September Ludie Article: I am blessed to have 3 grandchildren. One girl will turn 17 years old this month and she is as cute as a button and I have two grandsons who are 14 going on 30. I say this because it always seems that in any discussion, regardless of what the subject is the boys know every-thing. My granddaughter is the quiet one. She just shakes her head when the boys are to-gether, mainly because the boys don’t seem to think she is too bright, when in fact, she is probably the smartest one in the room. Never mind that she is the straight “A” student and both the boys are doing good to keep their “C” averages. My granddaughter told me that it is just better to ignore the boys. That way, they will think you agree with them, when in fact you don’t, and then they will shut up finally and leave you alone. It sounds like she under-stands them pretty good, wouldn’t you say?
I have heard that the best thing about having grandchildren is that you can send them home when you get tired of them. But I don’t send them home, I have more fun with the grandkids then I ever had with my kids, mainly because I was working all the time when the kids were growing up. I missed a lot of the important stuff with the kids, I try not to miss anything with the grandkids. Well enough about all that, let’s get on with the story for this month.
Minnie Johnson listed her home for sale with Lenny Mann. She explained that she wanted the sale handled without ad-vertising and without attracting any more attention than was absolutely necessary. She said she understood that he would have to have some contact with prospective buyers and possibly with other Realtors®, but that she did not want the prop-erty filed with the MLS, advertised, or in anyway publicly announced as being on the market. Minnie than stated that she would only cooperate with the three largest real estate firms within the county, including his firm, and as a condition of cooperation, the Realtors® within those companies may not share her information with anyone else. Lenny asked Minnie if she would sign a statement to that effect so that he could file the letter with the MLS per their required policy. Minnie agreed to sign the statement noting the terms she had discussed with Lenny. Lenny agreed to impress the same restrictions on the real estate firms and their agents mentioned in Minnie’s statement by providing them with a copy of her statement. Lenny contacted his friend, Brian Yale at Adams, Binder & Nape Realty Group. Brian is a buyers broker and his firm was on Minnie’s cooperation list. Lenny felt that Brian was in touch with prospective buyers who would fine the prop-erty appealing. Lenny approached Brian to invite his cooperation and explained fully the client’s instructions. Lenny discussed the matter with no other Realtors® and refrained from any kind of advertising of the property. A few days later, Lenny learned that Katty Stone, with Stone & Stone Realty, was discussing the property with several prospective buyers. She knew the price at which the property had been listed and other details about the property. Lenny was con-fused because he had not spoken with Katty, so he called her to ask how she had gotten the information. She revealed that Brian had provided her the information on the property. Katty’s name did not appear on Minnie’s list of brokerages that she stated she would cooperate with.
On the basis of the information from Katty Stone, Lenny charged Brian with unethical conduct in a complaint to the As-sociation of REALTORS®, specifying that Brian’s breach of confidently under the circumstances was a failure to respect his exclusive listing, and that this action had jeopardized his relationship with his client. The complaint was referred to the Association’s Professional Standards Committee, a hearing was scheduled. Brian was directed to answer the charge of unethical conduct in violation of Article 16. At the hearing, Lenny detailed the instructions of his client and the manner in which he had conveyed them to Brian in inviting his cooperation. Katty told the Hearing Panel that Brian had discussed the listing with her and, at no time, had he conveyed to her that the information was of a confidential nature. Brian defended himself against the charge of vio-lating Article 16 by saying that while he had discussed the matter briefly with Katty, he had not expressly invited her co-operation, and, therefore, had not violated Article 16.
