    +'5 Mo-erni6ation Pro$ess

    n 01# the Province !egan a process to modernie the provincial lottery and gaming

    !usiness following a strategic !usiness review completed !y the Ontario 'ottery and=aming Corporation O'=/$ %he !usiness review concluded that the private sectordelivery of lottery and gaming should !e e8panded and O'= should move from directdelivery of lottery and gaming to oversight of operations$ As a result# O'= !eganworing closer with private operators and municipalities to further the moderniationprocess for gaming$

    %he intent of O'= was to serve eastern Ontario with ones centered on Peter!orough#Belleville and Eingston under the control of one operator$ %he Peter!orough oneincluded the City and portions of 2elwyn %ownship# Otona!ee-2outh +onaghan%ownship and Cavan +onaghan %ownship$

     As part of the process# O'= reFuested that municipalities identify potential sites# passresolutions to confirm interest and ultimately ensure land use approvals were secured$n the summer of 01# the Province passed Ontario &egulation *1"1 to give furtherclarity to the e8pectations of O'=;s process and in particular# the role of a municipalcouncil$ Gnder &egulation *1"1 a municipal host must see pu!lic input into theesta!lishment of a proposed gaming site and must provide a written description of thesteps it too to consult and a summary of the pu!lic input received$ A host municipalityis also reFuired to pass a resolution supporting a gaming site$

    City as Host M"ni$i&ality

    On De!ruary 11# 01)# &eport P'P1)-01) was presented to Planning Committeerecommending that if Council continued to support the esta!lishment of a casino withinthe City as was first resolved on April # 01 then a formal resolution would need to !eapproved and that pu!lic delegations !e received in respect of the resolution and on thelocation options for a proposed casino$ %he report outlined 4 general location options forinclusion in the pu!lic discussion.

    Option A. %he Central Area owntown/Option B. 7ast Peter!orough Commercial CatalystOption C. %he =ateway ZoneOption . %he 2trategic Zone west of the City/

    On +arch # 01)# a special Planning Committee was held to review location options fora casino within the City and receive delegations$ After hearing pu!lic delegations#Planning Committee passed the following resolution.

    9Pursuant to 2ection of Ontario &egulation *1"1# the Council of the City ofPeter!orough here!y gives notice to the Ontario 'ottery and =aming Corporationof the City;s support for the esta!lishment of a gaming site in the municipality#and

    %hat the Ontario 'ottery and =aming Corporation !e advised that the City isprepared to give full consideration to an appropriate gaming site in the followinglocation options as descri!ed in Planning &eport P'P1)-01) appended to thisreport.

    i/ Option A. %he Central Area owntown/ii/ Option B. Commercial Catalyst Zone 7ast/iii/ Option C. %he =ateway Zone 2outhwest/:

    City Council at its meeting on +arch 1,# 01) ratified the decision of PlanningCommittee and the record fulfilling the o!ligations of Ontario &egulation *1"1 was

    forwarded to the O'=$ O'= formally advised the City that the local process satisfied thereFuirements of Ontario &egulation *1"1 deeming the City as a willing hostmunicipality$

    Hithin the Peter!orough Zone as defined !y O'= only the City of Peter!orough and the%ownship of Cavan +onaghan fulfilled the o!ligations of the legislation to stand as awilling host$ Accordingly# a fully modernied casino operation would only !e locatedwithin Cavan +onaghan or the City of Peter!orough as a replacement facility for theformer O'= Eawartha 2lots$ %hrough out the procurement process for an 7asternBundle operator# prospective !idders evaluated the site opportunities within thePeter!orough Zone and !ased their !id su!mission to O'= on the merits of a preferredlocation$ ?ost municipalities had no influence over the O'= proponent selectionprocess and no specific nowledge of the location preferences of individual !idders$%he moderniation program is a !usiness relationship !etween O'= and the privateoperator$

    The !ele$te- +&erator of the 7astern /"n-le

    n the summer of 01 O'= announced that =reat Canadian =aming Corporationoperating the eastern !undle as 2horelines Casinos/ was the successful 7asternBundle operator$ O'=;s announcement indicated that =reat Canadian =aming wouldFuicly tae over O'=;s presence at Eawartha 2lots and would !e given the opportunityto modernie the gaming !usiness in that community or an accepta!le City-!ased

    location$

    On 3ovem!er 1(# 01 Council gave Closed 2ession direction to staff to initiate theland use approvals for a City-!ased site in eeping with the +arch # 01) resolution ofCouncil if it !ecame clear that =reat Canadian =aming intended to pursue a City-!asedsite$ %he direction was as follows.

    %his !acground section sets the conte8t for the current land use planning decision!efore Council$ O'= adopted a moderniation program for gaming in the province$+unicipalities within specified maret ones were given an opportunity to declare amunicipal interest in hosting a casino$ %he City passed the reFuisite resolution followinga fulsome consultation program in +arch of 01) and identified ) accepta!le location

    options$ n response to a call for proposals =reat Canadian =aming was selected !yO'= as the owner"operator of the 7astern !undle$ =reat Canadian =aming selectedPeter!orough as their municipal host and the =ateway site as the specific location$ %heplanning approvals are the logical conclusion of a 4-year engagement program !etweenO'=# municipalities and potential operators$

    'an- 8se &&li$ations

    %he site selected !y =reat Canadian =aming for the Peter!orough facility is located inthe =ateway Zone at 1400 Crawford rive$ %he site is nown as the Jisitor Centre site

    and is currently occupied !y %im ?ortons and the %ourism nformation Centre$ %he rent-free occupancy of the Jisitor Centre !y the City su!-let rent-free to Peter!orough7conomic evelopment/ will end in 2eptem!er of 01< and there is no o!ligation for theCity to remain as a rent paying tenant at the site$

    n order for a casino to !e located at 1400 Crawford rive# planning approvals# asidentified in &eport P'P1)-01)# are necessary$ %he approvals sought are an OfficialPlan Amendment to permit a gaming esta!lishment"casino on the su!@ect lands and aZoning By-law amendment to create a special district for the su!@ect lands# which willpermit a gaming esta!lishment"casino# hotel and restaurant for the property$ Althoughthe property is already oned for a wide range of service commercial uses# including

    hotel and restaurant uses# the intent is to reduce the range of permitted commercialuses to match the intent of the proposed development$

    %he su!@ect property is appro8imately 4$( hectares 11$4 acres/ in sie# located in closepro8imity to the Crawford rive"Parway intersection$ %he site is designated 2erviceCommercial in the Official Plan# and is currently oned +$ and 2P$(*# permittingprestige industrial uses including regional scale offices and service commercial uses$

    %he gaming facility"casino will generally !e comprised of the following.

     Ad@acent to the property at 1400 Crawford rive to the north is City-owned land at *(?arper &oad$ %he City-owned land in this immediate area has !een identified for manyyears as a 9Duture ntercity Commuter Dacility:# and the proposed casino developmentcontinues to respect the space reFuirements of this important facility$

    %he Official Plan Amendment OPA/ proposes to add a policy to 2ection $) of theOfficial Plan that permits a casino and gaming facility on the su!@ect property$

    Poli$y %evie

    !e$tion 2) ; Commer$ial !tr"$t"re Poli$ies

    2ection $) outlines the commercial structure of the City of Peter!orough for the Central Area# 2hopping 3odes and 2pecial Policy Area# none of which the su!@ect site is part of$Hhile the site is not part of any of these areas# these policies are relevant to theconsideration of this OPA as the Official Plan policies must !e read as a whole$ %hereare relevant Central Area policies that provide direction on where certain uses shouldlocate$ n particular# the policies spea to entertainment and commercial uses wherethey are to !e among the prime focuses of the Central Area$

    Priority F"n$tions in the Central rea:

    2ection $)$1 states that the Central Area is.

    9the prime focus of office# cultural and entertainment "ses as well as a diverserange of retail facilities including specialty stores# regional uses and services inaddition to stores and services which support its residential population$ t is alsomuch more than a commercial area and provides the focus for governmentactivities community and re$reational "ses# higher density and specialiedforms of housing# heritage sites and !uildings# to"rist fa$ilities as well as thesite of several ey industries$: Kemphasis addedL

    Durther# the section states.

    9%he following are regarded as the particular priority functions for the Central Area.$$$entertainment facilities including cinemas and theatres# and hospitality and touristfacilities# governmental and community facilities $$$: K2ection $)$)$!/ i/L

    Conformity:

    2trict interpretation of these policies would reFuire that a casino as an entertainmentuse !e located in the Central Area5 however# at issue is whether a casino is really theind of entertainment use envisioned !y the Plan$

    %he intent of the Official Plan is to create a multi-functional destination in the Central Area$ %he De!ruary 11# 01) 2taff &eport P'P1(-0)* noted that# 9the conglomeration

    of ma@or entertainment uses in the Central Area is intended to create a multi-functionaldestination and generate traffic that in a synergistic way# adds to the vitality of the wholeCentral Area$ Businesses cross-fertilie each other and thus all win$: %he Central Area+aster Plan speas# in reference to the other entertainment uses contemplated# thatthey 9animate street life:# are 9conducive to the activity: and should have 9dailyinteraction with other complementary cultural activities:$ %he Central Area +aster Planpolicies in the Official Plan spea to cultural and entertainment uses such as a multi-purpose outdoor venue# museum# cinema or theater$ %hese are the types of uses that

    generate traffic in a synergistic way that adds to the vitality of the Central Area andpromotes cross-fertiliation of !usinesses$

    Conversely# a Casino tends to !e a destination unto itself that does not result in anysignificant cross-fertiliation with other uses$ t is a large land user reFuiring vast paring

    facilities that is not a use that is easily accommodated in the Central Area$ ts locationalreFuirements and land area reFuirements are similar to uses such as Costco that haveregional functions and are located outside of the Central Area$

    %he De!ruary 11# 01) 2taff &eport P'P1)-01)/ notes that# 9a casino is not the indof entertainment use that fulfills the intent of the entertainment function envisioned !ythe Plan$: Durther as descri!ed in P'P1)-01)# restricting casino"gaming to the Central

     Area would 9only satisfy the letter of the Official Plan as opposed to the intent of thePlan$: Based on the function of a casino as a relatively uniFue single-purposedestination# it would not contri!ute to the overall functionality of the Central Area in thesame way as a theater or cinema$ 2ince it would not contri!ute to the synergies and

    overall function of the Central Area# the proposed amendment# in locating the useelsewhere# does not compromise the function of the Central Area$ nstead# theproposed Official Plan amendment would conform to the overall intent of contri!uting tothe commercial hierarchy in an appropriate manner !y !ringing an important region-serving use to the City and locating it in an appropriate location$

    Durther# a gateway location# as proposed# on a service commercial designated site is anappropriate location for such a facility due to its transportation and future transitinfrastructure# as well as its visi!ility at a gateway to the City$

     Although a casino located in the Central Area will not achieve the synergies and cross-fertiliation envisioned for the Central Area# there may !e associated functions to acasino such as a stand-alone performing arts facility that are appropriate in the Central

     Area$ 2uch facilities and events would have a potential for synergistic relationships andcross fertiliation with other commercial facilities in the Central Area$ %herefore# in orderto maintain conformity with the intent of the Central Area priority policies# it is importantthat a !roader entertainment function is not accommodated as part of the plannedcasino"gaming facility and that stand-alone performance venues not !e permitted$

    %he Official Plan amendment addresses this concern !y restricting the use only toentertainment ancillary to the gaming use and not entertainment that would serve as adraw independent of the casino"gaming function$

    !e$tion ) ; !ervi$e Commer$ial Poli$ies

     As previously discussed# the su!@ect site is designated Commercial 2chedule A/ andconceptually shown on 2chedule as 2ervice Commercial$ %his designation permitscommercial recreational uses and tourist uses# specifically listing hotels# motels# andother hospitality and tourist services# and commercial recreation and assem!ly usesunder section 4$)$($)$

    Conformity:

     As discussed a!ove# the type of proposed facility# due to its regional scale anddestination nature# does not contri!ute to the intent of the Central Area$ 2ection 10$($)sets out to 9sta!ilie and strengthen the retail function of the Central Area$: ue to itsuniFue# single-attraction nature# the proposed use would not contri!ute to this intent#thus the amendment is considered appropriate$

    n order to implement the land use changes anticipated !y the proposed Official Plan Amendment to permit a =aming Clu! or Casino in the vicinity of %he Parway andCrawford rive intersection# a draft amendment to the Zoning By-law has !eenprepared in accordance with the process reFuirements under the Planning Act $

    %he site is currently oned +$ and 2P$(*# which permits a wide range of prestigeindustrial and service commercial uses$ Current permitted uses for the site include.

    %he proposed oning !y-law amendment is intended to implement the policy changesproposed in the draft Official Plan Amendment !y the creation of a new 2pecial Zoningistrict 2P$)()/# with a limited list of commercial uses# which includes the following.

    a/ A gaming esta!lishment"casino

    !/ A hotel

    c/ A restaurant

    Gses permitted under the e8isting +$ and 2P$(* oning would !e removed includinga regional scale office facility# currently permitted in the e8isting +$ 6 Business ParZoning istrict$ 1400 Crawford rive is the last undeveloped site in the City that en@oysthe regional scale office permission esta!lished 0 years ago as part of an industrialpolicy review$ %he +$ oning district facilitated the relocation of the Dederal offices

    from Eing 2treet to a su!ur!an location$ ropping the +$ oning category from 1400Crawford drive will further the Official Plan policies with regard to limiting large scaleoffice development outside of the Central Area$

    %he proposed amendment also introduces the following proposed definitions to 2ection1 of the Comprehensive Zoning By-law ,

    n order to provide clarity# the proposed amendment deletes the current definition forIPermanent =aming Clu! or Permanent Casino; and also replaces the reference toIPermanent =aming Clu! or Permanent Casino; with I=aming 7sta!lishment"Casino; !yway of an amendment to the definitions of IPlace of Amusement;# IPlace of Assem!ly;and IPlace of 7ntertainment;$

    %he proposed oning amendment will implement the 2ervice Commercial esignationof the lands in the Official Plan as well as the proposed policy amendment to 2ection$)$1 where!y a gaming clu! or casino is considered appropriate in the vicinity of %heParway and Crawford rive intersection$

    %he regulations proposed in the 2P$)() Zoning istrict are !ased on the commercialdistrict regulations that would typically implement the 2ervice Commercial esignatedlands in the Official Plan$ A ma8imum height of < storeys is proposed for the hotel onsite# and is considered appropriate for the scale of the development for the surroundingland uses$ Paring is to !e provided on site# however# additional paring can also !e

    provided in a shared arrangement with the future inter-city commuter facility on the Citylands to the north of the su!@ect property$ %herefore# provision has !een made in thedraft !y-law to allow up to M of the reFuired paring within 100 m of the su!@ect lands$

    Durther# it is recommended that the City-owned property at *( ?arper &oad !ereoned to permit a paring lot or paring garage to specifically permit paring to occuron this property$ %herefore# it is recommended that the following e8ception !e added to2ection )$, of the Zoning By-law and !e applied to *( ?arper &oad.

    $)0( n addition# a paring lot or paring garage is a permitted use$

    Based upon a review of paring standards for casino development in other

    municipalities and discussion with the provider# a paring ratio of 0$

    %he proposal contemplates the development of a 4#000 sFuare metre 4)#000 sFuare ft/gaming esta!lishment"casino# a 10 room hotel and the e8isting %im ?ortons$ %hee8isting %ourism nformation Centre !uilding would !e eliminated as of 2eptem!er of

    01 Planners conducted a %raffic mpact 2tudy$%heir study recommended a num!er of road improvements to accommodate theproposed development$ %hese improvements include.

     At the intersection of Parway at Crawford rive.

    •  Add a 0 m east!ound left turn lane

    •  &eplace the e8isting west!ound left turn phase with an east!ound"west!ound leftturn phase# add left turn signal heads for east!ound approach

    •  ncrease the west!ound left turn lane to (0 m from the e8isting 0 m

     At the intersection of Crawford rive e8tension at southeast access.

    •  Add a 1 m north!ound left turn lane

     At the intersection of Crawford rive e8tension at the northeast access.

     A wooded area that includes wetland and groundwater discharge is located along thewestern portion of the site and e8tends west of the property$ 2everal studies andapprovals have !een completed for the site and surrounding area in recent yearsincluding the Crawford &oad 7nvironmental Assessment 7A/ and the Jisitors CentreDish Compensation Plan$ %he natural heritage features and functions are relatively wellunderstood# sufficient to support the ZBA process# although detailed site specificinvestigations will !e reFuired as part of the site plan approval process$

    %he purpose of the Beacon report is to provide a preliminary overview of naturalheritage features located on and ad@acent to the property using e8isting information andnowledge of the su!@ect property and to provide recommendations for the ne8t steps toaddress natural heritage features through the site plan application phase$ %hese tasshave !een completed through a com!ination of !acground review# review of applica!lenatural heritage policies# consultation with the City and Otona!ee &egion Conservation

     Authority O&CA/# reconnaissance level site investigation in 01( and personalnowledge of the site from previous investigations$

    %hrough a review of the natural heritage features ad@acent to the site# O&CA confirmedthat their policies reFuire a )0 m !uffer to !e applied to non-provincially significant

    wetlands unless it can !e demonstrated that a reduced !uffer will not result in negativeimpact on the feature or its ecological functions$ O&CA identified that seasonalinvestigations of the wooded"wetland area will !e reFuired should a reduced !uffer !eproposed$

    woody vegetation coincides with the potential ma8imum limit of wetland conditions andthat / a )0 m !uffer is the ma8imum that would !e reFuired to protect the function ofthe feature$

     As esta!lished through consultation with O&CA and the City the )0 m ?olding Provisioncould !e removed once seasonal field investigations delineate the limit of the wetland#cree channel location to the west/ and determine the function of the features$ %hefunction of the feature needs to !e evaluated through an 7nvironmental mpact 2tudy72/# which must !e approved !y O&CA !efore the )0 m ?olding Provision can !eremoved$

    %he proposed Zoning By-law amendment respects the Beacon recommendation$
