National Plan for the Rights of Persons with Disabilities

The National Plan for the Rights of Persons with Disabilities – Viver sem Limite (“Living without Limits”), established by the Federal Government in November of 2011, reflects Brazil’s commitment to the Convention on the Rights of Persons with Disabilities, ratified by our country with the equivalence of a constitutional amendment.

Brazil has made progress in the implementation of the necessary structures for the full and effective exercise of legal capacity by all people with disabilities by promoting opportunities so that disabilities do not represent obstacles to the fulfillment of dreams, goals and projects, thus empowering the choices of all Brazilians

Currently, according to the National Census of 2010, 45.6 million Brazilians have claimed to have some type of disability.

The goal of “Viver sem Limite” is that the Convention be a part of people’s lives through the articulation of governmental policies regarding access to education, social inclusion, healthcare and accessibility.

The plan seeks to involve and mobilize all federal organisms and has an estimated budget of R$ 7.6 bilhões until 2014.

It was elaborated with the participation of more than 15 Ministries as well as the National Council on the Rights of Persons with Disabilities (Conade), which incorporated contributions from civil society.

Access to education

In order to guarantee access to education as a universal right, without discrimination and with equality of opportunities, the National “Live without Limits” Plan provides resources and support services for education in order to prepare and equip public schools and the basic school system to provide access to formal education to all students with disabilities.

ACTIONS

In basic education actions include the implementation of Multifunctional Resource Classrooms, the promotion of accessibility in schools, teacher training for Specialized Education, acquisition of accessible school buses and the amplification of the BPC School Program, which aims to guarantee access and permanence within school of children and adolescents with disabilities, aged 0 to 18 years, who are beneficiaries of the BPC Program.

In professional education, persons with disabilities have priority in registration for the National Program for Access to Technical Education (PRONATEC), created by the Federal Government in 2011 with the objective of increasing the availability of professional and technological education courses.

In superior education, nuclei for accessibility are being implemented in the Federal Institutions for Superior Education and 20 courses in Sign Language were created. The implementation of Courses on Bilingual Pedagogy is still a goal to be achieved.

Current Activities

Inclusive education: In 2007 there were 100,574 children with disabilities enrolled in elementary regular education. In 2014 Brazil achieved the mark of 309,801 children with disabilities attending elementary school around the country.

Implementation of Multifunctional Resource Classrooms: 13,500 classrooms have been implemented to complement or suplement schooling for students with disabilities.

Accessible Schools: 40,316 schools have been adapted according to acessibile architecture standards.

Accessibility in Superior Education: 59 universities have received resources to organize institutional policies geared towards the elimination of prejudice as well as pedagogical, architectural and communication barriers.

Professional and Technological Education: 17,047 persons with disabilities have been given priority enrollment in courses offered by Pronatec.

Social Inclusion

Public policies for social inclusion are geared towards developing actions which promote social participation and combat inequality, exclusion or restrictions which impede the full exercise of rights, with equal opportunities.

In relation to persons with disabilities, it is necessary to implement measures to grant support and impede discrimination based on physical, intellectual, mental or sensory disabilities.

ACTIONS

The “Living Without Limits” Plan provides for the effectiveness of the BPC Work Program, geared towards strengthening the autonomy and social participation of persons with disabilities.

The plan also invests in Reference Day Centers and Inclusive Residencies for persons with disabilities in dependent situations, which are social protection services offered by the Social Assistance Single System - SUAS. Nowadays we have 27 center being cofounded and 12 in full functioning. We also have 205 inclusive residencies being cofounded by the government and 65 in active service.

The services are offered by SUAS in the municipalities of the Federal District in coordination with other services, such as health services, in order to mainstream attention to persons with disabilities

Accessibility

In order for persons with disabilities to utilize, with equal opportunities, their physical space, as well as transportation and information services, appropriate measures are necessary to grant accessibility so that all persons may carry on their daily lives in an independent way, with safety and autonomy, utilizing all public spaces and infrastructure.

ACTIONS

As part of the National Plan “Living without Limits” the Ministry of Cities established the National Secretariat for Accessibility and Urban Programs in order to promote accessibility in all Federal, State and Municipal projects.

The Plan included actions related to the construction of adaptable houses in the program “My Home My Life”; technological centers to train and instruct Guide Dogs; institutionalize the National Program for Assistive Technology; credit lines for the acquisition of assistive technology; and the removal of taxes on assistive technology products.

Current activities

My Home, My Life Program: 941.9 thousand adaptable residential units, of which 11.492 are homes adapted for specific disabilities.

Microcredit: R$ 148 million employed in 25.166 thousand purchases of goods and services (wheelchairs, Braille printers, adaptable cars, walkers and accessible furniture).

Technological Centers for treining guide dogs: 7 centers which offer courses to train professionals certified to train guide dogs being activated and one active.

Health care

According to the Brazilian Constitution, healthcare is a right and a State obligation. The Single Healthcare System (Sistema Único de Saúde - SUS) is geared towards granting universal acess to health services to the entire Brazilian population.

The Convention on the Rights of Persons with Disabilities reaffirms this right and reiterates that all persons with disabilities should have access to all health services, without discrimination.

Actions

Through the “Living Without Limits” Plan, in 2012 the Federal Government, created the Network of Services for Persons with Disabilities for the implementation, qualification and monitoring of rehabilitation services in the states and municipalities.

This new policy is based on the articulation of services granting actions which promote health, identify disabilities, provide treatment and rehabilitation.

Several actions have been planned for 2014 among which qualification of basic service teams; creation of Specialized Centers (CER); orthopedic workshops and increased offer of prosthetic and other locomotion assistive devices; and qualification in dental care.

Current Activities

Therapeutic Guidelines: their adoption seeks to standardize, within the Universal Health Care System (SUS), the elaboration of diagnosis, treatment, control and monitoring of those with severe health problems.

Among the guidelines to be adopted, 9 have been published : Health Care for Persons with Down Syndrome; Neonatal Auditory Guidelines; Care for Amputated Persons; Care for Persons with Medular Lesions; Care for Persons with Cerebral Paralysis; and Care for the Rehabilitation of Persons with Autism; Care for victims of Cerebral Vascular Incident; and Attention for eye health on childhood. Another six guidelines will be implemented by the end of 2014.

Specialized Centers for Qualification and Rehabilitation: 117 centers were qualified.

Transportation for access to health: to facilitate access to persons with disabilities to Specialized Centers for Qualification and Rehabilitation, 108 vehicles delivered by December 2014.

Dental care for persons with disabilities : 483 Centers for Specialized Dental Care have been qualified to assist and build capacities, 81 surgical centers has been equiped and 5,674 personnel of basic health care teams being capacitated .

Monitoring, Evaluation and Assessment of Results

Actions are monitored every 15 to 30 days according to their level of complexity.

In areas in which public policies were already structured with mechanisms for data collection, adopted actions have presented shorte term results.

In areas in which public policies with a focus on persons with disabilities did not exist, the implementation of adopted actions has affected the infrastructure with mid to long term results.
