It might be that what the earlier tribunal meant was that when assessing compliance with the warranty, time spent sailing through adverse currents had to be left out of account, but time spent sailing with favourable currents had to be treated as if the time had been spent sailing with no current at all. If that was the tribunals view, the present tribunal respectfully doubted whether it could be right, even on the wording of the clause in that case.[]That warranty would be breached if the warranted speed could only be maintained with the aid of a favourable current.It followed that at any rate once non-compliance with the warranted speed had been established by reference to periods of good weather and not unfavourable current the application of a current factor was permissible to compensate for periods both of favourable and of adverse currents.
