CHAPTER- 1
INTRODUCTION
“ An Act to provide for setting out the practical regime of right to
information for citizens to secure access to information under the control of
public authorities, in order to promote transparency and accountability in the
working of every public authority.”
(Preamble to the RTI Act, 2005)
1.1 The RTI Act is an expression of the people’s aspiration for an open
Government. Democracy requires an informed citizenry and
transparency of functioning. It is imperative to contain corruption and
to hold Government and their instrumentalities accountable to the
citizens. With such objectives the Right to Information Act was enacted
on 15th June, 2005.
1.2 Information does not belong to the Government---it belongs to
everybody and any information gathered by the Government is for the
benefit of the public. The Act has come to establish “transparency as
the norm and secrecy as an exception.”
1.3 The Right to Information thus placed the obligation on the Government
to store and organize information in such a way that makes it easily
accessible to the public, to provide information proactively by
responding promptly to all such requests for information.

1.4 The system that was put in place has provided access to information
and is a positive step taken by the Government to achieve economic
and social goals, poverty alleviation and reduction of corruption.
1.5 The public authorities having realised the effect of the Act and are
responding positively in catering to the needs of the people by
providing the required information.
1.6 Further, the Commission is mandated to submit its Annual Report to
the Government under section 25(1) of the Act. In pursuance to this ,
the Commission is presenting an overview of the status of
implementation of the Act during 2012 (01.01.2012 to 31.12.2012)
1.7 This report contains analysis of the data received from the state
government departments in accordance with the responsibility cast on
them under section 25(2) and 25(3) of the Act.
1.8 The report includes :-
(i) Number of requests for information received and disposed by
the Departments.
(ii) Number of requests rejected u/s 8 & 9 of the Act.
(iii) Number of appeals /complaints received & disposed by the
commission.
(iv) Amount collected as application fee and further fee collected
by the State Public Information Officers.

(v) Amount of penalty imposed on SPIO’s and compensation
awarded.
(vi) Analysis of information furnished by departments.
1.9 The Annual Report also presents a detailed account of activities and
events associated with the State Information Commission as well as its
Budget during 2011-2012 and 2012-2013.

CHAPTER-II
Constitution of the State Information Commission,
Haryana
2.1 The State Information Commission Haryana is a constitutional Authority
vested with quasi-judicial powers established on 31st October ,2005
under central RTI Act, 2005.
The duties and functions of the Commission are to conduct
efficient and fair examination into complaints/appeals of access to
information requests. The commission strives to maximize compliance
with the Act for disclosure of public sector information in order to
promote transparency and accountability in the working of every Public
Authority.
In exercise of the powers vested under sub-section 3 of section
15, the State Government appointed the following State Chief

2.7 As on 31st December 2012, all the posts except Legal Consultant,
remained filled up in the Commission. Sh. Bhupinder Singh, HCS joined
as Secretary of the Commission w.e.f from 18.09.2012. As a matter of
policy, the staff was taken on transfer from the Haryana Civil
Secretariat and other Departments of the State Government. When
officials of Haryana Civil Secretariat or Government Departments were
not made available, appointments were made on contract basis or
through identified outsourced agency.

CHAPTER - III
Salary and allowances
3.1 The salary and allowances payable and other terms and conditions of
service as provided under Sub Section 5 of Section 16 of the RTI Act
of:-
(i) The State Chief Information Commissioner shall be the same as that of an Election Commissioner;
(ii) The State Information Commissioner shall be the same as that of the Chief Secretary to the State Government;
Provided that if the State Chief Information Commissioner or a State
Information Commissioner, at the time of his appointment is, in receipt
of a pension, other than a disability or wound pension, in respect of
any previous service under the Government of India or under the
Government of a State, his salary in respect of the service as the State
Chief Information Commissioner or a State Information Commissioner
shall be reduced by the amount of that pension including any portion
of pension which was commuted and pension equivalent of other forms
of retirement benefits excluding pension equivalent to retirement
gratuity;
3.2 The salary and allowances payable to other officers and employees of
the State Information Commission, Haryana shall be at par with other

State Government employees. Personnel appointed on contract basis
or out sourced are entitled for payments at the contract rates which
shall not be less than the minimum wages.

CHAPTER-IV
Administration of the Right to Information Act
4.1 Effective Suo-moto disclosure of information:
Right to Information Act under Section 4 mandates every public
authority for pro-active disclosure of information. The information
which is required to be disclosed under this section includes
particulars of the organization including functions and duties, rules,
regulations, instructions, manuals, and records followed for the
discharge of functions, directory of officers and officials alongwith
monthly remuneration being paid to them, details of annual budget
including expenditure incurred, details of schemes/programmes
being handled, its beneficiaries and concession or subsidy being
provided etc. The particulars of State Assistant Public Officers/State
Public Information Officers/First Appellate Authority are also
required to be disclosed. It is a statutory requirement which every
public authority is bound to meet. Further, it is not sufficient to
publish the above information once but every public authority is
obliged to update such information periodically. As far as possible
the information should be updated immediately as and when any
development takes place. The information may be posted on the
website facilitating the citizens to access to the information without

approaching the public authority. This exercise as per requirement
of RTI Act, 2005 was to be completed within one hundred and
twenty days from its commencement but a number of public
authorities are yet to take effective steps as contemplated under
Section 4 of the Act.
4.2 Maintenance and retrieval of records.
Section 4 (1) (a) of the Right to Information Act 2005 lays
importance on maintenance of records by the public authorities duly
catalogued and indexed in a manner and form which facilitates
access within a reasonable time. In many cases the disposal of
requests asking for copies of documents, it was experienced that
the State Public Information Officers failed to retrieve the
documents requested because of absence of a proper record
keeping system. Record keeping is an area neglected in most of the
offices of Government and Public Sector Undertakings. Government
may launch a special drive in this direction so that the record
available in the offices of the public authorities are properly
catalogued, indexed and stored in a manner that facilitate easy
retrieval of information. The Act also emphasizes upon
computerization of the records and access through net-work.

4.3 Provisions of adequate staff and budget for furnishing the information.
The Right to Information Act, 2005 can successfully create a
practical regime for information sharing with the citizen if there is
an effective delivery mechanism in public authorities especially at
the district and block levels. Some of the public authorities at the
district or at the block level do not have any basic infrastructure like
photocopiers, computers etc. to provide information to the public.
Since funds under contingency are also limited the option to get
photocopies from the market is also not possible. In the absence of
infrastructure hand written illegible information is sometimes
furnished to the information seekers. These difficulties had been
constantly voiced in the interaction which the Commission had with
the members of the public, State Public Information Officers and
other stake holders apart from being raised in the public hearings
before the Commission. Therefore, the State Government may
earmark a certain percentage of budgets for implementation of the
RTI related issues. Adequate provisions be made for purchase of
stationery, office equipments like photocopiers, computer etc. in the
office of designated officers.
4.4 Cost and Fee rules under the RTI Act.
Section 27 of the Right to Information Act, 2005 read with Sections
6 (1), 7 (1) and 7 (5) of the Act provide for prescribing fee for

submission of application and the cost for providing the information.
Accordingly, the Haryana Government had notified the Haryana
Right to Information Rules, 2005 on 28th October 2005 wherein the
application fee was prescribed @ Rs. 50/- and additional fee @ Rs.
10/- per page. The State Government after reconsidering the
matter and by repealing the Haryana Right to Information Rules,
2005 notified Haryana Right to Information Rules, 2009 on 21st
December 2009 wherein the additional fee to be charged under sub
Section 5 of Section 7 of the Act was reduced from Rs. 10/- to Rs.
2/- per page. Copy of the rules notified on 21st December 2009 is
appended at Annexure ‘A’.
4.5. Appeal Procedure
In exercise of powers conferred under Section 27 read with sub-
Section 10 of the Section 19 of the Right to Information Act, 2005,
the State Government laid down the procedure for filing appeals,
procedure for deciding appeal, mode of serving notices, appearance
of appellant/complainant before the Commission etc. by notifying
Haryana Right to Information Rules, 2009 on 21st December 2009
by repealing the earlier rules notified on 28th October 2005.

CHAPTER-V
Monitoring and Reporting 5.1 Section 25 of the Right to Information Act, 2005 provides that State
Information Commission at the end of each year shall prepare a report
on the implementation of the provisions of this Act for the year and
forward a copy to the appropriate Government. The report is required
to be laid before the State Legislature thereafter. Section 25 (2) of the
Act further mandates that each Ministry or Department or Public
Under takings shall in relation to the public authorities within their
jurisdiction collect and provide such information to the State
Information Commission as is required to prepare the Annual Report
by the Commission. When no report was received from the public
authorities, the Commission vide letter dated 28.10.2013 directed the
Administrative Secretaries, Heads of Departments, Divisional
Commissioners, Deputy Commissioners of the Districts in the State,
Managing Directors of Boards, Corporations and public sectors
undertakings, Registrar, Punjab & Haryana High Court, Secretary
Haryana Vidhan Sabha to collect the required details from the
designated State Public Information Officers and furnish it to the
Commission for the preparation of the Annual report from 01.01.2012
to 31.12.2012. Statistical analysis of the administration of the Act, on

the basis of the data received by the Commission from the various
public authorities, arranged in alphabetical order in respect of
Administrative Secretaries, Heads of Departments, Boards,
Corporations, Public Undertakings, Commissioners of Divisions and
Deputy Commissioners separately is annexed as Annexure ‘B’. A list of
major Departments and public authorities who did not respond to the
Communications from the Commission dated 28.10.2013 is placed at
Annexure ‘C'.
5.2 As per available information during the period from 01.01.2012 to
31.12.2012, a total of 34996 applications were received by the
reporting public authorities. The access to information was withheld on
account of exemption provisions in 169 and 92 cases under Section 8
and 9 respectively of the RTI Act, 2005. Thus access to information
was denied in about 0.745 percentages of total cases. A total sum of
Rs. 1487878 was deposited as prescribed application fee and
additional fee by the applicants during the period under report.
These figure shows that the public authorities have by and large
provided the information in majority of cases to the RTI applicants.
5.3 Suggestions received from the Public Authorities towards
improved implementation of the Act.
For bringing improvement in the implementation of the RTI Act, 2005,
certain suggestions have been received from various public authorities

while submitting reports sought under Section 25(2) of the Act. These
are as under:-
(i) The designated State Public Information Officer should be a
senior level officer who could take action against the erring
officer/official for committing delay in supplying the information.
(ii) Additional fee should be enhanced to discourage the information
seeker for frivolous information.
(iii) Numerous, frivolous and voluminous complaints are received
from RTI applicants which not only diverts the attention of the
staff but also resources in collecting such information which do
not serve any public interest.
(iv) To reduce frivolous applications and to ensure that only genuine
information seekers invoke the provision of the RTI Act it is
suggested that only one information be allowed in one RTI
application.
(v) The BPL applicants are seeking information which does not relate
to them. Generally the BPL applicants are seeking the entire
information on the functioning of the public authority which is
apparently a misuse of the Act. In such cases there should be
some mechanism in the Act so that the BPL persons are actually
benefited for their cause. The time limit of 30 days should be

increased in respect of the information pertaining to more than 5
years old.
(vi) The State Public Information Officers/First Public Authorities
should be refreshed from time to time by imparting trainings.
(vii) The penalty should be imposed upon the public authority with
the stipulation to recover it from the erring official responsible
for the delay in supplying the information.
(viii) Third party information should not be disclosed.

CHAPTER-VI
Status of Complaints and Appeals
6.1 The State Information Commission has the original jurisdiction to
receive and enquire into the complaints under Section 18 (2) and
second appellate jurisdiction under Section 19 (3) to receive
appeals against the decisions of the public authorities. During
the period from 01.01.2012 to 31.12.2012 the institution of
complaints and appeals, decision taken and the matters which
were remained pending as on 31.12.2012, is given below:-

6.2 During this period from 01.01.2012 to 31.12.2012 the Commission
decided 1140 miscellaneous applications by advising the applicants
suitably to take further necessary action to complete the formalities as
mandated under the RTI Act, 2005 and rules before entertaining the
request as complaint or appeal.
6.3 The State Information Commission, Haryana has been deciding all the
complaints and appeals after summoning both the parties and by
following the practice of affording an opportunity of personal hearing
to both complainants/appellants and the State Public Information
Officers/First Appellate Authorities and third parties as well. Decisions
are announced after examining the written and oral submissions made
by the parties. The original and the relevant record is also perused, if
deemed necessary by the Commission during the hearing.
6.4 Action taken Under Section 20 of the Act.
The Commission during 01.01.2012 to 31.12.2012 issued 882 show
cause notices for imposing penalty to the State Public Information
Officers and the Deemed State Public Information Officers under
Section 20 (1) of the RTI Act, 2005. Penalty was imposed on 79 State
Public Information Officers/Deemed State Public Information Officers
respectively who had failed to furnish complete information within the

specified time limit and the delay was not found to be due to
reasonable cause. Details of these cases for the period of report from
01.01.2012 to 31.12.2012 are placed at Annexure ‘D’ alongwith the
details of amount imposed on account of penalty. Disciplinary action
had also been recommended under Section 20 (2) of the Act against
the delinquent officers/officials including the deemed State Public
Information Officer who had failed to provide timely and complete
information to the State Public Information Officer. During 01.01.2012
to 31.12.2012 in 14 cases it was recommended to initiate disciplinary
action against the erring officials/officers, details of such cases are
placed at Annexure ‘E’.
6.5 Compensation under Section 19 (8) (b):
Section 19 (8) (b) of the Act empowered the Commission to require
the public authorities to compensate the complainants or the
appellants for any loss or detriment suffered by them. Details of these
cases in which compensation had been awarded during the report
period of 01.01.2012 to 31.12.2012 are at Annexure ‘F'. During this
period in 264 number of cases, compensation has been awarded to the
appellate/complainants. It is pertinent to mention here that some of
the public authorities decided to recover the same from the concerned
State Public Information Officer or the person found responsible for the
delay.

6.6 Court Cases
In some cases the aggrieved parties have preferred writs against the
orders of the Commission in Hon’ble Punjab & Haryana High Court at
Chandigarh. The Commission in its statutory capacity under the
provisions of the Right to Information Act, 2005 has decided not to
defend such writs. In such situations a letter to the Registrar (Writ)
and Registrar (Judicial) including the Advocate General, Haryana as
well is being sent.
6.7 Website and email address of the Commission:
The website of the Commission www.cicharyana.gov.in is operational.
The cause list and orders passed by the Commission on Complaints
and appeals cases are being posted on the website. The email address
of the Commission is [email protected].
6.8 Central Assistance for IT enablement
During the calender Year 2012 the Government of India, Ministry of
Personnel, Public Grievances and Pensions, Department of Personnel &
Training, New Delhi released an amount of Rs 9,68,540/- towards
second installment of IT enablement under the erstwhile scheme “
Strengthening and Capacity Building And Awareness Generation for
Effective Implementation of the Right To Information Act ” under the
Centrally Sponsored plan Scheme. The Scheme aims at strengthening
the infrastructure of the Commission in terms of computers, up-
gradation of the existing website, file tracking system, application
status through SMS, digitization of record, video conferencing facility.

6.9 Improving Transparency and Accountability in Government
through Effective Implementation of RTI Act, 2005.
Ministry of Personnel Public Grievances and Pension ,Department of
Personnel & Training, Government of India released an amount of Rs
2,87,449/- towards Workshops/seminars and competitions under
awareness Generation for RTI during the calendar Year 2012. Further
this amount was released for 4 workshops for citizens /SPIOs/FAAs
and Essay competitions in 50 Colleges .State Govt has designated the
H.I.P.A.(Haryana Institute of Public administration) Gurgaon as Nodal
agency to organize workshops and Director Higher Education has been
authorized to conduct Essay competitions.

CHAPTER-VII
Creation of awareness about the Act.
7.1 Section 26 of the Right to Information Act directs the State
Government to create awareness among the public by developing and
organizing educational programmes to advance the understating of the
public, in particular of disadvantaged communities as to how to
exercise the rights contemplated under this Act. The Sub Section 1 (d)
of Section 26 of the Act casts obligation on the Government to train
State Public Information Officer of public authorities and produce
relevant training material for use by the public authorities themselves.
The Commission in its earlier reports has suggested launching of a
programme for training and awareness of the public for ensuring
effective implementation of the Act. The response of the Government
is as under:-
(i) Training Programme for SAPIOs/SPIOs/FAAs.
The State Government has designated the Haryana institute of
public administration (HIPA), Gurgaon as nodal agency in this
regard. Training for the designated officers which includes
SAPIOs/SPIOs and FAAs is being imparted in regular intervals by
HIPA as well as other training institutes like HVPNL Technical
Training institutes for power utility department and Haryana

Institute of Rural Development, Nilokheri. Training to other
employees working in various public authorities on RTI Act is
also being imparted to sensitize them and to make them aware
for dealing with the matters related to RTI.
(ii) Publication of directory and a user guide.
The Commission in its first and second report recommended that
a guide in the official language should be compiled to assist the
citizens in exercise of their right to access information under the
Act. It was also recommended to prepare a directory of the
designated SAPIOs/SPIOs and the FAAs. Now in the year of 2008
on the recommendations of the State Government the HIPA,
Gurgaon has published a directory of the designated officer’s
alongwith a user guide on RTI and a ready reckoner on the Act in
English and Hindi for the use of citizens of the State.

Recommendations for the reformation
The Right to Information Act casts responsibility upon both, the
State Information Commission as well as public authorities, to suggest
measures for effective implementation of the Act. Recommendations
for reforms of the Commission to the State Government and the public
authorities are as under:-
(i) Disposal of first appeals:-
Sub Section 1 of Section 19 of the Act provides for taking up a
matter of first appeal before the Appellate Authority in the pubic
authority, when the applicant is not satisfied with the
information furnished by the State Public Information of the
public authority. The First Appellate Authority is to dispose of the
appeal within 30 days or within such extended period not
exceeding a total of 45 days from the date of filing the appeal.
In many cases, Commission has experienced that the First
Appellate Authority either deal with the appeal late or do not
dispose it of at all. This inevitably results in delayed receipt of
information or compels the applicant to take up the matter with
the Commission in second appeal. This causes delay, additional
expenditure and avoidable agony. The Commission, therefore,

recommends providing training to concerned officials to improve
their perception of and performance under the Act.
(ii) State Public Information Officers also need training to sensitize
them to the needs of citizens. A massive round of training of
SPIOs must therefore, be undertaken to enable them to
discharge the responsibilities cast on them under the Act.
(iii) Even though pro-active disclosure was mandatory under section
4(1), it was noticed that pro-active disclosure was not done in a
satisfactory manner by many public authorities. The public
authorities should realize the importance of pro-active disclosure
as, in the long run , such disclosure would reduce the number of
requests for information. Hence it is recommended that
Government may suitably instruct the public authorities to
disclose as much information as possible under section 4(1) of
the Right to information Act, such as functions, duties,
procedures, accountability and norms set by the public
authorities for discharge of their functions has all the
characteristics of the citizen’s charter.
(iv) Citizen’s charter should therefore form an integral part of the
disclosure under Section 4 (1) (b) so that the public is aware of
the commitments of a public authority towards the citizens. All
public authorities must, whenever necessary, revisit their

procedures. Irksome procedures should be debated in public and
made more citizens friendly. Citizens should be able to enforce
the norms disclosed under the RTI Act whenever necessary.
(v) Disclosures under Section 4 (1) (b) must contain all the details
as required under the Act and these details should be
periodically updated. Commissions should have the authority to
penalize pubic authorities for inadequate disclosure or non-
disclosure of details required under this Section.
(vi) It should be obligatory for public authorities to publish these
disclosures in their Annual Reports.
(vii) It is suggested that specific columns be included in the annual
confidential reports of officers regarding their attitude towards
implementation of the Act. The self assessment report of the
SPIO and the First Appellate Authority must include information
regarding number of applications/appeals received by them and
their disposal.

No.S.O.99/C.A.22/2005/S.27/2009.—In exercise of the powers conferred sub-section (1) read with sub-section (2) of section 27 of the Right to Information Act, 2005 (Act 22 of 2005), the Governor of Haryana hereby makes the following rules providing for information under the said Act, namely :—
Short title and
commencement.
1. (1) These rules may be called the Haryana Right to Information Rules , 2009.
(2) They shall come into force from 1st
January, 2010.
2. (1) In these rules, unless the context otherwise requires,
a) “Act” means the Right to Information Act, 2005 (Act 22 of 2005);
b) “Commission” means the Haryana Information Commission , constituted under section 15 of the Act;
c) “Model Form” means a model form appended to these rules;
d) “section” means the section of the Act.
(2) The words and expressions used in these rules, but nor defined, shall have the same meanings as respectively assigned to them in the Act.
Application for 3. (1) a person who desires to obtain any information Obtaining admissible under the Act, shall make an application, preferably in Information Model Form ‘A’ to the State Public Information Officer and in his Sections 2(m), 6 absence to State Assistant Public Information Officer along-with fee and 27 as specified in sub-rule (1) of rule 5 of these rules.
(2) On the receipt of an application, made under sub-rule (1), the State Public Information Officer or State Assistant Public Information Officer as the case may be, shall give a receipt in token, thereof to the applicant.

Deposit of fee 4. (1) The fee shall be deposited with the State Public Section 6 Information Officer either in Cash against proper receipt, by Bank

800-Other Receipts-86 Fee under the Right to Information Act, 2005”.
(2) The amount of fee shall be credited to the account as referred in sub-rule (1): Provided that the Boards, Corporations and other autonomous bodies of the State may get the amount of requisite fee deposited in their own accounts maintained by the. (3) On receipt of an application, submitted under sub-rule (1) of rule 3, the State Public Information Officer shall scrutinize the application and shall assess how much fee is required to be paid by the applicant for obtaining the information. (4) The fee assessed under sub-rule (3), shall be intimated to the applicant by the State Public Information Officer, expeditiously, in Model Form ‘B’ to ensure the delivery of information within time specified under sub-section (1) of section 7 of the Act. (5) In case the applicant fails to deposit the requisite fee within a fifteen days after the issuance of the intimation given to him under sub- rule (4), it shall be construed that the applicant is no longer interested in obtaining the information sought for and his application shall be deemed to have been filed.
Quantum of fee. 5. (1) An application for obtaining any information under sub Section 6 and 7 section (1) of the section 6 shall be accompanied with a fee of Rs. 50/-
. (2) For providing information under sub-section (1) of section 7, the fee shall be charged from the applicant at the following rates, namely: — (a) Rs. 2/- for each page in A-4 or A-3 size paper, created or copied; and (b) if information is to be provided on a large size of paper than that specified in clause (a), the actual cost shall be charged.

(3) For providing information under sub-section (5) of section 7, the fee shall be charged from the applicant at the following rates, namely:-
(a) Rs. 50/- for providing information in a floppy;
(b) Rs. 100/- for providing information in diskette; and
(c) if information sought is of such a nature, which is contained in a printed document, of which a price has been fixed, then that information shall be provided after charging the price, fixed for that printed document. However, if only an extract or page of such a printed document is asked for, then a fee of Rs. 2/- per page shall be charged.
(4) No fee for inspection of record shall be charged, if such an inspection is made for one hour only. However, if inspection is made for a period of more than one hour, then a fee of rupees ten shall be charged for every fifteen minutes in excess of first hour. Every fraction of the period above fifteen minutes shall be construed as complete period of fifteen minutes and it shall be charged as full period of fifteen minutes.
Procedure for 6. (1) The memorandum of appeal shall contain the following filing appeals. information, namely :— Sections 19(1) and (3) (a) name and address of the appellant, including the details of
contact telephone/mobile Numbers/e-mail address, if any;
b) official designation and address of State Public Information Officer or State Assistant Public Information Officer, as the case may be ;
(c) official designation and address of the Officer against the decision of whom the appeal is preferred;
(d) particulars of the order including number, if any , against which the appeal is preferred;
(e) brief facts leading to the appeal;
(f) prayer or relief sought;
(g) grounds for the prayer or relief;
(h) verification by the appellant; and
(i) any other information which the Commission may deem
necessary for deciding the appeal.

(2) the appellant shall submit three copies of the memorandum of appeal for official purpose.
(3) Every appeal made to the Commission shall be accompanied by the following documents, namely :—
(a) self attested copies of the Orders or documents against which the appeal is being preferred;
(b) copies of documents relied upon by the appellant and
referred to in the appeal; and
(c) an index of the documents referred to in the appeal. Provided that in case complete documents are not furnished, the appeal shall not be rejected but the appellant shall be asked to complete the above formalities.
Procedure for 7. Before deciding an appeal, the Commission shall , — Deciding appeal Section 19(10) (a) serve notice to the concerned persons;
(b) entertain any evidence in support of appeal, which may be oral or in writing from the concerned persons; (c) examine on oath or an affidavit from the persons concerned; (d) examine the documents or any records or copies thereof; (e) inquire through the authorized office the facts of the appeal or may require facts in detail, if he so deems appropriate, hear the State Public Information Officer or any other senior officer who had decided the first appeal, as the case may be; and (f) receive evidence on affidavits from the State Public Information Officer or any senior officer who had decided the appeal or from any other person from whom the evidence may be deemed necessary.
Mode of 8. The Commission may serve notice to the persons concerned serving notice in any of the following modes, namely :— section 19(10)
(a) By hand delivery (dasti) through process server;
(b) By Registered Post, Speed Post, Under Postal Certificate, Courier or such other means ;
(c) By electronic mail, if e-mail address is provided ; or

(d) By publication in the newspaper.
Appearance or 9. The appellant or the complainant, as the case may be, shall in Appellant / Complainant every case be informed of the date of hearing at least 15
clearthat date. If the complainant/ appellant fails to appear on the date of hearing, the Commission will decide the matter on merits: Provided that where the Commission is satisfied that the circumstances exist due to which the complainant or appellant is being prevented from attending the hearing, then, he may afford the complainant or appellant another opportunity of being heard before taking a final decision days before .
Order by 10. (1) the Commission shall make order in writing and Commission pronounce the same in the presence of the concerned parties. section 19(10)
(2) The party concerned may obtain the copy of the order from the Commission.
Repeal and 11. The Haryana Right to Information Rules, 2005 are hereby Saving repealed: Provided that any order made or action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules.
