issues resulting from Summer rains. It turned down a request from homeowner William Ellis requesting reexamination of solutions for water flowing from the Eagle preserve into and through his yard (and others in the area) to reach the street and storm drains.

The board cited both their attorney’s opinion from several years ago and Florida court decisions. Both were based on a legal premise that water naturally flowing from higher ground to lower ground is not the re-sponsibility of the owner of the property from which it is flow-ing and therefore the LMA is not responsible for the situation.

The Board also expressed concern that the homeowner needs to use care in making changes in water flow to avoid interfering with any county rules regarding the Eagle Pre-serve. Questions were raised about berms added to some homes blocking flowing water from the Preserve. The Board felt this is an individual home-owner issue, not an LMA issue.

DRAINAGE IN THE LANDINGS Don Smally, LMA Chairman of Roads and Drainage

A lot of questions have been asked about the drainage, or

lack thereof, in The Landings. Here are some thoughts on the subject that might help residents understand the problems.

A principle of engineering is that there is only one way water will flow--DOWNHILL. In a consulting practice here in Sarasota I learned the slopes of the surfaces on which the storm-water is expected to flow must be suitable for the type of material on those surfaces. The material can he asphalt, concrete or grass. Minimally the sloped grassed areas we see in The Landings will absorb water until they become satu-rated: then the water has to go somewhere else, or it will stand.

Not long ago the editor of the Landings Eagle interviewed Bob Morris, developer of The Landings. Bob talked about letting the water from the streets flow gently on to the grassed areas to be absorbed in the ground.. He emphasized that if concrete curbs were used to get rid of street runoff the woodsy ambiance of the project would be lost with all that citified concrete. I agree with Mr. Morris, who, by the way, is an architect, not an engineer.

All developers, including architects, are required to retain engineers to design streets and drainage for housing projects. The engineer’s job is to design a drainage system to fit the developer’s layout of streets and building sites, and try to make the finished product look like his client’s general con-cept..

In the case of The Landings single family home areas the developer wanted water from the streets and yards to flow to

grass swales along each street. The swales would drain into inlets connecting to underground pipes, leading to lakes and eventually to the Bay; a concept that had been used in many projects. He also wanted to save as many trees as possible, which meant the roads and swales would wind around trees. It was also contemplated the driveways for each home site would cross the swale either by following the slope of the swale, or by installing a pipe in the swale and crossing over it.

The developer’s engineer prepared the plans but didn’t indi-cate trees. The plans showed the road. and swales as straight or gently curving lines following the road. It was left up to the road builder to place the road and swales so as to save as many trees as possible.

The road builder did the best he could, constructing the roads by going around trees. The swales, critical for drainage. were routed around some trees and vegetation, and unfortu-nately in other places were omitted. The winding around trees worked to further reduce the slopes by adding length to the distance the water must travel.. Although the plans showed a specific drainage system the final product didn’t fulfill their intent; the swales are too flat and will not carry water.

Perhaps the most troublesome part of the system was the fact that where there were swales, the developer didn’t require each homebuilder to make the driveways fit the cross section of the swales, or cross over them by installing adequately sized pipes. This blocks flow along the swales to the inlets. This poor drainage system, in the single family area, coupled with low building elevations, may have contributed to flood-ing of some units during heavy rains..

but of a different sort. The roads are of the “reverse crown’ design: the center of the road carries storm water to inlets. Water stands because the asphalt, at minimal slopes, cannot be graded precisely and water may stand in small pools called ‘bird baths” if it doesn’t flow fast enough. The problem here is not the concept but rather the slope of the asphalt street is not steep enough for the system to drain. Standing water eventually damages pavement. Using concrete curbing down the center of the street would allow water to flow, with mini-mal slopes because concrete can be built to precise grades

The results of the above are evident in the Landings. To correct the problems would he costly and disruptive. Many of our trees and vegetation, planted by homeowners, would he disturbed. If groups of neighbors on a particular street wanted to get together and fund a project to correct problems, an en-gineer must be retained to design it, and supervise the con-struction to see the plans are followed.

Several Landins have brought to our attention a recent article in the New York Times (National Edition) and condensed in the Sarasota Herald Tribune. In it, writer Motoko Rich wrote of the benefits and horrors of homeowner (or condo) associations. It tells the tale of a homeowner, one Mr. Haggerty, who kept his trash can in the front yard allegedly “hidden by a bush.” He refused to pay a $50 fine and eventually the association obtained a nearly $12,000 court judgment against him. They garnisheed his pizza business and eventually it folded.

It references foreclosure against home owners in San Diego, Scottsdale and San Francisco.

Community associations certainly pro-vide advantages. They provide a degree of governance to the community, they as-sure architectural and maintenance quality standards and they assure residents pay their fair share of common community ex-penses. It is the potential abuses Landins mentioned to us.

The downsides in the article were best articulated by Bob Finn a retired judge from Nebraska: “people have egos, and they can get into power positions and they can fine you for not trimming your bushes. If you speak unkindly to a clerk they can deny you your privileges to use your facilities. The only way you can change that is by electing new board members.”

Are such abuses possible in the Landings? Possible? Certainly. Currently occurring? We think not. Protected against? We be-

lieve so. The Eagle considers it a responsibility to serve as a watchdog just as the national

press does the federal government. While our niche is tiny, we do consider ourselves a member of the fourth estate.

When the LMA reestablished The Eagle they committed to editorial freedom as part of the arrangement, (They pay for the printing of four pages, bulk postage to local resi-dents, and a service fee for eight of the ten annual issues.)

There are 22 different associations representing various housing and recreational units in the Landings. The Eagle has legal access to only two, The LMA and the LHA. All meetings are open to members, and The Eagle staff are members of those two associations. We try to attend and report upon them regularly.

Though not a member of the Racquet Club it shares its minutes with The Eagle en-couraging all to read them by allowing their publication on our Internet site. To date we have not been refused information by any association. Occasionally The Eagle is in-vited to cover other meetings by an officer or member.

But, as a owner-resident you are a member of at least two associations, the LMA and your housing unit association plus possibly the LRC. Owner-residents are the best watchdogs. Do not permit your boards to act outside your interests, and the interests of fellow residents. The Eagle is here to help you expose such abuses, should you believe they exist.

On the issue of being fined unfairly. Both the LMA and LHA have recently voted amendments permitting such fines. They have both included, in compliance with a protective Florida law, an adjudication method including ample notice and judgment by three peers unconnected with the board issuing the fine.

In short you have a watch dog and protection by Florida laws governing home and condo associations.

But these are not the best protection. The best protection is your active participation in Landings government. Attend

board meetings, volunteer for committees and, eventually join a board. IPSIPSIPSIPS

Editor: The properties of

homeowners, under Arti-cle IV, sec. 10 of The Landings Homeowners Association Covenants, must have a drainage swale along the abutting streets. Driveways must have a matching contour or a culvert under the driveway paving to carry the water flowing in the swale from one side to the other. Article V, sec. 2 makes the lot owner re-sponsible for maintaining the frontage area, which includes the swale, be-tween the front property line and the street. Article VI prohibits any obstruc-tion of the swales unless approved by LHA.

Most of the swales are OK but in a few places, where swales have been obstructed or silted in, the drainage backs up in the swales of the higher level neighboring properties. In my morning walks I have noted two extreme cases where stagnant wa-ter is trapped for much longer times than the in-cubation period of mos-quitoes, on the north side of Landings Boulevard east of Landings Court, and along Kestral Park-way South below Land-ings Boulevard. Since the Landings Management Association is responsible for our drainage system, and for community health conditions, it should act to eliminate the stagnant pools in swales and along the roads. In some places the LMA did this when the roads were resurfaced.

for the abutting owners when I became one of them 16 years ago. It became progressively worse as homes were built on the surrounding lots. The lots on your side of the eagle sanctuary receive, as you indicated, a considerable flow, but the swales along the sides of my lot and other lots on the south side of the eagle sanctuary also carry a substantial flow from the sanctuary.

LMA is the legal owner of the eagle sanctuary and it is LMA's responsibility to solve the problem of surface drainage. I think LHA, as spokesman for the abutting homeowners, should call

upon LMA to order an engi-neering plan to solve the problem. The current mos-quito threat has made this urgently necessary. To en-courage a prompt response from LMA, LHA should offer its assistance in getting the cooperation of the abut-ting owners, if and as needed.

With that said, we would like to remind everyone planning a party on the Halloween Night to make sure to submit your guest list at least 4 to 5 days in advance. Beneath those blue tarps on Carriage House II roofs there’s a sad tale. Serious leaks have left many residents with water damage and attendant problems.

The roofs were installed in 1994 by Single-ton Roofing a popular Sarasota contractor used by a number of Landings home owners, including the work recently undertaken on Landings South I.

The installation was guaranteed for five years and the tiles, which sources tell The Eagle are of premium quality are guaranteed for 25 years.

Consultants commissioned by the Associa-tion indicate roofs in all but one of the double units will need serious renovation or replace-ment.

The Board has engaged counsel to assist in determining options. At deadline attorneys had contacted Singleton but received no re-sponse.

Association President Larry Spelman said “settlement options are being discussed.”

Based on the past costs a full replacement could cost each unit around $10,000.

One owner tells The Eagle he’d like to examine alternatives to tile roofs; metal, fi-berglass, plastic, etc.

Comcast Repairs Cause Outages

Late August and Septem-

ber brought multiple, brief outages to both Comcast Cable and Internet service.

The outages are caused as Comcast locates electronic “leaks” in the system. Once located the cable must be cut while under repair to avoid hazardous shocks to the maintenance worker.

The young man making the repair explained how he waits until the last moment to cut the power to mini-mize downtime.

The “leaks” cause inter-ference disturbing both the analogue and digital signals carried.

One source indicated Landins report more inter-net modem problems than usual, six to eight a day.

Rod Dagenais, Comcast Area Vice-president, ex-plained The Landings “is especially susceptible to leakage issues because all installations are under-ground and our water table is especially high.”

The older co-ax installa-tions are most affected. The fiber, installed about six years ago for digital service, is affected by lightening strikes, the cause of at least one of the repairs under taken .

By the time you read this, according to Dagenais, the work should be completed.

Phillippi Development Update

As reported earlier developer Robert Mor-ris is “preselling” residences in the Phillippi Landing development.

He’s targeting 20 as the magic number for financing and starting the project construc-tion.. He expects to start by the end of the year, with 12 presales already in place.

There will be a grand opening of the sales office at the Trail and Phillippi Shores Drive, at the south-east corner of the School Board parking area. Incidentally, that sales property is owned by Morris’ Company,. They have retained it through the several sales of the surrounding property.

In another water related issue, standing water against the west wall bordering Pintail Way was discussed. Argus man-agement will work with Landings handyman to determine if seepage holes can be added to the wall itself.

The Treasurer reports expendi-tures are $32,000 under budget. This appears to be due largely to savings in electric costs resulting from improved efficiency of new pumps in several Landings lakes.

Roadwork is complete for the year except for a small modification on K e s t r a l P a r k T e r r ac e a n d “reforming” the north speed bump on Kestral Park Way North. Repairs to a storm drain are being arranged with the county. Small leaks are causing very small “sink-hole like” depressions in one homeowners yard.

Occasional visitors, generally teenagers, have been using foul lan-guage with the security staff. The Board indicated if it does-n’t stop they would set a policy of refusing entrance to of-fenders.

The Board voted to add a weekend security patrol from 10 am to 6 pm Saturday and Sunday at an annual cost of approxi-mately $6,500. .

The Lakes committee reports lilies clogging the North Lake have been removed and a new cable, pump and motor in-stalled in Carriage Lake.

The board voted against including e-mail addresses in the

(“LMA” from page 1) next Greenbook, citing space problems and privacy issues. The Newcomers Party, co-sponsored by the LRC and LMA

is now scheduled for Thursday, October 23, early evening. Come meet your newest neighbors and old friends.

At the September LMA Meeting Landin Barbara Chertok renewed her request for e-mail listings in the Greenbook. She

argued they were, in fact, less privacy in-vading than phone numbers. The complica-tions of compiling was brought up. An-other attendee suggested a form indicating how and want you want listed in the Green-book be included in the annual billing to be returned with your the annual payment. It could include e-mail address, and an addi-tional name could be added to the listing. That can currently be accomplished now with a call to Argus Management. The Board decided to discuss this further after public input and requested The Eagle ask for such feedback. The Treasurer indicated the LMA was slightly under budget, but it was likely that would be used yet this year. At the October meeting there will be a presentation from a

bank desiring to obtain LMA accounts. Argus Management reported work on the Speed Bump near-

est the North Gate and a road adjustment on Kestral Park Ter-race would occur when the rains let up. He also indicated the original road plan to redo part of Landings Boulevard next year may be modified to do the entire road.

The shrubbery at Landings Blvd. and Starling will be exam-ined. If it is inhibiting safe turns adjustments will be dis-cussed with the appropriate association.

Several issues requiring resident input are coming up at the LMA Board Meet-ings. E-mail and other listing items in the Greenbook will be reconsidered at the October meeting. The installation of barcode gate open-ers replacing the current “clickers” at entry and exit gates, at substantial cost, will be discussed at the November meeting. Mark your calendars for the first Thurs-day of the month and offer your opin-ions.

August 30 Lightening Damage

Landins living on the perimeter Eagle Preserve were jolted by a resounding crack of lightening early evening, Saturday

August 30. The only physical evi-dence of the hit is the long vertical gash in the bark of a tall pine on the south-east corner of the preserve. But there was other damage. Comcast lost a fairly long sec-tion of co-ax cable, likely as a result of the same

Hit. A number of homes lost cable coverage until late afternoon Sunday.

Several television sets, or components of sets, like tuners, were fried, needing repair or replace-ment. At lease one computer was damaged be-yond repair and several lost minor components needing re-placement. One alarm system needed major repairs.

The lesson of the various damage is how it entered the home. The route was probably “multipath” coming from Comcast’s coax cable, the phone company’s telephone line

and the power company’s cable. The importance of a good quality surge protector on valu-

able electronic equipment cannot be underestimated. They are all designed to protect from power surges. But, make certain the protector handles the co-ax going to your TV sets, cable modem and possibly FM radio depending on how your

home is wired. An appropriate computer protector will also have an in-put and output for the phone line entering your computer for its built in modem. Finally, if you are consider-ing one of the new, more ex-pensive, digital/High Definition television sets be sure to in-clude a good suppressor for it and your other stereo equip-ment. When installing such a set you may also want to add an outside, roof antenna to facili-tate the best reception of Tampa, Sarasota, Ft. Meyers

and Naples, over-the-air digital and high definition signals. The picture is quite spectacular. Such installations are legal as a federal law superceded the

Landings covenants regarding such installations. If you plan such an installation be sure to include appropriate, grounded lightening arrestors.

If Comcast Goes Out, Report It

In researching this story The Eagle learned Comcast waits until it has multi-ple reports of outage before it supplies priority repair service.

They explained when calls come from one home it is often a consumer error. Therefore they may not respond immedi-ately, especially on weekends.

If multiple homes are out they respond more rapidly.

So, don’t assume your neighbor will call. Report the outage yourself.. Com-cast’s phone number is on calendar page 27 of The Eagle.

Landings Wildlife with Sheryn Deis

This rarely seen green anole seems to be very happy at the

Landings Racquet Club. If you see this little guy in your yard, consider yourself lucky. The Florida green anole, the only anole native to the United States, was a common sight in the 70’s.

It is now rarely seen. Although opinions differ, it seems they are competing for ter-ritory with the frequently seen brown anole, also known as the Cuban Brown Anole.

The brown anole is not native to the United States, coming from the Caribbean. It has become well-established in South Florida and is now the most commonly-seen liz-ard. Unlike their Cuban relatives, the green anoles are not prolific breeders and young green hatchlings are preyed upon by the Brown anole.

Because they stay active higher above the ground, the greens fall prey to feral cats and other predators. Florida green anoles can change color from green to brown. The brown cannot change it’s color to green. . .only to a darker shade of brown.

To distinguish between the two in the brown phase, the greens have an even coloring while the browns have patterns and mark-ings.

“Eagles Nest Area.” In it, the area is described as “Tract F, Exhibit A” excluding it from the Covenants provisions. It sets it aside as private property, owned by C&M Associates (The Landings Developer) and not to be developed.

The plats (the formal layout and legal description of the development area) filed with the county refer to simply as “Tract F.” Significantly The Eagle’s search of the “fine print of the plats” found no reference to “eagles” or “preserve” in the descriptions or notes. We invite a more thorough search to insure that is the case. It is significant because, according to county officials, that is the most likely spot to verify an area as being set aside as a “preserve.”

While the Covenants designate C&M Associates as the sole owner of the area it is identified in a quitclaim deed dated March 13, 1987 as transferring from C&M Associates to LMA ownership as Tract F, which is the entire 7.4 acres, in-cluding the easement off Landings Blvd.

What does all this mean in terms the eagle area, its use, its maintenance, its potential for development (not as if anyone would desire that), exploitation as an amenity for residents, or whatever use?

First the “eagles” area is owned by the LMA and therefore by all property and residence owners of The Landings for use as they might wish within the covenants or by alteration of the covenants.

Second, the LMA may do such things as cut and maintain damaged or dead trees without having to wait until they fall and are not limited to simply trimming branches off dead trees after they fall. They could alter the land for drainage, landscape, or other purposes within the framework of want is permitted for any land.

One attorney, knowledgeable of The Landings, indicates “the restrictions in the Covenants on the future maintenance and use of the area are stated in terms of the developer's "intentions." This leaves the developer, and LMA as succes-sor owner, free to abandon such intentions and exercise the unrestricted rights of land ownership.”

It appears only the issue of protecting eagles might stand in the way of other uses of the area.

Federal law makes it illegal to harass an eagle or its nest. An active nest must be abandoned for five years before it may be moved. No eagle nest has been seen in the area for fifteen years. County officials advise clearing use of the site with the US Department of Fish and Wildlife.

Bottom line it seems our “eagle’s nest area” is owned by us. It can probably be used for whatever purpose property owners might agree upon under Covenant voting rules. And, since its status as a “preserve” appears not to exist it can be maintained as any other common property in The Landings.

New Singles Group

Editors Note: Prior to the August issue of The Eagle we got a call from a Landin interested in starting a “singles” group. The paper offered a free classified to judge interest. Here is Ellie Alpert’s summary of the first meeting. We wish them success.

held Wednesday, August 27. About 10 attended. Initial dis-cussions covered how each person anticipated the group could answer their needs.

We agreed to invite people knowledgeable in starting such a group to talk with us.

Some suggestions bantered about were travel, theatre trips, museum viewing. It was agreed to meet the last Wednesday of each month. We are making arrangements with the Rac-quet Club at this writing.

The group seemed enthusiastic to get started We also agreed to serve refreshments at the next meeting, at which George Blake is our scheduled speaker. Call Ellie Alpert at 924-6648 for details.

Landings Flyboys Meet

The Flyboys are scheduled to climb back into the cockpit at noon, Wednesday, October 1 at the Racquet Club. Accord-ing to Don Smally “all of you pilots, bombardiers, navigators and air crewmen, past and present, mark your calendars and bring some tall tales thought-up during the summer.”

LRC President’s Report By Bob Fernander

Welcome back, those of you returning to The Landings. The relentless summer rains that created such a problem for the Sarasota area are gone and not too soon. Our won-derful staff managed to keep the courts open most of the summer and their condi-tion is the envy of every club in the area. Kudos to our staff. You will all have an opportunity to thank them at the Staff Ap-preciation Day on Oct.24. In fact, there is much going on at your

club this fall, just check the Landings Clip-out Calendar at the end of The Eagle.

For all you snow birds you will notice the additional new heater for the pool which we hope will keep the pool comfort-able even on the coldest days, the relocation of the bike rack, additional fencing near the gazebo, a new and more powerful (ugh) ball machine and a remodeled kitchen.

We have adjusted the rental fees for use of the club facili-ties to reflect those of like facilities in the area. Kevin can explain these in detail if you wish to use them.

I want to thank the tennis committee and our tennis profes-sional Robbie for their programs this summer, particularly the round robins that have been so well attended and successful.

Our social committee has been hard at work. They will pre-sent Staff Appreciation Day, Jazz By the Pool, Welcome Newcomers, and the Holiday Gala. Lisa Overdevest and her staff are doing a great job. Our board meetings are the third Tuesday of the month at 2PM. Members are invited.

Annual Father & Son Tourney Set

The Annual Father and Son Tournament is scheduled for

PLAYING THE ZONES

DEFENSIVE ZONE Have you ever seen national ranked players under 12 play a match? They

do not over hit the ball by playing first or second ball winners. They play high balls but, do not make too many unforced errors. The objectives on the defensive zone are two:

Neutralize your opponent, push him back and... Give yourself time to recover. By looping down and deep you will play a high percentage

point and the opponent will not be able to hit winners. RALLY ZONE

The objective on the rally zone is to change direction. Learning to control the center of the court.

What is the advantage of the server? He is on the center of the court and can move the opponent to the side of the court. The problem is some receivers perceive the court is 27 ft. wide, but you can generate angles too! So, if you can learn to open the court, the server would not run just 13 1/2 ft. (to get your service return down the line), he actually might run 18 ft.

A great little place to gather. . .

(by playing a short crosscourt angle shot.) So the answer is open the court and hit angles. An angle shot is defined as the shot that crosses the sidelines (singles & doubles) before it crosses the baseline. The objective is to practice drills that allows you to move your opponent around and anticipate and generate an offensive position. What are these offensive posi-tions?

(1) A floater:, If you are able to control the center of the court by hitting a heavy high looping ball the opponent might play back a floater in the middle of the court, then anticipate and move a half step inside the baseline.

(2) Failure to recover: By scrambling your deep down the line shots with wide short angle crosscourt you are increasing the opponent’s response time (make them run 311/2 ft. in-stead of 27 ft.). Remember that when the Ball Travel is less than Players Response Time. .you are in an OFFENSIVE POSITION.

(3) A short ball: If the opponent’s ball lands short down the center and your opponent is well positioned at the baseline, play either way away from the center. If that short ball lands away from the middle, approach deep down the line or cross-court angle, to pull your opponent outside the court and also to get a better center of coverage (in case of an opponent’s passing shot).

LRC Manager’s Report by Kevin Richards, LRC Manager

Well, the summer is finally over and I must say from, the LRC Staff's view-point, it couldn't have come soon enough!! It has been a very long, very difficult summer primarily because of all the heavy rain; but also, several very serious acts of vandalism at the Club over the past 2-3 months. Someone thinks it's funny or "neat" to mark-up the new white vinyl fencing we recently installed around the facility. Of

course, every time this person marks up the fencing, we have to spend time scrubbing the marks off. Then there is someone who thinks it's OK to tear off sprinkler heads near the gazebo area. Every time this happens we must call the irrigation company to repair or replace those broken heads - a waste of your money!! The VCR in the Lakeside Clubhouse was stolen, the gray counter attached to the outside of the Fitness Center ripped off the wall, the Pool-side kitchen seriously damaged, toilet-paper holders ripped off the wall, showers left running (a real waste of water) and other items damaged as well.

I have fenced the area by the ladies side entry into the Fit-ness Center and the gazebo area. We’ve initiated action to install hidden security cameras to catch these people. It is VERY frustrating for the LRC Board of Directors and the LRC Staff to "fight" this type of behavior. Hopefully, we will be successful in our efforts to identify those people responsi-ble. We WILL press charges.

I also have some other news for current LRC Members. The Board Of Directors voted in the August meeting to elimi-nate the $20 credit for 2004. Since we no longer charge guest fees for an in-house, overnight guest, the $20 credit seemed redundant. The only time we will collect a guest fee is when a member has a "local" guest using the facility.

I look forward to seeing all of you at the Staff Apprecia-tion Day on Friday, 24 October and at the JAZZ BY THE POOL event on Sunday, 16 November. Once again, I thank all of you for your continued support and lets have a GREAT fall season!!

LANDING RACQUET CLUB Board of Directors Meeting August 19, 2003

Treasurer’s Report: Expenses over budget for July in the amount of $2,700.00, due to some leak repairs (which had the water bill out of line) on the fountain, toilets, urinal and replacement of 4 toilets. Kevin Richards, reported that he will be sending a letter to the Sarasota Utili-ties requesting a partial refund on the water bill for the last 3 months.

January through July - $4,300.00 of Income over Expenses. The 2002 Audit was discussed. The company charged a lot more

than the original cost on their proposal. J. Berkey was will review the bill and reply to the auditors.

Manager’s Report: Kevin Richards reported the Following: The court maintenance for July was not done till August 12-13 due

to constant rains. The courts have been kept up due to the hard work of the LRC staff. They deserve a lot of credit and Thanks for their hard work.

New kitchen cabinets have been installed in the Poolside Clubhouse and look great. This was necessary after someone ruined the old ones.

Brick pavers are now all clean, this was done in-house; bike rack moved to the new location; the white rock lining walkways out to the courts is being replaced; ditches outside the courts have been dug out permitting better drainage —this also is being done in-house; third heater for the pool was installed.

It was suggested that there is a need to post the service date on bills so that the owner’s receipts match their billing.

Committee Reports: Social Program –“Staff Appreciation Party” will be October 24,

2003. Kevin suggested a gift certificate be given to employees for restaurants.

“Holiday Gala” – will be December 7, 2003, committee is currently

working on all the details. “Jazz by the Pool” will be October 16, 2003. “Welcome Newcomers” will be October 23, 2003 the LMA and

LRC Board of Directors will be present. Tennis Committee: Round Robin has been moved to Saturday, Sep-

tember 6th. A portable Backboard was discussed and pictures shown to the

Board of Directors. Motion unanimously carried to purchase for $140.00 plus shipping and tax.

Member Guest will be discussed at the committee’s September meeting.

Robbie presented the possibility of renting a couple of the courts to the Gomez Brothers for their training sessions with young people. There would be professional trainers on-site along with approximately 15 to 20 well – disciplined teenagers and Robbie would also oversee. At the end of each day they would sweep and line the courts as part of the contract. The money would be put toward a fund for the replace-ment of Lights and Fences. They would use courts not otherwise in use.

Motion carried unanimously to allow Kevin and Robbie to enter into a month to month agreement with the Gomez Brothers. It would be reviewed by J. Berkey and the Tennis Committee.

Fitness Center/Library: Air-conditioning was down for 5 to 6 days due to bad fan motor . The library is growing quickly.

Old Business Motion to dissolve the $20.00 “Guest Fee” carried unanimously. New rates for the room rental were discussed. It was suggested the

Poolside rate go from $75.00 to $125.00 for rental plus a refundable cleaning fee of $75.00; Lakeside rate go from $150.00 to 250.00 with a refundable cleaning fee of $100.00.

Motion passed unanimously to put new rates into effect September 1, 2003

EAGLE’S EYE Pet of the Month

Toby, Government Participant

The Eagle, campaigning as it does for participation in

Landings government, couldn’t resist Toby. We found him attending a Carriage House II meeting at which their roof problem was under discussion.

Toby is an 11 year old Schnauzer, a native of Sarasota who joined his Kestral Park Circle family shortly after their arrival from Minnesota.

A survivor, he has successfully combated several serious illnesses while maintaining his affection for people. He also reacts specifically to human’s moods.

He does fear thunder, as many Landings canine pets seem

Landin Artist Ellie Alpert’s work Listening, embellishes the

cover of the August issue of Natural Awakenings magazine . The shell is used, according to Alpert, “because listening to

the sounds com- ing form the bowels of the sea reminds us of the mysteries of life. The yellow in the

girl’s hair is reflective of the warmth of the sun.” Ellie was born in Boston and has studied at The Boston Museum of Fine Arts School, The School of Practical Art and The Massachu-setts College of Art. She spearheaded and co-chaired a Landings art show, showcasing

Proposed 2004 Budget (Draft) The budget committee of J. Berk-ery, J. Jost and Kevin Richards presented their draft to the Board of Directors. They decided that after 7 years it was necessary to increase the yearly dues from $750.00 to $810.00. It has be-come very difficult to keep the premises up on the current amount. There was a long discus-sion of the increase and the affect on the members.

The 2004 Budget was ap-proved, unanimously, as pre-sented.
