Introduction(for SULEV (PZEV) only)

Certain 325i models are certified toCalifornia’s stringent Super Ultra LowEmission Vehicle (SULEV) standards andalso qualify as a Partial Zero EmissionVehicle (PZEV) under the California AirResources Board Zero Emission Vehicleprogram. In addition to very low tailpipe andzero-evaporative emissions, this PZEVcertification includes a unique warrantywhen the vehicle is registered in Californiaand certain Northeastern states as indicatedelsewhere in this booklet.

The emission certification standard can beverified on the Vehicle Emission ControlInformation label located in the enginecompartment. A representative label isshown below, with the SULEV (PZEV)certification indicated by the arrow.

BMW Full MaintenancePrograms - 2005 Models

BMW Full Maintenance Programs are a benefitdesigned to help reduce the cost of scheduledand unscheduled maintenance.

2005 3 Series vehicles (except M3)purchased from any Authorized BMW centerin the United States or Puerto Rico arecovered by Full Maintenance for 48 months or50,000 miles, whichever occurs first. Coveragebegins on the date of first retail sale or the datethe vehicle is first placed in service as ademonstrator or company vehicle, whicheveris earlier.

Any authorized BMW center in the UnitedStates or Puerto Rico will perform the sched-uled or additional maintenance services onyour vehicle at no expense to you. Themaintenance schedule intervals are based onnormal driving conditions and operation.Should you request more frequent mainte-nance service, the cost of these serviceswill not be covered by the MaintenanceProgram.

Coverage

Full Maintenance covers all factory recom-mended maintenance, as determined by theservice interval indicator. Additional items thatneed replacement due to normal wear andtear, and that are not covered by the originalNew Vehicle Limited Warranty - such as brakepads, brake rotors, and wiper blade inserts -are included, provided wear and tearexceeds BMW specifications. Any adjust-ments required due to normal operatingconditions are also included. See pages 6-9of this booklet for additional information.

Maintenance Intervals

Time intervals should be followed using themaintenance interval as indicated by the BMWService Indicator lights on the check controlpanel in the dashboard.

This BMW Service and Warranty InformationBooklet should be presented to your BMWcenter when maintenance is required. YourBMW center will stamp this book documentingthe services or maintenance performed.

Exclusions from coverage

– Items reimbursable under your New VehicleLimited Warranty.

– Gasoline and gasoline additive.– Windshield washer additive (except when

in conjunction with scheduledmaintenance).

– Tires, wheel alignment, tire balance androtation.

– Wear and tear of soft trim items, such as:seats, carpets, moldings, headliner, doorpanels and all chrome trim.

– Damage detected when performing the rustperforation inspection.

– Damage which results from negligence,improper operation of the vehicle, wear andtear or deterioration due to driving habits orconditions, improper repair, environmentalinfluences, flood, accident or fire damage,road salt corrosion, alteration, installation ofnon-BMW accessories, or use of improper,poor quality or contaminated fuel.

– Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined.

– Maintenance or repair after the vehicle isdeemed a total loss.

– Maintenance or repairs performed by otherthan an Authorized BMW center within theUnited States or Puerto Rico.

– Vehicles used in competitive events.– Oil changes performed outside the

recommended maintenance intervals asindicated by the Service Interval Indicator.

Maintenance Upgrade Option

Please contact your authorized BMW centerfor information regarding an optional 6 year100,000 mile maintenance upgrade.

Maintenance System

The BMW Maintenance System has beendevised with the following objectives: tomaximize vehicle safety, reliability, and resalevalue by minimizing breakdowns resulting fromwear, and minimizing cost and inconvenienceby computing maintenance intervals basedupon the specific manner in which eachindividual vehicle is driven.

Maintenance intervals on motor vehicles haveconventionally been specified based uponaccumulated mileage. However, the type ofdriving conditions has a major influence onroutine maintenance requirements; distancetraveled is only one of the significant factors.A vehicle driven for 50,000 miles of short tripsin the city with numerous cold starts, pro-longed periods of idling, stop-and-go driving,and high engine speeds during accelerationrequires more frequent maintenanceintervals than a vehicle driven for 50,000miles for long distances at low enginespeeds primarily at operating temperature.

The advanced technologies at BMW have ledto the development of the unique BMW serviceinterval indicator which computes the actualoptimum maintenance requirements basednot only upon the accumulated mileage, buttaking into account important factors such asengine coolant temperatures, high or lowengine speeds, short or long trip driving, andnumber of vehicle starts. The maintenanceinterval may therefore be maximized withconsiderable savings to owners of vehiclessubjected to light duty.

The Service Interval Indicator consists of amileage reading, and the inscriptions “OILSERVICE” and “INSPECTION”.

Whenever the ignition is switched on, thedisplay shows the next scheduled type ofservice and the remaining distance until theservice should be performed. The distance isbased on your driving style.

If the maintenance interval has been ex-ceeded, a “—” symbol reminds you of theurgent need for servicing. In the interests ofroad safety and reliability, you should avoiddriving your BMW when the “—” symbol isshowing, and have the essential maintenancework performed without delay.

After each maintenance is performed the serviceindicator is reset in order to compute the nextservice interval.

If the Service Interval Indicator displays anillogical reading, or if there is no display, consulta BMW center.

If the speedometer, tachometer or coolanttemperature gauge should develop a fault, theservice interval indicator will probably cease tooperate correctly as well, since it depends oncorrect speed, distance and temperaturereadings. The fault must be located and rectifiedby a BMW center.

A detailed list of all maintenance operationsincluded in each of the elements of the BMWMaintenance System is found on pages 6-9.These elements are as follows:

The performance of certain subsequentmaintenance elements, as required by theBMW New Vehicle Limited Warranty, will bespecified at intervals computed by the BMWservice interval indicator as follows:

– Oil Service: Engine oil changed with theengine at operating temperature.

Note: change oil at least once a year.

Your BMW is factory-equipped with anewly-developed synthetic engine oil. Atthe time of the printing of this booklet BMWHigh-Performance Synthetic 5W-30 Oil(Part Number 07 51 0 017 866) and Mobil 15W-30 and 5W-40 oils are stronglyrecommended and approved by BMW forthe 3 Series models covered in this booklet.BMW is evaluating various synthetic oils forinclusion in our list of recommended motoroils.

For the most current list of synthetic oils,please contact your BMW center, or callBMW of North America at 1-800-831-1117.You can also obtain this information fromour website, www.bmwusa.com/.

It is recommended to check engine oil levelwhenever fuel is added to the vehicle.

If you need to add oil between oil changesand are unable to obtain BMW High Per-formance Synthetic Oil, Mobil 1 or anotherspecial oil on the list, use a synthetic oilwith an API rating of SJ or higher.

– Inspection I: Major vehicle maintenanceas specified in the following pages underInspection I.

– Inspection II: Additional major vehiclemaintenance as specified in the followingpages under Inspection II.

The following maintenance elements mustbe performed at the mileage/time stated(time intervals begin from the vehicle’sproduction date):

– Brake Fluid Service: Change brake fluidevery two years.

– Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced every 120,000miles (3 Series with optional SequentialManual Gearbox (SMG) 100,000 miles), tomaximize vehicle fuel economy andminimize exhaust pollution. In the SULEV(PZEV) models, the oxygen sensor mustbe replaced every 150,000 miles. Thereplacement of the oxygen sensor isrequired under the terms of the appli-cable BMW emission system warranties.

– Spark Plug Service: Replace spark plugsevery 100,000 miles. Your BMW isequipped with platinum-tipped spark plugs.These allow a longer service life thanconventional spark plugs.

– Automatic Transmission Service: ChangeATF every 100,000 miles.

The engine coolant has a lifetime rating anddoes not need to be changed.

For your convenience, you may also wish tohave your BMW center perform any necessaryoperations to fulfill any state inspectionrequirements in your area concurrent with themaintenance elements specified above duringother repairs.

Make sure that confirmation of maintenancework is always entered in this Service andWarranty Information Booklet. You may needthis for any warranty claims that becomenecessary, and later on as evidence that yourcar has been given the correct and regularmaintenance that justifies its resale or trade-invalue.

Unscheduled Maintenance

Only use fuels advertised to have adequatedetergency and low alcohol content. Use offuels with insufficient detergent and/or excessalcohol can cause driveability problems thatnecessitate cleaning intake valves and fuelinjection valves, and, when applicable,adjusting the engine idle. We suggest havingthis work performed by your authorized BMWcenter, perhaps while regular maintenance isperformed. Your BMW center can also recom-mend a gasoline additive that will providesufficient detergency. While this recommendedunscheduled maintenance is not required inorder to maintain the emission warranty,cleaning of intake valves or, when applicable,fuel injection valves, or adjustment of engineidle, necessitated by use of inappropriate fuel,is not covered by warranty because no defectin material or workmanship or componentfailure is involved.

Special Note

Most maintenance items and schedules statedherein reflect the combined recommendationsfor model year 2005 3 Series BMWs, and aresubject to change. The most currentmaintenance recommendations are availablefrom your authorized BMW center.

If your car is driven only for short distances ofless than 10 miles over a prolonged period oftime, without an occasional drive at highwayspeeds, the engine’s charging system will notmaintain the battery. Insufficient use of thevehicle could result in short term startingproblems and in the long term could damagethe battery.

In case the car is not operated for more thanfour weeks it is advisable to:

a)consider using a proper trickle charger,following the charger manufacturer’sinstructions, to maintain the battery’s state ofcharge; or

b)consult your BMW center regarding batteryremoval. Once removed, the battery must becharged and stored in a cool, dry placewhere it can be protected from freezing. Ifthe battery will be stored for over 3 months, itmust be recharged every 3 months, or else itwill become damaged and useless.

Please consult with your BMW center forfurther guidance and information.

Corrosion Protection

Extensive corrosion protection measuresimplemented by BMW now make it possible tooffer a twelve-year limited mileage anti-corrosion warranty against rust perforation onyour vehicle provided that the vehicle ismaintained in accordance with the provisionsof the New Vehicle Limited Warranty asoutlined in the Warranty Section of thisStatement (page 30).

The major degree of corrosion protection isdue to the electrophoretic dip painting processwhich cathodically deposits paint particles onall body parts, attracting paint particles into theminutest cavities or seams. Body parts aredesigned to provide optimum corrosionprotection.

During manufacture, exterior body partsreceive an additional corrosion protection coat.Hood, trunk, doors and other body parts withmetal folds are coated with PVC and sealedfrom the outside.

All floor panels receive a resilient coating ofPVC for maximum protection against damagedue to stones, etc.

Corrosion protection materials tested overmany years are applied to the surfaces ofcavities and to the entire underside of thevehicle during and after assembly.

Requirements for maintaining the twelve-yearunlimited mileage anti-corrosion warranty areoutlined in the Warranty Section of thisStatement (page 32).

Restoring corrosion protection

Please take care that anti-corrosion material isreplaced when your car is repaired after bodyor chassis damage.

BMW will not accept any liability for anyparts and accessories not approved byBMW.

Underbody maintenance

The underbody has to be cleaned at leastonce a year, in spring, with plain water in orderto remove mud, chemical sediments and otherdeposits. If those materials are not removed,corrosion (rust) will occur.

Your BMW center will do this anti-corrosionservice for you.

WARNING

Do not apply additional undercoating or rust-proofing on or near the exhaust manifold,exhaust pipes, catalytic converter or heatshields. During driving, the substance usedfor undercoating could overheat and causea fire.

During a specific period (usually the earlier of12 months or 12,000 miles, though thisperiod varies by state), some statesrequire us or our authorized BMW center,to repair in a reasonable number of attempts,any defect or condition which substantiallyimpairs the use, value, or safety of a newvehicle sold, leased or registered in thatstate.

A “reasonable number of attempts” is gener-ally defined as (i) two or more attempts torepair the same defect (the number of attemptsmay vary by state) or (ii) that the same defecthas caused the vehicle to be out of service byreason of repair for more than 30 days (thisperiod may vary by state), except for delayscreated by conditions beyond our control.

If we are unable to correct a defect or conditioncovered by these statutes in a reasonablenumber of attempts, we may be obligatedeither to replace the vehicle or reimburse theowner/lessee in an amount equal to thepurchase price or lease payments paid by theowner/lessee, less the amount directlyattributable to use of the vehicle by the owner/lessee.

5. BBB AUTO LINE staff may try to helpresolve your dispute through mediation. Ifmediation is not successful, or if you do notwish to participate in mediation, claims withinthe program’s jurisdiction may be presentedto an arbitrator at an informal hearing. Thearbitrator’s decision should ordinarily beissued within 40 days from the time yourcomplaint is filed; there may be a delay of 7days if you did not first contact BMW aboutyour problem, or a delay of up to 30 days ifthe arbitrator requests an inspection/report byan impartial technical expert or furtherinvestigation and report by BBB AUTO LINE.

6. You are required to use BBB AUTO LINEbefore asserting in court any rights or rem-edies conferred by California Civil CodeSection 1793.22. California Civil CodeSection 1793.22(b) creates a presumptionthat BMW has had a reasonable number ofattempts to conform the vehicle to its appli-cable express warranties if, within 18 monthsfrom delivery to the buyer or 18,000 miles onthe vehicle’s odometer, whichever occurs first,one or more of the following occurs:

• The same nonconformity has been subjectto repair 4 or more times by BMW or itsagents AND the buyer has notified BMW ofthe need for the repair of the nonconformity;OR

• The vehicle is out of service by reason ofrepair of nonconformities by BMW or itsagents for a cumulative total of more than30 calendar days after delivery of thevehicle to the buyer.

The following remedies may be sought inBBB AUTO LINE: repairs, reimbursement formoney paid to repair a vehicle or otherexpenses incurred as a result of a vehiclenonconformity, repurchase or replacement ofyour vehicle and compensation for damagesand remedies available under BMW’s writtenwarranty or applicable law.

9. The following remedies may not be soughtin BBB AUTO LINE: punitive or multipledamages, attorneys’ fees, or consequentialdamages other than as provided in CaliforniaCivil Code Section 1794(a) and (b).

10. You may reject the decision issued by aBBB AUTO LINE arbitrator. If you reject thedecision, you will be free to pursue furtherlegal action. The arbitrator’s decision and anyfindings will be admissible in a court action.

11. If you accept the arbitrator’s decision,BMW will be bound by the decision, and willcomply with the decision within a reasonabletime not to exceed 30 days after we receivenotice of your acceptance of the decision.

The BMW Roadside Assistance Programreflects BMW’s commitment to your completesatisfaction with the BMW ownershipexperience.

It is available for U.S. version BMWs in all 50states, Canada, and Puerto Rico 24 hours aday, 365 days a year.

It is a valuable benefit provided to you at noadditional cost. (Subject to certain limitationsand exclusions noted on pages 26-28).

Owner’s Eligibility

You are covered if your vehicle is:

– A new BMW automobile, distributed byBMW NA, and purchased at an authorizedBMW center, OR;

– A new BMW automobile, purchased underthe BMW NA European Delivery Plan, OR;

– A new, U.S. version, BMW automobilepurchased under the Diplomatic or MilitarySales programs, operated in any of the 50states, Canada and Puerto Rico.

Coverage is provided for the vehicle itself,regardless of the driver. Protection is concurrentwith the New Vehicle Limited Warranty.

Getting Started

A temporary Roadside Assistance IdentificationCard can be found inside of your vehicleportfolio. It contains the 24-hour toll-free numberfor Roadside Assistance.

For your convenience a decal, showing thesame information as the ID card, has beenaffixed to the tool kit cover on the trunk lid.

In a few weeks you will receive a permanentBMW Roadside Assistance ID card by mail. Thedate of purchase and the vehicle identificationnumber (VIN) are embossed on the card.

This card should be carried by the driver ofyour BMW automobile.

Calling For Assistance

The toll-free BMW Roadside Assistancenumber is answered by a BMW RoadsideAssistance service representative. In order foryou to receive quick and reliable services, it isessential that you should provide detailed andaccurate information to the servicerepresentative.

Be prepared to give:

1. Your name and address.

2. Your complete Vehicle Identification Number(found on your vehicle registration or yourpermanent BMW Roadside Assistance IDcard).

3. Model description of your vehicle.

4. Date of purchase.

5. License plate number of your vehicle.

6. Vehicle location (including nearby cross-roads/intersections, highway mile markers,street numbers, landmarks, etc.).

7. Location you are calling from (including atelephone number where you can bereached). If you are calling from a publicphone wait there for the return call. Do notleave this location without informing theRoadside Assistance service representative.

8. A description of your vehicle’s problem.Specific and accurate information willenable the Roadside Assistance servicerepresentative to provide the proper help.

From the information you provide, the BMWRoadside Assistance service representativewill determine the type of help required.

Dispatch Service

A service provider will be dispatched to thesite of your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablements suchas flat tires, dead batteries, and out of fuelconditions is provided up to a maximum of$100.00 per incident by BMW RoadsideAssistance.

The cost for parts and fuel, when used on-site,are the responsibility of the owner/driver. TheNew Vehicle Limited Warranty does not coverany of the above on-site services.

Lock-Out

For security purposes, the driver will need toprove ownership by presenting proper docu-mentation, i.e., a valid drivers license, registra-tion, etc. Lock-out service will be provided up toa maximum of $100.00 per incident.

Towing Service

In the event of a mechanical breakdownnormally covered under the New Vehicle LimitedWarranty, your vehicle will be transported (at nocost) to the nearest authorized BMW center. Yourvehicle is also covered in the event of anaccident or collision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to asecure location and transported to thenearest authorized BMW center on the nextbusiness day.

If you request that the vehicle be taken to alocation other than the nearest authorized BMWcenter, any additional expense will be yourresponsibility.

However, you may request (at no cost) to betaken to a different BMW center as long as it iswithin 50 additional miles of the "nearest" BMWcenter.

Towing requests for vehicles disabled becauseof casualty, fire, act of God, or violation of law(federal, state or local) are accepted at theexpense of the owner/driver.

If it is necessary for you to have your vehicletowed through your own arrangements, youmust contact BMW Roadside Assistance forprior authorization and instructions on claimprocedures. All claims must be submittedwithin sixty (60) days of the disablement oroccurrence, accompanied by the originalreceipts. Claims received after that time periodmay not be honored and are subject to the fulldiscretion of BMW Roadside Assistance. IfBMW Roadside Assistance is not contacted for"prior" authorization, the maximum coverage fortowing situations is $100.00.

Sign-and-Drive

In most instances, services provided under theBMW Roadside Assistance Program do notrequire immediate payment.

Usually, you will be able to sign a receipt, so theprovider of the service can be reimburseddirectly by BMW Roadside Assistance.

Parts, materials and fuel should be paid by youdirectly to the provider of the services.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:

– Breakdowns that are warranty related, and;

– Must occur in excess of 100 miles from thedriver’s residence, and;

– Repairs cannot be completed duringnormal business hours on the same day ofbreakdown.

Reimbursements will be made for meals,lodging, car rentals, and alternate transporta-tion to bring the driver and the BMW automo-bile together after the vehicle has beenrepaired by an authorized BMW center.Original receipts must accompany all reim-bursement requests.

Trip interruption coverage is limited to $750.00per incident, to a maximum of five days perincident.

Always contact BMW Roadside Assistance fortrip interruption benefits. They will assist inmaking all the necessary arrangements.

Car Rental Discounts

Discounts of up to 30% are available fromAlamo, Avis, Dollar, Hertz and National carrental companies. Benefits may vary with eachcompany and location, and are subject tochange without notice.

Simply display your BMW Service Card(showing the applicable Plan number) duringreservation and at the time of rental to secureyour discount.

Auto Valet Service

Should there be a need beyond BMWRoadside Assistance, Auto Valet will provide apersonal assistant who will help in every wayto get you to your final destination. Auto Valetwill help you locate a rental car or taxi agency,hotel or even help procure airline reservations.

In event of an emergency, this service willassist you in getting information out to theproper party whether it’s business or personal.If unable to contact, the message relay servicewill document the information, and will make

reasonable efforts to deliver the message tothe message recipient.

Personalized Trip Routing

Leave the planning to us. Simply give one ofour Roadside Assistance service representa-tives a call, and we’ll provide you with detailed,easy to read, computerized trip itinerary andcompanion map package.

Exclusions

Specifically excluded from coverage are:

– Fines, taxes, or impound towing feescaused by a violation of local or state law.

– Expenses related to hazardous weatherconditions (removal from snow, ice, etc.).

– Expenses for the removal of snow tires, andmounting or removal of snow chains.

Warrantor

BMW NA warrants 2005 U.S. specificationvehicles distributed by BMW NA or sold throughthe BMW NA European Delivery Programagainst defects in materials or workmanship tothe first retail purchaser, and each subsequentpurchaser.

Warranty Period

The warranty period is 48 months or 50,000miles, whichever occurs first.

Warranty Begins

This warranty begins on the date of firstretail sale, or the date the vehicle is firstplaced in service as a demonstrator orcompany vehicle, whichever is earlier.

Warranty Coverage

To obtain service under this warranty, thevehicle must be brought, upon discovery of adefect in material or workmanship, to theworkshop of any authorized BMW center,during normal business hours. The BMWcenter will, without charge for parts or labor,either repair or replace the defective part(s)using new or authorized remanufactured parts.The decision to repair or replace said part(s) issolely the prerogative of BMW NA. Parts forwhich replacements are made become theproperty of BMW NA.

In all cases, a reasonable time must beallowed for warranty repairs to be completedafter the vehicle is received by the BMWcenter.

Safety Belt Warranty - Kansas

Safety belts are covered under the BMW NewVehicle Limited Warranty for defects in materialor workmanship for a period of 10 years,

unlimited mileage from the date of purchase. Inorder to be eligible for this coverage, the vehiclemust be a new car retailed in the State ofKansas and the repair performed by anauthorized BMW center in Kansas.

Towing/Other Owner Benefits

A 24-hour Roadside Assistance Program isavailable to every BMW owner during the newvehicle warranty period.

Other Items

Wheel alignment, balancing and wiper bladeinserts are covered up to 2,000 miles.

Items which are subject to wear and tear ordeterioration due to driving habits or condi-tions, such as brake pads/linings, brake discs,clutch disc, pressure plate, filters, upholstery,trim and chrome items, paint finish, drive belts,glass, and similar items, are specificallylimited to defects in material or workmanship.

This warranty does not apply to thefollowing:

Damage which results from negligence,improper operation of the vehicle, improperrepair, lack of or improper maintenance,environmental influences, flood, accident orfire damage, road salt corrosion, or use ofimproper or contaminated fuel.

Maintenance services and parts whenreplaced during maintenance such as sparkplugs, lubricants, fluids, engine tuneup parts,replacement of filters, coolant, and refrigerant.

Failure to maintain the vehicle properly inaccordance with the instructions in theOwner’s Manual or the Service section of thisStatement, that results in the failure of anypart of the vehicle.

Modification of the vehicle or installation of anyperformance accessories or componentsattached to the vehicle which alters theoriginal engineering and/or operatingspecifications or which result in damage to theother original components, electrical interfer-ence, electrical short, radio static, water leaksand wind noise.

Tires are warranted by their respectivemanufacturer as detailed in the applicabletire manufacturer’s warranty statements.Instructions for proper tire care and mainte-nance are contained in the Owner’s Manual.Should you experience difficulty in obtainingwarranty service from a tire manufacturer, yourauthorized BMW center will assist you inresolving the difficulty.

Non-BMW Parts – While you may elect to usenon-genuine BMW parts for maintenance orrepair services, BMW NA is not obligated topay for repairs that include non-genuine BMWparts or for any damage resulting from the useof non-genuine parts.

BMW will not accept any liability for anyparts and accessories not approved byBMW.

This warranty shall be null and void if thevehicle identification number has beenaltered or cannot be read, if the odometerhas been replaced or altered and the truemileage cannot be determined, if the vehiclehas been declared a total loss or sold forsalvage purposes, or if the vehicle has beenused in any competitive event.

General

These warranties give you specific legal rights,and you may also have other rights which varyfrom state to state.

THE DURATION OF ANY IMPLIED WAR-RANTIES, INCLUDING THE IMPLIEDWARRANTY OF MERCHANTABILITY, ISLIMITED TO THE DURATION OF THEEXPRESS WARRANTIES HEREIN. BMWNA HEREBY EXCLUDES INCIDENTAL ANDCONSEQUENTIAL DAMAGES, INCLUDINGLOSS OF TIME, INCONVENIENCE, ORLOSS OF USE OF THE VEHICLE, FOR ANYBREACH OF ANY EXPRESS OR IMPLIEDWARRANTY, INCLUDING THE IMPLIEDWARRANTY OF MERCHANTABILITY,APPLICABLE TO THIS PRODUCT.

Some states do not allow limitations on howlong an implied warranty lasts, or the exclu-sion or limitation of incidental or consequentialdamages, so the above limitations andexclusions may not apply to you.

The BMW Certified Pre-Owned LimitedWarranty:

The BMW Certified Pre-Owned limitedwarranty is applicable to the retail purchaserand each subsequent retail purchaser (not forresale purposes) of the CPO vehicle soldthrough an authorized BMW center for 2 yearsor 50,000 miles from the effective date,whichever occurs first.

BMW NA warrants this original vehicle againstdefects in materials or workmanship which willresult in rust perforation of the vehicle body fora period of 12 years unlimited mileage,commencing on the date of first retail sale, orthe date the vehicle is first placed in service asa demonstrator or company vehicle, whicheveris earlier.

To obtain service under this warranty, thevehicle must be brought, upon discovery ofany rust perforation, to the workshop of anyauthorized BMW center. This BMW center will,without charge for parts or labor, either repairor replace the defective part(s). The decision torepair or replace said part(s) is solely theprerogative of BMW of North America. Parts forwhich replacements are made become theproperty of BMW of North America.

REQUIRED MAINTENANCE:

In order to keep this warranty in effect, thevehicle must be inspected at every BMWInspection II (at least every two years). Anyareas requiring preventative maintenancemust be repaired. (THIS INSPECTION/MAINTENANCE IS AT THE OWNER’SEXPENSE).

The Inspection/Maintenance consists of:

a. Washing the chassis before inspection, ifnecessary, due to dirt accumulation.

b. Repairing any damages to undercoating orpaint due to stone chips, gravel erosion,scratches, or other external influences.

BMW of North America makes no otherexpress warranty on this product except thenew car warranty or the warranty as to theemission control system. THE DURATION OFANY IMPLIED WARRANTIES, INCLUDINGTHE IMPLIED WARRANTY OF MERCHANT-ABILITY, IS LIMITED TO THE DURATION OFTHE EXPRESS WARRANTIES HEREIN.

BMW OF NORTH AMERICA HEREBYEXCLUDES INCIDENTAL AND CONSE-QUENTIAL DAMAGES, INCLUDING LOSS OFTIME, INCONVENIENCE, OR LOSS OF USEOF THE VEHICLE, FOR ANY BREACH OFANY EXPRESS OR IMPLIED WARRANTY,INCLUDING THE IMPLIED WARRANTY OFMERCHANTABILITY, APPLICABLE TO THISPRODUCT.

Some states do not allow limitations on howlong an implied warranty lasts, or the exclu-sion or limitation of incidental or consequentialdamages, so the above limitations andexclusions may not apply to you.

This warranty gives you specific legal rights,and you may also have other rights which varyfrom state to state. Any legal claim or actionarising from any express or implied warrantycontained herein must be brought within 12months of the date it arises.

This warranty does not apply to thefollowing:

a. Damage caused by negligence, improperaccident damage repairs, or improper use.

b. Damage attributable to failure to performrequired inspections/maintenance at thespecified intervals or in accordance with theBMW rust inspection/maintenance programinstructions. Proof must be provided by apaid invoice or filling in the appropriateboxes in the Service Section of thisStatement.

BMW will not accept any liability for any partsand accessories not approved by BMW.

This warranty shall be null and void if thevehicle identification number has beenaltered or cannot be read, if the odometerhas been replaced or altered and the truemileage cannot be determined, if the vehiclehas been declared a total loss or sold forsalvage purposes, or if the vehicle has beenused in any competitive event.

This warranty applies only to U.S. specifica-tion vehicles distributed by BMW of NorthAmerica (BMW NA) or sold through the BMWNA European Delivery Program.

In accordance with the defect warrantyprovisions of section 207(b) of the Clean AirAct, BMW NA warrants to the first retailpurchaser, and each subsequent purchaser,that the car (a) was designed, built andequipped so as to conform, at the time ofsale, with all regulations of the U.S. Environ-mental Protection Agency applicable at thetime of manufacture and (b) is free fromdefects in materials and workmanship whichwould cause it to fail to conform withapplicable regulations for a period of 2 yearsor 24,000 miles, whichever occurs first,except for specific emission control compo-nents (as listed on page 37), for which thewarranty period is 8 years or 80,000 miles,whichever occurs first.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or company vehicle,whichever is earlier.

Warranty claims must be made as soon asreasonably possible after a defect isdiscovered. To make a claim, the car mustbe brought to any authorized BMW centerduring normal business hours.

The BMW center will, without charge for partsor labor (including diagnosis), either repair orreplace the defective part, if any. The decisionwhether to repair or replace said parts is solelythe prerogative of BMW NA and must beexpected to correct the failure of the warrantedpart. Parts for which replacements are madebecome the property of BMW NA. In all cases,a reasonable time must be allowed forwarranty repairs to be completed after the caris received by the BMW center.

For assistance in determining which specificparts or components of your vehicle arecovered under this warranty, please contactyour BMW center.

It is the owner’s responsibility to have allscheduled inspection and maintenanceservices performed (at the owner’s ex-pense), as prescribed in the maintenanceschedule for the BMW Emission ControlSystem. Service intervals are computed bythe onboard BMW service interval indicatorand displayed on the instrument panel. Theinstructions for proper maintenance and usecan be found in the Owner’s Manual. It isstrongly recommended that any replacementparts used for maintenance, repair orreplacement of emission control systems becertified BMW Service Parts or BMWAuthorized Remanufactured Parts. Withoutinvalidating this warranty, the owner mayelect to have maintenance, repair orreplacement of the emission control systemsperformed by any automotive repair estab-lishment, or elect to use parts other thancertified BMW Service Parts. However, thecost of such service or parts will not becovered under this warranty, except inemergency situations. In an emergencysituation, where an authorized BMW centeror a warranty replacement part is notreasonably available (within 30 days),repairs may be performed at any availableservice establishment using any equivalentpart. BMW NA will reimburse the owner forsuch emergency repairs (including labor,parts and diagnosis not to exceed BMW NArates for labor, parts, and diagnosis in saidarea) that are covered under this warranty.Replaced parts and paid invoices must bepresented at a BMW center as a condition ofreimbursement for emergency repairs notperformed by a BMW center.

The use of replacement parts, which are notof equivalent quality, may impair the effec-tiveness of the emission control system. Ifother than certified BMW Service Parts orAuthorized Remanufactured Parts are usedfor maintenance, repair or replacement ofcomponents affecting emission control, theowner should obtain assurances that such

parts are warranted by their manufacturer tobe equivalent to genuine BMW parts inperformance and durability. BMW NAassumes no liability under this warranty withrespect to parts other than genuine BMWparts.

However, the use of non-BMW replacementparts or non-EPA certified parts does notinvalidate the warranty on other components,unless non-BMW parts or non-EPA certifiedparts cause damage to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, improper adjustment, modification,alteration, tampering, disconnection, improperor inadequate maintenance, use of leaded fuelor fuels containing more than 10% ethanol, orother oxygenates with more than 2.8% oxygenby weight (i.e., more than 15% MTBE or morethan 3% methanol plus an equivalent amountof co-solvent).

The replacement of maintenance parts, suchas spark plugs, filters and similar items used inrequired maintenance services, the repair orreplacement of maintenance parts beyond thefirst required inspection/maintenance, or if thepart has been replaced earlier for reasonsother than it being defective.

The car or any part of the car unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileagecannot be determined.

The car, if the vehicle identification number isaltered or cannot be read, or if the car hasbeen declared a total loss or sold for salvagepurposes.

General

These warranties give you specific legal rights,and you may also have other rights which varyfrom state to state.

Some states do not allow limitations on howlong an implied warranty lasts, or the exclu-sion or limitation of incidental or consequentialdamages, so the above limitations andexclusions may not apply to you. Additionally,if you are a California, Maine, Massachusettsor Vermont resident and your vehicle isregistered in that state, your vehicle is eligiblefor California Emissions Warranty coverage.

In those states and jurisdictions that haveestablished periodic vehicle emissions tests toencourage proper vehicle maintenance andrequire the car to pass an emissions testapproved by the U.S. Environmental ProtectionAgency and:

1. The car was distributed by BMW of NorthAmerica (BMW NA), or sold through theBMW NA European Delivery Program; and

2. The car has been maintained and oper-ated in accordance with the instructions forproper maintenance and use set forth inthe Owner’s Manual supplied with the car;and

3. The car fails to conform to the applicableemissions standards of the EPA as judgedby an EPA approved emissions test; and

4. The failure to conform results or will resultin the owner of the car having to bear apenalty or other sanction (including thedenial of the right to use the car) underlocal state or federal law if the non-conformity is not remedied within aspecified period of time.

Then, in accordance with the provisions ofsection 207(b) of the Clean Air Act, BMW NAwarrants that if the car is eligible for coverageunder this warranty, any non-conformities inthe car, which cause it to fail an EPA-approvedemissions test will, without charge for parts orlabor (including diagnosis), be adjusted,repaired, or replaced, at the option of BMW NAto proper specifications, in order to make thecar comply with applicable emissions stan-dards. The decision to adjust, repair or replaceparts is solely the prerogative of BMW NA andmust reasonably be expected to correct thefailure of the warranted part.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or company vehicle,whichever is earlier. This warranty continuesfor a period of 2 years or 24,000 miles,whichever occurs first, except for specificemissions control components (as listed onpage 38), for which the warranty period is 8years or 80,000 miles whichever occurs first.

This warranty is made subject to the terms andconditions that apply to the Emission ControlSystem Warranty and the New Vehicle LimitedWarranty.

No claim under this warranty will be deniedon the basis of use of a properly installedEPA certified emission part for maintenanceand repair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in themaintenance or repair of a vehicle only if thevehicle manufacturer presents evidence thatthe uncertified replacement part is eitherdefective in materials or workmanship or notequivalent from an emission standpoint to theoriginal equipment part.

Maintenance, replacement, or repair ofemission control devices and systems maybe performed by any automotive repairestablishment or individual using anycertified part.

Immediately after the car has failed an EPAapproved emission short test, your claim canbe made at any authorized BMW center. TheBMW center will honor or deny your claimwithin the time period specified by local orstate laws (not to exceed 30 days), to avoidfurther penalties or sanctions. lf the claim isdenied, the BMW center will notify you inwriting of the reason(s). The BMW center isrequired by law to honor the claim if notice ofdenial is not received by the owner within thespecified time period.

The California Air Resources Board and BMWof North America (BMW NA) are pleased toexplain the emission control system warrantyon your 2005 vehicle. In California, new motorvehicles must be designed, built andequipped to meet the State’s stringent anti-smog stan-dards. BMW NA must warrant theemission control system on your vehicle for theperiods of time listed below provided there hasbeen no abuse, neglect or impropermaintenance of your vehicle.

Your emission control system may includeparts such as the fuel injection system, theignition system, catalytic converter, and enginecomputer. Also included may be hoses, belts,connectors and other emission-relatedassemblies.

Where a warrantable condition exists, BMW NAwill repair your vehicle at no cost to youincluding diagnosis, parts and labor.

Manufacturer’s Warranty Coverage:

– For 3 years or 50,000 miles or 15 years or150,000 miles for the SULEV (PZEV),whichever occurs first:

1. If your vehicle fails a Smog Check inspec-tion, all necessary repairs and adjustmentswill be made by BMW NA to ensure thatyour vehicle passes the inspection. This isyour emission control system PERFOR-MANCE WARRANTY.

2. If any emission-related part on your vehicleis defective, the part will be repaired orreplaced by BMW NA. This is your short-term emission control system DEFECTSWARRANTY.

– For 7 years or 70,000 miles whicheveroccurs first:

If an emission-related part, specially noted onpage 41 as having coverage for 7 years or

70,000 miles is defective, the part will berepaired or replaced by BMW NA. This is yourlong-term emission control system DEFECTSWARRANTY.

Owner’s Warranty Responsibilities:

– As the vehicle owner, you are responsiblefor the performance of the required mainte-nance listed in your Owner’s Manual. BMWNA recommends that you retain all receiptscovering maintenance on your vehicle, butBMW NA cannot deny warranty solely forthe lack of receipts or for your failure toensure the performance of all scheduledmaintenance.

– You are responsible for presenting yourvehicle to an authorized BMW center assoon as a problem exists. The warrantyrepairs should be completed in a reason-able amount of time, not to exceed 30 days.

– As the vehicle owner, you should also beaware that BMW NA may deny yourwarranty coverage if your vehicle or part hasfailed due to abuse, neglect, impropermaintenance or unapproved modifications.

This warranty applies to California certifiedvehicles distributed by BMW of North America(BMW NA) or sold through the BMW NAEuropean Delivery Program, registered andoperated primarily in California.

BMW NA warrants to the original purchaser andeach subsequent owner that the vehicle is:

(a)designed, built and equipped so as toconform with the applicable California AirResources Board emission standards.

(b)free from defects in materials and workman-ship which cause any part that can affectemissions to fail to conform with applicablerequirements or to fail a California SmogCheck test or EPA approved short test for aperiod of 3 years or 50,000 miles, or 15years or 150,000 miles for the SULEV(PZEV), whichever occurs first.

(c) free from defects in materials and workman-ship in emission related parts, which arecontained in the California EmissionWarranty Parts List on page 40, for a periodof 7 years or 70,000 miles, whicheveroccurs first.

This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or company vehicle,whichever is earlier.

To obtain service under this warranty, thevehicle must be brought, upon failure of aSmog Check test or upon discovery of thedefect, to the workshop of any authorizedBMW center, during normal business hours.The BMW center will honor or deny your claimwithin 30 days. If the claim is denied, the BMWcenter will notify you in writing of the reason(s).The BMW center is required by law to honorthe claim if notice is not given to the ownerwithin 30 days.

The BMW center will, without charge for partsor labor (including diagnosis), either adjust,repair or replace the defective part and otherparts affected by the failure of the warranted

part, if any. If your vehicle failed the CaliforniaSmog Check test or an EPA approved shorttest, then BMW NA will repair your vehicle sothat it will pass this test. Items that requirescheduled replacement are warranted up tothe replacement interval specified in theService section of this Statement. BMW NAmay repair a part in lieu of replacing it whenperforming warranty repairs. Parts for whichreplacements are made become the propertyof BMW NA. After 3 years or 50,000 miles, andin accordance with paragraph (c) above, suchrepairs are limited to the repair or replacementof those parts identified in the CaliforniaEmissions Warranty List.

If your California registered vehicle is between7 and 8 years old and has been driven lessthan 80,000 miles, then your vehicle is eligiblefor additional warranty coverage under theFederal Emissions Warranty.

A repair performed as the result of a smogcheck test failure due to a defect in a part,which is warranted for 7 years/70,000 miles, iscovered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repairto be completed, after the car is received bythe BMW center.

It is the owner’s responsibility to have allrequired maintenance services performed (atthe owner’s expense), as prescribed in themaintenance schedule for the BMW EmissionControl System. Service intervals are com-puted by the service interval indicator anddisplayed on the instrument panel.

*The California Emissions Control SystemLimited Warranty applies to all 2005 U.S.specification BMW vehicles sold, leased, and/or registered in California, Maine,Massachusetts, New York or Vermont.

However, BMW NA will not deny your warrantyrepair claims solely because you do not havemaintenance records or you did not performthe required maintenance unless BMW NA

demonstrates that such lack of requiredmaintenance is a direct cause of the emissioncontrol system failure. The instructions forrequired maintenance and use can be foundin the Owner’s Manual and in the Servicesection of this Statement.

It is strongly recommended that any replace-ment parts used for maintenance, repair orreplacement of emission control systems begenuine BMW Service Parts or BMWAuthorized Remanufactured Parts. Withoutinvalidating this warranty, the owner mayelect to have maintenance, repair orreplacement of the emission control systemsperformed by any automotive repair estab-lishment, or elect to use parts other thanBMW Authorized Remanufactured orgenuine BMW Service Parts. However, thecost of such service or parts will not becovered under this warranty, except inemergency situations. In an emergencysituation, where an authorized BMW centeris not reasonably available or a warrantyreplacement part is not available within 30days, repairs may be performed at anyavailable service establishment or by anyindividual using any replacement part.

A repair not completed within 30 daysconstitutes an emergency. BMW NA willreimburse the owner for such emergencyrepairs (including labor, parts and diagnosisnot to exceed BMW suggested retail price forall warranted parts replaced and laborcharges based on the manufacturer’s recom-mended time allowance for the warranty repairand the geographically appropriate hourlylabor rate) that are covered under thiswarranty. Replaced parts and paid invoicesmust be presented to a BMW center as acondition of reimbursement for emergencyrepairs not performed by a BMW center.

The use of replacement parts, which are not ofequivalent quality, may impair the effective-ness of emission control systems. If other thangenuine BMW Service Parts or AuthorizedRemanu-factured Parts are used for mainte-nance, repair or replacement of componentsaffecting emission control, the owner shouldobtain assurances that such parts are war-

ranted by their manufacturer to be equivalentto genuine BMW parts in performance anddurability. BMW NA assumes no liability underthis warranty with respect to parts other thangenuine BMW parts.

However, the use of non-BMW replacementparts does not invalidate the warranty on othercomponents, unless non-BMW parts causedamage to warranted parts.

What is not covered

This warranty does not cover malfunctionscaused by any of the following: accident, flood,misuse, modification, alteration, tampering,disconnection, improper or inadequatemaintenance, except if performed by anauthorized BMW center doing warranty repairwork, use of leaded fuel or fuel other than asspecified in the Owner’s Manual.

The replacement of maintenance parts, suchas spark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

Any car on which the odometer has beenreplaced or altered and the true mileagecannot be determined.

The car, if the vehicle identification number isaltered or cannot be determined, or if the carhas been declared a total loss or sold forsalvage purposes.

General

The warranty gives you specific legal rights,and you may also have other rights which varyfrom state to state.

THE DURATION OF ANY IMPLIED WARRAN-TIES, INCLUDING THE IMPLIED WARRANTYOF MERCHANTABILITY, IS LIMITED TO THEDURATION OF THE EXPRESS WARRANTIESHEREIN.
