CMVR & SAFETY REGULATION T-1 Auto Cess Committee A meeting of the Auto Cess Committee under the Ministry of Heavy Industry was held on 13th July 2015 to review ARAI ongoing projects and consider new proposals under the Auto Cess Fund. The committee agreed to support projects on low floor light weight buses with aluminium super structure for city application, including performance improvement with 4% design optimization, components and systems. A project on low temperature diesel combustion system to achieve Euro VI emission norms was also agreed.

T-2 Inauguration: State of Art pedestrian safety facility SIAM participated in the state of the art pedestrian safety facility held on 13th July 2015 at ARAI Chakan complex, Pune. T-3 New version of Draft Road Transport and Safety Bill 2015

The new version of the Road Transport and Safety Bill 2015 was released at MoRTH’s website on 24th June, 2015. This version of the bill is a condensed version of the previous drafts and is more comprehensive. Few observations:

− The vehicle manufacturers have been made responsible for scrapping and recycling of motor vehicles that have been rendered incapable of use.

− The retrofitment clause in the new bill maintains the manufacturer’s responsibility for any retrofitment carried out by a third party.

− Manufacturer might be fined upto INR 5L for any violation under the sections: (26)“Design, construction and maintenance of motor vehicles”, (28)“Vehicle Type Approval requirements and certification”, (30)“Certificates of conformity” and (32)“Alteration of vehicles and retrofitting of vehicle parts”.

− Refusal to recall would either have to be met with imprisonment for upto 3 months or fine which could extend to the cost of each vehicle recalled or both.

T-4 Cochin Port Trust Proposal to increase Axel Weight of Trucks Ministry of Road Transport and Highway convened a meeting to discuss the proposal of Cochin Port Trust to allow increase of the Axel weight of Trucks in India in view of the Axel weight prevalent in other parts of the world. Since the containers which are shipped in India are of heavier weight and are transported in smaller trucks in Europe with higher allowable Axel weight, similar size trucks are fined by Transport Department officials in India. NHAI and MoRTH officials were reluctant to consider increase in the Axel weight due to various concerns related to infrastructure capability to handle additional Axel weight. SIAM also pointed out that in India, Trucks are allowed to carry upto 49 tons and generally in Europe the maximum GVW is about 44 tons, hence incase the container are to be transported within India, a truck with higher number of Axels could be used. TWO WHEELER T-5 Mandatory ABS Fitment on Two Wheelers A telecon of Two Wheeler CEOs was held on 11th July 2015 to review the SIAM position on mandatory fitment of ABS for Two Wheelers. Mr K N Radhakrishnan, President & CEO, TVS Motor Company and Mr Harjeet Singh, Chairman SIAM Two Wheeler Group highlighted the discussions with Hon’ble Minister & Secretary of Road Transport held on 8th June 2015, wherein SIAM had submitted that ABS may not be made mandatory in India, as there aren’t any statistically‐significant results to suggest that ABS reduces two wheeler crash risk, and other low hanging fruits like AHO and helmet enforcement may be looked upon first. The Ministry was of the view that European Union would have carried in-depth analysis before mandating ABS. Therefore they did not agree with SIAM view. However, after discussion Ministry agreed to take views of ARAI on the subject before taking a final decision on the issue. After detail discussions SIAM Two Wheeler CEOs Council proposed the following recommendations to SIAM President and seek his direction for taking the issue forward:

1. ABS fitment in two wheelers would not have an overall improvement of safety of two wheeler riders in India.

2. In case the above does not result in Government agreeing to drop the proposal to mandate ABS for Two Wheelers then; a) SIAM could propose that each manufacturer should have atleast one model with

option of ABS b) If not, SIAM could propose that all manufacturers will have atleast one variant as

an option with ABS, for all +125cc motorcycle models of a manufacturer c) If not, then inspite of very strong reservation from one SIAM member, SIAM

could propose that a cc based categorisation, which is higher than 125 cc, can be considered for fitment of ABS for Two Wheelers. Initially SIAM could propose 250 cc as a cut-off for fitment of ABS.

For further details please contact Mr Atanu Ganguli ([email protected]) T-6 Meeting of SIAM 2 Wheelers Group with GCC Standardization Organisation A meeting of the Govt. of India/ SIAM delegation was held with the delegation from the GSO. The Indian side was led by Mr B.S Bhalla IAS, Joint Secretary in the Ministry of Commerce Govt. of India SIAM side was led by Mr Harjeet Singh, Vice President R&D, Hero MotoCorp Ltd and Chairman of the SIAM 2 Wheelers group. The meeting was also attended by a number of two wheeler manufacturers. The procedure for conformance to standards for exports of 2 wheelers to the Gulf Countries was discussed in detail. The GSO Delegation clarified all the doubts raised by the 2 wheeler manufacturers. Points raised by the GSO Delegation were also explained by the manufacturers. The GSO Delegation also handed over a new draft standard which has been circulated to members for comments. The GSO delegation expressed their satisfaction with the discussions and suggested that such exchange of views with SIAM may be continued on a regular basis. INTERNATIONAL HARMONIZATION T-7 Meeting Standing Committee on WP.29 A meeting of Standing Committee on WP.29 was held under the chairmanship of Mr Sanjay Bandopadhyaya, Joint Secretary, MoRTH on 15th July 2015 at New Delhi. The participants included the Chair and Co-Chair of the India GR Groups, MoHI, SIAM, and TMA. The white paper on improvement in implementation of the 1998 agreement prepared by EU, Japan and USA was tabled as an informal document. The three areas have been identified for improvement:

1. Improving the project selection strategy for the program of work. 2. Improving the management of GTR development process 3. Improving the adoption process of GTRs at the national/regional level.

EMISSIONS & CONSERVATION T-8 National Green Tribunal, Western Zonal Bench at Pune The PIL submitted before the Pune Bench of the National Green Tribunal prayed preponement of BS VI emission norms in parts of India by April, 2017 and pan India by 31st March, 2018. SIAM being a respondent in this petition pointed out in its affidavit that the MC Mehta case at the Supreme Court is also along the same lines and that this matter should be left to the latter, being the highest court. In SIAM submission it was pointed out that the Hon’ble Tribunal can exercise its original jurisdiction only when a substantial question relating to environment including the enforcement of legal rights would arise out of the implementation of the enactments. Hence, this application is not maintainable before the Tribunal. Similar objections were raised by the other respondent, Reliance Industries. At the hearing on 15th July, 2015, the tribunal agreed to hear and decide such objections on the 14th September, 2015. For further details please contact Ms Novika Sood ([email protected])

T-9 National Green Tribunal, Principal Bench As a significant step to improve the ambient air quality, the National Green Tribunal on 19th January, 2015, ordered that all vehicles more than 15 years old would not ply in the national capital. NGT in its order dated 7th April, 2015 directed that all diesel vehicles (light or heavy) older than 10 years would not be permitted to ply in NCR, Delhi. The 7th April, 2015 had been facing subsequent stays. Previous hearings have seen Principal Bench, NGT dismissing reports from IITs and MoRTH “as they lacked data and analysis”. At the hearing held on 14th July, 2015 the Bench wanted to know if the Government had some other credible source apportionment study Report and as to what was the basis of the Government forming an opinion that Diesel Vehicles could also be run for 15 and not 10 years. It was pointed out by SIAM counsel that the lifespan of a vehicle cannot be the criteria for deciding when a vehicle could be phased out but it should be the fitness and implementation of the fitness regime which needs to be tightened; and stressed upon the drastic improvement in technology of diesel engines not only in India but throughout the world. The sales of diesel cars had increased and that shortly upon implementation of BS V and BS VI norms, there would be minimal pollution by diesel vehicles. T-10 Fuel Efficiency Labels for Passenger Cars BEE had convened a meeting to discuss the possible options for categorizing Stars for fuel efficiency performance of vehicles. SIAM internal meeting to finalise the proposal for FE Star labels was held on 29th June 2015. SIAM final proposal is derived from one of the proposals of BEE where the Star category is based on the 2017 regulation and 20% slope bandwidth is considered between each Stars. The only change in SIAM proposal is a 27.5% band width for Star 2 category, in order to maintain uniform distribution of vehicles. In case this proposal does not get accepted, SIAM will propose uniform 20% change in slope, between each Star, with middle of three Star as the regulation line for 2017. The next meeting of BEE is likely to be scheduled in August 2015. On the administrative part SIAM will communicate to BEE that the label should be at point of sale and not on each vehicle and an A4 size label will be displayed at the dealerships. SIAM will also mention that there should not be any maximum and minimum value band for a given reference weight category for FE label, as changes in the FE values of new models, may result in regulatory non-compliance for labels and therefore controlling the implementation of the same through dealers across the country, would be very difficult. Regarding the size of the label, it was proposed that in case the SIAM proposal for label at dealer point is not accepted and BEE insists for label on each vehicle, then a small size label, will be proposed by SIAM. The contents of the label will be the Declared FE, Name of the Manufacturer, Vehicle model name, Engine size, Fuel, Date of Print and Star Category based on Gasoline equivalent value. SIAM would also propose that BEE should only notify the Star label categories and the Test agencies will mention the Stars on the Test Report. SIAM would submit that there should be no requirement for registration of manufacturers with BEE and no fees should be paid by SIAM members to BEE. T-11 Meeting with ARAI & ICAT on Changes in COP Procedures In the 49th SCOE held on Feb 2015 COP, changes were discussed and SIAM had raised concerns on Dealer COP wherein it was decided that the same may be discussed with CEO NATRIP. SIAM had submitted comments to changes in the TAP document to ARAI. SIAM also had a meeting with ICAT and Mr Nitin Gokarn, then CEO, NATRIP on 8th May 2015 wherein it was agreed to commence a Pilot project on Dealer / Warehouse COP and SIAM would need to prepare proposal on the same. It was decided that other changes in COP be discussed with Test agencies directly. Therefore a meeting was held with ICAT & ARAI on 18th June 2015 to discuss changes in COP. Regarding Dealer / Warehouse COP, SIAM had proposed that a Pilot project for Dealer COP could be initiated to understand various administrative, technical and financial issues. Emission results will be generated through this study would need to be analyzed. This will form the basis for further decisions on the requirement of a dealer end COP. Dealer will be randomly selected by the test agency and only one vehicle of any one model could be selected from each vehicle manufacturer. However, after detail discussion it was agreed that current COP procedure to continue. Instead of one vehicle per manufacturer, three vehicles of any one model per OE per category (one each of 2W/ 3W / 4W - upto 3.5 tons), to be selected from dealership(s) / Warehouse(s), annually. No specific decision could be taken on items such as tolerance in

Weight measurement of COP vehicles, Serial Number addition for emission components, extended COP and 1.3 Factor. These items were thereafter discussed in the SCOE meeting on 15th July 2015. For further details please contact Mr Atanu Ganguli ([email protected])

T-12 Recommendation of Lok Sabha Committee on Petroleum and Natural Gas on Auto Fuel Policy

Lok Sabha Committee on Petroleum and Natural Gas on Auto Fuel Policy have suggested various measures for implementing and administrating future emission regulations. Apart from suggesting earlier implementation of the recommendations of Expert Committee Report on Auto Fuel Vision & Policy 2025, the committee also recommended that MoPNG should constitute inter-ministerial committees at the level of Secretaries for implementation of future emission norms as the SCOE Committee under Joint Secretary, MoRTH is a low level committee. It has recommended that there should be ‘One Country-One Fuel Norm’ and MoPNG should strictly adhere to BS IV by April 2017 and BS VI by 2020 across the country. For upgradation of Oil Refineries, MoPNG should monitor the projects and ensure BS VI by 2020 and levy cess for fuel upgradation projects. Bio Fuel, CNG & Hydrogen Fuels should be given priority. MoPNG to coordinate with PCRA and BEE to expedite Fuel Efficiency labelling program for vehicles. MoPNG to work with MoRTH & State Governments on PUC and funds should be allocated in planned scheme for networked PUC system. MoPNG to impress upon MoRTH to set up Inspection & Certification Centres and Fitness testing age of Private Vehicles to be brought down from 15 years. T-13 Changes in Diesel Smoke Opacity Test Procedure Ministry of Road Transport and Highways has issued a notification revising the test procedure for free acceleration smoke test during PUC check and Type 2 tests for Diesel vehicles. The measurement of temperature is not mandatory if the vehicle passes the test and the number of free acceleration revving has been reduced to three. T-14 Availability of AUS 32 for BS IV extension across the country Since Government of India has decided to extend BS IV in phases across the country to be completed by April 2017, a meeting was organized with select suppliers of AUS 32 to discuss the status of availability of AUS 32 for BS IV vehicles across the country. M/s Valvoline Cummins explained their preparedness and also said that the concept of AUS 32 matures over a period of time, which commences from supply of packaged AUS 32 to full-fledged dispensing of AUS 32 from retail outlet as the demand increases. M/s Gulf Oil also explained that availability and supply of AUS 32 will not be a constraint for all BS IV vehicles. During the discussion, it was also highlighted that there needs to be representation to Government allowing the non-aqueous AUS 32 for import and also indigenous

T-15 BIS Specification for Ethanol and Bio-Diesel Blended Fuel In view of the recent Government of India initiatives to promote Bio-Fuels in India, BIS has been directed to finalise specifications for various blends of Ethanol and Bio-Diesel for Automotive applications. From SIAM, Dr Mathew Abraham, Mahindra & Mahindra has been made the convener for the Working Group on E85 & ED95 specification while IOC has been made the convener for Bio-Diesel. BIS has suggested that the specification needs to be finalized on priority and it is expected that the same will be made available to BIS for printing within next couple of weeks. SIAM members have also decided that it is important to organise a Workshop with producers of Associations of Bio Fuels to understand the future likely availability of various fuels in the country to enable vehicle manufactures plan their products accordingly. TRADE FAIR E-1 SIAM Trade fair group meeting

A meeting of SIAM Trade fairs group was held on 26th June 2015 at India Expo Mart, Greater Noida, Delhi NCR under the chairmanship of Mr Arvind Kumar Saxena, Chairman, SIAM Trade Fair group and President & Managing Director, General Motors India. Mr Sugato Sen, Deputy Director General, SIAM, gave a detailed presentation on Auto Expo – The Motor Show 2016 covering different aspects like - Event Date & Timings, Specifications of new halls, Confirmed Exhibitors, scheduled dates, space allocation procedure, Stall design guideline and submission, Passes and various badges entitlement of exhibitors etc.

Some important points discussed during the day were:

1. Location of stalls likely to change from 2014 edition to achieve better space utilization and for safety and security of stalls and visitors. Attempt will be made to accommodate members of the hangers in the last edition in New Permanent Halls this time.

The decision of Organisers on space allotment will be final and no change will be possible after space announcement since it will go to all exhibitors and others may not want change.

2. Exhibitors must submit 4 copies of the design and drawing of their stall (floor plan & elevation with dimensions in meters) in 3D view mentioning display position of exhibits, furniture, brandings, mezzanine floor if any and office area including specification of stand material with dimensions in meters, to the Organisers for approval by 16th November, 2015.

3. A checklist will be sent by SIAM to exhibitors according to which they will have to

submit their stand designs in due course of time.

4. Organisers will coordinate only with the designated Contact person FROM THE MEMBER COMPANY, who should be a full time employee. No agency personnel should be allowed to interact with the organisers.

5. Inauguration of the show is planned for morning hours on 4th February 2016 like last event in 2014. For Inauguration of Motor Show 2016 Finance Minister/ Minister Ministry of Heavy Industries and Public Enterprises shall be invited.

6. As requested by a few members a press conference of the Motor show shall be organized in Chennai other than cities like Delhi, Mumbai, Kolkata etc.

7. There shall be no cash transactions for F&B in the venue. A robust system will be managed by BookMyShow through centralised card system.

8. Members were requested to use the Motor Show logo/ show dates in their mass media advertisements/hoardings etc to promote Motor show in various cities.

E-2 SIAM GST Workshop

The logistics group of SIAM organised a workshop on Goods & Services Tax (GST) on 15th July in New Delhi. The objective of the workshop was to create awareness about the

upcoming GST amongst Supply Chain, Marketing and Taxation officials of the SIAM member companies. Presentations were made by leading consultants E&Y, KPMG. A T Kearney and PwC on various aspects of GST and also had interactions with the audience. More than 100 participants from OEMs and Logistics Service Providing companies attend the workshop. VEHICLE CLASSIFICATION, SALES REPORTING & ANALYSIS E-3 Overall Industry Growth Remains Subdued in June Production The industry produced a total 5,750,518 vehicles including passenger vehicles, commercial vehicles, three wheelers and two wheelers in April-June 2015 as against 5,661,908 in April-June 2014, registering a marginal growth of 1.57 percent over the same period last year. Domestic Sales The sales of Passenger Vehicles grew by 6.17 percent in April-June 2015 over the same period last year. Within the Passenger Vehicles, Passenger Cars and Vans grew by 8.57 percent, 1.47 percent respectively while Utility Vehicles dropped by (-) 0.57 percent during April-June 2015 over the same period last year. The overall Commercial Vehicles segment registered a growth of 3.55 percent in April-June 2015 as compared to same period last year. Medium & Heavy Commercial Vehicles (M&HCVs) registered a growth at 23.23 percent while Light Commercial Vehicles declined by (-) 7.37 percent during April-June 2015 over the same period last year. Three Wheelers sales declined by (-) 6.77 percent in April-June 2015 over the same period last year. Passenger Carriers and Goods Carriers declined by (-) 7.97 percent and (-) 1.51 percent respectively in April-June 2015 over April-June 2014. Two Wheelers sales registered a marginal growth of 0.64 percent in April-June 2015 over April-June 2014. Within the Two Wheelers segment, Scooters and Mopeds grew by 7.25 percent and 3.92 percent respectively while Motorcycles dropped by (-) 1.97 percent in April-June 2015 over April-June 2014. Exports In April-June 2015, overall automobile exports grew by 9.22 percent. Passenger Vehicles, Commercial Vehicles, Three Wheelers and Two Wheelers registered a growth at 0.75 percent 26.01 percent 40.05, percent and 6.15 percent respectively in April-June 2015 over April-June 2014.

SIAM is a member on the Empowered Board of the ministry of steel on the research project on Galvanising of steel sheets for automotive applications. A meeting of the board was held in the National Metallurgical Laboratory, Jamshedpur where this project is being executed. Progress of the project was discussed and the data available with other research projects elsewhere were requested to be compiled. A. Discussion on Foreign Trade Policy – Next Steps

The Foreign Trade Policy 2015-16 (FTP) was released in April 2015. The new FTP helped ease many procedural requirements, however the incentive available on vehicle exports were reduced from 2% - 4% to a flat 2%. Also, for a few important markets (like Sri Lanka and Bangladesh), the benefit was totally withdrawn. Members expressed their concern on the reduction in incentive as 2% is not adequate for addressing the cascading tax impact. The group discussed various issues with regards to the FTP and it was decided that a representation would be made to Department of Commerce to highlight the concerns of the automobile industry. The following Member companies had sent their submission on the foreign trade policy to the secretariat: 1) Bajaj Auto 2) Hyundai Motor 3) Mahindra & Mahindra 4) Tata Motors 5) TVS Motor 6) Volkswagen

The inputs received from all the members were discussed and the suggestions which were to be forwarded to the Ministry were finalized.

E-6 Meeting in the Tariff Commission on Inverted Duty structure

SIAM attended a meeting called by the Tariff Commission to discuss the Inverted Duty Structure suffered by the industry and any remedial measures.

SIAM informed them that at present in respect of finished vehicles there is no inverted duty structure, however in case the Govt decides to reduce duties under any FTAs , then the position might change and inverted duty structure may arise.

E-7 SIAM submits paper on ‘Goods & Services Tax - Aspirations &

Expectations of Indian Automobile Industry’

SIAM Taxation group made a paper on ‘Goods & Services Tax - Aspirations & Expectations of Indian Automobile Industry’. This paper was submitted to the select committee of Rajya Sabha on the Constitution (122nd Amendment) (GST) Bill, 2014. Suggestions were made on the following points in the paper: 1. Additional Tax (AT) of 1% 2. Subsume All Taxes/Duties 3. Special process and provisions for Sale of Pre-Owned / Used Vehicles 4. Minimum exemption / 100% credit flow to business 5. Protection of benefits under Area based exemptions 6. Clarity in provisions 7. Release of draft rules for study and comments of Trade and Industry 8. IT System 9. Statutory forms

E-8 SIAM Submission on Constitutional Amendment Bill (CAB) SIAM Taxation group made a presentation on the suggestions on the Constitutional Amendment Bill (CAB). This presentation was submitted to the select committee of Rajya Sabha on the Constitution (122nd Amendment) (GST) Bill, 2014. The presentation included submission on the following sections in the bill:

1) Section 279A: Establishment & Power of GST Council. 2) Section 366 (12A): Definition of ‘goods and services tax’ 3) Section 18: Additional Tax (AT) of 1%

PUBLIC POLICY P-1 Valedictory Function of Road Safety Awareness Summer Camp for School

Children The valedictory function of the Road Safety Awareness Summer Camp for School Children was held at the Institute of Driver Training and Research at Sarai Kale Khan on 30th June 2015. Dr Muktesh Chandra, Special Commissioner of Police - Traffic, Delhi graced the occasion as Chief Guest. Senior Delhi Traffic Police Officials and other dignitaries were also present on the occasion. The valedictory function was held with a view to acknowledge the cooperation and participation of various NGOs and corporate houses in the road safety awareness summer camps organized by Delhi Traffic Police, in 6 batches of 5 days duration each from 18th May 2015 to 26th June 2015 at the five Traffic Training Parks situated at Baba Kharak Singh Marg, Bal Bhawan, Pragati Maidan, Punjabi Bagh and Roshanara Bagh.

Delhi Traffic Police along with SIAM and its members had come up with this unique idea of organizing road safety awareness summer camp for the benefit of school students from class VI to XII with the dual objective of helping children in utilizing their summer vacation in a meaningful way and learn some life skill techniques in an enjoyable manner which will have a bearing on their personality in the years to come. The course contents of the summer camp was designed to inculcate good road safety habits in the students which in turn will help them grow up into sensible, sensitive and responsible road users. The summer camp was purely free of cost and the participating students were provided daily refreshments. Each student was awarded with a certificate of participation on the conclusion of the summer camp. Many competitions such as Painting Competition, Quiz Competition and Slogan Writing Competition were held among the participants and awards were given to the participants.

On the occasion of the valedictory function quiz competition on topics relating to road safety, first aid, disaster management, etc were held among the toppers (participants of the summer camp) of the Quiz Competition in each batch in each park and the best team was awarded with prizes. The runners up teams were also felicitated. The Traffic Training Park which gave the winning team was awarded the Rolling Trophy for being the best park. The Road Safety Awareness Summer camp received an overwhelming response from the participating students and appreciation from all quarters. A total of 2100 participated in the summer camp from 18th May 2015 to 26th June 2015 at the five traffic training parks. For further details contact Ms. Meenakshi Kukreja ([email protected]) P-2 Road Safety Awareness Workshop for Bal Bhavan School, Mayur Vihar SIAM – SAFE received a request from Bal Bhavan School to organise Road Safety Workshop for their standard VII students. SIAM with kind assistance from Honda Motorcycle and Scooter organised a workshop for 200 number of students on 16th July 2015. We had also distributed the Road Safety Comics to the students.
