 and 13-2308,  threatening or intimidating  as prohibited in A.R.S. 13-1202,   assault

as prohibited in A.R.S. 13-1203 including but not limited to the   unlawful discharge of firearms, on or near the dwelling

unit premises, or any breach of the lease agreement that otherwise jeopardizes the health, safety and welfare of the

landlord, his agent or other tenant or involving imminent or actual serious property damage, as defined in A.R.S.

33-1368.

6. VIOLATION OF THE ABOVE PROVISIONS SHALL BE A MATERIAL AND IRREPARABLE VIOLATION OF THE

LEASE AND GOOD CAUSE FOR IMMEDIATE TERMINATION ON TENANCY.  A  single violation of any of the provisions

of this added addendum shall be deemed a serious violation and a material and irreparable non-compliance. It is

understood that a single violation shall be good cause for  immediate termination of the lease  under A.R.S. 33-1377, as

provided in A.R.S. 33-1368. Unless otherwise provided by law, proof of violation   shall not require criminal conviction,

but shall be by a preponderance of the evidence.

7.   In case of conflict between the provisions of this addendum and any other provisions of the lease, the provisions of theaddendum shall govern.

8.   This LEASE ADDENDUM is incorporated into the lease executed or renewed this day between Owner and Resident.

LOCKOUT POLICY AND PROCEDURE

It is policy of  Foxfire Apartments  that after hour's on-call staff will not perform lockout procedures. It is therefore crucial that

as a resident of our community, you take note of the following suggestions:

• Before leaving your home, make sure that you have your key with you.

• Make sure all appropriate household members have their own keys.

• In the unfortunate circumstance that you should lock yourself out of your apartment after hours, you will be responsible for

contacting a locksmith to gain access to your apartment and for the charges incurred by the work performed. Please refer

to the following tips when hiring a locksmith:

• Ask if the locksmith requires identification with a current address (such as, driver's license, current utility bill, etc.)

• Ask if they are licensed and bonded. Obtain the name of the locksmith who will be responding to your call and request thatappropriate licenses are supplied at that time. Be sure licenses have not expired.

• If your locks are changed or re-keyed by a locksmith, you agree to notify the Management Office immediately. We will

arrange to have our on-site maintenance staff re-key the locks at no additional charge to you. This will allow management

to have the correct key to each unit on file in the event of an emergency.

Arizona   recently passed a Medical Marijuana law that permits the limited use of Medical Marijuana in specific and limited

circumstances. The State of   Arizona   has adopted, or is in the process of adopting, rules that govern the manner of

establishing the regulations for the use of medical marijuana.

Despite  Arizona's new law, the federal Controlled Substance Act (CSA) categorizes marijuana as a Schedule 1 substance

and the manufacture, distribution, or possession of marijuana is a federal criminal offense. See 21 U.S.C. §801 et seq.

Furthermore, the U.S. Department of Housing and Urban Development has sent out a Memorandum that specifically states

that the use of marijuana for medical purposes violates federal law and that federal and state nondiscrimination laws do notrequire landlords to accommodate requests by current or prospective residents with disabilities to use medical marijuana. See

Medical Use of Marijuana and Reasonable Accommodation in Federal Public and Assisted Housing dated January 20, 2011

This property has determined that the use, possession, distribution or manufacture of marijuana has been determined to

interfere with the health, safety, welfare and right to peaceful enjoyment of the premises by other residents. As such, the

management hereby informs and reminds all tenants that they signed a Crime Free Addendum when they moved in and,

pursuant to that addendum and the supporting federal laws, any use of marijuana (medical or otherwise) by the tenant or their

guests will result in an immediate termination. If you have any questions or concerns about this policy, please speak to

management.

MOLD INFORMATION AND PREVENTION ADDENDUM

The following are simple measures which can be taken to avoid and, if necessary, to address mold and mildew problems in

your home.

Mold and mildew are found virtually everywhere in our environment, both indoors and outdoors and in both new and old

structures. Molds are naturally occurring microscopic organisms that spread through the dispersal of airborne spores. Moldand mildew have existed practically from the beginning of time. All of us have lived with mold spores all our lives. There is

conflicting scientific evidence as to what constitutes a sufficient accumulation of mold which could lead to adverse health

effects. Nonetheless, appropriate precautions need to be taken.

The best way to avoid problems with mold and mildew is to prevent excessive moisture buildup in your home. Excess moisture

can collect in a home from a variety of sources. Broken water lines or sprinklers, the accumulation of rainwater from roofs or

windows, or plumbing leaks can lead to water infiltration. However, excess moisture can also build up as a result of daily

activities such as showering, laundering, cooking and watering plants. Other factors, such as poor air circulation, extreme

differences in indoor and outdoor air, or failure to quickly clean up accumulated moisture can encourage mold growth.

There are several measures you can take to reduce moisture build-up in your home and discourage the growth of mold and

mildew. First, make sure your home is properly ventilated through operation of your HVAC system and/or by periodically

opening window and doors on days when the outdoor weather is dry (i.e., humidity is below 50 percent) to help humid areas ofyour dwelling dry out. Proper air circulation will help prevent excess moisture buildup in the more humid areas of your home.

In order to minimize the opportunity for moisture buildup, turn on any exhaust fans in the kitchen, bathroom or laundry area

before you start to shower, wash cloths, or cook with open pots and allow them to continue operating until after these activities

are completed. Wipe down any visible moisture accumulation on windows, walls, ceilings or other surfaces as soon as

possible. It is recommended that after taking a shower or bath you (1) wipe moisture off of the shower walls, shower doors the

bathtub and bathroom floor; (2)) leave the bathroom door open until all moisture on the mirrors and bathroom walls and tile

surfaces has dissipated; and (3) hang up your towels and bath mats so they will completely dry out.

Finally, promptly call the management office to report any signs of water leakage or infiltration, or any signs of excessive mold

or mildew growth. We will have one of our service associates come to your home to evaluate the situation.

Following these simple steps will reduce the likelihood of mold and mildew problems from developing in your home. If you

have any questions regarding the information in this letter, the management office will be happy to assist you.

PARKING ADDENDUMThere is a maximum of two vehicles  allowed to be parked on the property per apartment home.

Please do not back into parking spaces.  The exhaust discolors the buildings and sidewalks.

Any and all vehicles parked in a fire lane  are subject to immediate tow.

Any vehicles which   obstruct access to the property   will be towed immediately. Any vehicle   parked in handicapped

parking without permit  will be towed immediately.

All vehicles parked at the property must be in operable condition:

• Current registration stickers must be displayed at all times or vehicle will be tagged with a warning notice and then towed

after 24 hours.

• Any vehicle in a state of disrepair will be tagged with a warning notice, and then towed after 24 hours.

• Repair work, oil changes, and similar work are not permitted in the parking lots. Please perform this type of work off of the

property.

No boats, trailers, recreational, or oversized vehicles may be parked in the property's parking lot without prior written

permission of Property Manager. They will be towed after a 24-hour notice.

Motorcycles are subject to the same rules as automobiles. They must be operated in a safe manner and kept in good working

order.

Car alarms are considered a noise disturbance if they interfere with the quiet enjoyment of others residents' apartment homes.

These vehicles creating the nuisance will be towed at the owner's expense.

Parking spaces may be reassigned or unassigned to meet the needs of the community.

Please contact the management office if there is a parking issue. Management will coordinate all towing.

RESIDENT PROTECTION LETTER

Dear Residents,

We would like to take the opportunity to express our gratitude to you for choosing  Foxfire Apartments as your residence. We

hope that you will find living here to be an enjoyable experience. Although it is regrettable that we live in times in which our

protection from crimes is a genuine concern, we would like to remind you to be as careful as possible with respect to your

safety and security. Please be aware that each resident should seek to insure his or her own safety and property. In this

regard we suggest everyone take the following precautions:

WHILE AT HOME

1.   Lock your doors and latch your windows and inform management if they are not working properly.

2.   If you have night latches or deadbolts on the door, use them while you are inside your dwelling.

3.   When answering the door, first check who is there by looking through a window or peephole. If you do not know the people

standing outside, first talk to them without opening the door and do not open the door until you are satisfied you know who

the individual is.

4.   Be careful to whom you give or lend your keys to and do not put your name, address or phone number on your key ring.

5.   Keep phone numbers for emergency, medical, crime stoppers, police, and fire departments handy.6.   Periodically check your smoke detector for dead batteries and report any malfunctions to management.

7.   Immediately report any malfunction of safety devices directly to the property management. This includes, but not limited to,

broken gates, locks, burned out lights in stairwells or parking lots.

8.   Close your blinds at night, and keep a light on if possible.

9.   Let the property management and your friends know when you are going to be away from home for an extended period of

time. Get to know your neighbors and ask them to keep an eye on your apartment since the management can not assume

that responsibility.

10. Mark or engrave identification on valuable personal possessions.

WHILE OUT

1.   Lock your doors while you're away, including any dead bolts you may have.

2.   Leave a radio playing softly.

3.   Close and latch your windows.

4.   Use lamp timers when you go out in the evening or go away on vacation. They can be purchased at most hardware or

convenient stores.

5.   Tell a roommate or spouse when you're planning to go away, including the date and time of your return.

6.   Avoid walking alone in dark isolated areas.

7.   Do not hide a key under the doormat or nearby flowerpot. (That is the first place a burglar will look).

8.   Do not lend your gate access card or entry code number to guests or strangers. If you feel your code has been obtained by

any unauthorized individuals, contact the property management for a replacement, or key code change.

9.   Make arrangements for your newspaper and mail delivery to stop.10. Keep as few valuable items at home as possible.

11.  Whenever possible, do not leave any visible items in your car. Such as CD's, tapes, wrapped packages, briefcases,

purses, etc.

12. Do not leave your keys in your car. Be sure to lock your car anytime you enter or exit.

13. Carry your keys in your hand while walking to your car. Whether it is at home, school, work or on vacation.

14. Remember to check the back seat before entering your car.

Our onsite maintenance personnel and any courtesy guards in the apartment community have been hired by the property

management to oversee the owner's property and have not been entrusted with the responsibility to ensure the personal

safety of residents. In the event that you feel your personal safety is threatened, you should always contact your local police

department for the best response to your needs.

Please make an effort to watch out for your neighbors and report any suspicious activity on the property immediately to the

SATELLITE DISH AND ANTENNA ADDENDUM

Under a Federal Communications order, you as our resident have a limited right to install a satellite dish or receiving antenna

on the leased premises. We as a rental housing owner are allowed to impose reasonable restrictions relating to such

installation. You are required to comply with these restrictions as a condition of installing such equipment. This addendum

contains the restrictions that you and we agree to follow.

 ________    Number and size.   You may only install one satellite dish or receiving

antenna on the leased premises. A satellite dish may not exceed one meter (3.3 feet) in diameter. An antenna may receive

but not transmit signals.

2. Location.   Location of the satellite dish or antenna is limited to (1) inside your dwelling, or (2) in an area outside your

dwelling such as a balcony, patio, and yard, etc. which you have exclusive use under your lease. Installation is not

permitted on any parking area, roof, exterior wall, window, windowsill, fence or common area, or in an area that other

residents are allowed to use. A satellite dish or antenna may not protrude beyond the vertical and horizontal space that is

leased to you for your exclusive use.

3. Safety and non-interference.   Your installation: (1) must comply with the reasonable safety standards; (2) may not

interfere with our cable, telephone or electrical systems of those of neighboring properties; (3) may not be connected to our

telecommunication systems; and (4) may not be connected to our electrical system except by plugging into a 110-voltduplex receptacle. If the satellite dish or antenna is placed in a permitted outside area, it must be safely secured by one of

the three methods: (1) Securely attaching it to a portable, heavy object such as a small slab of concrete; (2) clamping it to

a part of the buildings exterior that lies within your leased premises (such as a balcony or patio railing); or (3) any other

method approved by us. No other methods are allowed. We may require reasonable screening of the satellite dish or

antenna by plants, etc., so long as it does not impair reception.

4. Signal transmission from exterior dish or antenna to interior of dwelling.   Under the FCC orders you may not

damage or alter the leased premises and may not drill holes through outside walls, door jams, windowsills, etc. If your

satellite dish or antenna is located outside you're dwelling (on a balcony, patio, etc.), the signals received by it may be

transmitted to the interior of your dwelling only by the following methods: (1) running a "flat" cable under a door jam or

windowsill in a manner that does not physically alter the premises and does not interfere with operation of the door or

window; (2) running a traditional or flat cable through a pre-existing hole in the wall (that will not need to be enlarged to

accommodate the cable); (3) connection cables "through a window pane" similar to how an external car antenna for acellular phone can be connected to inside wiring by a devise glued to either side of the window- without drilling a hole

through the window; (4) wireless transmission of signal from the satellite dish or antenna to a device inside the dwelling; or

(5) any other method approved by us.

5. Workmanship.   In order to insure safety, we must approve the strength and type of materials used for installation. A

qualified person or company who provides proof of general liability in the amount of $500,000 per occurrence and

$1,000,000 general aggregate must do installation. Our approval will not be unreasonably withheld.

6. Maintenance.   You will have the sole responsibility for maintaining your satellite dish, antenna and all related equipment.

7. Removal and damages.   You must remove the satellite dish or antenna and other related equipment when you move

out of the dwelling. You must pay for any damages and for the cost of repairs or repainting which may be reasonably

necessary to restore the leased premises to its condition prior to the installation of the satellite dish, antenna or related

equipment.

8. Liability insurance and indemnity.   You must take full responsibility for the satellite dish or antenna (including

installation) and must provide us with evidence of liability insurance to protect us against claims of personal injury and

property damage to others, relating to your satellite dish or antenna. The insurance coverage must be in the amount of

$100,000 which is an amount reasonably determined by us to accomplish that purpose. You agree to hold us harmless

and indemnify us against any of the above claims by others. We are not responsible for the theft or damage of the satellite

dish or antenna. It is your responsibility to contact the Satellite Company to determine who owns the satellite dish and is

responsible for any and all claims made by others. Insurance coverage for the installation of the satellite dish or antenna is

defined under paragraph 5 of this addendum.

9. Satellite Dish Security Deposit.   Your satellite dish security deposit will be in the sum of $100.00 in order to help

protect us against possible repair cost, damages, or failure to remove at the time of move-out. The security deposit does

not imply a right to drill or otherwise alter the leased premises.

You may start installation of your satellite dish or antenna only after you have (1) signed this addendum; (2) provided us with

written evidence of the liability insurance referred to in paragraph 5 and 8 of this addendum; (3) paid us the addition security

deposit, if applicable, in paragraph 9; and (4) received our approval of the person or company who will do the installation.

SCORPION AWARENESS ADDENDUM

The comfort of your new home is of utmost importance to us. Your new mountain surroundings offer beauty and tranquility but

also provide a home to a few undesirable critters. Your home and community are treated on a regular basis to control scorpion

infestations. This treatment will not eliminate scorpions as they are indigenous to Arizona. Please immediately report all

scorpion sightings to the office for treatment. Also, be aware that as Arizona is home to scorpions and other desert dwellers,

sightings will not constitute grounds for lease termination.

In the event of a scorpion sting;

1)   Stay Calm.

2)   Recognize scorpion sting symptoms: immediate pain or burning, very little swelling, sensitivity to touch, and

numbness/tingling sensation. A Bark Scorpion is poisonous. The Bark Scorpion sting may have additional symptoms such

as numbness or tingling of extremities or face, blurry vision, or muscle twitching.

3)   If you are victim of a scorpion sting, wash the area with soap and water.

4)   Apply a cool compress on the area of the scorpion sting.

5)   Call the Poison Control Center at (800) 362-0101 or (602) 253-3334. If you develop symptoms of a Bark Scorpion sting, go

to the nearest emergency room.

6)   Keep your tetanus shots and booster current.

SWIMMING POOL RULES AND REGULATIONSThe following rules and regulations are for the benefit and protection of all residents and their guests to assure the safe and

sanitary operation of the pool area and health club facilities. Your cooperation in observing all requirements will not only be

appreciated, but will also assure pleasant conditions for you in these areas. As used herein, "pool area" shall include any or all

of the following: swimming pool, sauna, whirlpool baths, running track, tennis court, basketball court or racquetball court,

showers, restrooms and locker room facilities and any fences or wall-in areas surrounding same; "health club" shall includeany exercise rooms, pool room or clubhouse, and apparatus, such as bicycles, rowing machines, weights, tanning beds and

other related equipment.

1.   Residents agree to display required identification or pass if any, upon owners request upon entering the pool area or

health club.

2.   All persons using the facilities within the pool area and health club do so at their own risk and sole responsibility. NO

LIFEGUARD IS ON DUTY. NO DIVING ALLOWED. Owner and agent assume no responsibility for any accident, injury or

loss in connection with such use. To the full extent permitted by law, persons using the pool and health club covenant and

agree with owner and agent to make no claim against owner or agent for or on account of any loss of life or personal

injury, or damage to or loss of personal property. Resident and their guest agree to assume all risks and to use extreme

care and caution in all acts concerning their activities in the pool area or health club, in order to avoid mishaps to

themselves or others.

3.   Any person who causes any property damage or loss will be held responsible for said damages or loss and will be charged

for same.

4.   Residents will be held responsible for all actions of their occupant(s) and their guests. Two guests per resident are

allowed. Residents are responsible for and must always accompany their guest.

5.   Only persons in proper attire are permitted in the pool area or health club. This includes swimwear not in violation of

Arizona Revised Statues 13-1402 as defined by Title 4, Chapter 1, Article 1.

10. The pool area or health club may be closed at any time due to weather, breakdown of equipment, operational defects, or

other causes in the judgement of owner or agent. Occupant(s) under  14  years of age must be accompanied by an adult for

admission to the pool area and the adult must remain with the occupant(s) the entire time they are in the pool area.

Occupant(s) 14  to 17 years of age are not permitted to supervise other occupant(s) under 14 years of age in the pool area.

11. The use of kickboards, tubes, beachballs, rafts and all other swimming equipment may be prohibited at owner or agent's

discretion.

12. FAILURE TO COMPLY WITH ANY OF THESE FOREGOING RULES AND REGULATIONS MAY RESULT IN THE

VIOLATOR BEING PROHIBITED FROM THE POOL AREA AND HEALTH CLUB, EITHER PERMANENTLY OR

ADDENDUM TO LEASE AGREEMENT

Pursuant to A.R.S. § 33-1314 of the Arizona Residential Landlord and Tenant Act, if a municipality that levies a transaction

privilege tax on residential rent charges the percentage of that tax, the landlord by service of a thirty (30) day written notice to

APARTMENT RENTAL AGREEMENT - UTILITY ADDENDUMThis Addendum is incorporated into and made a part of the Apartment Lease Agreement between  Foxfire Apartments  and

Resident(s)   Sukrit Ghorai, Harshwardhan Pagare, Pritam Kumar, and Akku Aby Mathews   dated   May 20, 2016. The

parties hereto agree that in the event of a conflict between the Lease and this Addendum, this Addendum shall govern.

1.   Residents' monthly rent payments made under this lease (no matter duration of lease) does not include payment forwater/wastewater/sewer/gas/trash ("Utilities"). Instead, by this Agreement, Resident(s) shall pay for utilities outlined below.

Resident(s) will receive a monthly bill for additional utilities and services from  Conservice  at which time such additional

utilities and services shall for all purposes be included in the term "Utilities." Resident(s) agree to submit payment by the

date specified on the bill and agrees to mail payment to the address specified on the bill. Owner is responsible for paying

the master metered water, wastewater, sewer, gas and trash costs, common area usage, as well as any penalties, late

fees, or interest pertaining to the utilities.

2.   For the duration of your lease, Owner is authorized to bill Resident(s) and Resident(s) agrees to be responsible for utility

service. Residents will be billed for the following utilities: Water, Wastewater/Sewer, Electricity, Gas, and Trash. The

formula for billing utilities is noted below:

Water/Wastewater/Sewer/Gas

Resident's bill will be allocated from the property's total gas, water and wastewater/sewer costs based on the squarefootage of your apartment and the number of actual occupants in the apartment.

Your monthly bill will differ based upon a number of variables such as total water consumption; the number of residents on

the property; and the water/wastewater rates charged by the utility company(s).

Trash

Your initial monthly trash charge will be   $9.00  and is based on historical trash charges. This is subject to change based

upon actual trash charges incurred by the property.

Electricity

Resident shall promptly contact the local electric utility(ies) (as applicable) to establish an account in Resident's name for

the provision of gas and electric service to Resident's unit.

Resident shall ensure that the start date for each such account is the Resident's move-in date. If Resident fails to comply

with the conditions of this paragraph and Owner is subsequently charged with utility charges attributable to Resident's

occupancy of the unit, then Resident shall be issued (and shall pay) a bill for such services by Owner or the billing provider

(which shall include a service charge in the amount of $25.00 on each occasion); such service charge is used to

compensate Owner for Resident's failure to become the customer of record for such accounts, including, but not limited to

charges assessed by the third party billing provider to Owner for processing of the bill for the delinquent time period,

opportunity cost of the money not paid and other administrative costs. Resident and Owner agree that the charge

described above is a reasonable estimate of the costs incurred.

3.   The cost of providing the utilities noted above to the Apartment is considered additional rent. In the event such bill is not

paid by the due date, such failure to pay shall constitute default under the Lease. Such default will entitle management to

all remedies available under the Lease. Outstanding balances will be deducted from the Security Deposit at leasetermination.

4.   A late fee of  5%  will be added to all delinquent balances and a NSF charge of   $50.00  will be assessed for any returned

checks.

5.   Resident(s) agrees that an Administrative Charge of $5.99 per month will be included in the cost of providing and billing for

water, wastewater/sewer, gas and trash service.

6.   Resident(s) acknowledge that a one time only Account Activation Charge of   $0.00   will be due and payable with the first

month's billing.

7.   Resident(s) acknowledge that upon the expiration of their lease, should they elect to continue leasing on a month-to-month

basis, they remain or become responsible for their utility charges.

8.   Management is not liable for any loss or damages Residents(s) incurs as the result of outages, interruptions or fluctuations

in utilities provided to the Resident(s)' apartments unless said loss or damage is a direct result of negligence by

Management or its Employees.

9.   Resident(s) shall not tamper with, interfere with, adjust or disconnect any water sub metering system or device. Violation of

this provision is a material breach or default of this Utility Addendum and Lease Agreement and, as such, entitles

Management to exercise all remedies available under said Lease.

11.  Resident(s) waives trial by jury in any action arising in any way from Resident's tenancy unless otherwise required by

applicable Federal, State or Local Law.
