SECTION 1 GENERAL REQUIREMENTS

1. INTRODUCTION

The Specifications as a whole define the requirements for the quality of materials, goods

and workmanship to be provided under the Contract for the construction of the whole of

the Works (both the Permanent Works and the Temporary Works), and they shall be read

and interpreted in conjunction with the Drawings and other Contract Documents.

This Section contains general items not related to specific elements of the Permanent

Works and shall be considered and read as being common to all other Sections of the

Specifications dealing with specific elements of work, particularly the materials,

workmanship and execution aspects.

2. SCOPE OF WORKS

The major items of construction work to be carried out are as follows:

The Contractor is required to carry out the Works in full accordance with the intent of

both the Drawings and the Specifications, but shall not be entitled to take advantage of

any error on or omission from the Drawings or of any discrepancy between the Drawings

and the Specifications, which are intended to be complementary documents.

4.AVAILABILITY OF SITE

A sufficient area of the Site will be made available to the Contractor free of charge to

enable him to commence mobilization from the date the Engineer’s order to commence

work is issued.

Further the following restrictions shall apply to the availability of the Site:-

(a) The Contractor shall give the Engineer one (1) week prior notice of his requirement

for an area to be handed over to him.

(b) The Contractor shall confine his activities and his work force within the areas of the

Site currently available to him.

The Contractor shall not use any portion of the Site for any purpose not directly connected

with the Works unless the written permission of the Engineer shall have been first

obtained.

The whole of the Site shall be deemed to be private property and the Contractor shall keep

out trespassers, hawkers or peddlers and all persons lacking authorization by the Engineer

or the Employer.

The Contractor shall not erect or allow to be erected, advertisements in any form on the

Site or on adjoining grounds, but shall provide a signage at the entrance of the Site bearing

the name of the Contractor and such other information as detailed by the Engineer.

The Contractor shall not establish on any portion of the site any living accommodation for

his staff, employees or sub-contractors.

6. PROJECT DOCUMENTS

The Contractor shall maintain a full set of the Contract Documents permanently in his

main Site office, together with one copy of the most updated set of each of the following:

(a) the Drawings issued for construction purposes;

(b) the Specifications issued for construction purposes;

(c) Addenda to the Contract Documents, if any;

(d) the approved Permanent Works Shop and Working Drawings;

(e) Temporary Works Drawings consented to by the Engineer;

(f) Variation (Change) Orders;

(g) Instructions;

(h) Investigation Reports pertaining to the Site and the Works;

(i) All Test Reports;

(j) Approved Construction Programme;

(k) Approved Method Statements and other approved construction

arrangements;

(l) Manufacturer’s data for all proprietary materials and goods to be used in the

Works;

(m) Standards and Codes of Practice listed in Section above.

The Engineer shall be entitled to review all the above data at any time during the

execution of the Works, and the Contractor shall ensure that all such documents are kept

in an orderly fashion and properly documented/listed to ensure ease in locating the

required information at all times.

7.CONSTRUCTION PERMITS

The Contractor shall obtain necessary permits, certificates and other consents from

Government and Local Authorities and shall submit all such permits to the Engineer.

8. COORDINATION PROCEDURES

The Contractor shall, within seven (7) days after the Commencement Date, prepare and

submit for the Engineer’s approval the proposed detailed Project Coordination Procedures

to ensure that the construction work activities proceed smoothly. The proposed

Coordination Procedures shall be developed in compliance with the quality assurance

plan, and shall contain, but not be limited to, such information as is described hereunder.

The Coordination Procedures shall be accompanied by a proposed project organization

chart, the job descriptions of the following positions, the names of the proposed

candidates thereof and their resumes:

(a) Contractor’s Representative or Site Engineer

(b) Materials Engineer

(c) Site Safety Officer;

The Contractor’s Representative or Site Engineer shall be the official focal point of

contact for the Employer for the duration of the Contract and must be fluent in the English

language. If the Contractor’s Representative wishes to delegate part of his roles and

authority to another person or other persons, he shall submit a notice one week in advance

to the Engineer to obtain approval. The notice shall contain the extent and period of and

the reasons for the delegation(s).

Communication between the Employer and the Contractor is required to be made through

the Engineer and the Contractor’s Representative, notwithstanding that varied types of

communication at different levels in the respective organizations are desirable for smooth

and efficient project operation. The Contractor shall prepare the communication

procedures in consideration of the organization charts of both parties, the office locations,

the authorities delegated to the personnel and the importance of the various matters to be

handled.

The communication procedures shall cover various types of communications such as

letters, notes, reports, meetings, etc. If the Engineer issues an oral instruction, the

Contractor shall confirm the same within seven (7) days thereafter and, if not contradicted

by the Engineer within a further seven (7) days from receipt of such confirmation, it shall

be deemed to be an instruction of the Engineer.

To ensure adequate coordination of the Works in each individual Site, the Contractor shall

arrange and chair meetings on the Site with all subcontractors at least weekly. The

Engineer reserves the right to attend such meetings and must be kept informed by the

Contractor in advance as to the dates of all such meetings. The Contractor shall also

furnish the Engineer with the minutes of all such meetings.

At least once each month, and more often if the progress of the Works so requires, the

Contractor shall attend site meetings with the Engineer and the Employer to discuss the

progress and quality of the Works.

9. Existing Structures and Utilities

The Contractor shall ensure that no unauthorised and unnecessary damage or interference

occurs to any existing structures in and around the Site as a result of any action or inaction

by himself or his Sub-Contractors.

Any mains, drains, pipes and cable, etc (except as provided for in the Contract), Whether

above or under ground, that are encountered within the Site during the construction of the

Works shall be left in position and carefully supported and guarded from injury by the

Contractor.

The Contractor shall then notify the Engineer of the existence of the utility and shall

obtain his advice on the measures to be adopted in respect of the service.

The Contractor will be liable for all costs resulting from damage or interference caused by

him or his Sub-Contractors to any such structures and utilities.

10. MOBILIZATION / DEMOBILIZATION

10.1 Mobilization

The Contractor shall mobilize and put into work all personnel, construction equipment and

temporary plant requirements necessary to undertake and complete the Works within the

time frame allowed for in the detailed Construction Program, and methods of construction,

as approved by the Engineer.

Mobilization shall include the provision, organizing and transportation to the Site of

essential construction equipment, vessels, staff and other necessary items to commence

the execution of the Works on the Site in earnest, and encompasses the setting up and the

installation of all construction equipment and other plant to render it fully operational, and

the completion of such temporary buildings on the Site as will allow the Contractor’s on-

Site administration team to function effectively.

Mobilization also entails the Contractor providing a sufficient supply of spare parts for the

construction equipment. Breakdowns of essential construction equipment and plant are to

be repaired on Site by the most expeditious method possible entirely at the Contractor’s

expense.

In the event that repairs are beyond the ability of personnel or tools at the Site to effect

repairs in a reasonable time, such that the construction equipment or plant has to be

removed from the Site, then replacement equipment or plant of a similar capacity shall

immediately be provided by the Contractor at no additional cost to the Employer. No

extension of the time for completion of the Works will be granted due to the breakdown of

construction equipment or plant or the inability of the Contractor to obtain replacement

equipment when necessary.

Sanitary conveniences for the use of persons employed on the Works shall be provided

and maintained by the Contractor to the extent and in such manner and at such places as

shall be approved by the Engineer and the Authority concerned, and all persons connected

with the Works shall be obliged to us them. The Contractor will not be permitted to use

the conveniences of the Employer.

10.2 Construction Equipment, tools and other Facilities

Each item of construction equipment shall be fit for the tasks it is required to undertake

and must be maintained in good order at all times. In the event of breakdown, or if the

Engineer so instructs, defective construction equipment shall be taken out of operation

until such time as it has been adequately repaired and made fit to resume operation.

Without limitation to the Engineer’s rights to declare construction equipment to be

defective, equipment will be deemed defective if it belches smoke, makes too much noise,

suffers continual breakdowns, has badly worn tracks, tires or drive belts, or is otherwise

considered to be unsafe.

The Contractor shall also ensure that the Site is provided with sufficient quantities of

handheld and power driven tools and the like to fully satisfy the construction needs of the

Works. All such tools shall be maintained in first class order and pose no danger to users

or others passing or working in the vicinity where the tools are being used. In the event

that the Engineer pronounces certain tools to be defective, the Contractor shall forthwith

remove such defective tools from the Site.

Wherever needed to ensure safe access to the Works, the Contractor shall provide

scaffolding, staging, trestles, ladders and the like. All such facilities shall be maintained in

first class order throughout their use on the Site and must pose no danger to users or others

in the vicinity. Scaffolding and the like shall be provided with enough strength and

stiffness to support the weight of loads and any dynamic forces created by construction

activities. In the case of scaffolding and the like, the Contractor must utilize only qualified

personnel for the erection and for the carrying out of regular safety checks to ensure that

connections are secure at all times, and that toe boards and guard rails are properly in

place and secure. Where the Engineer deems that any such temporary facilities are unsafe,

the Contractor shall promptly cease from using them until such time as they have been

rendered safe.

All extra costs incurred by the Contractor due to construction equipment, tools and other

facilities referred to above being deemed defective or unsafe, including the cost of hiring

in replacement construction equipment and tools at short notice, shall be at the sole

expense of the Contractor.

10.3 Demobilization

Demobilization shall include:

(a) the dismantling and removal of all construction equipment from the Site;

(b) the dismantling and removal of all temporary buildings, structures and

utilities, and the cleaning up of the Site as provided for by the requirements

of the Contract;

(c) the removal of all supplementary markers furnished and installed by the

Contractor, except for those the Employer has opted to retain;

(d) the authorized removal and disposal of debris, materials and goods not

incorporated within the Works prior to the Contractor moving out from the

Site.

11. SURVEY WORKS

11.1 General

The Employer does not represent that the available geotechnical data shows completely

the existing conditions on the Site and does not warrant the correctness of the designation

of rock or other naturally occurring materials shown on any Drawings or in reports, maps

or other information made available to the Contractor by the Employer. Neither does the

Employer warrant the correctness of any interpretation, deduction or conclusion shown in

those records or on the Drawings.

The Contractor shall make his own assessment and conclusions as to the nature of the

materials to be excavated and the difficulties of making and maintaining the required

excavation and of undertaking work affected by the geotechnical condition at the Site, and

shall accept full responsibility therefore.

All surveys shall be carried out with reference to the Benchmarks and the Chart Datum

Level as designated by the Engineer.

Datum of elevation is derived from MLLW, Elevation 0.00

All items specified herein shall be carried out by the Contractor’s licensed Geodetic

Engineers (Surveyors). The Contractor shall submit in advance, for the consent of the

Engineer, true copies of the licenses and qualification of the Geodetic Engineers

(Surveyors) to be employed for the Works.

Field Notes, calculation sheets and all other documents shall be prepared in the manner

approved by the Engineer. Upon completion of the Works, the Contractor shall submit

field notes and other documents upon request of the Engineer for his inspection and

examination.

11.2 Project Boundary

The approximate Project Boundary is shown on the Drawings; any modification of the

boundary, if any, will be directed by the Engineer. The Contractor shall install and

maintain supplemental benchmarks adjacent to the project boundary at his own expense.

11.3 Location and Protection of Utilities

Before commencing construction work, the Contractor shall undertake a survey to

establish the detailed location of all cables/ pipes and other utility lines within the Site.

Survey results shall be recorded in plan form to the satisfaction of the Engineer, and

surface pegs shall be fixed on the Site to indicate the location of all underground utilities.

These pegs shall remain for the duration of the Contract, and the Contractor shall be

responsible for any temporary protection of cables or pipes necessary during the execution

of the Works.

Any damage to the utilities caused directly or indirectly by the Contractor's work will be

considered the Contractor's responsibility.

Where the Engineer considers that it is necessary to move or permanently protect any

existing cables or pipes, the Contractor will arrange for this work at no cost to the

Employer.

The Contractor should cooperate in this work and, in particular, should give adequate

notice of any utilities that he considers should be moved or permanently protected.

11.3.1 Topographic Survey Work

A Topographic Survey of each designated area of the Site shall be conducted before

commencement of earthwork operations. When necessary or so instructed by the

Engineer, supplemental topographic surveys shall be undertaken.

The Topographic Survey shall be carried out by means of traversing and leveling.

Topographic maps shall be prepared by CAD software. An electronic copy of the survey

shall be provided to the Engineer andalso presented in ink on 0.03 mm double

faced/matting mylar sheets, using a scale directed by the Engineer.

12. SETTING-OUT OF THE WORKS

The Contractors shall be responsible for all setting out of the Works in conformity with

the Drawings and for the provision of all necessary instruments, appurtenances and labour

required in connections therewith.

Before any Works are commenced on the Site, the Contractor shall establish appropriate

base lines uniquely identified to existing features on site.

The alignment and referencing of the base lines shall be agreed with the Engineer and

shall be utilized for all setting out.

The Contractor shall be responsible at his own cost for the protection, preservation and if

necessary re-establishment of all pegs, bench marks and other setting out references which

lie within the Site of the Works. Loss of, disturbance of, or damage to any pegs or mark

shall be reported immediately by the Contractor to the Engineer.

All reduced levels, including all bench marks are referenced to MLLW..

The Contractor shall set down construction stakes establishing lines and grades for

construction in accordance with the Drawings, and shall secure the approval of the

Engineer before commencing construction.

The Contractor shall provide the Engineer with all necessary information to enable him to

check the setting out of the Works, including explanation of any marks established by the

Contractor for the setting out. In order that arrangements may be made for checking, the

Contractor shall give the Engineer not less than 48 hours notice of his intention to stake

out or establish levels for any part of the Works.

The Engineer shall, if he deems it necessary, revise the requirements for the lines and

grades, and the Contractor shall adjust the stakes accordingly.

The Contractor shall be solely responsible for the accuracy of the setting out of the Works,

notwithstanding the Engineer’s checking thereof.

13. SAMPLES AND TESTING OF MATERIALS, AND WORKMANSHIP

13.1 Schedule of Tests

Quality control of materials and goods for the Permanent Works will be essential to the

Project, and is one of the principal tasks to be undertaken by the Contractor.

Testing of materials and goods for quality control purposes shall be undertaken in one of,

or any combination of each, the following three test laboratories:

(a) on-Site Test Laboratory;

(b) in a third-party testing laboratory approved by the Engineer;

(c) at a supplier’s (or their agent’s) laboratory approved by the Engineer.

The Engineer will choose the best test means considering the necessity of the test, the

intensity of the test and the possibility of carrying out the test at the Site Test Laboratory.

The Contractor shall also prepare a Schedule of Tests applicable to the approved

Construction Program, indicating the length of time for each series of tests and attendant

reporting activities, and showing an appropriate time allowance for the Engineer’s

evaluation.

13.2 Test Standards

All tests shall be carried out in accordance with the requirements and procedures of the

specified standards or as otherwise instructed by the Engineer.

Other approved equivalent standards may be applied for testing and, where the Contractor

wishes to use such other standards, he shall submit three (3) copies of the relevant

standards for the Engineer’s approval at least fourteen (14) days before the scheduled date

of any test so affected.

13.3 Tests Not Particularized

Unless otherwise expressly stated, all tests and related works in connection with Testing

shall be considered as incidental to the Permanent Works requiring such tests, and all

costs thereof shall be deemed to be included in and covered within the unit rates or prices

of the Pay Items to which they relate.

13.4 Testing

Notwithstanding any previous inspections and tests, all materials and goods delivered to

the Site shall be subject to examination or testing as specified in the Contract or as

directed by the Engineer. Should additional tests beyond those specified be desired by the

Engineer, the Contractor will be advised in sufficient time to arrange for such testing.

The Engineer shall be at liberty to reject any materials and goods that do not comply with

the requirements of the Contract, notwithstanding any previous approval thereof.

The provision of testing equipment, specialists and labor shall be in line with the

requirements dictated by the approved Construction Program and on the basis that all

specified tests can be completed within the normal working hours of one shift, except for

tests of such nature that they are required to be carried out continuously beyond normal

working hours.

13.5 Test Samples

The Contractor shall furnish test samples as instructed or specified, and shall provide

reasonable assistance and cooperation as necessary to permit tests to be performed on

materials and goods or work in place, including reasonable stoppage of work during

testing.

The Contractor shall not be entitled to any extra payment or extension of time for

completion of the Works on account of the rejection of materials, goods or workmanship

due to their non-compliance with the requirements of the Contract or due to the waiting

time reasonably required for carrying out tests and their evaluations.

All materials, equipment and workmanship shall comply with current appropriate

Standards with amendments unless otherwise specified. Other equivalent standards which

ensure equal or higher quality than the standards mentioned may be accepted, subject to

the approval of the Engineer, which will not unreasonably be withheld.

Acceptance of the Works in this Contract will be subject to satisfactory results from the

tests nominated for each particular section of the work.

14. Materials and Goods

Unless otherwise specifically provided for under the Contract, all materials and goods

incorporated into the completed Works shall fully satisfy the requirements (including

testing requirements) of all relevant Specifications and shall be new and of the best quality

of their respective kinds as specified herein and/or described on the Drawings, and shall

be obtained from sources and suppliers approved by the Engineer.

If no Specifications exist for certain materials and goods referred to on the Drawings or

otherwise inherently required by the nature of the work involved, such materials and

goods provided by the Contractor shall be the best of their respective kinds and fit in all

respects for the intended purpose.

Unless advised otherwise by the Engineer, the Contractor is required to provide to the

Engineer samples, together with full technical information of all materials and goods

(including all essential accessories) to be used for construction purposes. Such samples

and information are to be provided to the Engineer at least fourteen (14) days before the

scheduled date of use of the respective materials and goods.

Where applicable, the Engineer will instruct the Contractor to carry out tests on materials

and goods, as described elsewhere in the Specifications. The Contractor shall make

arrangements for these tests, and deliver copies of the test results to the Engineer in a

timely fashion.

On the basis of the samples, technical information and test results (where applicable) the

Engineer will decide upon the approval or rejection of the request for the use of such items

for the Works and forthwith removed from the Site by the Contractor.

When reference to a standard is made without indication of a specific grade, the materials

and goods shall be the best of their kind consistent with the grade required, which is to be

selected with due consideration being given to the purpose thereof.

15. Salvaged Materials

All materials obtained during the preparation of the Site for the construction of the Works

shall belong to the Employer (unless otherwise provided for under the Contract) and must

not be removed from the Site without the consent of the Employer.

However, the Contractor may use for the construction of the Works any of the materials

excavated or salvaged under the Contract that the Engineer may determine to be suitable

for such use and shall use such materials if so directed by the Engineer.

Items to be retained by the Employer shall be carefully removed from the Site, encased in

protective coverings as necessary or directed and carefully transported to such location as

specified or directed by the Engineer.

16. Workmanship

All workmanship shall be of the best quality appropriate to each category of work in the

light of internationally recognized standards of practice, whether or not specific reference

is made in the Specifications to particular standards and/or codes of practice to be

followed.

Where specialist activities are required, the Contractor may be required to demonstrate

that the personnel engaged to undertake the work are all fully qualified to carry out the

task.

Where the Contractor cannot demonstrate that certain persons have the necessary skills

and qualifications for the work they are (or are to be) engaged upon, the Engineer shall

have the right to dismiss those persons from the Site and, in such event, the Contractor

shall replace them forthwith with persons of proven adequacy, entirely at his own

expense.

During its progress, and upon completion, each element of the Works shall conform to in

every detail in full accordance with the requirements of the Specifications. Finished work

not matching the Drawings, not meeting the requirements of the Specifications and/or not

matching the standard set by any relevant samples of workmanship shall be rejected by the

Engineer and shall forthwith be demolished and removed from the Site by the Contractor.

In the event of the Contractor’s failure or refusal to remove rejected work, the Engineer

shall be entitled to engage others to effect its demolition and removal, and all costs

associated therewith shall be at the cost of the Contractor.

In the event that the Contractor is unable to achieve the standard required for any work, all

extra costs involved shall be chargeable to the Contractor.

17. SUBMITTALS

17.1 General Requirements

The Contractor shall submit to the Engineer for review and approval all Shop/ Fabrication

and Working Drawings. Within fourteen (14) days after the Commencement Date, the

Contractor shall furnish to the Engineer, as a checklist, a complete schedule of all

submissions that the Contractor will be required to make under the Contract, indicating all

scheduled dates for such submissions and anticipated approvals, and allowing adequate

time for resubmissions. The schedule shall include for the submission of all calculations,

mock-ups, tests and the like, and indicate any delivery time requirements.

All dimensions and units on Drawings shall be in the metric system. All Drawings

submitted shall be clear and legible. Drawings which in the opinion of the Engineer are of

an inadequate standard will be rejected.

Any approval by the Engineer of any of the Contractor’s Drawings or designs shall in no

way relieve the Contractor of his responsibility for the Works under the Contract and shall

only be regarded as general approval relating to their sufficiency and compliance with the

intention of the Contract.

Also, approval of Drawings by the Engineer shall not be taken to imply that dimensions

have been checked.

Otherwise stated within the Specifications, the Engineer shall review Shop and Working

Drawings within fourteen (14) days after the submission by the Contractor. The Engineer

shall inform the Contractor if approval will take longer period than fourteen (14) days.

The result of the Engineer’s review will be signified using a series of “notations” as

specifically referred to hereunder, identifying items that have been approved (with or

without comment) or that require resubmission.

17.2 Shop and Working Drawings

The Contractor shall prepare the Shop and Working Drawings (including Subcontractor’s,

suppliers or distributor’s schedules, data and Shop Drawings) that illustrate appropriate

portions of work showing the work item identified in relation to responsibility, fabrication,

layout, setting or erection details as specified in the appropriate Sections.

Shop and Working Drawings shall be prepared in the same version of AUTOCAD as the

software provided by the Contractor to the Engineer and shall be submitted as electronic

files in CD-ROM media, with one printed copy in A-1 size on transparency paper, and 3

(three) printed copies on A-3 size good quality paper.

17.3 “As-Built” Record Drawings

The Contractor shall prepare accurate “As Built” Record Drawings to faithfully record the

deviations from the Contract Documents necessitated by the Site conditions or due to

changes instructed by the Engineer.

The Contractor shall mark “as-built” changes in red pencil on one copy of the relevant

Drawings, and record the following information:

(a) depth of various elements of foundations in relation to the project datum;

(b) horizontal and vertical location of underground utilities and appurtenances

referenced to permanent surface locations;

(c) location of internal utilities and appurtenances concealed in construction,

referenced to visible and accessible features of structures;

(d) field changes of dimensions and details;

(e) changes and variations required by the Variation (Change) Orders;

Immediately prior to the Tests on Completion of the whole of the Works the Contractor

shall:

(a) neatly transfer “as-built” notations to a second copy of the Drawings and

submit both sets to the Engineer for his final evaluation;

(b) mark up two (2) sets of Shop Drawings and manufacturers data sheets

to record supply changes or field changes and submit to the Engineer.

Within twenty-eight (28) days after the issuance of the Taking-Over Certificate, the

Contractor shall submit to the Engineer three (3) sets of final agreed “As-Built” Record

Drawings.

The Contractor shall prepare ‘As Built’ Drawings that record accurately and clearly the

detail of the Works as constructed including all permanent services and any temporary

services remaining on the Site at the completion of the Contract.

Within 2 weeks of the date of issue of the Taking Over Certificate of the whole of the

Works the Contractor shall submit for approval 2 prints of all Contract and Contractors

‘As Built’ Drawings. The Contract Drawings amended with ‘As Built’ details shall have

‘As Built’ Drawing’ stencilled in the title block in place of ‘Working Drawing’ and shall

include the date and details of ‘As Built’ amendments in the Revision Box.

Following review of all submitted Drawings the Engineer will return to the Contractor one

print of each Drawing requiring amendments which shall then be amended by the

Contractor and resubmitted for approval within one week.

Within 2 weeks of receiving approval from the Engineer of all ‘As Built’ Contract and

Contractor’s Drawings the Contractor shall provide one print, one card mounted 35mm

negative with the title of the Project and the Contract Drawing number labelled, and on

plastic reproducible transparency (0.6mm thick minimum) of all Contract and

Contractor’s Drawing of the Works as built.

As Built” drawings shall be prepared by the Contractor in the same version of AUTOCAD

as the software provided to the Engineerand shall be submitted as electronic files in CD-

ROM media.

No Certificate for Final Payment shall be issued to the Contractor by the Engineer unless

the “As-Built” drawings are submitted and approved by the Engineer.

17.4 Preparation of Shop and Working Drawings

To ensure adequate control of the off-Site fabrication and on-Site construction work, the

Contractor will need to supplement the Drawings provided by the Employer with Shop

and Working Drawings that are to be produced by the Contractor’s subcontractors and

suppliers. Such further drawings shall all be prepared at the Contractor’s expense.

All Shop and Working Drawings are required to be submitted to the Engineer for review.

They must be accompanied by a submittal form and shall bear the project identification

data in or near the title block.

All drawings submitted by the Contractor shall be certified by the Contractor to be correct,

and shall be furnished together with the submittal form.

Such drawings shall include, but not be limited to, match-marks, erection diagrams and

other details, such as field connections for proper installation and erection of equipment.

They shall be submitted before fabrication or installation is commenced, allowing at least

seven (7) days for review by the Engineer.

17.5 Review and Approval of Shop and Working Drawings

One copy of each drawing shall be returned to the Contractor and marked by the Engineer

with one of the following notations to signify the Engineer’s approval or otherwise:

(1) Approval Granted - Construction May Proceed;

(2) Approval Granted - Submit Final Drawings - Construction May Proceed;

(3) Approval Granted Except As Noted – Make Changes and Submit Final

Drawings - Construction May Proceed With Changes As Noted;

(4) Not Approved - Correct the Drawings and Resubmit;

(5) Review Not Required - Construction May Proceed.

Returned copies of drawings marked with notations “1” and “2” authorize the Contractor

to proceed with construction. However, for returned copies provided with notation “2”,

such approval for construction shall be subject to the submittal of the final drawings.

Although construction may proceed with notation “3” (approval with comments), the

Contractor shall incorporate the comments, resubmit the drawing(s) and obtain notation

“1” for approval from the Engineer.

Returned copies of drawings marked with Notation “5” authorize the Contractor to

proceed with the construction covered by such copies.

Returned copies of drawings marked with either Notation “2”, “3” or “4” shall be

resubmitted in the format and required quantities as required by the Engineer not later than

seven (7) calendar days after date of transmittal by the Engineer of copies of such

drawings.

All Shop and Working Drawings that have been approved by the Engineer shall form part

of the Contract, but no approval of the Contractor’s drawings by the Engineer shall relieve

the Contractor of any of his obligations to meet all the requirements of the contract or

relieve the Contractor of the responsibility for the correctness of such drawings.

18. CONTRACTOR’S SITE ESTABLISHMENT AND OTHER TEMPORARY

WORKS

The Contractor shall establish a Work Area for his use within the available area provided

by the PO. This area shall be made available to the Contractor free of charge on the date

of commencement of work on Site. Normal access to the site shall be restricted to the

main gate.

The Contractor shall be responsible for making all arrangements and meeting all costs of

filling and for the establishment of sheds, offices, stores and the storage of plant and

materials within his Work Area and for leaving it clean and tidy on completion.

The Contractor shall make his own arrangement in consultation with the appropriate

authorities for any additional land required for working areas outside the boundaries of the

Site and the Employer will not accept any liability in connection with such land.

The Contractor shall, within 7 days of acceptance of his Tender submit to the Engineer for

approval full details of the proposed layout of his offices, laboratory, amenities, stores,

workshops, etc., within his Work Area.

The Contractor shall provide and erect office (complete with toilet) and laboratory

accommodation and shall remove all items from the Site on Completion of the whole of

the Works.

Sanitary conveniences for the use of persons employed on the Works shall be provided

and maintained by the Contractor to the extent and in such manner and at such places as

shall be approved by the Engineer and the Authority concerned, and all persons connected

with the Works shall be obliged to us them.

The Contractor shall prohibit the committing of nuisance by his employees on the Site or

upon the land of the Employer or adjacent landowners and any employee found violating

this provision shall be liable to immediate discharge and be refused further employment

on the Works.

The Engineer reserves the right to designate additional or alternative work or storage areas

other than those shown on the Drawings and the Contractor shall allow the use of such

areas by others upon reasonable request from the Engineer.

A certain portion of the Site, as designated on the Drawings, will be allocated to and made

available for use by the Contractor, to enable him to set up such on-Site establishment,

shall be responsible for securing such space outside the Site entirely at his own cost,

including arranging the leasing and payment thereof with the relevant property owners.

All temporary buildings and facilities constructed by the Contractor shall conform to all

applicable national and local building codes, and shall be designed to be aesthetically

pleasing in both form and configuration. The design and layout of such temporary

buildings and facilities and their subsequent construction shall also be subject to the

approval of the Engineer.

Upon completion of the Works or prior to completion, if so directed by the Engineer, all

Temporary Works (including all temporary structures, installations and utilities) shall be

carefully dismantled and removed from the Site, and all areas of the Site previously

occupied by such Temporary Works shall be reinstated as may have been particularly

specified within the Contract Documents, or the area shall otherwise be made good, as

appropriate for the particular location.

18.1 Temporary Access Roads

The Contractor shall construct all necessary temporary access roads to and around the Site

as may be necessitated to carry out the Works efficiently.

All such temporary access roads outside the Site area must be approved by the relevant

authorities and/or the owners of the land being traversed. Within the Site area, all such

temporary access roads require approval from the Engineer before installation begins.

18.2 Temporary Utilities and Services

18.2.1 Water

The Contractor shall make his own arrangements for the supply, storage and distribution

of water for his own needs (incl. toilets) and for that required in the execution of the

Works.

18.2.2 Electricity

The Contractor shall provide and maintain an adequate supply of electric power (either by

the use of generator(s) or by service connection to the main power line) for his own needs

and for that required in the execution of the Works. Stand-by generators shall also be

provided, with adequate capacity to reasonably sustain the Works in the event of mains

power failure or failure of the primary generator(s).

19. Communication Facilities

Whenever applicable, the Contractor shall ensure that his own on-Site offices are provided

with a minimum of one telephone line.

For safety purposes, the Contractor shall also provide radio or other communication

devices for use by all heavy equipment operators and their respective point men.

20. Temporary Works

Temporary works shall include for all work necessary for the proper execution of the

Works, for the maintenance of security of the Works, for providing and maintaining

authorized access to the Works, for providing and maintaining public rights of way and

public services, for supporting structures and plant during construction, for temporary

drainage or for any temporary purpose and shall be properly designed by the Contractor.

Such Works shall include the provision of signs, barricades, warning lights and devices

and any other items of equipment for the safe execution of the Works.

In particular the Contractor shall:

o enclose all openings, excavations etc. with railings or similar means;

o supply, erect and maintain temporary fencing and gates as directed.

Complete details, in duplicate, of all proposed temporary works, shall be submitted to the

Engineer or other appropriate authority for approval, a minimum of 14 days prior to the

construction of such temporary works and no work shall commence until the approval of

the Engineer has been given.

On completion of the Works, the Contractor shall remove, demolish, clear away and

dispose of any temporary works and shall make good all roads, areas of land or other areas

that may have been occupied for constructional purposes, all to the satisfaction of the

Engineer.

The Contractor shall provide all such temporary facilities and safeguards as may be

specified or as may be required for the safe and proper execution of the Works. Unless

otherwise directed by the Engineer in special circumstances, the design of all Temporary

Works is entirely at the choice of and the responsibility of the Contractor.

Notwithstanding the foregoing, the Contractor shall provide in writing to the Engineer a

general description of the construction arrangements and methods, including all

Temporary Works arrangements, which the Contractor proposes to adopt for the execution

of the Works.

All Temporary Works and other related activities shall comply in all respects with all

applicable local regulations and ordinances, particularly with respect to safety of workers.

They shall be adequate for their intended uses and for all loads imposed without excessive

settlement, deflection or deformation. All parts and members shall be properly supported,

wedged, braced and secured to prevent displacement or failure.

Temporary utilities used during the construction works shall be adequate for their intended

use. They shall not be overloaded or otherwise used or arranged in such a manner as could

endanger persons or property. Connections shall be properly made, with lines and wiring

securely anchored in place and protected against possible accidents.

Drawings for all major Temporary Works items such as are contained in the following list

shall be prepared by the Contractor and submitted to the Engineer for review prior to their

implementation, together with full details including all supporting calculations:

.

Notwithstanding the Engineer’s review of the details proposed by the Contractor for

Temporary Works, the Contractor shall take full responsibility for the adequacy and safety

thereof.

The Contractor shall also take full responsibility for the stability and safety of partially

finished sections of the Permanent Works. The Contractor shall pay due attention to,

amongst other things, the following critical factors, and take adequate steps to avoid their

occurrence:

o Failure of structures by external forces including wind.

.

o Failure of structure by dead weight.

o Circular slip failure or the like, due to imbalance of the soil weight and

the internal shear resistance strength of the soil.

21. Drainage of the Works

The Contractor shall be solely responsible for ensuring that the Works are kept fully and

adequately drained throughout the construction period and shall construct temporary

drains as necessary. Any existing drains, pipes or channels in areas adjacent to the Works

that area affected by the Works shall be diverted or extended as necessary to ensure they

flow freely at all times.

The Contractor shall keep all work areas free from water and ensure that the work can be

carried out under dry conditions.

Where stormy weather is expected, the Contractor shall ensure that all loose materials,

construction equipment and the like is secured, and that adequate additional Temporary

Works are carried out to protect the whole of the Works and ensure the safety of personnel

and property.

Notwithstanding any approval by the Engineer of the construction methodology adopted

in the removal of excess water from the Site, the Contractor will be held responsible for

the suitability and effectiveness of such procedures. The Contractor will be required to

make good any damage to the Works caused by storms, typhoons, abnormal tides or

floods entirely at his own expense. Any loss of production, additional overheads or

additional costs of any kind due to any of the foregoing occurrences, are solely at the

Contractor’s risk.

22. Construction Equipment, Tools and other Facilities

The Contractor shall ensure that he mobilizes sufficient construction equipment to ensure

completion of the Works within the time frame allowed for in the Construction Program,

notwithstanding that more equipment is required than he had allowed for in his Bid

submission. The Contractor shall also ensure that he maintains sufficient quantities of

spare parts and consumables for the construction equipment on the Site, and that he

provides adequate maintenance facilities, including lifts, ramps, cranes and the like, to

keep all the equipment maintained in proper condition with minimal need to remove the

construction equipment from the Site for repair purposes.

Each item of construction equipment shall be fit for the tasks it is required to undertake

and must be maintained in good order at all times. In the event of breakdown, or if the

Engineer so instructs, defective construction equipment shall be taken out of operation

until such time as it has been adequately repaired and made fit to resume operation.

Without limitation to the Engineer’s rights to declare construction equipment to be

defective, equipment will be deemed defective if it belches smoke, makes too much noise,

suffers continual breakdowns, has badly worn tracks, tires or drive belts, or is otherwise

considered to be unsafe.

The Contractor shall also ensure that the Site is provided with sufficient quantities of

handheld and power driven tools and the like to fully satisfy the construction needs of the

Works. All such tools shall be maintained in first class order and pose no danger to users

or others passing or working in the vicinity where the tools are being used. In the event

that the Engineer pronounces certain tools to be defective, the Contractor shall forthwith

remove such defective tools from the Site.

Wherever needed to ensure safe access to the Works, the Contractor shall provide

scaffolding, staging, trestles, ladders and the like. All such facilities shall be maintained in

first class order throughout their use on the Site and must pose no danger to users or others

in the vicinity. Scaffolding and the like shall be provided with enough strength and

stiffness to support the weight of loads and any dynamic forces created by construction

activities. In the case of scaffolding and the like, the Contractor must utilize only qualified

personnel for the erection and for the carrying out of regular safety checks to ensure that

connections are secure at all times, and that toe boards and guard rails are properly in

place and secure. Where the Engineer deems that any such temporary facilities are unsafe,

the Contractor shall promptly cease from using them until such time as they have been

rendered safe.

All extra costs incurred by the Contractor due to construction equipment, tools and other

facilities referred to above being deemed defective or unsafe, including the cost of hiring

in replacement construction equipment and tools at short notice, shall be at the sole

expense of the Contractor.

23. ENGINEER’S SITE OFFICE

The Engineer’s staff office shall be constructed in the Contractor’s Site Establishment area

preferably in close proximity to the office of the Contractor’s Representative.

The Contractor is to provide the Engineer’s Site office with a working table with a chair.

24. SAFETY AT WORK

24.1 Contractor’s Responsibilities

The Contractor shall be solely and entirely responsible for the safety of all people entering

and/or working on the Site and for all members of the general public affected in any way

by the activities of the Contractor or his subcontractors and suppliers in connection with

the execution of the Works on the Site, including delivery and removal of construction

equipment, materials and goods to and from the Site. An announcement and notice board,

at least 1.00 m x 2.00 m in size, shall be installed by the Contractor to show the area and

routing for public transport, and the area being used by the Contractor.

The Contractor shall also be held responsible for the adequate protection of the whole of

the Works at all times (including materials and goods not yet incorporated into the Works

and partially completed work) until the issuance of the Taking Over Certificate for the

Works.

The Contractor shall comply with all laws, regulations and the like of any Authority

having jurisdiction over the Site, especially in relation to safety of persons and road users,

etc. and shall maintain the Site in a safe condition for his employees.

The Contractor shall also assume full responsibility for the adequacy, stability and safety

of all on-Site operations and methods of construction including all Temporary Works.

Except where otherwise provided for under the Contract, the Contractor shall not be held

responsible or liable for the design or specification of the Permanent Works or for any

design or specification provided by the Employer or Engineer in respect of any items of

Temporary Works. However, the Contractor is required to prepare all necessary Shop and

Working Drawings for the Permanent Works and provide copies thereof to the Engineer

for review purposes.

24.2 Protection Measures for Workers and the Public

The Contractor shall engage a full time Safety Officer on the Site, whose only duty will be

to consider and deal with all safety matters on the Site. The Contractor’s designated Safety

Officer shall be properly qualified to do the job and be fully conversant with the

implementation of the rules for safety relating to construction sites and with the

Contractor’s own safety regulations and codes drawn up in compliance therewith (a copy

of which must be deposited with the Engineer for his review and comment before

construction work commences).

24.3 First Aid Facilities

Availability of First Aid Facilities and Emergency Services, and Fire Fighting Equipment

The Contractor shall provide and maintain, at easily accessible locations throughout the

Site and at the Contractor’s Site establishment facilities, adequate first aid kits at least to

the standard as may be required by current legislation or subsequent amendments thereto,

together with reasonable quantities of bandages, sterile materials and other supplies for

first-aid treatment of minor injuries.

The Contractor shall determine the locations of the nearest available hospital (or other

appropriate medical services), fire station and police station, and shall maintain an updated

list of such information, a copy of which shall be deposited with the Engineer and an

adequate number of further copies posted at strategic locations throughout the Site and

within the Contractor’s Site establishment facilities.

The Contractor shall be solely responsible for the safety of his personnel and shall ensure

that all his personnel are safe.

The Contractor shall promptly but in any case within 24 hours of the occurrence of any

accident of fire at or about the Site or in connection with the execution of the Works under

the Contract, report such accident or fire to the Engineer.

24.4 Medical Room Provision

The Contractor shall provide and maintain, throughout the duration of the execution of the

Works, a designated Medical Room located in an easily accessible area within the

Contractor’s on-Site compound.

The first aid kit held in the medical room shall, as an absolute minimum, be provided

with all the items recommended by such standard hospitals. It must not be used for

anything other than the intended purpose.

Adequate signage must be placed prominently around the Site to direct personnel to the

Medical Room.

24.5 Medical Aide

The Contractor shall provide a medical aide to be in full time attendance at the medical

room for the sole purpose of attending to the medical needs of the Contractor’s staff and

workers, and to provide first aid assistance in the event of injuries.

Whenever work is ongoing on the Site beyond standard working hours, arrangements

must be made by the Contractor to ensure that the nursing facilities described above are

still available at all times, entirely at the Contractor’s cost.

25. SITE SECURITY

The Contractor shall take all necessary measures to provide security and protection of the

Works and to defer or prevent unauthorized members of the public from gaining access to

the Site both inside and outside normal working hours.

The Contractor is responsible for the general security of the working areas and all other

areas provided to him for temporary use. He shall provide patrolling watchmen to prevent

such areas from unauthorized access on a 24-hour basis. Such watchmen shall be provided

with 2-way radio communication devices to a central security base, which is also required

to be manned on a 24-hour basis.

All Contractor's personnel and vehicular traffic shall comply with the Employer’s

regulations concerning entry and exit to the port area. Gates provided in the temporary

security fencing provided by the Contractor shall also comply with any specific

Employer’s requirements regarding the need to control and monitor materials and cargo

passing into and out of the area.

Where required by the Employer, the Contractor shall ensure that all personnel and

vehicles obtain the requisite passes to allow them access into and exit from the area.. All

costs in connection therewith shall be borne by the Contractor.

The Contractor shall be held liable for any breaches in security committed by his own

personnel and those of his subcontractors and suppliers.

26. Final Cleaning

The Contractor shall carry out final cleaning and tidying up operations immediately prior

to, and as a condition precedent to, inspection for the issue of the Taking-Over Certificate.

The Contractor will be required to employ experienced workers or professional cleaners

for the final cleaning.

27. CONSTRUCTION PROGRAM AND PROGRESS OF THE WORKS

The Construction Program shall be presented both in bar chart (Gantt) form and in the

form of a Critical Path Method (CPM) diagram showing sequences, dependencies,

durations and dates for the execution of all major items within the periods stated in the

Contract, following the sub-divisions of work set down in the Bill of Quantities. The

Construction Program shall be supported by:

(a) data as to the construction methods to be employed;

(b) a Construction Equipment Utilization Schedule (showing a full

breakdown of the equipment provision);

(c) a Schedule of Preparatory Work;

(d) a Manpower Utilization Schedule (showing a full breakdown of the

manpower provision);

(e) a Subcontracting Schedule (showing all off-Site prefabrication

provisions);

(f) a Materials and Goods Delivery Schedule;

(g) a Mobilization/Demobilization Schedule.

The CPM diagram incorporating the above mentioned schedules shall be prepared by an

approved project management software, and shall be presented in hard copy and electronic

form to the Engineer.

Approval by the Engineer of the Construction Program and the supporting data and

schedules shall not relieve the Contractor from any duties or responsibilities under the

Contract.

The Engineer reserves the right to review the progress of the Works from time to time and

the Contractor shall assist with such reviews. The Engineer reserves the right to instruct

the Contractor to modify and up-date the Construction Program at any time during the

progress of the Contract to ensure completion by the due dates and any such revisions

shall be carried out at the Contractor’s own cost but shall not relieve him of the

responsibility for the sufficiency thereof.

If any event occurs, which delays the Contractor in his execution of any part of the Works,

it is the Contractor’s responsibility to revise his program in order to minimize the effect of

any such delays.

28. Updating, Monitoring and Reporting Progress

The Contractor shall monitor the progress of the Works including that of his

subcontractors and suppliers for the purpose of ongoing network planning, scheduling and

updating, and shall confirm the actual progress on each current activity shown on

applicable CPM networks.

The CPM networks shall form part of the Monthly Progress Report and shall indicate

changes of schedule, if any, in network activity duration and start/finish imposed dates. It

shall also be provided in electronic form.

The Contractor shall prepare written explanatory notes on the particular activities that are

overrunning or going to overrun against the time allowed in the current Construction

Program. If any such overrunning work is on the critical path, the Contractor shall

evaluate the reason for the delay, decide upon the corrective action that needs to be taken

by him to bring the completion time for such work back on schedule and report all such

matters to the Engineer. In deciding upon the most appropriate catch-up program for each

item of delayed work, the Contractor will be required to consider all of the following

options:

(a) increasing the amount of construction equipment;

(b) increasing the size of the labor force;

(c) introducing alternative construction methods;

(d) substitution of specified materials and goods for others more readily

available;

(e) shortening succeeding work activities falling within the critical path.

29. PROGRESS PHOTOGRAPHS / VIDEOS

The Contractor shall provide every month a colored photographic/video record of the

construction work. Such photographs shall be taken when or where directed by the

Engineer, and at the following occasions or events:

(a) when a portion of the work is difficult or impossible to inspect after a

particular activity or operation;

(b) when a portion of the work will be covered by backfilling or filling

material after completion and acceptance by the Engineer;

(c) where a special or unusual feature of the works or latent conditions of

the Site are present.

Bird’s eye view photographs/videos must be taken to cover the whole of the construction

activities encompassed within the Works, both before and after construction, together with

other detailed photographs to include, amongst others, the following:

(a) physical obstructions on the Site or in the sea;

(b) concreting work;

(c) rehabilitation and repair work;

(d) all work that will subsequently be covered;

(e) damage to any property;

(f) adverse physical conditions;

When submitting each photograph, the Contractor is required to ensure that the following

requirements are met in full:

(a) An indication is to be provided, such as a signboard, to show the station

from which the photograph was taken, the date it was taken, with the scale

and other informative data inserted thereon to signify the relative

dimensions of the photograph.

(b) Photographs shall be taken at appropriate angles to show: the longitudinal

axis of roadways and pavement construction, the facade and elevations of

each structure; every detail of work activities, etc. at points designated by

the Engineer.

(c) Photographs shall be taken on the same points at the same angle before,

during and after the completion of a particular section of work. The

“during” photographs shall show the equipment being used.

(d) Each photograph shall be captioned and identified with a description of the

work to which the photograph relates, stating whether the work is still in

progress or has been completed, the nature of the operation or activity

being photographed and the presence of unusual features.

(e) Each photograph shall be properly referenced to enable easy retrieval and

cross-referencing at a later date.

(f) Each photograph shall be clearly discernible, in color, having a dimension

of not less than 90 mm x 120 mm.

A proof of the photographs shall be submitted in batches at intervals of not less than one

month or as otherwise required by the Engineer. After selection by the Engineer of the

photographs required to serve as a permanent record of the progress and condition of the

Works, the Contractor shall submit two (2) copies of each photograph.

All photographs selected by the Engineer and bearing his signature shall be compiled in

approved albums provided by the Contractor, and shall be arranged in order as required by

the Engineer. Each album shall show the name of the project on the cover and shall

contain a location map of the construction, etc.

All photographs selected by the Engineer shall become the property of the Employer.

30. DEFECTS PRIOR TO TAKING OVER

If any work carried out or any materials or goods supplied and/or installed by the

Contractor are defective or not in accordance with the Contract, the Contractor shall

propose to the Engineer, with all speed, the remedial works necessary to rectify the matter

such as to achieve compliance with the requirements of the Contract. The Engineer shall

review the Contractor's proposal and, when agreed by the Engineer, the Contractor shall

carry out the agreed remedial work immediately thereafter.

The Contractor will be held responsible for carrying out all remedial work arising from

defective work or defective materials and goods used in the Works, together with the cost

of such remedial work and any resultant delay in completing the Works, occupation of any

buildings or delays caused to follow-on contracts.

31. UNEXPLODED DEVICES

In an event of unexploded devices being discovered during the execution of the Works,

the Contractor immediately advice the Engineer and shall take the appropriate action in

arranging mobilization of the Bomb Disposal Team for investigation and disposal of the

said devices. In such an eventuality, the Employer will make such allowance for

additional costs and delays incurred by the Contractor as shall be determined by the

Engineer.

32. PROJECT SIGNBOARD AND COMMEMORATIVE PLATE

The Contractor shall provide PROJECT SIGNBOARD measuring1200 mm x 2400

mm in accordance with the DPWH Department Order (D.O.)No. 37 Series 2010 and

supplemented by D.O. No. 30 series 2012.

The Contractor shall also provide MEMORIAL PLATE made of brass as shown in

the Drawing.
