FESTIVAL OF 1000 BIKES

First weekend of July saw theFestival of 1000 Bikes take

place at Mallory Park, which is apicturesque little circuit in Leices-tershire. One of the attractions was theopportunity to do a few laps roundthe circuit so we sent our money offand waited for the passes to dropthrough the letterbox. We arrived on Friday afternoonand set up camp. Went off to getthe bike, helmet etc checked andsign on and after a bite to eat wewandered across to the Beer Tent(not much in the way of decentbeer but the Band were brilliant !!) As well as the Track Sessionsfor Road Bikes on the Saturdaythere was a Pre-65 Trial. Unfortu-nately there isn't much scope to layout Sections at Mallory but the or-ganisers managed to find eight (oneof which had the added obstacle ofa tent on a flat area in the middleof it - must have been put up in thedark. Luckily everyone rode aroundthe tent and not through it !) Thesmall but enthusiastic entry put ona good display to give the specta-tors an idea of what Trials are allabout. Two Track Sessions No.9 andNo.18 had been booked both ofwhich resulted in a big grin on re-turning to the Camper. In between

(as well as trying to keep cool) wehad a look at the Avenue of Clubsand the Auto Jumble Still no decent beer in the BeerTent and this time the Band wasn'tvery good either, never mind, youcan't win ‘em all. The Race Paddock is situatedinside the track and the pukkarace bikes were assembled thereready for their outings on Sunday.Sammy Miller had brought along aselection of the bikes from the mu-seum, some of which were out onthe track for the Past MastersEvent. Bonhams had some ratherexpensive looking examples on dis-play and the sprint section hadtheir bikes all lined up ready fortheir demonstrations which tookplace on Sunday lunchtime. The Grasstrack and SpeedwaySection were also represented. Thepiece of ground they were usinglooked rather bumpy and they hadlaid out a small "donut" shapedcircuit. It was also rather dusty soperhaps wasn't a fair demonstra-tion of what Grass Track is allabout. All in all a good weekend with arelaxed atmosphere covering allaspects of biking.

ELIGIBILTY. Open to all members of clubs affiliated to the ACU riding solo machines of“British manufacture” & Twinshock Machines.

COURSE - All on private land and will consist of 3 laps of 15 sections.

CLASSES - (A - British Bike Hard Route) (B - British Bike Easier Route) (C - TwinshockBike Hard Route) (D - Twinshock Bike Easier Route) (E – Gentlefolk -Any BritishBike/Twinshock).PLEASE NOTE. Gentlefolk class will only ride two laps of the white route for no award.All other classes will ride 3 Laps.

MARKING. Will be as in TSR22 B. (no stop).

AWARDS - Premier award. Best British Bike performance on the red route. (Name on theMinnie Glenfell trophy, plus a replica).Best British Bike performance riding white route (Name on the Cyril Smith trophy, plus areplica).The Jack Rees Trophy for the best performance on the red route riding a Triumph (To beheld for one year )

GENERAL - Sections will be laid out with two alternative routes. Expert Route - Red Mark-ers. Easier Route – White Markers. The onus of following the correct route lies with the rid-er!

Sizzlers Catering will be in attendance.

PLEASE INDICATE ON THE ENTRY FORM WHICH ROUTE YOU WISH TO RIDE. Whensigning on you will be issued with a colour coded riding number, you will not be able tochange your selected route during the event!!

In recent years, we have report-ed on the threat posed by the

so-called ‘Vnuk’ judgement by theEuropean Court of Justice (CJEU).We had hoped that moves in Brus-sels to amend the Motor Insur-ance Directive (MID) would seeexemptions granted to motor andmotorcycle sport. But recent pro-posals to amend the MID haveseen the European Commissiondo a 180 degree U-turn and Vnukis now in danger of become a seri-ous reality.

The background to all this isthat in 2007, a Mr Vnuk in Slove-nia was knocked off a ladder atwork by a reversing tractor andtrailer. He was injured andclaimed compensation from thetractor’s motor insurance. As theincident happened away from thepublic road, the claim was out-side the policy and the insurerrefused to pay. The CJEU becameinvolved and ruled that the Slove-nian government had failed totranspose the Directive into na-tional law correctly and the MotorInsurance Directive required thatall vehicles must have insurancecover for all uses everywhere cov-ering all risks and liabilities. Thisruling was challenged by the Brit-ish, Irish and German govern-

ments, but in 2014 the CJEUrejected the appeal.

The UK government, alongwith sports bodies and industry,lobbied the European Commis-sion to change the legislation sothat motorsport would be exempt.We were helped by insurance bod-ies such as British Insurance Bro-kers Association (BIBA) and theAssociation of British Insurers(ABI), who stated that insuringmotorsport in the same way asnormal road use would be ex-tremely expensive (particularly forvehicle to vehicle collisions on thetrack), that such a policy wouldnot be commercially viable, andno underwriter would want toenter this market. The UK Govern-ment also supports our positionon the matter.

In April 2016, the argumentthat motorsport was a case apartwas accepted by the then Com-missioner in charge of this portfo-lio, Lord Hill, who directed thatan amendment be tabled shortlyto be completed by the end of theyear. However, rather than pub-lish immediately, he held a con-sultation and then, after theBrexit vote, Lord Hill resigned.The new Commissioner in chargedecided to roll the amendmentinto a longer process known as

“Refit” which included the issuewith several other changes to theMotor Insurance Directive.

The European Commissionheld two more consultations onthe issue during 2017. The re-sponses to both were overwhelm-ingly in favour of the EUexempting motorsport from man-datory insurance requirements.

However in May 2018, twoyears after the Commission prom-ised to exempt motorsport, theypublished a formal proposal foran amendment and an impactassessment that explicitly includ-ed motorsport in the scope forcompulsory motor insurance.

The detail of this proposal wasto include a definition of the ‘useof a vehicle’ which included alluse of a vehicle on all terrains,whether moving or stationary.

If adopted, this proposal willmean that all vehicles, whetherfamily cars, museum pieces, offroad competition machines orMotoGP bikes, will need a mini-mum 3rd party motor insurancecovering all damages and liabili-ties at all times and for all uses -including use on a closed circuitor a closed public road.

We now have a short windowof opportunity to stop the threatof Vnuk becoming reality. Wehave been working with the AMCAand the MCIA to ensure that ourEuropean counterparts lobbytheir governments and membersof the European Parliament (EP).The objective is to get the Europe-

an Parliament to amend the Euro-pean Commission proposals, sothat motor and motorcycle sportsare removed from the scope of theDirective. But it’s vital that otherEU governments are also broughton side, given that the EP votewill only be advisory and not bind-ing on the Commission.

Votes in Europe will take placelater this year. If we are unsuc-cessful in getting the proposedDirective amended, the theatre ofaction then moves to the UK,where we will be calling on theUK Government to not implementunder any circumstances. At thatpoint we may request the directhelp of clubs in contacting MPs –though there is nothing wrongwith writing to your MP about thematter now.

Given the current state of theBrexit negotiations, we cannotlook to Brexit to solve this prob-lem for us, as European direc-tives may still apply to motorinsurance after the UK leaves theEU. In any case, this is a Europe-an problem, not just a UK matter.

Irrespective of the UK’s placein the future, we will do what wecan to support our European col-leagues and friends in their en-deavours to save motor andmotorcycle sport.
