    by the Federal Reserve Board TheOrder barred Acosta from association with any

    broker or dealer and ordered him to cease and desist from committing or causing any

    violation or future violation of Section 17a of the Securities Act and Sections 7c9a2 9a4 10b and 15c1 of the Exchange Act and Rules lOb-S and lScl-2

  • thereunder and Regulation promulgated by the Federal Reserve Board Acosta was

    found unable to pay disgorgement or civil penalty based of his present financial

    condition

    The Order as to Mark Goldman states that Goldman participated in the market

    manipulation of security and in furtherance of the manipulation willfully violated

    Sections 9a2 and 10b of the Exchange Act and Rule lOb-5 thereunder and willfullyaided abetted and caused violations of Section 5c of the Exchange Act and Rule15c1-2 thereunder In addition the Orders states that Goldman failed reasonably to

    supervise registered representatives under his supervision with view to preventing their

    violations of Section 17a of the Securities Act and Section 10b of the Exchange Actand Rule lOb-.5 thereunder and their aiding abetting and causing violations of Section

    7c of the Exchange Act and Regulation promulgated by the Federal Reserve BoardThe Order barred Goldman from association with any broker or dealer and ordered that

    he cease and desist from committing or causing any violation and any future violation of

    Section 9a2 10b and 15c1 of the Exchange Act and Rules lOb-5 and 15c-2thereunder Goldman was found unable to pay civil penalty based on his presentfinancial condition and commitment to pay $120000 in satisfaction of claims againsthim by the Trustee in the Goldman bankruptcy proceeding and the Trustee in the
