Short Overview of* Information on Employing
Academic Personnel from EEA and Third
Countries (Status June 2016)
Work permit
In principle, persons in regular employment (angestellt) at universities, provided they are
working in research and teaching, including artistic work, are exempted from the Foreign
Nationals Employment Act (Ausländerbeschäftigungsgesetz, AuslBG), i.e. no work permit is
required. However, no other gainful employment, including self-employment, is allowed.
Residence
Nationals of EEA Countries (EU, Iceland, Liechtenstein, Norway) and Switzerland:
Residence of up to 3 months
In principle, nationals of EEA countries and Switzerland are entitled to stay in Austria for up
to three months without registering with the immigration/settlement authority
(Niederlassungs- und Aufenthaltsbehörde). The person must register their address with the
local authority within three days of arrival (‘Anmeldung’; entry in the Melderegister; applies
to everyone, including Austrians; in Graz, do this at the ServiceCenter of the City of Graz in
Schmiedgasse 26) and this is sufficient.
Residence longer than 3 months
If the period of residence is longer than 3 months, nationals of EEA countries and
Switzerland are required to register with the local immigration/settlement authority (in

Graz: Office of the Government of Styria, Department 3†, Paulustorgasse 4), applying for a
confirmation of registration (Anmeldebescheinigung). This application must be submitted
within 4 months of the beginning of the period of residence.
CAUTION: Failure to register residence within 4 months is a violation of administrative law
and is punishable by a fine of up to 250 euro.
Nationals of EEA countries and Switzerland are entitled to reside and/or settle in Austria if:
1. they are in gainful employment or self-employment
2. they have adequate health insurance and prove that they have sufficient income or
funds to support themselves.
3. the main purpose of their stay is the enrolment for a course of education at a school
or educational institution and if they fulfil the conditions of number 2.
If these conditions are fulfilled, the authority (Office of the Government of Styria) issues a
confirmation of registration (Anmeldebescheinigung).
Nationals of Croatia – Special Regulations
Please note: Special regulations apply to Croatian nationals (status: 2015).
Third Countries (Countries Outside EU, EEA and Switzerland):
For nationals of third countries, the prerequisite for taking up employment at the University
of Graz, the Medical University of Graz or Graz University of Technology is a valid residence
title which includes the right to work.
Residence up to 3 or up to 6 months:
Nationals of third countries must apply for either a Visa C – Gainful Employment (Visum C-
Erwerb; residence visa for up to 90 days) or a Visa D – Gainful Employment (Visum D-
Erwerb; residence visa for more than 90 and up to 180 days) at the Austrian Representation
in their country of origin. These categories of visa allow the holder to stay in Austria for up to

three or six months and they are allowed to take up employment immediately after arrival in
Austria.
Nationals of third countries who are entitled to enter Austria without a visa must apply for a
a Visa C – Gainful Employment (Visum C-Erwerb) or Visa D – Gainful Employment (Visum D-
Erwerb), on the basis of which they will be allowed to take up employment. If they are in
possession of such a visa, they can take up employment immediately after arrival in Austria.
Residence for Longer than 6 Months:
i. Temporary Residence in Austria:
Residence Permit ‘Researcher’
The work permit ‘Researcher’, with a period of validity of up to two years is for nationals of
third countries who have a Hosting Agreement with a certified research institution or with a
research institution that does not need certification. The universities make such Hosting
Agreements with prospective researchers. To arrange a hosting agreement, contact the
relevant member of the personnel department who will inform you about the procedure to
follow.
Residence Permit ‘Special Cases of Gainful Employment’
The work permit ‘Special Cases of Gainful Employment’ with a period of validity of up to one
year is for nationals of third countries who are exempted from the Foreign Nationals
Employment Act (Ausländerbeschäftigungsgesetz, AuslBG).
Prospective academic employees must apply for this residence permit; the application must
be made in person at the local Austrian Representation in the country of origin. The
applicant must wait to receive the decision on this application in their country of origin,
before entering Austria. Therefore it is essential to submit the application in good time (at
least three months before the planned beginning of employment).
Important: In order to collect the residence title, the applicant must first go to the Austrian
Representation and have their fingerprints taken; the document of the residence title is then
issued about 10 working days later.

If the prospective employee is entitled to enter Austria without a visa, and is already in
Austria, or has a lawful residence title after a legal arrival, they may submit the application
for this category of residence permit to their local immigration/settlement authority in
Austria (if their place of residence is in Graz: Office of the Government of Styria, Department
3‡, Paulustorgasse 4). They are not allowed to take up any gainful employment before the
residence permit that allows them to do so is issued.
