Overview

Shergroup can provide a complete set of enforcement management solutions for the problem of unauthorised occupiers/trespassers

These elements include:

1. Rapid response attendance within an agreed Service Level Agreement as part of an annual contract

2. Initial attendance by specialist enforcement officer to assess situation for case by case situations

3. Common Law eviction service within an agreed timescale

Rapid Response Attendances1) Shergroup Enforcement can provide an initial site

attendance within an agreed time period of hours/day on receipt of request

2) The contracted time period can be subject to the geographical location of the client’s premises

3) Shergroup operates a national team of enforcement personnel to attend anywhere within England and Wales

4) Shergroup also has relationships with enforcement officers in Scotland to assist with enforcement as and when required

5) Shergroup will work with the client to deliver an enforcement solution within the timescale needed by the client

6) Shergroup will use its operational expertise to cover off a number of operational matters including:

Notification and involvement of the local police

Health and safety compliance

Prevailing weather conditions

Insurance issues

Initial Assessment1) In initial attendance can be made by an experienced enforcement

officer to inspect a problem matter

2) The officer will assess the site and formally “warn” the occupants of the pending eviction

3) Using Shergroup’s comprehensive generic risk assessment/method statement framework the eviction will then be co-ordinated

4) If the officer identifies any risk which would place the operation outside of the standardised framework, a more detailed site-specific survey in line with health and safety laws will be carried out

5) If necessary a detailed Operational Plan will then be prepared

6) Shergroup’s Operational Plans have been agreed with major constabularies including:

The Metropolitan Police

Avon and Somerset Police

Surrey Police

Devon and Cornwall Police

Thames Valley Police

Common Law Eviction1) We appreciate land owners clients are looking for alternatives to

court action in managing trespasser situations

2) Shergroup can assist in the delivery of a lower cost option for enforcement in such situations by providing a “Common Law” eviction service

3) Common law eviction is possible in most instances where land belonging to the land owner has been occupied by unauthorised persons

4) The law provides that, where a trespasser peaceably enters on to, or is found on land, the person who is in, or is entitled to, possession may request the trespasser to leave

5) If the trespasser refuses to leave, he can be removed using “reasonable force” as defined in law

6) Shergroup has developed a full Operational Planning Guide for such situations including a clear definition as to what constitutes “reasonable force”

7) Shergroup can assess and carry out an enforcement operation in such situations within the client’s timescale

8) We can provide specialist trained and equipped Enforcement Officers

9) We provide all ancillary equipment including towing vehicles to remove caravans and mobile homes from the site

Enforcement of a Writ of Possession1) here a common law evicition is not appropriate (for example

where reasaonable force will not be sufficient to remove trespassers) a claim for possession can be issued in the county court or High Court

2) The resulting order for possession can be transferred to Shergroup for enforcement using our official capacity as High Court Enforcement Officers

3) Because we are also expert lawyers in the field of enforcement we can also liaise with the client’s exisiting legal team to prepare and submit the claim for possession and to transfer it to the High Court for enforcement.

4) Once we are in receipt of an order for possession we can call on the local police to assist us in the enforcement process under our statutory powers

5) We will provide specialist trained and equipped EOs to remove persons in occupation using firm, decisive and proportionate action

6) We will liaise with the local constabulary to provide an effective and proportionate response, using the powers granted under the Writ of Possession
