The Congress has passed and thePresident has received the fiscal 2001 Commerce
Justice State and related agencies appropriationsbill that will fund the SEC The bill
has not yet been signed but is expectedto be signed no later than Thursday Effective
1201 a.m EST the day the bill is signed the fee rate on filings made pursuantto Section
6b of the Securities Act of 1933 will decrease to $250 per $1000000or .00025 of the
aggregate offeringamount The current fee rate of $264 per $1000000 is
in effect until

ENFORCEMENT PROCEEDINGS
DAVID LEWIS SENTENCED TO 46 MONTHS IMPRISONMENT FOR OILAND GAS
BOILER ROOM SCHEME
The Commission announced that on December DavidShane Lewis was sentenced by
U.S District Judge Barbara M.G Lynn in Dallas Texas to concurrent termsof 46
months imprisonment ordered to make restitutionof $2228171 placed on supervised
release for three years to be served at theend of his term of imprisonment and ordered
to pay $200 special assessment UnitedStates David Shane Lewis 00-CR-064-M
and 00-CR-0 16-C USDCTNDTX Lewis earlier had pleaded guilty to one count of
securities fraud in connection with severaloil and gas offerings by Spartan Oil
Corporation Spartan and to one countof conspiracy to commit mail fraud in connection
with an oil and gas offering by Centurion GroupInc
On January 30 2000 the Commission filed related civil action allegingthat Lewis and
Spartan using boiler room sales forcemade numerous material misrepresentations and
omissions in connection with successionof fraudulent oil and gas offerings and had
misapplied investor finds The Commissionaction continues Information derived from
the SEC investigation was used by the FBI and the United States Attorneyin its
development of its case against LewisDavid Shane Lewis 00-CR-064-M
and 10O-CR-016-C USDC/NDTX LR-16830
ALAN GIBBONS ENJOINED FOR MISAPPROPRIATING INVESTOR FUNDS
On December 14 an injunctive Order was entered settling misappropriationof funds
case filed by the U.S Securities and Exchange Commission againstAlan Gibbons
resident of Chicago Illinois Under the settlementGibbons is enjoined from violating
antifraud provisions of the federal securities lawsand must pay disgorgement in the
amount of $172000 the payment of which is waived based on Gibbonsdemonstrated
inability to pay Gibbons consented to the entryof the Order without admitting or
denying the allegationsin the complaint
The complaint alleges that between September1995 and March 1999 Gibbons
recidivist securities laws violator offered and sold approximately $172000in stock and
promissory notesissued by companies he formed and owned The Complaint alleges
that Gibbons told investors their funds would be usedfor his companies However
Gibbons used the funds for personal expenses The complaint allegesthat Gibbons
materially misrepresented to investorsthe use safety liquidity and returns on
the
investments Gibbons told investors that the investments were risk-free guaranteedand
would produce large returns For exampleGibbons told some investors that they would
receive return of 5% per month on their investments However Gibbons companies
conducted little or no business lacked guarantorlacked sufficient liquid assets to
pay the investors and theinvestors received no returns on their investments
